Justification and Approval (J&A) Historian Support J&A Number 11-22 Justification for Other Than Full and Open Competition (J&A)

1. Agency and Contracting Activity: (FAR 6.303-2(a)(1))

HQ, USASOC, Deputy Chief of Staff Acquisitions and Contracting, Building E-2929, Fort Bragg, NC 28310.

2. Description of Action: (FAR 6.303-2(a)(2))

The requested action is for a 3-month bridge order to provide Historian Support at USASOC. The order is a firm fixed price, funded with FY11 O/M funding in the amount of $54,882.53

3. Description of Supplies/Services: (FAR 6.303-2(a)(3))

USASOC proposes to acquire continued support that will assist with the editing, design, and graphic layout support for the Veritas magazine developed by the USASOC History Office. Currently, the support is provided by Echota Technologies under purchase order H92239-05-P-0248. The order was awarded in September 2005 for a base year and four 1-year options under Section 8(a) of the Small Business Act (15 U.S.C. 637(a)) and FAR 19-8 as a sole source 8(a) award that ends on 27 March 2011. This follow-on order will bridge the support gap between purchase order H92239-05-P-0248 and a new order that will result from negotiations with a certified 8(a) contractor. Award of the new order is anticipated on or around 15 Jun 2011. The J&A requests approval for a Firm Fixed Price purchase order awarded to the incumbent, Echota Technologies, to provide continued support for the customer.

4. Authority Cited: (FAR 6.303-2(a)(4))

X 10 U.S.C 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1. The purchase order is a logical follow-on to a purchase order awarded in 2005. The incumbent, Echota Technologies, has provided the services for the past 5 ½ years.

5. Reason for Authority Cited: (FAR 6.303-2(a)(5))

Failure to secure the proposed contractor shall result in the termination of the Veritas magazine production cycle. Because of the collaborative and cyclic nature of producing a publication, removal of the contractor will disrupt the History Office workflow and make any further progress impossible. Furthermore, research completed by USASOC historians will fail to reach the target audience (soldiers, veterans, and civilians), thus devaluing their work and making pertinent historical information inaccessible to the troops.

6. Efforts/Actions to Increase Competition: (FAR 6.303-2(a)(6))

The current action will be synopsized on FedBizOpps as intent to award sole source to the incumbent. This contract action will bridge the support gap between purchase order H92239-05-P-0248 and the new purchase order. The next contract action will not be publicized based on the exception at FAR 52.202(a)(4), the contract action is expressly authorized by a statute to be made through another Government agency. The follow-on contract action is authorized by the Small Business Act (15 U.S.C. 637(a)) to be made through the Small Business Administration (SBA). The follow-on action will be negotiated sole source with a certified 8(a) contractor since the anticipated total value of the contract action, including options, will not exceed $4 million.

7. Market Research: (FAR 6.303-2(a)(8))

Market research, with the intent of identifying a certified 8(a) contractor, was conducted for the new order. A search of the Dynamic Small Business Search identified 85 - 8(a) contractors in the NAICS code 519120. A search of CCR located 90 - 8(a) contractors. Several contractors possess the qualifications for this requirement and additional research is being conducted. This office is also requesting past performance information from the Small Business Administration.

No other potential sources indicated an interest in writing.

NOTICE 1

Prior to approval, J&As will be screened to identify proprietary data and information exempted from disclosure by 5 U.S.C. 552, Freedom of Information Act, so that the final J&A may be prepared for required posting to FedBizOpps IAW Section 844 of NDAA 2009 as implemented via DPAP Memo, Public Disclosure of Justification and Approval Documents for Noncompetitive Contracts, dated 13 February 2009. J&As shall be posted to FedBizOpps within 14 days unless 10 U.S.C 2304(c)(2), Unusual and Compelling Urgency is cited. In that particular case the J&A will be posted within 30 days. Information selected for removal will be highlighted in yellow much like this statement so that signature authorities will know what information will be removed after approval, before posting.

I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based on the prices currently being paid as well as prices paid for similar services on previous contracts and in the commercial marketplace.
