A. STANDARD FORM 33 - SOLICITATION

1. GENERAL:

The Government intends to award a Firm Fixed Price for Elevator Inspection and Testing Services for various buildings located in Greater Southwest Region 7 (Texas, Louisiana, Oklahoma, Arkansas, and New Mexico). The award will be for one year base, and 4 (one) year option periods.

2. PROPOSAL DUE DATE:

The proposal is due 4:00 pm, CDT, September 6, 2016. Questions regarding this proposal are due by 4:00 pm, CDT August 15, 2016. The electronic copy of the proposal shall be provided on CD-R (not CD-RW) compact disks, using Adobe Reader (.pdf format) (Version 9.4) the technical proposal and Microsoft Excel 2007 (.xlsx format) for Attachment 1, GSA Region 7, Zone Master Pricing Sheet and Figure L-1 Management Plan Worksheet. All CD-R compact disk(s) shall be labeled with the solicitation number, company name and date. Offerors shall ensure that all disks are virus free. Nothing may be on the disks except the proposal files. Please submit via registered mail, UPS, or FEDEX..

In addition, one printed copy of the technical and price proposal to include resumes, licenses, and all other submittals must be submitted to Marsha Payne, General Services Administration, Acquisition Management Division (7PQB), 819 Taylor Street, Room 12B360, Fort Worth, TX 76102, by the closing date and time of the RFP.

3. PROPOSAL ACCEPTANCE:

The offeror must update Blocks 15 a, b, c and complete Blocks 16, 17, & 18 of the SF 33 to constitute your acceptance of the terms and conditions of the solicitation.

4. PRE-WORK CONFERENCE:

Upon award of the contract a pre-work conference will be conducted at the Fritz G. Lanham Federal Building, 819 Taylor St., Fort Worth, TX. The date of the conference is to be determined after award.

Attendance may be by telephone conference. Key personnel’s attendance will be required.

B. SERVICES

1. DESCRIPTION OF SERVICES.

The contractor shall provide all management, supervision, labor, and Qualified Elevator Inspector QEI inspection equipment. The contractor shall plan, schedule, coordinate and assure effective performance of all services described herein. The contractor shall provide all services in accordance with the requirements of these specifications for various buildings located in the following five state area: Texas, New Mexico, Arkansas, Oklahoma, and Louisiana. The contract will be for the 1-Year Base Period with four 1-year options.

C. DESCRIPTION/SPECIFICATION/WORK STATEMENT

1. BACKGROUND

General Services Administration (GSA), Public Buildings Service (PBS) is a national US government agency organized into 11 geographic regional areas. This contract pertains to the Code required semi-annual, annual and 5 year load / tests and their respective inspections for elevators throughout the PBS Greater Southwest Region 7. Region 7 encompasses the states of Texas, Louisiana, Oklahoma, Arkansas, and New Mexico.

2. WORK BY OTHERS

The Government reserves the right to undertake by another contract and contractor, by Government employees, or by other means, the same type or similar work as contracted for herein and to do so shall not be a violation of the terms of this contract nor be considered as a termination in whole or in part of work contracted for hereunder.

3. SCOPE OF WORK

General Services Administration (GSA), Public Buildings Service (PBS) requires contractor support to provide elevator inspection and testing services throughout the five state area of the Greater Southwest Region 7 (Texas, Louisiana, Oklahoma, Arkansas, and New Mexico). Services may include other additional services, including but not limited to, Consulting Services, Additional Inspections, Due Diligence Inspections,

4. TASK DESCRIPTION

The Offeror will be responsible for performing a complete “GSA Maintenance Contract Compliance Inspection” and “Code Compliance Inspection” including semi-annual inspections, annual inspections and 5-year full load full speed test/inspections on each elevator listed in this request for proposal. Test weights for 5 year safety tests shall be provided by the elevator maintenance contractor. The Offeror shall act as the “Government’s Representative” when witnessing the required inspections/tests, and use it’s experience, expertise and professional judgment to try to insure against any unnecessary equipment damage prior to the accomplishment of the inspection/tests. The contractor shall provide all management, supervision, labor, QEI inspection equipment, reports and travel necessary to complete the specified semi-annual and annual inspections/tests and periodic testing as identified in GSA Region 7, Zone Master Schedule Pricing Sheet (Attachment 1). All locations are within the five state area of the Greater Southwest Region The inspections and tests shall include but are not limited to the following systems, equipment and components:

All maintenance practices, cleanliness and maintenance compliance Hoistway and car doors, hangers, guides and operating devices Hoisting machines, sheaves, and brakes Motors and motor generator sets Hoisting, governor, safety, compensation and operating cables Controllers (including contacts, switches, etc.)

Signal systems, controls, and traveling cables Governors, safeties, interlocks, and contacts Guide rails and oiling devices Terminal, slowdown and leveling devices Elevator cars, counterweights, and buffers Machine rooms, hoistways and pits

Automatic and manual emergency fire services (Phase I & Phase II) Emergency Power Operations Pit Flood Monitoring Device (if applicable)

4.1 Reference Criteria – Inspections and tests shall conform to the requirements, industry practices/procedures and regulations contained in the most recent edition of the following guides:

ASME A17.1, Safety Code for Elevators and Escalators with published supplements.

ASME A17.2, Inspector’s Manual for Elevators and Escalators with published supplements.

ASME A120.1, Safety Requirements for Powered Platforms for Exterior Building Maintenance

4.2 Schedule of Work – Work shall consist of inspection services and tests as specified in this section and shall cover, at the minimum, the following:

(a) Inspect maintenance practices, including pictures for non-compliance with the Multi- Regional Elevator Maintenance and Repair Contract and report the condition for each item in Section 5.

(b) Perform semi-annual inspections and monitor all tests as required in referenced criteria.

(c) Perform annual inspections and monitor all tests as required in referenced criteria.

(d) Monitor/Witness all five-year full-load, full-speed safety tests, governor and buffer tests as required and referenced to in the most current edition of the ASME A-17-1. All inspection and test intervals shall be taken from Table N-1.

(e) Perform any other tests and monitor/witness all tests by elevator mechanics.

4.3 Scheduling of Work

It will be necessary to coordinate all inspections or tests with the Contracting Officer’s Representative (COR) to facilitate effective use of time in conjunction with the elevator maintenance contractor or mechanic; this is especially applicable for the 5-year governor, safety and buffer tests. The COR shall be notified in writing no less than ten business days before scheduled inspection.

All work shall be performed during regular working hours of the regular working week of the trade.

Exceptions to this may be the testing and inspection of the firefighter’s service operation, and the testing of the emergency control systems. These exceptions, when scheduled after regular working hours will require the prior approval of the COR and shall be performed as part of this contract at no additional cost to the Government.

Coordination with the elevator maintenance contractor shall be scheduled by the Offeror performing under this contract with communication to the COR on ALL scheduling so the COR may monitor and confirm the scheduling process. The Offeror shall not proceed to the inspection site until coordination of an agreed date and time has been verified.

If the contract schedule is not met, or any operation is omitted when scheduled for performance, the Offeror will be notified of this failure or omission and he will be requested by the Contracting Officer (CO) to perform the omitted service. If the Offeror does not comply with the request within such time as the CO deems to be reasonable, employees of the Government or other contractors may complete the work. The cost thereof will be deducted from any money due the Offeror under the Contract.

4.4 Inspections

Inspections shall include an inspection of maintenance practices and cleanliness. A copy of the Multi- Regional Elevator Maintenance and Repair scope of work shall be made available for use to check for compliance. Include with inspection reports any pictures as necessary for proof of deficient maintenance/repair practices.

It is the responsibility of the Offeror to determine that the equipment is in a safe operating condition, that it has not been altered except in conformity to the applicable codes or regulations, and that it performs in accordance with test requirements. Inspections shall be made in accordance with the current ASME A17 Codes as applicable.

NOTE: No elevator will be taken out of service during rush hours for the purpose of routine maintenance inspections or tests unless it has been determined that the removal of the car from service will not affect the overall service. If, in an unavoidable event, a car must be taken from service, approval must first be obtained from the Service Center Manager.

4.5 Periodic Safety Tests

The required test tags (which shall indicate name of the company performing the test, type of test, and date of test) shall be attached to each device tested. Verification that this information is attached to each device tested is considered a requirement of this contract . It shall be noted during inspections for safety and included on the report of inspections and tests.

All full load safety tests shall be performed in accordance with ASME A17.1 Code; where applicable, including rated load and speed tests. Inspections and tests of hydraulic elevator shall be performed in accordance with the ASME A17.1 Code, where applicable.

4.6 Annual Safety Tests

The Offeror shall witness annual tests of fire and emergency control system, safety mechanisms, devices, controls, equipment and systems relevant to the units. Offeror shall test the operation of elevators under emergency conditions and shall test the emergency power where applicable. The Offeror shall act as government agent and supervise the safety tests under the guidelines and procedures contained within ASME A17.1, A17.2 Codes, all applicable parts.

(a)Annual no-load safety tests of elevators, dumbwaiters and powered platforms shall be made in accordance with the ASME A17.1 Code, as applicable. Surface damage to the steel guide rails as a result of tests shall be corrected by the maintenance contractor by hand filing after each test and verified complete as part of the work under this contract.

(b) If the governor seal has been broken, damaged or removed, the Offeror shall test the governors including checking the governor switch and tripping speed settings with a tachometer by disconnecting the governor cable from the sheave and spinning the governor by mechanical means. All governors shall be reset where necessary to meet the requirements of ASME A17.1 Code. The governor shall be sealed and metal tagged in accordance with ASME A17.1 Code, with name of company making the test, the date of the test, and the set tripping speeds.

Hydraulic inspections shall comply with Part VIII of the A17.1 Code, and Part II of the Inspector’s Manual.

4.7 Unsafe Equipment

If the equipment fails to meet the requirements, the inspector shall note the failure on the inspection report and not issue a new inspection certificate. If a condition exists which may cause an accident or serious mechanical failure, the inspector shall shut down the equipment and “lock out / tag out” the equipment.

He/she shall immediately notify the Customer Service Center Manager, the Property Manager, or their designated official and the COTR of the action taken. Service may not be resumed until the deficiencies have been corrected and a Qualified Elevator Inspector (QEI) has made an inspection of the equipment and the certificate reissued.

4.8 Emergency Conditions

Any condition found which may jeopardize the safety of the passengers, the pubic or the equipment itself shall be verbally reported to the GSA Property Manager and the COR immediately. Within 24 hours a written report with a complete description of the condition shall be submitted in writing to the GSA Property Manager & COR. The report shall clearly list the emergency condition found, the corrective action recommended and the time required for the corrective action recommended.

4.9 Certificate of Inspection

Upon completion of inspection, if the unit meets the safety requirements and there are no serious maintenance deficiencies, the inspector shall, ensure the appropriate signatures and dates are entered on the Certificate of Elevator Inspection (GSA Form 55) (Attachment 2). The Certificates of Elevator Inspection are to be kept in the Offeror’s office files and furnished to the GSA Customer Service Center office whenever requested. Certificates for units other than elevators are to be kept and handled in the same manner.

When all spaces are filled or if the certificate becomes soiled or unsightly, it should be replaced.

5. INSPECTION AND TEST REPORTS

Upon completion of each inspection, the inspector shall complete an Elevator Inspection Report (Attachment 3) for each unit. The Offeror will be provided with an electronic copy of the form in Microsoft Excel format along with instructions for processing (Also Attachment 3) of the form. Each unit report shall identify any violations/deficiencies by the elevator maintenance contractor in Section II- A of the form and each violation/deficiencies by GSA inserted into Section II-B of the report.

References are to be cited for each nonstandard item noted. Within ten (10) business days after the performance of the inspection, the Offeror shall submit reports as follows:

The Offeror shall maintain a complete file of inspection reports and inspection certificates at his office for a minimum of five (5) years. If the above Point of Contact changes, Offeror will be notified via an email.

6. WORKMANSHIP

All inspections, workmanship, or equipment shall be subject to re-inspection, examination, and test by Government inspectors at any and all times during the course of the work and at any and all places where such work is being carried on. The Government shall have the right to reject defective inspections or reports. Rejected items shall be satisfactorily corrected and/or replaced without additional expense to the Government.

7. DEFINITIONS

7.1 Imminent Danger – Description of condition for a unit, which, in the professional judgment of a qualified inspector, poses a threat of accident or failure in such a manner that, could cause death or serious injury to persons or sizable damage to property.

NOTE: If an “imminent danger” condition exists or the equipment is unsafe, circumstances must be reviewed by the Customer Service Center Manger. The unit shall not be placed back in service until written certification is provided to that Manager assuring that the unit is safe for operation.

7.2 Unit - Any individual type of vertical transportation equipment such as passenger, service or freight elevators, escalators, lifts, dumbwaiters, window washers, and wall gliders.

7.3 Elevator Maintenance Personal- A GSA representative or other GSA contracted entity performing elevator maintenance service.

8. INSPECTORS

Critical to performance of this Scope of Work (SOW) are the positions identified as inspectors or inspection personnel and the experience of the people in those positions. The proposed inspection personnel will reflect and understand the different skill sets necessary as well as the different functions to be performed.

ASME A17.1, Sections 8.10.1.1 and 8.11.1.1, requires inspectors and inspection supervisors to be certified by an organization accredited by ASME in accordance with the requirements contained in the most recent edition of the ASME QEI “Standard for the Qualification of Elevator Inspectors".

The Offeror shall identify and provide resumes and copies of required QEI Certificates of those personnel in inspector positions. New copies of “Re-Certified” QEI Certificates shall be provided annually, after the recertification of the credential, to the CO & COTR for verification of QEI-1 requirements.

9. Personnel Changes/Additions

Should it become necessary to replace or add inspection personnel, the Offeror shall submit to the Contracting Officer (CO), the resume and copies of required certificates. No changes shall be made until written approval is granted by the CO. No increase in the cost of this contract will be allowed when such addition or change of personnel is authorized.

10. SECURITY CLEARANCE

SECURITY REQUIREMENTS AND PERSONAL IDENTITY VERIFICATION PROCEDURES

A. GENERAL: The Contractor shall comply with directions provided by the Contracting Officer (CO) regarding all security requirements. All contract employees shall receive a favorable suitability determination, security clearance, and/or meet all security requirements, prior to reporting to work or performing work under this contract.

Employees that cannot obtain a favorable security determination, security clearance, or meet security requirements, will not be allowed to work in the Government facility.

If the Contracting Officer or his/her representative receives an unfavorable or unsuitable report on any employee, or if the Contracting Officer's Representative finds a prospective employee to be unsuitable or unfit for his/her assigned duties, the Contractor shall be advised immediately that such employee will not be allowed to work or be assigned to work under the contract.

B. The Government has full and complete control over granting, denying, withholding or terminating clearances for employees. The Government may authorize and grant temporary clearance to employees of the Contractor. However, the granting of a temporary clearance shall not be considered, as assurance that full clearance will follow.

The granting of either temporary or full clearance shall not prevent, preclude, or bar the withdrawal or termination of any such clearance by the Government.

C. HOMELAND SECURITY PRESIDENTIAL DIRECTIVE (HSPD)-12: HSPD-12 is the “Policy for a Common Identification Standard for Federal Employees and Contractors” (the Directive) and became effective August 5, 2005. The Directive requires all Federal governmental departments and agencies to conduct background investigations and adjudicate the results (HSPD-12 compliant suitability determinations) for all contract employees requiring routine unescorted access to Federally-controlled facilities and/or information systems for more than 6 months before identification cards will be issued.

Contract employees working less than 6 months will be considered “temporary” and all facility access control procedures will apply. GSA may require low risk suitability determinations for “temporary” employees, or has the option of clearing “temporary” contractors with an HSPD-12 compliant suitability determination. “Temporary” contract employees that are not required to receive a favorable suitability determination shall be escorted at all times while in non-public space.

The Contractor shall comply with guidance concerning implementation of this Directive as provided herein and by the Contracting Officer (CO).

D. The Government may, as it deems appropriate, authorize and grant temporary suitability determinations to employees of the Contractor. However, the granting of a temporary suitability determination to any such employee shall not be considered as assurance that a favorable suitability determination will follow as a result or condition thereof, and the granting of either temporary or full determination shall in no way prevent, preclude or bar the withdrawal or termination of any such determination by the Government.

E. Depending on the contract and work, a full Notice-to Proceed shall be issued after the initial favorable preliminary suitable clearance process is completed for those required to work on the contract OR partial Notice-To-Proceed shall be issued as the favorable preliminary suitable clearance process is completed for phases of work under the contract in or on the Federally-controlled facility. Contract workers may be added throughout the

Section C Page 11 performance period required by the contract , but must complete the clearance process prior to working in or on the Federally-controlled facility.

F. PERSONAL IDENTITY VERIFICATION OF OR PERSONNEL: The Contractor shall comply with agency personal identity verification procedures that implement Homeland Security Presidential Directive-12 (HSPD-12) as required by the clause of this FAR 52.204-9 and all other security and clearance requirements provided herein and by the Contracting Officer (CO).

G. GSAM 552.237-71 QUALIFICATIONS OF EMPLOYEES (MAY 1989): The Contracting Officer or a designated representative may require the Contractor to remove any employee(s) from GSA controlled buildings or other real property should it be determined that the individual(s) is either unsuitable for security reasons or otherwise unfit to work on GSA controlled property.

The Contractor shall fill out and cause each of his employees on the contract work to fill out, for submission to the Government, such forms, as may be necessary for security or other reasons.

Each employee of the Contractor shall be a citizen of the United States of America, or an alien who has been lawfully admitted for permanent residence as evidenced by Alien Registration Receipt Card, Form I-151. The employee may also present other evidence from the Immigration and Naturalization Service that employment will not affect his immigration status.

H. REQUIRED INFORMATION SUBMISSIONS Unless otherwise specified, the Contractor shall submit the information required below to the Government, as directed by the CO, as soon as possible after award (but not later than 14 calendar days before start date) for all personnel. The following information will be submitted to the Government for all new or replacement personnel not later than 14 calendar days before beginning contract work. The CO will advise the Contractor on where this information will be submitted.

(1) All employees (including employees, sub employees, and officers of the firm) requiring unescorted access to federally controlled facilities and/or information systems for more than 6 months, and/or who may visit the work site during the period of this who need unescorted access shall submit the following:

(a) One copy of the FPS “or Information Sheet” which will be provided to the Contractor at time of award. The Contractor shall complete the Contractor and Contractor Applicant Information Sections as directed by the Government.

(b) One original copy of completed SF 85P with original signature, Questionnaire for Public Trust Positions, with SF 86A, Continuation Sheet.

The medical release form attached to the back of the 85P form is not required to be completed for NACI and NACIC background investigations. The SF- 85P and 86A are available for download at http://www.gsa.gov/formslibrary.

Alternatively, Contractors may be required to submit this information electronically through a web-based network.

(c) Two original completed FD-258, Fingerprint Cards. The Government will furnish blank forms upon request.

(2) “Temporary” contract employees (including employees, sub employees, and officers of the firm) requiring unescorted access to federally controlled facilities for less than 6 months, or other “Temporary” employees as designated by the CO, Section C Page 12 who may visit the work site during the period of this contract who need unescorted access shall submit the following:

(a) One copy of a FPS “or Information Sheet” which will be provided to the or at time of award. The Contractor shall complete the Contractor and Contractor Applicant Information Sections as directed by the Government.

(b) One original copy of completed "Statement of Personal History" (FPS 176T or other prescribed form) which will be provided to the Contractor at time of award.

(c) Two original completed FD-258, Fingerprint Cards. The Government will furnish blank forms upon request.

I. The Contractor shall furnish the required information to the Government, as specified by the CO, in a sealed envelope together with a transmittal letter on company letterhead for each applicant. The transmittal letter shall be attached to the outside of the envelope and list the following:

(1) The Contractor Applicant’s full name;

(2) The contract number and if applicable, the order number;

(3) The Contracting Officer’s name;

(4) The Contracting Officer’s Representative (COR) or Contracting Officer’s Technical Representative (COTR) name;

(5) The Prime Contractor name, address, and telephone number;

(6) If applicable, the subcontractor, name, address and telephone number; and

(7) The name, address, and title of the Contractor representative submitting the security packet.

J. GENERAL DESCRIPTION OF THE CLEARANCE PROCESS

(1) Name Check and Fingerprint Check. Upon receipt of the sealed envelope containing the required forms, the Government will forward each clearance package to the clearance processing office for initial processing. A preliminary review will be conducted of various national criminal and security data files. If these checks are favorable the Contractor employee may be granted limited access to Federally-controlled facilities and Federal information systems with a preliminary favorable suitability determination. This process takes approximately 3 to 10 business days but could take longer.

(2) For Contractor employees who receive a favorable preliminary check as described above, and depending on the location and type of work to be performed, a more detailed agency check may also be initiated. The check may include record searches with selected sources covering specific areas of the employee’s background, including credit, and written inquiries covering specific areas of the employee’s background.

(3) Issuance of Identification Credential. Upon receipt of favorable suitability determination, each contract employee may be issued a 5-year identification credential in accordance with the federally-controlled facility procedures and, if applicable, be granted access to those Federal information systems necessary to accomplish the Contract. A temporary ID may be issued after a preliminary favorable suitability determination. The Contractor shall ensure that all contract employees display their

Section C Page 13 credentials in accordance with facility procedures. The Contractor shall also ensure that such credentials are returned to the government as employees are dismissed, terminated, or upon expiration of the contract. The Contactor will be assessed a fee for each identification credential that is lost or otherwise not returned.

(4) Unsuitable Employees. If the Government receives an unsuitable report on any prospective Contractor employee, or if the Government finds a prospective Contractor employee to be otherwise unsuitable or unfit for his assigned duties, the Contractor shall be advised immediately by the CO that such employee will not be allowed to work under this contract. The Contractor must then take action immediately to relieve the employee of all duties and responsibilities related to this contract and return his Identification Credentials, if such credentials were issued. The Contractor will not be compensated for such actions. Unsuitable employees may be escorted off Federal property by DHS/ICE/FPS or other law enforcement entities depending on the reason for the unsuitable determination.

(5) Site-Specific Requirements. Specific federally-controlled facilities or those areas located within a given facility may have additional security clearance requirements in addition to those cited above. These will be specified by the Government through the CO or designated representative.

(6) Prior Clearances and the Re-Clearance Process. All employees are required to be cleared every 5 years and favorable contract employee background investigations are good for 5 years. If anytime during a 5 year period, a cleared contract employee is to work on a different contract that they were previously cleared to work on, then the original clearance notices must be submitted by the CO or his representative to DHS/ICE/FPS to update and clearance information. During the 5 year period, unless specifically requested to do so by the CO or designated representative, no further forms or information will be required from the Contractor. However, if threat levels or security conditions change during the cleared period, access and clearance requirements may change with limited advanced notice which may require previously cleared Contractor employees to have clearances updated, renewed, or reprocessed.

K. IDENTIFICATION CREDENTIAL

(1) Upon receipt of favorable suitability determination as indicated herein, each employee of the Contractor will be issued an identification credential. At all times while working on the contract a contract employee, including subcontractor employees, must have in his/her possession the specific Government identification credential issued to them by the Government. The identification credential shall be displayed and be visible at all times while on Government property. The COR, GSA personnel designated by him/her, Government law enforcement, or security personnel shall periodically verify passes of Contractor employees with their personnel identification. Contractor employees shall comply with security verification procedures at all times.

(2) The Contractor shall see that every contract employee has a Government issued identification credential before the employee enters on duty. As required by the Government, the Contractor shall make his employees available for photo identification badges, on a schedule to be worked out with the Contracting Officer’s Representative. The Government will make the identification credentials badges after a favorable security determination has been received for the Contractor’s employees. Each identification credential shall have an expiration date and Contractor employees shall sign each badge at the time of photographing.

(3) The Contractor shall be responsible for ensuring that all identification credentials are returned to the Contracting Officer's Representative as his employees leave the contract (contract is completed, employees leave employment of the company, employees are dismissed or terminated). The Contractor will notify the Contracting Officer’s Representative when employee badges are lost.

L. ESCORT REQUIREMENTS: It may be necessary to escort temporary employees that do not have favorable preliminary or final suitability determinations and must work in Federally-controlled space. In those cases, ALL uncleared employees must be escorted in non-public space by a Government employee or another responsible cleared employee that is approved by the Contracting Officer or his/her designee. Other Government agencies may have specific agency security requirements for their own space that may only allow escort by Government employees or those designated by their agency.

Government employees or approved cleared employees that provide escorts for uncleared contract employees must always be in close proximity and eyesight of the uncleared contract employee. The Government escort must watch uncleared contract employees and remain with uncleared contract employees for the entire time they are in the building and/or Federally-controlled space. An uncleared contract employee can not be left alone or out of eyesight at anytime they are in non-public space. A cleared and approved escort may not bring several uncleared contract employees, into Federally-controlled space, that are not within close proximity or eyesight at all times. A cleared and approved escort may not have multiple uncleared contract employees in non-public space on different parts of one floor or different floors at the same time. Any security violation of escort requirements by a cleared and approved Government employee will result in immediate removal from the contract of all employees involved, i.e., escorts and uncleared contract escorted employees. Also, violations of escort requirements by contract employees in accordance with security requirements may be grounds for termination of the contract .

M. STANDARDS OF CONDUCT: The Contractor shall be responsible for maintaining satisfactory standards of employee competency, conduct, appearance, and integrity and shall be responsible for taking such disciplinary action with respect to his employees as may be necessary. The Contractor is responsible for ensuring that his employees do not disturb papers on desks, open desk drawers or cabinets, or use Government telephones, except as authorized. Each employee is expected to adhere to standards of behavior that reflect favorably on his/her employer, and the Federal Government. No smoking is allowed in the building.

N. Under the following conditions, the Contracting Officer or his/her representative may request the Contractor to immediately remove any employee(s) from the work site.

When the Government determines such employee to be: incompetent, careless, insubordinate, unsuitable or otherwise objectionable; or whose continued employment the Government deems contrary to the public interest, inconsistent with the best interests of security, or is identified as a potential threat to the health, safety, security, general well being or operational mission of the facility and its population.

The Contracting Officer may also request the Contractor to immediately remove any employee(s) from the work site(s) should it be determined that individuals are being assigned to duty who have been disqualified for either suitability or security reasons, or who are found to be unfit for performing duties during their tour(s) of duty.

Contractor employees who are removed from contract work shall be required to leave the work site immediately.

The Contractor must comply with any removal request. For clarification, a determination to remove an employee will be made for, but is not limited to, incidents involving the most immediately identifiable types of misconduct or delinquency as set forth below:

(1) Failure to receive a suitability determination, temporary clearance, or clearance from GSA or a tenant agency.

(2) Violation of Federal, State, or local law.

(3) Violation of the Rules and Regulations Governing Public Buildings and Grounds, 41 CFR 101-20.3. This includes the carrying or possession of explosives, or items intended to be used to fabricate an explosive or incendiary device.

(4) Neglect of duty, including sleeping while on duty, unreasonable delays, or failure to carry out assigned tasks, conducting personal affairs during official time, refusing to render assistance, or cooperate in upholding the integrity of the security program at the work site.

(5) Falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records, or concealment of material facts by willful omissions from official documents or records.

(6) Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words or actions, fighting, or participation in disruptive activities, which interferes with the normal efficient operations of the Government.

(7) Theft, vandalism, immoral conduct, or any other criminal actions.

(8) Selling, consuming, or being under the influence of intoxicants, drugs, or substances which produce similar effects while in or on Federally-controlled property.

(9) Improper use of Government identification.

(10) Unauthorized use of communication equipment on Government property.

(11) Violation of security procedures or regulations.

(12) Violation of Title 18, U.S.C., Section 930, which prohibits the knowing possession or the causing to be present of firearms or other dangerous weapons in Federal facilities and Court facilities.

The Contracting Officer will make all determinations regarding the removal of any employee(s) from work site(s), except under certain conditions. When a Contracting Officer is not available, either during the day or after hours, or in situations where a delay would not be in the best interest of the Government or is identified as a potential threat to the health, safety, security, general well being or operational mission of the facility and its population, the Contracting Officer’s Representative will have the authority to immediately remove the contract employee from the work site.

Law enforcement officers of the DHS/ICE/Federal Protective Service will have the authority to immediately remove any contract employee from the work site who is found

Section C Page 16 to be in violation of any of the items mentioned above and where a delay in removal would not be in the best interest of the Government, security, or is identified as a potential threat to the health, safety, security, general well being or operational mission of the facility and its population. The Contracting Officer will be notified as soon after the incident as practical or at the beginning of the next business day if an action happened after hours. The Contracting Office will make all official notifications to the Contractor.

In the event of a dispute, the Contracting Officer will make a final determination.

Specific reasons for removal of an employee(s) will be provided to the Contractor in writing.

The Contractor is responsible for providing replacement employees in cases where contract employees are removed from working at the work site or on the contract.

O. SENSITIVE BUT UNCLASSIFIED (SBU) BUILDING INFORMATION

(1) GSA Contractors that do not have HSPD-12 compliant clearances can not obtain Sensitive But Unclassified (SBU) information (Privacy Act data, building information, and financial information) through GSA’s IT systems.

(2) Contractors and prospective bidders with a need to know, that do not have HSPD- 12 clearances and access rights to GSA IT systems, can not be provided SBU building information, drawings, etc., in accordance with GSA Order 3490.1 that provides for the dissemination of paper and electronic SBU building information for all Federally-controlled space (owned, leased and delegated).

(3) SBU information includes but is not limited to:

(a) Paper and/or electronic documentation of the physical facility information

(b) Building designs (such as floor plans)

(c) Construction & renovation/alteration plans and specifications

(d) Equipment plans and locations

(e) Building operating plans

(f) Information used for building service s and/or guard services

For all GSA controlled facilities, any other information considered a security risk, shall be considered covered under this category.

(4) All SBU building information, either in electronic or paper formats, shall have specific imprinting on each page to designate it is Government property and indicate the prohibition of copying, dissemination, and distribution

(5) Contractors authorized to receive SBU information shall provide the following identification:

(a) A copy of a valid business license

(b) Verification of a valid DUNS Number

(c) A Valid IRS Tax ID Number

(d) A Valid picture state driver’s license

(6) Contractors shall sign a Document Security Notice when they receive the information.

(7) Contractors shall be responsible for safeguarding SBU information. At the completion of work, secondary and other disseminators shall be required to turn over their Document Security Notice dissemination records to GSA to be kept with the permanent files.

(8) Authorized contract users shall destroy all SBU information and documents when no longer needed. Destruction shall be done by burning or shredding hardcopy, and/or physically destroying CD’s, deleting and removing files from the electronic recycling bins, and removing material from computer hard drives using permanent erase utility or similar software.

(9) All authorized contract users of SBU building information shall notify the GSA Disseminator in writing that they have properly disposed of the SBU building information/documents.

(10) The GSA Disseminator shall maintain all records of SBU building information disposal (along with the signed Document Security Notices) pursuant to the GSA system of keeping long-term records and plans. All Document Security Notices and Records of Disposals shall be kept with the permanent files.

12. INCREASE OR DECREASE IN SERVICES AFTER AWARD

By signing its offer, the offeror agrees to provide additional service for the same prices offered for basic services if additional services are ordered by the Contracting Officer (CO) pursuant to FAR 52.212-4 “ terms and conditions – Commercial Items,” paragraph (c) “changes.” Similarly, the offeror agrees to maintain the same prices for service if the Government reduces the amount of service required for basic services. This pricing agreement is limited to changes that are within the general scope of this contract.

Services may include other additional services, including but not limited to, Consulting Services, Additional Inspections, Due Diligence Inspections, Also include language with allows these services to be in addition to the standard billing.

D. PACKAGING AND MARKING

D.1. PAYMENT OF POSTAGE AND FEES

All postage and fees related to submitting information including forms, reports, etc., to the CO or the COR shall be paid by the Contractor.

D.2. MARKING

All deliverables shall be preserved, packaged, packed, and marked and must conform to normal commercial packing standards to assure safe delivery at the destination.

All information submitted to the CO or the COR shall clearly indicate the number of the contract for which the information is being submitted.

E. INSPECTION AND ACCEPTANCE

E.1. FAILURE TO PERFORM

1. If any of the services do not conform to contract requirements, the Government may require the

Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. If the work remains deficient, the Contracting Officer may have the work accomplished by other means and deduct the cost thereof from the monthly payment.
