Company A Q1: Reference: L.1 Submission of Proposals (p.350) Part I – Price Proposal requires an original and 3 copies of the completed SF 33; original and three copies of Section B Services and Price/Cost; and 3 copies of the price breakdown.

Question: Will the Government verify that the Price Breakdown should be 3 copies and not ‘original and three copies’? Will the Government clarify how these documents should be organized and bound? In other words, are offerors to submit 4 copies, 1 containing the original version of all required pricing documents, and 3 separate copies (Copy 1 of 3, 2 of 3, and 3 of 3) containing all required pricing documents?

Answer: L.1, Part I, paragraph (3) should have read “An original and three copies of the price breakdown….” The documents can be organized by submitting one binder with original documents and 3 separate binders with copies for a total of 4 binders. A copy of the certification of the class will be provided to R7 FMSP after the successful completion of the class. If the individual does not complete the class, the cost of the class itself will be reimbursed to the Federal Government.“ Question: Does this mean that the Government will be providing reimbursement for the course and any travel expenses incurred to attend? At this time there is not a Travel/ODC CLIN listed in Section B.

Answer: No

Q37: Page 49, Several Sections referenced to sustainability Question: The solicitation is very clear in relation to the objectives of the contract in terms of sustainability, energy performance goals, and green technology. However, it does not have the information that will allow contractors to properly price these requirements. It appears to us that in order for a contractor to fully meet the sustainability requirements either a subcontract for sustainability or a very competent in-house team of individuals with extensive experience in sustainability, energy performance, and BAS must be utilized. If this is not required, the agency-s and EO goals in this area will very likely not be met. Is the government going to require a sustainability subcontractor?

Answer - A sustainability subcontractor is not required. The building systems have been installed and set up in a manner to help maximize sustainability. The contractor should employ personnel that are familiar with the BAS as well as the proper operation of the energy efficient equipment. The key is not to deviate from the approved operating plan.

The proper operation of the building equipment will enable the contractor to meet the sustainability requirements.

Q38: Page 77, C.17. Building Management Support Services Question: Due to constant projects being performed throughout the buildings, specifically the ongoing ARRA project in Hato Rey and the new St Thomas project, the O&M, contractor support service hours can be significantly higher. This represents a high risk to the contractor. Can GSA reconsider paying O&M contractors for the hours used in such support services?

Answer: No, GSA will not reconsider, the requirements in referenced page 77, C.17 is to be considered as part of basic services.

Q39: Page 78, C.18. Inspection Assistance for Space Build Outs and Building renovations/modernizations Question: Due to constant projects being performed throughout the buildings, specifically the ongoing ARRA project in Hato Rey and the new St Thomas project, the O&M, contractor support service hours can be significantly higher. This represents a high risk to the contractor. Can GSA reconsider paying O&M contractor for the hours used in such support services?

Answer: No, GSA will not reconsider, the requirements in referenced page 78, C.18 is to be considered as part of basic services.

Q40: Page 80, The BAS is accessed through the control system. It is important that the Contractor’s operator is familiar with this system as well. While GSA will maintain the software, firmware updates, and the licenses for the system, it is the contractor’s responsibility to operate, maintain and repair it. R2 GSA cannot stress enough the importance of these control systems, and the qualifications of the Operator. A large amount of success with this contract hinges on these two items.

Question: Please provide the name of the contractors who installed the BAS systems per building.

Answer: At the USVI locations and Jose V. Toledo FOB in Old San Juan, PR the systems were installed by Multi Air Services Engineers (MASE). At the Federico Degetau FBO in Hato Rey, PR the system was installed by TRANE

Q41: Page 119, (1) The reduction rate in dollars per day will be equal to the per month contract price for the building(s), divided by the number of working days per month. (2) The reduction rate in dollars per day multiplied by the number of days services were not provided or required. In the event services are provided for portions of day(s), appropriate adjustments will be made by the CO to assure the Contractor is compensated for services provided.

Question: The contractor will have the employees assigned to these contracts and in the event of a building closeout; the contractor will not necessarily be able to relocate these employees to be productive at other locations and still pay them. Also, the contract has other associated costs that are not necessarily related to direct labor and the contractor should receive payment for these. Please advise if GSA will reconsider paying at least labor cost and some additional percentage to the contractor in these cases.

Answer: No. The Government will not pay for services not required or not provided in the events stated in the referenced Section G., paragraphs b(1) and b(2), Page 119, except for essential personnel / excepted services as indicated in the referenced section.”

Q42: Page 121, 2. The Contractor will be held liable for all costs, including administrative costs, incurred by the Government as a result of his/her failure to provide prescribed environmental conditions at all times.

Question: Does this mean that the government will apply deductions if the contractor does not maintain environmental conditions such as temperature, humidity, VOC, or CO2 on the areas?

Answer - The Government realizes that there may be situations where temperature, humidity or other environmental conditions may deviate from what is prescribed due to equipment failures, natural disasters, etc. The intent of this item in the deduction table is to hold the contractor responsible and liable for any costs incurred by the government due to the contractor’s negligence or failure to follow proper operating protocol resulting in a significant deviation in the environmental conditions prescribed.

Q43: Page 122, 12. Failure to provide adequate personnel to perform fire watch duties when required.

Question: Please confirm that these fire watch duties are related to tasks required within this contract scope of work. Please confirm that the contractor is not required to perform fire watch duties for other contracts.

Answer - Most fire watch duties would only be necessary in the event of either a failure in a piece of equipment or system or if the contractor is performing work that disables any equipment that would necessitate a fire watch. There may be instances when the contractor would be required to provide a fire watch due to other contractors performing work in the building(s) but the contractor would be reimbursed in this instance provided they brought in additional personnel over and above those already on duty.

Q44: Page 130, H.10. Ordinances, Taxes, Permits, and Licenses Question: Taxes obligation has always been a grey area when working on Federal Contracts. Sometimes agencies will present a tax exemption letter to the contractor, but sometimes they will direct contractors to pay for all local taxes. Please advise if GSA will provide a tax exemption letter to the contractor or if the contractor will need to pay B to B tax, IVU tax, and municipal tax.

Answer: Contractor must comply with all taxes laws and regulations applicable to their businesses in Puerto Rico and the USVI. See Solicitation clauses 52.229-3. No tax exemption letter will be provided.

Q45: Page 172, (2) The Contractor shall require that the licensed design professionals it retains for the Project acquire and maintain professional liability insurance in the amount of $5,000,000 per claim and shall provide proof to the Contracting Officer.

Question: Please advise if a Licensed PE is being required as part of the contractor team.

Answer: No there is no requirement for a licensed PE.

Q46: Page 174, Compliance with Wage Determination and CBA Question: In the case of Hato Rey Building Per 29 CFR 4.163 - Section 4(c) of the Act The contractors will have to pay the new employees whether employing the existing employees or bringing new employees the same rate and benefits that the existing employees are earning. This situation introduces a high risk to the contractor because employees located in other buildings will not necessarily receive the same benefits. This can lead to unsatisfied employees and ultimately have all employees of all four building joining the Union and requesting benefits increase. In leu to this: Is the agency going to increase the price of the contract by the amount of cost increased to the contractor in the event non-union employees decide to join the union? Is the agency going to request a variance hearing to Wage and Hour Division?

Even in section (g) Contract Reconfiguration it is not clear which will be the predecessor contract and what it is going to apply to this contract. This needs to be clarified in order to have all contractors competing in equal terms.

Answer - The Hato Rey Building CBA is for the Hato Rey location only. In the event the other locations decide to form a union for their specific location, the resulting CBA must be submitted to and approved by the US Department of Labor before it can be incorporated into the contract. A variance hearing is not applicable in the presented scenario.

Q47: Page 378, Factor 1 – Prior Experience on Similar Contracts / Task Orders Similar Size is defined as: Work performed in multiple (3 or more) office buildings Question: The prior experience section suggests that one past experience must be for a campus with buildings larger than 75,000 GSF, a second past experience must be for a building larger than 75,000 GSF, and the third past experience should be similar but not necessarily larger than 75,000 GSF. Then, the Similar Size section appears to say that all three past experiences must be for buildings larger than 75,000 GSF. This seems to be a latent ambiguity. Please clarify the past experience requirement in terms of building size.

Answer: This answer will address only the size criteria as questioned. There are other criteria to be met under the experience factor clearly stated in Section M of the solicitation. According to Section M.4, Factor 1, (as revised by this solicitation amendment) it states: “The offeror is requested to submit a detailed descriptive listing of three (3) projects performed as the prime contractor for a minimum of twelve (12) consecutive months within the past seven (7) years and that are similar in nature to the one described in this solicitation……...The projects submitted shall meet the following criteria:

● Two (2) of the projects submitted shall be for buildings that are a minimum of 70,000 GSF in size. In no way will we count any individual buildings on a single contract/ task order that is less than 70,000 GSF.

● At least one (1) of the projects submitted shall demonstrate the ability to manage a campus of buildings/facilities. A campus is defined as two or more buildings on a single property or adjacent properties where each building meet the minimum square footage of 70,000 GSF. In no way will any building less than 70,000 GSF be counted in the GSF. Adjacent Property is two or more contiguous properties, or where the respective property boundaries for two or more properties are within 100 linear feet……” The section referenced in this question (and language quoted above in this answer) clearly states that the three projects submitted as experience must meet a minimum size criteria. The minimum size criteria is 70,000 GSF per building: two projects for buildings of a minimum 70,000 GSF and one project for a campus. The campus is further defined as two or more buildings on a single property or adjacent properties where each building meet the minimum square footage of 70,000

GSF.

Company F Q48: GSA is requesting resumes and signed letters of commitment for a minimum of five different staff members. However, the project does not start until November of 2017, more than nine months after proposals will be submitted. Since a large number of events will occur during this time period, it does not seem realistic for those commitments to stand.

Question: Can this requirement be removed and can contractors submit detailed qualifications that the staff they will hire will be required to meet? If not, can GSA supply bidders will the five resumes and signed letters of the current incumbent staff who can meet this expectation?

Answer: No. The Letters of Commitment requirement will not be removed from the solicitation.

Q49: Can GSA provide names, contacts and phone numbers for all the subcontractors currently being used for water treatment, electrical, BAS, generator, chiller, boiler, elevators, fire alarm, and sprinkler systems at all locations under this solicitation?

Answer: See answer to Q34

Q50: Can GSA provide the current staffing levels at the various locations under this solicitation?

Answer - No, this is a performance based contract and this information is not available.

Q51: Are all locations currently using the NCMMS or will the incoming contractor have to set up or establish this system upon award of the contract?

Answer: All locations in the Caribbean have access to the GSA NCMMS program and are…
