Performance Work Statement Waste Sampling

U.S. Coast Base Kodiak Environmental

Kodiak, Alaska

1. GENERAL

U.S. Coast Guard (USCG) Base Kodiak is located on the east side of Kodiak Island, approximately 8 miles south of the City of Kodiak (population 5,983 as of 2020). The base covers approximately

25,000 acres with 190 buildings. Approximately 1200 active duty Coast Guard personnel are assigned to the base, with over 460 dependents. Over 200 civilians work on base each day. Various

Coast Guard tenants occupy the site: Air Station Kodiak, Electronics Support Detachment, two cutters, as well as visiting vessels. In addition, 17 federal, state, and local organizations maintain a physical presence and operations at the Base.

2. CONTRACTOR SUPPORT

USCG Base Kodiak requires services for the sampling and analysis of all regulated waste delivered to the Transfer Storage and Disposal Facility (TSDF), to include Building N48, N102 and Storage

Lockers.

2.1 Unless otherwise specified, the Contractor shall provide all labor, materials, supplies, administrative, technical and managerial expertise and efforts necessary to accomplish the proper collection/shipment of requested samples and analytical review. Sampling and analysis must be performed in compliance with EPA requirements.

2.2 The Contractor shall provide a Project Manager as a point of contact (POC) to Base Kodiak personnel. The Base Kodiak POC will be the Supervisor of the Environmental Division as well as the TSDF Manager. The contractor will have provisions for the Base Kodiak POC to be able to communicate with laboratory personnel if the situation arises.

2.3 The Contractor shall provide standard turnaround times (TAT) of not less than 7 to 10 working days (except holidays and weekends).

2.4 The Contractor shall be able to provide rush TAT not greater than 3 to 5 working days (except holidays and weekends.)

2.5 The Contractor shall utilize a laboratory certified by state and federal agencies, which have jurisdiction of laboratories performing analytical testing of hazardous materials and hazardous waste products of the State of Alaska.

2.5.1 The Contractor shall provide a copy of the laboratory’s certification and/or letters from the appropriate regulatory agencies stating current certification to Base Kodiak

Environmental.

2.5.2 Should the Contractor laboratory fail to meet certification requirements, the Contractor, at its own expense, shall provide samples to a certified laboratory that can conduct the analytical testing within the holding time required by regulation.

2.6 The Contractor shall, at its own expense, provide re-sampling efforts for samples that are in the custody of the contractor or laboratory which exceed holding times. There shall be no expense to Base Kodiak for this breach by the Contractor.

3. SAMPLE / ANALYTICAL REQUIREMENTS

3.1 The contractor shall be capable of providing sampling and analytical results for the requirement parameters in oil, water, solid, or open matrix, as outlined in Section 6.2.

3.2 Base Kodiak may require other analytical testing; the Contractor shall provide the same services identified in section 2.0 at the same rate provided for the specified parameter requirements in section 3.1.

3.3 Sampling requirements are not a batch/quarterly requisite and will need performed on an “as needed” basis per individual waste as accumulated, with work initiated by the government via e-mail.

4. NOTIFICATIONS

4.1 The service performed under this contract is to be performed during normal Base Kodiak working days/hours unless otherwise approved by the Contracting Officer (KO). Services will not be scheduled to be performed on a regular Federal Holiday (see below), or one designated by Presidential proclamation. Normal hours of operation under this contract will be between the hours of 8:00am and 4:00pm AST.

4.1.1 Federal Holidays

*This holiday is observed on the preceding Friday or the following Monday when the holiday occurs on Saturday or Sunday, respectively.

4.2 All Contractor personnel performing work under this Performance Work Statement (PWS) shall be qualified via training and experience, corresponding with duties being fulfilled, to the minimum requirements under relevant 29 CFR-OSHA, 40 CFR-EPA, 49-CFR-DOT, E385 Standards and updates thereto. The Contractor shall be responsible for, and complete in appropriate timeframes, all initial and refresher training required of Contractor personnel.

Upon request by the Government, the Contractor shall provide proof that these trainings were completed.

4.3 Contractor employees performing services under this order will be controlled, directed and supervised by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the PWS.

Contractor employees will perform their duties independent of, and without supervision of any Government official. The tasks, duties and responsibilities set forth in the task order may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States

Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform inspection and acceptance of the completed work. *Contractor personnel may NOT represent the U.S. Coast Guard in any manner, including before any government or private panel, board or association.*

4.4 GOVERNMENT FURNISHED EQUIPMENT AND/OR FACILITIES:

FACILITY AND COMPUTER ACCESS

Trusted Associate Sponsorship System (TASS)

(a) "Contractor employee" means an employee of a firm, or an individual, under contract or subcontract to the Coast Guard to provide services who also requires one or more of the following:

• Physical access to multiple Coast Guard facilities or multiple federally controlled facilities within the Base Kodiak footprint, on behalf of the Coast Guard on a recurring basis.

(b) Homeland Security Presidential Directive (HSPD)-12 mandates a Federal standard for secure and reliable forms of identification for Federal employees and contractor employees.

The Common Access Card (CAC) is a personal identification card for the Department of

Defense/Uniformed Services and complies with HSPD-12. The Coast Guard has instituted the CAC as its HSPD-12 compliant personal identification card for contractor and subcontractor employees who are required to access a Coast Guard, Department of Defense

(DOD), or other federally-controlled computer information system and/or facility, or need public key infrastructure (PKI) authentication to perform their contractual duties. The

Trusted Associate Sponsorship System (TASS) is the automated application process for obtaining a CAC.

(c) Contractor and subcontractor employees working pursuant to this contract who are required to access a Coast Guard, DOD, or other federally-controlled computer information system and/or facility, or need PKI authentication to perform their contractual duties shall use TASS to obtain a CAC.

(d) The Contracting Officer Representative (COR) or Assisting Contracting Officer

Representative (ACOR) is the TASS Trusted Agent (TA) and initiates contractor accounts in the TASS, approving, returning, or rejecting CAC applications (as applicable); re-verifying assigned contractors every six months; revoking contractor and employee eligibility for a

CAC.

(e) The TA ensures that contractor personnel satisfy the security requirements for CAC issuance prior to creating the CAC application in TASS. Current investigative requirements shall be verified according to Commandant Instruction COMDTINST 5500.18, Coast Guard https://www.dhs.gov/homeland-security-presidential-directive-12

Trusted Associate Sponsorship System. The initial CAC issuance requires a favorably adjudicated Tier 1 investigation (equivalent or higher) or a Tier 1 background investigation

(BI) (equivalent or higher) package that has been successfully scheduled with the investigative service provider (ISP) and a FBI fingerprint check with favorable results. The

TA and Sponsor or other appropriate Federal Government representative must coordinate with the unit BI Verifier (Command Security Officer /Trusted Agent Security Manager) or the U.S. Coast Guard Security (SECCEN) to confirm the appropriate investigation has been favorably adjudicated or scheduled at the ISP with favorable FBI fingerprint results.

(f) The COR or Contracting Officer provides such forms to, or requests such information from, contractor employees that may be necessary for obtaining a CAC via the TASS. The

Contractor submits completed forms and information as directed by the COR or Contracting

Officer. Contractors are responsible for the accuracy and completeness of the information submitted and for any liability resulting from the Government's reliance on inaccurate or incomplete information.

(g) Contractor employees who are declined via the TASS are ineligible to perform work under this contract.

(h) When an employee with a CAC is no longer performing day to day operations under this contract, the employee must return the CAC to the COR/TA or Contracting Officer on the same day the employee stops working or contract expires.

(i) The contractor shall insert this clause in all subcontracts when a subcontractor's employee is required to access a Coast Guard, DOD, or other federally-controlled computer information system and/or facility, or need PKI authentication to perform contractual duties.

5. DELIVERABLES

5.1 The Contractor shall furnish the following reports, documents and electronic copies within 30 days of the analytical testing.

5.1.1 A report outlining the results of the analytical for each sample tested, annotating if the waste is a solid waste that exhibits any of the characteristics of hazardous waste and if the hazardous waste is prohibited from land disposal as outlined in 40 CFR Parts 260 to

279. The Contractor may e-mail a copy of these results in advance of sending the original documents to Base Kodiak Environmental.

5.1.2 Quality Assurance/Quality Control (QA/QC) reports as required by state and federal regulations.

5.1.3 A copy of the laboratory’s certification and/or letters from the appropriate regulatory agencies stating current certification.

5.1.4 Training records for Contractor employees performing work under this PWS.
