All personnel responsible for developing, reviewing and approving a single source determination shall ensure that sound business judgment is applied in researching, documenting and approving such actions.
The rationale for a single source determination is not constrained by this form. If filled out electronically, the form will expand to the written narrative. If not available electronically, the drafter shall attach continuation sheets to ensure rationale is fully supported.
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION
THRESHOLD AS DEFINED IN FAR 2.101
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER (within its warrant authority) DETERMINES THAT ONLY ONE SOURCE IS AVAILABLE IAW FAR 13.106-1(b). THIS DETERMINATION SHALL BE SUPPORTED WITH FULL JUSTIFICATION FOR SINGLE SOURCE FROM THE CUSTOMER. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:

DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:
This contract is for renewal of maintenance support and product upgrades for Jacada Integrator software (HostFuse 4.5.3). The contract includes a twelve-month base period. The contract also includes Jacada Integrator Deployment Kits (Qty. 6). HostFuse is currently being used for automation of entry and synchronization of contract and financial data between two NAVFAC information systems; FIS and ieFACMAN. The current maintenance service contract (N3943018P2060) for HostFuse maintenance support expires on 27 Jun 2020. Renewal of the maintenance support is necessary to maintain the interface between the aforementioned systems.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES
CAN BE USED:
Intellectual property rights mean that only Jacada is qualified to provide software maintenance support and product upgrades/patches for HostFuse.
No other vendors beside Jacada, Inc. has the rights to sell and provide licenses/support for HostFuse.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:
Jacada, Inc. owns the software source code and all rights to the Jacada Integrator Windows Deployment Licenses. Only the entity that owns the intellectual property rights in the software can provide software maintenance which is necessary for software updates and technical support requirements. Jacada owns the rights; therefore, they are the only provider that can modify the source code and copyrighted software. The requirements for system upgrades and software maintenance are necessary to support the various applications that are already deployed by NAVFAC. Jacada is the only source who can extend the current software maintenance. Jacada is the only seller for Jacada Integrator Windows Deployment Licenses. There are no third party vendors authorized by Jacada, Inc. that can sell Jacada products/services.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN
COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE:
FAR 13.106-1(b) provides for the use of other than full and open competition in the case of purchases not exceeding the simplified acquisition threshold when the contracting officer determines that the circumstances of the contract action deem only one source reasonably available, including brand name. Additionally, after factoring in software acquisition, development, and testing costs of potential replacements, it was determined that pursuing alternative solutions would in fact be more costly to the government by a wide margin than writing a new contract with Jacada.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO
COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED:
HostFuse is currently being used for automation of entry and synchronization of contract and financial data between two NAVFAC information systems; FIS and ieFACMAN. Without HostFuse, the data entry and synchronization will need to be performed manually. The rate at which contracts and financial data are processed would be reduced dramatically and could jeopardize the commands ability to adequately meet the goals set in our mission statement. Manual data entry will also reduce data accuracy due to human error. Costs would also rise due to the need to train contract specialists on how to complete these tasks manually. Time spent training specialists would also further reduce availability of staff to complete their objectives. Until the above functionality is deemed no longer needed by NAVFAC and/or the software comes to its end of life, HostFuse will need to be continued to be maintained for use. When the time comes to replace HostFuse software, NAVFAC will reassess the market to determine other viable competitive options.
