About this file
This document is a justification for a sole source award for emergency HVAC repair services at two National Park Service facilities. The justification cites urgent and compelling circumstances to address failures of HVAC systems at the Death Valley National Park maintenance headquarters and visitor center/park headquarters that have caused unsafe temperatures over 120 degrees Fahrenheit. Market research found only one vendor, JonAire Inc., able and willing to perform the critical repairs. The estimated cost is $12,500. The contracting officer certification determines the price to be fair and reasonable and that only one source is available. Solicitation number 140P8123P0038 will result in a limited sole source award to JonAire Inc. by the Department of the Interior National Park Service Pacific West Region for emergency HVAC repairs at the specified Death Valley National Park locations.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR
Part 2) UP TO SAT (See FAR 13.106-1)

PR Number: ___See A01 PR_______
1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
Emergency HVAC repair of the Maint HQ and Park VC/HQ. Anticipated cost is $12.5K
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
___X___ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: The HVAC systems at the Maint HQ and PARK VC/HQ are either failing or have failed. The VC/HQ HVAC cooling tower needs immediate replacement of the motor and shaft that provide for the cooling to the Parks HQ and Visitors Center. The Maintenace HQ building had a catastrophic failure of the compressor unit to the HVAC thereby shutting down all HVAC functions to the building creating a serious life safety issue. In the last four weeks temperatures in the park have been over 100 degrees, in the last 13 days temperatures in the park have risen to over 120 degrees making the procurement an urgent and compelling need to protect staff and visitors from heat stroke and other heat related health complications to both staff and visitors. This does not consider the need to protect government IT equipment from over heating causing a domino effect of loss of critical IT data and equipment.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:
Brief market research was performed by performing cold calls to vendors in the areas of Las Vegas, Pahrump, NV and Ridgecrest, CA that have the technical expertise to provide the requirement needed to restore climate control to the Park HQ/VC and Maint HQ buildings. Only one vendor is willing to respond to provide the service, JonAire Inc. This is a life, safety and health issue and the repairs need to be made in order to ensure the safety of the Public and Park employees.

4. If this is a determination for sole source, the contracting officer certifies:
