Glenn Emig (202) 502 8669 Contracting Officer

The purpose of this amendment is to (A) provide answers to questions received in response to the solicitation, (B) clarify the purpose of the estimated numbers of hours provided in CLINs 0001, 1001, 2001, 3001 and 4001 Section B.1 Price/Cost Schedule and (C) clarify the purpose of the estimated numbers of hours provided in Attachment 2: Sample Pricing Table (Pricing Model).

A. FERC received six (6) questions in response to the solicitation. The questions and FERC’s answers are provided herein.

Question 1: Does the Combined Synopsis/Solicitation under solicitation number FERC15R0008 contain requirements similar to a current contract? If possible, please provide the current contract number. Or, is this a new requirement for the government?

Answer 1: This is not a new requirement. This procurement contains requirements similar to the previous procurement FERC-09-BPA-90165 which expired on September 19, 2014. The incumbent contractor was Stebbing & Associates; 634 Mississippi Avenue; Signal Mountain, TN.

Question 2: Regarding solicitation “FERC-15-R-0008” ... will there be multiple awards or one single selection?

Answer 2: The government intends to award a single contract.

Question 3: Regarding the reinstated solicitation for LNG Technical Support Services, I am hoping you could provide some clarification on conflict of interest section (Section 14.2) and Section VII of the proposal (Organizational and Personal Conflict of Interest).

Does the FERC plan to review the Offeror’s list of customers and make a determination of conflict of interest as part of the proposal review?

It stands to reason that an Offeror with clients in LNG or hydrocarbon processing would be well suited for technical support of the FERC and must demonstrate ability to resolve conflict of interest potential as part of collaboration with the FERC.

Could you please clarify the intent of this requirement? It is our intention to be compliant with the FERC’s policies regarding conflict of interest.

Answer 3: FERC plans to review the offeror’s list of customers and make an assessment as part of the proposal review.

The purpose of the Personal and Organizational Conflict of Interest assessment is to assess the risk of the offeror being conflicted out of work which will be required under the resultant contract.

The purpose of E.1.4 Submission of Offerors, Volume 1 Technical Proposal, Subsection VII (Organizational and Personal Conflict of Interest) is to identify the information which should be included in the offeror’s proposal regarding organizational and personal conflict of interest. This information will be used as part of the proposal evaluation process to assess the risk of the offeror being conflicted out of work which will be required under the resultant contract.

The purpose of Statement of Work, Section 14.2 is to prevent organizational conflicts of interests which may arise post-award, during contract performance.

Question 4: Our firm is currently engaged as Owners Engineer for two US based LNG Export Terminal, does this present a potential CoI to engage our firm for the review of other KLNG Facilities in the US in which we are not involved?

Answer 4: FERC makes Organizational and Personal Conflict of Interest determinations on a case by case basis. For this reason, absent a specific set of facts, it is difficult to give a specific answer. Generally speaking, FERC would assess the situations described in question 4 above as a potential risk for proposal evaluation purposes.

Question 5: Is FERC engaging only one Consultant/Firm to carry out the scope of work for all LNG Facilities that are require FERC approval?

Answer 5: Yes, FERC anticipates awarding a single contract to a single company. The work required under the contract does not include work for all LNG facilities that require FERC approval. The amount of work anticipated under this contract is reflected in the estimated number of labor hours identified in section B.1 and attachment 2 of the solicitation.

Question 6: Can our firm propose more than one individual engineer (LNG Specialist) for the various tasks that are outlines in the RFP?

Answer 6: Yes, offerors may propose more than one engineer; however, the page limits remain unchanged.

B. The numbers of hours provided in CLINs 0001, 1001, 2001, 3001 and 4001 are estimates of the numbers of hours the government anticipates will be necessary for each performance period. This is the government’s best estimate of the level of work. This is not a guarantee of the amount of work required for each performance period. The actual number of hours required each period will depend on the government’s actual need during each performance period.

C. The numbers of hours provided in Attachment 2: Sample Pricing Table (Pricing Model) are for evaluation purposes. Offerors shall use the stated number of hours for calculating their proposed price. The numbers of hours provided in attachment 2 are estimates of the numbers of hours the government anticipates will be necessary for each performance period. This is the government’s best estimate of the level of work. Accordingly, the solicitation is amended to add the following note to Section E.1.4 Submission of Offers, Volume 2 – Price Proposal, II – Price Information:

· Note: The numbers of hours provided in Attachment 2: Sample Pricing Table (Pricing Model) are for evaluation purposes. Offerors shall use the stated number of hours for calculating their proposed price. The numbers of hours provided in attachment 2 are estimates of the number of hours the government anticipates will be necessary for each performance period. This is the government’s best estimate of the level of work.
