JUSTIFICATION FOR OTHER THAN FULL & OPEN COMPETITION

PROJECT NAME:

Rosche Parking Contract Renewal

The following Justification for Other than Full & Open Competition (JOFOC) is prepared in accordance with FAR Subpart 6.302-2 and under the authority of the test program for commercial items at 41 U.S.C. 1901.

1. ORGANIZATION:

Federal Energy Regulatory Commission (FERC) Office of the Executive Director, Chief Financial Officer, Logistics Management Division 888 1st Street, NE Washington, DC 20426

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

The FERC is seeking the use of underground parking spaces located at the 888 First Street N.E., Washington, DC 20426 building with twenty four hour, seven days a week access. A new contract is required to include a base and four, one year options to renew the existing Rosche Parking contract #: FERC11-C-0010 which expires on September 30th, 2015. The acquisition will be treated as an acquisition of commercial items in accordance with 12.102(f)(1).

3. DESCRIPTION OF REQUIREMENT & VALUE: N/A

FERC requires 388 indoor, covered, and secure parking spaces on P2 and P2, at least two bicycle racks. Five parking spaces located on the P1 garage level for FERC Government vehicles at 888 First Street, N.E. Washington, DC 20426. No fewer than three of the P2 and P3 parking spaces must be reserved for personnel with disabilities, so that FERC is able to provide reasonable accommodation and work access for those with disabilities. The agency also requires access to the parking facility 24 hours, seven days a week. Providing parking facilities outside the 888 First Street, N.E., Washington, DC 20426 address would negatively impact the FERC work place, since employees would not have reasonable and flexible, without delay, access to work in order to timely conduct their assigned duties. FERC requires that parking facilities be immediately below its Headquarters office building located at 888 First Street, N.E., Washington, DC 20426 to ensure the safety of staff as well as provide reasonable access for those with disabilities.

4. STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(2) in accordance with:

[ 1 ] FAR 6.302-1, only one responsible source and no other supplies and services will satisfy Agency Requirements;

5. DEMONSTRATE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS:

This award is being made according to FAR 6.302-1, only one responsible vendor and no other supplies or services will satisfy FERC’s parking requirements. At the present time more than 1,200 individuals work at the 888 First Street, N.E., Washington, DC 20426 location, some of whom work long hours and on weekends. Some have temporary or permanent disabilities, which will require FERC to make available to them safe, convenient parking. Therefore, FERC requires facilities with 24 hour 7 days convenient access and parking facilities underneath 888 First Street, N.E., Washington, DC 20426. The market research revealed that no garage, except for the proposed landlord Rosche, meets all of FERC’s parking requirements.

6. SOURCES SOUGHT EFFORTS:

Market research was conducted, the details of which are provided in section 8 below. No competition is anticipated for the proposed action. Pursuant to FAR 13.501 (a) (1) (iii), the resulting contract action will be synopsized and a copy of this justification will be made publicly available on the Federal Business Opportunities page within 14 days of award of the order.

The market research found there are no other parking facilities within 888 First Street, N.E., Washington, DC 20426 vicinity that can provide FERC with 388 parking spaces and meet the other stated FERC parking requirements. Rosche is the only contractor who can supply parking services at the 888 First Street, N.E., Washington, DC 20426 location and meet all of FERC’s parking requirements as they are the building owner.

7. DETERMINATION OF FAIR & REASONABLE PRICING:

The market research conducted revealed that the pricing was calculated by increasing the monthly price per space by 3%. This price multiplied by 388 parking spaces provided by Rosche then multiplied by 12 months for each fiscal year. This approach is similar to the previous contract terms. In addition, FERC contacted Federal Parking (825 North Capitol St. N.E., Washington, DC 20002), Colonial Parking (750 1st street, N.E., Washington, DC), and all of these parking facilities are near FERC Headquarters cannot support 388 parking spaces or meet FERC’s parking requirements. Additionally, Colonial parking currently has a waitlist for parking and does have any monthly parking spaces available.

Based upon a consideration of market research, as well as comparability of FERC’s required parking services, FERC concludes that the price of $214.47 per month, per parking space with a price increase of 3% for the succeeding option years (should it be exercised), is fair and reasonable.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED & RESULTS:

As mentioned section 7 the market research considered three other potential parking facilities located within walking distance from FERC Headquarters to 888 First Street, N.E., Washington, DC 20426. However the required area for the proposed parking garage is underneath the FERC Headquarters office building. In addition, the three considered parking facilities could not accommodate up to 388 parking spaces.

9. ANY OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION:

Describe any factors that would make it difficult/more costly for another Contractor to provide the service/product.

The FERC Headquarters building is owned by Rosche therefore, there are no other contractors are permitted by the building owner to provide parking services inside the 888 First Street, N.E., Washington, DC 20426 building.

10. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION.

As mentioned above in sections 6, 7, and 8 FERC contacted three nearby parking facilities and all three stated that cannot support 388 parking spaces or meet FERC’s parking requirements.

11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SERVICES REQUIRED:

FERC’s parking requirements are expected to remain unchanged, at least in significant part, due to the recent ten year lease renewal of the Headquarters building at the 888 First Street, N.E., Washington, DC 20426. The ten year lease renewal was dated 7-10-2014. It is expected that the current requirement will continue for the duration of the ten year lease extension. Upon the expiration of this proposed contract renewal the FERC will update its market research to identify whether there are any new or revised parking facilities options, within the vicinity of 888 First Street, N.E., Washington, DC 20426 that can meet future FERC parking requirements for further competition in the future.
