Part 1 – Description The U.S. Food and Drug Administration’s (FDA) Center for Drug Evaluation and Research

(CDER) is requesting a Triple Quadrupole Mass Spectrometer Coupled with HPLC System. This is re-posting of solicitation and the FDA changed evaluation criteria to clarify how the system will be evaluated for sensitivity and that the award determination is now best value instead of two

(2) phase process. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Part 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposal are being requested, and a separate written solicitation will not be issued.

This solicitation is a Request for Proposal (RFP) using FAR Part 12 and 13 procedures. The solicitation document and incorporated provisions and clauses are those in effect through Federal

Acquisition Circular (FAC) 2020-08, August 13, 2020. The North American Industry

Classification System (NAICS) code for the proposed acquisition is 334516 Analytical

Laboratory Instrument Manufacturing, Small Size Standard 1,000 Employees. The requirement is open to all responsible offerors.

Part 3 – Description/Specifications

3.1 Background

The purpose of this request is to purchase a liquid chromatography system coupled with a triple quadrupole mass spectrometer (LC-QQQ) for selective and sensitive analysis of pharmaceutical analytes at the Division of Pharmaceutical Analysis (DPA) (a division in CDER/OPQ/OTR). This acquisition will improve DPA’s capacity to assess the safety and quality of pharmaceuticals through the application of advanced analytics to support the FDA’s mission of protecting public health through testing and research.

Selective and sensitive detection and quantification of pharmaceutical impurities and contaminants is of the utmost importance in the evaluation of pharmaceutical safety and quality.

Pharmaceutical impurities and contaminants, such as genotoxic impurities, leachables, adulterated substances, process impurities and drug degradation products, compromise drug quality and efficacy, and can cause serious safety issues. Many of these impurities are present at very low levels and require highly selective and sensitive analytical techniques for their detection and quantification.

Liquid chromatography coupled with triple quadrupole mass spectrometer (LC-QQQ) is one of the common and preferred analytical techniques for the identification and quantitation of impurities at very low level. LC-QQQ achieves high selectivity and sensitive detection mainly through a process termed multiple reaction monitoring (MRM). In this process, targeted analytes are introduced to the mass spectrometer (QQQ) after chromatographic separation and are selected for fragmentation based on their respective masses. The resultant signature fragments are then used for detection and quantification of the targeted analytes.

DPA will utilize the acquired LC-QQQ system mainly for the analysis of trace level impurities, such as nitrosamines, a group of compounds that are probable human carcinogen, to support the

FDA’s quality and safety assessment of marketed drug products and regulatory actions.

Additionally, LC-QQQ will serve as orthogonal and complimentary technique to other LC-MS platforms, such as LC-HRMS (liquid chromatography LC coupled with high resolution mass spectrometer), to confirm the analysis results from these platforms, providing high confidence in the reported results.

DPA considers LC-QQQ the optimal analytical technique to meet the needs of detecting and quantifying low level impurities, and requests acquiring an LC-QQQ system.

3.2 Statement of Work

Requirements

The statement of work below describes a liquid chromatography system coupled with a triple quadrupole mass spectrometer (LC-QQQ) to improve CDER/OPQ/OTR/DPA’s capability for selective and sensitive detection and quantitation of various analytes related to pharmaceutical compounds.

The Triple Quadrupole Mass Spectrometer Coupled with HPLC System shall meet the following salient characteristics:

3.2.1 Technical Requirement

The instrument package shall meet the following criteria:

a. The LC System shall consist of:

i. A pump that accommodates backpressure of not less than 1200 bar, and provides a maximum flow rate not less than 2 mL/min.

ii. An autosampler which allows temperature control within a minimum range of 4 °C –

37 °C.

iii. A thermostat column compartment that is capable of cooling (to below ambient temperature) and heating the column (not less than 80°C).

iv. A UV-Vis detector with a photo diode array (PDA) function.

b. The triple quadrupole mass spectrometer shall include both an electrospray ion source (ESI) and an atmospheric pressure chemical ionization (APCI) ion source.

c. The following performance characteristics of the triple quadrupole mass spectrometer are minimum requirements.

i. Wide range mass-to-charge (m/z) ratio determination with the minimum m/z not greater than 10.

ii. Fast scan speed, at least 12,000 Da/sec.

iii. Rapid polarity switch, minimum 25msec.

iv. Sensitive detection of analytes; NMT 1 pg reserpine.

v. Mass resolution NMT 0.7 Da.

iv. Mass Stability NMT 0.1amu for 24 hours.

d. LC-MS system shall have good performance for N-nitrosodimethylamine (NDMA). The detection limit is defined as the NDMA amount (in pg) yielding repeatable peak areas with

% RSD < = 10 for not less than six measurements (C18 reverse phase column at a size of 50 x 4.6 mm should be used with 0.1% formic acid in water and 0.1% formic acid in methanol as mobile phases). See Attachment 1

e. A computer workstation for system operation shall be included.

f. The following software shall be included.

i. Instrument control and data acquisition for LC and MS under one platform.

ii. Qualitative and quantitative data processing.

g. The LC system, mass spectrometer, and all items included with the purchase order shall further be installed and verified as functionally operational. Installation and operational qualification (IQ/OQ) certification shall be provided. Performance Qualification (PQ) shall be provided by contractor and shall include demonstration of N-nitrosodimethylamine

(NDMA) detection (See Attachment 1)

h. Inclusion of on-site training of instrument operation, maintenance and application are required.

3.2.2 Trade and Service Specifications

a. The instrument shall be a newly manufactured unit, not used, refurbished or previously used for demonstration. The life cycle of this instrument is intended to be greater than ten years at full performance. CDER must be able to reasonably expect service and technical support from the vendor during its lifecycle.

b. The entire system shall be warranted for parts and labor for 12 months from the date of installation. The vendor shall provide a copy and pricing in writing for any available extended warranties and service contracts that provides minimum 1 annual PM. The vendor shall also be capable of servicing the instrument through the extended warranty or service contract. This information shall not obligate CDER to purchase an extended warranty.

c. The vendor shall demonstrate the ability to manufacture the instrument system with a high degree of quality control as evidenced by units in use by other customers performing applications with similar technical demands.

d. Provide test result using attachment # 1 instructions. Vendor are responsible to purchase test sample. This sample can be purchase from SPEXCertiPrep as 1 mL of 1000 ug/mL methanol solution at estimated price of $36.00. The catalog number is S-2815. Below is website link:

Part 4 –Performance and Deliverables

4.1 Delivery, Installation, Training, and Support: 52.247-34 F.O.B. Destination

The vendor is responsible for delivery of the instrument and all components specified above. The vendor will demonstrate upon installation that the item will meet all performance specifications by the manufacturer. The entire system must ship as one lot, no back orders allowed. If shipments must be sent separately, payment will not be made until all deliveries have been made.

The instrument will not be accepted until those performance specifications have been met. The contracting officer representative (COR) will perform inspection and acceptance of the liquid chromatography system coupled with a triple quadrupole mass spectrometer.

The entire system will be warranted for parts and labor for one (1) year from date of installation.

Service and installation must be provided by service engineers who are trained and certified by the original manufacturer of the instrument. Engineers should have access to the manufacturer’s latest technical developments, repair procedures, application updates, diagnostic software, and planned maintenance procedures. Must be able to provide any needed parts, labor, and travel for repair in a timely fashion three to seven (3-7) days.

The vendor shall cover all costs associated with the following:

• Crating and shipping shall be included in this proposal to the delivery address.

• On-site installation, hardware, software, and applications training shall be provided at the FDA site.

• All appropriate training manuals and literature must be supplied either electronically or n hard copy.

• Technical support shall be provided through common avenues: phone, web, fax, during standard business hour.

• Delivery site preparation checklist within forth teen (14) days of award.

• Delivery of a system, followed by installation and operation qualifications and training

Ninety (90) days after delivery.

Place of Performance and Work Hours

Delivery and installation should be coordinated through the Contracting Officer Representative.

Work shall be conducted Monday through Friday, excluding federal holidays during the times of

9.00 AM to 4.00 PM EST. Contractor shall provide at least 72 hours notice for installation, set-up, and vendor is responsible for delivery and installation of the instrument to the laboratory facility.

All delivery crew, engineers and technicians must have a valid U.S. Driver’s license for entry through security.

Inspection and Acceptance Criteria

The Contracting Officer Representative (COR) will perform inspection and acceptance of equipment, installation and services to be provided. The COR – to be determined upon contract award - is the authorized representative of the Contracting Officer.

At installation, the instrument operation and performance qualification shall be demonstrated

(IQ/OQ/PQ) as stand-alone system. After the delivery and installation of the instrument, the

Government shall have thirty (30) working days to inspect and verify that the equipment is operational and functional.

Period of Performance

The period of performance for this contract is one (1) year from the completion of installation and validation of the equipment.

This is a standard procurement for a commercial product item. Period of performance will be the standard delivery after placement of the order, plus warranty and service contract coverage for one (1) year.

Warranty/Preventative Maintenance Service Agreement

Warranty: Vendor must offer a minimum one (1) year warranty for parts and labor for repairs or defects. Following initial warranty/service/technical support coverage, the FDA shall have a unilateral right to exercise optional periods to extend the warranty/service agreement to include preventative maintenance.

Optional Periods

Deliverable Period of Performance

Option Period 1 Begins at the expiration of the base period and will end after one year.

Option Period 2 Begins at the expiration of the 1st option period and will end after one year.

Option Period 3 Begins at the expiration of the 2nd option period and will end after one year.

Option Period 4 Begins at the expiration of the 3rd option period and will end after one year.

Entire system must be warranted for parts and labor for one (1) year from date of acceptance, including one PM visit to occur approximately 1-3 months before the original warranty expires. Warranty service should be equivalent to the maintenance agreement requested in the next section.

Option Year Maintenance Agreement: As part of this purchase, Center for CDER seeks an option year maintenance agreement for four (4) option years, beginning one year after date of installation and acceptance. This shall not obligate CDER to purchase the extended warranty. If

Government exercises Option Year not containing comprehensive repair coverage, repairs may be paid by credit card order for repairs quoted at time of need, not to exceed (NTE) $5,000.

Part 5 –Contract Administration

The period of performance (POP) begins the date of contract award execution and continues for one (1) year beginning on the day of formal government acceptance.

The anticipated Period of Performance is as follows:

Base Period: 09/21/2020 – 09//20/2021

Option Year 1: 09//21/2021 – 09/20/2022 – Extended Warranty/Preventive Maintenance

Option Year 2: 09//21/2022 – 09/20/2023 – Extended Warranty/Preventive Maintenance

Option Year 3: 09//21/2023 – 09/20/2024 – Extended Warranty/Preventive Maintenance

5.1 Administrative Points of Contact

For this PART, (COR TBD) is the authorized representative of the Contracting Officer.

The Contracting Officer’s Representative (COR) will perform inspection and acceptance of equipment, installation and services to be provided.

The COR is responsible for the following as required by this order: (1) monitoring the

Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluations;

(4) performing technical inspections and acceptances; and (5) assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as an agent of the Government under this order. Only the Contracting Officer has authority to: direct or negotiate any changes in the order, including modifying or extending the period of performance, changing the delivery schedule, authorizing reimbursement to the Contractor for any costs incurred during the performance of this order, or otherwise change any terms and conditions of this order.
