PART 1 – GENERAL INFORMATION
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 and 13.5, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Government contemplates issuing a firm fixed-price purchase order resulting from this solicitation. This solicitation document incorporates provisions and clauses in effect through Federal Acquisition Circular FAC 2020-06, effective May 6, 2020.
The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 – Analytical Laboratory Instrument Manufacturing, with an associated size standard of 1,000 employees. This requirement is being solicited as a total small business set-aside.

PART 3 – DESCRIPTION OF REQUIREMENTS
Background The Forensic Chemistry Center (FCC) in the FDA’s Office of Regulatory Affairs/Office of Regulatory Science/Medical Products and Specialty Labs (ORA/ORS/OMPSLO) requires a desktop X-Ray microtomography (XMCT) system. This technology shall provide new capabilities to analyze the internal components of electronic vaping devices and counterfeit electronic nicotine delivery systems (ENDS) and components as part of ongoing support for criminal investigations and adverse events, including deaths, associated with vaping pulmonary illness investigations and exploding batteries used in counterfeit ENDS products.
Purpose The purpose of this acquisition is to provide systems for nondestructive sample analysis of vaping devices, counterfeit ENDS systems, components and batteries that have already been associated with
FDA-20-RFQ-1227199 Page 2 of 17 fatalities and other ongoing adverse events reported to Office of Emergency Operations. Most of the internal components and batteries obtained for analysis require destructive testing. This technology shall allow for nondestructive 3-dimensional X-ray scans to create models of internal components for further measurements and comparisons to authentic samples.
Scope The contractor shall provide one complete XMCT system. The contractor shall also install and qualify the system, provide training to government staff and offer options for extended preventative maintenance for the life of the instrument.
Description of Requirements This requirement is being solicited in accordance with FAR 52.211-6, Brand Name or Equal. Equivalent specifications that differ from the requirements shall be justified by the proposing vendor. The XMCT system shall be equivalent to a Skyscan 1275 and include all equipment to meet the following minimum technical specifications:
Hardware Specifications
• Single push-button operation
• X-ray source: should be between ~ 20-100 kV, 10 W max., < 5 μm spot size at 4 W, air-cooled
• Integrated Al and Cu filter
• Large field of view X-ray detector with distortion-free ~ 3-megapixel active pixel CMOS flat-panel detector with approximately 75 μm square pixels, full format, up to 26 frames/second in full resolution, 14-bit digitalization
• Resolution: smallest isotropic voxel size at object plane of ~ < 4 microns for 2Kx2K pixels in reconstructed cross-sections
• Maximum scanned volume up to ~96 mm in diameter, ~120 mm in length by automatically connected partial scans or ~ 50 mm for a single scan.
• Optional automatic sample chamber that can handle up to 16 samples with different sizes.
• Four axis precision object manipulator based on stepping motors with microstepping drives
• A minimum of 5Mp shielded CMOS visual camera for monitoring of the object position inside the specimen chamber and with possibility to save image of the object in BMP, JPG or PNG format
• System dimensions of ~ W 1040 mm x D 665 mm x H 400 mm and weight between 160- 180 kg. Power: 100-240V AC, 50-60Hz, 3A max. Due to weight and space considerations, this is the largest size system that is required.
• Typical power consumption of ~90W at maximum X-ray power
Computer Specifications The Contractor shall provide a compatible workstation with that meets the minimum specifications:
• 3.4GHz, 10.4GT/s, 2666MHz memory access
• 128GB, 2666MHz DDR4 memory

• 8 GB NVIDIA® Quadro® Graphical card
• 16 TB (4x4 TB) SAS HDD in RAID 0 for data
• 512GB SolidStateDrive for operating system and software
• Monitor, sound bar, keyboard, mouse, DVD+/- RW drive
• Windows 10 Professional (64-bit) English
• Software suite shall be preinstalled in the PC
Software Specifications The associated software provided with the system shall meet the following specifications.
• Source and camera control, obtaining shadow images and series of angular projections for reconstruction, acquisition parameter control including different sets of measurement protocols. Easy to use graphical Windows user interface.
• Reconstruction software for single PC version with GPU acceleration.
• Standard circular scanning mode and Helical scanning mode and reconstruction.
• Use modified Feldkamp multi-slice volumetric (cone-beam) reconstruction algorithm for round scanning trajectory and exact reconstruction algorithm for helical (spiral) scanning.
• Single slice or selected/full volume reconstructed after one scan.
• Full cross section size (full image mode), partial reconstruction mode, and possibility for detail local reconstruction with object larger than field of view.
• Automatic misalignment correction, ring artefact correction, adjustable smoothing, beam hardening correction, detector’s dead pixel correction, drift compensation, reconstruction from circular or spiral (helical) acquisition, automatic reconstruction from number of partial scans of long objects, drawing rulers, automatic and manual selection for grey-scale window.
• Output file formats: 16bit TIFF, 24bit (greyscale) JPEG, 8-bit BMP, PNG, text format.
• Visualization software (Data viewer) with images are displayed as a slice-by-slice movie.
Data viewer shall also have a viewing mode with three intersecting orthogonal slices centered at any selected point inside the reconstructed volume and be able to rotate around any axis and resample reconstructed dataset in any alternative orientation.
• Be able to convert between TIFF, BMP and JPEG files with adjustment of color palette, inversion, renaming, resizing and combining of datasets. The converter shall provide conversion from the set of reconstructed slices to file(s) in DICOM 3 format.
• Analyzer to measure comprehensive 2D and 3D morphometric parameters. The 3D models created by analyzer are loaded and viewed from the accompanying volumetric software.
• Realistic Surface Rendering Visualization Software with ability to view inside the models by cutting away a part or making it transparent.
• A “flight recorder” for flexible and fast creation of “movies” for animated presentation of scanned object in a 3D virtual environment by automatic interpolation between several selected key frames.
• Stereo imaging using red-green or red-cyan glasses.

• Export to mobile devices and datasets exported to mobile devices can be used for volume rendering, virtual manipulation and cut using free versions of software for mobiles. The mobile versions support iOS devices (iPhone, iPad, iPod) as well as mobiles running Android.
• Simpleware modeling software by Synopsis or equivalent licensing agreement shall be provided
• Modules shall allow for geometric measurements, export STL for 3D printing or modeling and CAD compare
• Provide a 1-year lease for node locked software license.
• Provide at least 8-hour block of software training for individual sessions
Technical and Service Requirements The Contractor shall also provide the following support services along with the XMCT system:
• The system must be a newly manufactured unit, not used and refurbished or previously used for demonstration.
• The entire system must be warranted for parts and labor for at least 12 months from the date of installation acceptance and shall include at a minimum: coverage on all non-consumable items and parts supplied including base instrument, computer, monitor, and power conditioning equipment supplied, unlimited site service visits, factory-certified replacement parts, engineer labor and travel costs, software updates and notifications, and phone assistance.
• The system shall be delivered FOB Destination and include inside delivery, set-up, installation and training. Sufficient training for up to five users shall be provided during installation, such that operators may independently operate the instrument and increase familiarity and proficiency. The training shall include manuals and consumables to be used during training. It is expected that the training shall take up to 3 days and cover operation of the instrument, software use, and general maintenance. This course must take place at the Government site.
• Entire turn-key system shall be delivered no later than 30 days after contract award.
• The Government must be able to expect routine customer service and technical support to be available from the vendor during the contract lifecycle. In addition, the Contractor shall include unlimited phone, email and online support for the instrument for the life of the instrument.
• SkyScan software or equivalent for instrument shall be provided as an unlimited site license with free updates for life of the instrument.
• For each option year, if exercised, the Contractor shall provide one annual preventative maintenance service visit for the system, to be scheduled with the Laboratory POC.

PART 4 – DELIVERIES AND PERFORMANCE
Deliveries All deliveries required by the contractor shall be made F.O.B. destination. All deliverables required under this contract shall be packaged, marked and shipped in accordance with Government specifications. At a minimum, all deliverables shall be marked with the contract number and contractor name. The contractor shall guarantee that all required materials shall be delivered in immediate usable and acceptable condition.
Place of Performance Satisfactory performance of this contract shall be deemed to occur upon completion of services described above and/or upon acceptance by the Contracting Officer or the Technical Representative of these products and services. The equipment shall be delivered and installed to:

The POC for the laboratory will be identified at the time of award. The Contractor shall contact the Government POC at least 48 hours prior to delivery or service. Unless otherwise specified, deliveries and services shall occur at the address above, Monday through Friday (excluding Federal Holidays) between the hours of 8:00 a.m. and 4:00 p.m. in accordance of the laboratory location time zone (Eastern Time, Central Time, or Pacific Time). Supplies or services scheduled for delivery or service on a Federal holiday shall be made the next business day.
When the technician arrives on-site to perform installation, training or any system maintenance, they will need to check in with the Front Security Guards and provide proper identification (i.e. state driver license and evidence of employment with vendor). They will receive an “Escort Required” temporary badge, which must be worn always while in the building, and will need to stay with lab personnel during their visit.
When their work is complete, the technician will check out with the same Security Guards, returning the temporary badge. Tobacco, of any form, is not permitted on Federal Property, in Federal Buildings or parking lots.
Period of Performance The required equipment shall be delivered no later than 30 days after date of award, unless the Government approves an alternate delivery schedule. The included warranty for the equipment shall be
FDA-20-RFQ-1227199 Page 6 of 17 one year from the date of installation and verification of the equipment. If exercised, the optional extended warranty shall begin at the end of the base warranty period.
PART 5 – CONTRACT ADMINISTRATION DATA

The Technical Representative is responsible for: (1) monitoring the Contractor’s technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to (1) Direct or negotiate any changes in the RFQ; (2) Modify or extend the period of performance; (3) Change the delivery schedule; (4) Authorize reimbursement to the Contractor any costs incurred during the performance of this contract; or (5) Otherwise change any terms and conditions of this contract.

Payment Schedule:
The Contractor shall submit an invoice for the equipment subsequent to the delivery and installation of the required equipment. Annual invoices for the optional extended warranty, if exercised, shall be submitted after exercise of the option.

B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer - System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:
(i) Name and address of the contractor;
(ii) Invoice date and invoice number;
(iii) Contract/Order number (including a reference to any base award for Indefinite-Delivery/Indefinite- Quantity Contracts or Blanket Purchase Agreements);
(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:
(a) period of performance for which costs are claimed;
(b) itemized travel costs, including origin and destination;
(c) any other supporting information necessary to clarify questionable expenditures;

The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
