JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

FAR Part 6

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Operational Support Contracts Unit (OSCU), proposes to enter into a contract on a basis of other than full and open competition for FBI Police uniforms on behalf of the Security Division, Security Operations Section.

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

This sole source justification is being competed and awarded as a brand name requirement as a new Blanket Purchase Order (BPA) contract to provide the FBI Police with matching uniforms. This brand name justification is for all the items necessary to complete an FBI Police Officers uniform. This contract will be a firm fixed price BPA contract.

3. A description of the supplies or services required to meet the agency’s needs.

This requirement is to provide the FBI Police Officers with complete matching uniforms and replacement items (see attached list for detailed product information). The FBI Police Officers located at various locations across the country require that they all wear the same uniforms in order to ensure that all officers are identifiable and look the same. Any differences in the unformed appearance of any officer could cause confusion and ultimately impact the mission of the FBI Police and their ability to protect both federal employees and the public. The estimated value of this contract is not to exceed $2,000,000 over a 5 year contract that consists of one (1) base year and four (4) one (1) year option periods.

4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1)(or 10 USC 2304(c) (1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

The items found on the attached list have all been carefully tested and selected to meet safety, durability, and quality standards set forth by regulation and FBI policy. The items on the list also currently make up the uniforms that all FBI Police Officers currently wear. In order to maintain a uniform appearance the FBI Police must continue to purchase the same items so all officers are wearing matching uniforms.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

This requirement will be publicized on the Federal Business Opportunities website (www.fbo.gov) in order to allow the maximum competition practicable under this brand name justification.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated dollar value of this contract is not to exceed $2,000,000.00 including all option periods. Additionally this requirement is for commercially available items and will be competed to the maximum extent practicable the Government can determine if prices are fair and reasonable.

8. A description of the market research conducted and the results.

The FBI Police are constantly completing market research by searching for any new items that may better meet their criteria at a lower cost. In addition, they work closely with other Government agencies and local law enforcement and the items they use for their uniform needs.

9. Any other facts supporting the use of other than full and open competition.

10. A listing of any sources that expressed a written interest in the acquisition.

This item will be competed on www.fbo.gov for any interested parties that can offer the items on the attached list.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
