AEDC-G001 SUBMISSION OF INVOICES (DEC 2013)

AEDC-H001 INSURANCE CLAUSE IMPLEMENTATION (MAY 2012)
The Contractor shall obtain and maintain the minimum kinds and amounts of insurance during performance of this contact as specified by FAR 28.307-2 Liability, and contemplated by FAR 52.228-5, Insurance-Work on a Government Installation, and/or 52.228-7, Insurance--Liability to Third Persons.
AEDC-H002 REQUIRED INSURANCE (MAY 2012)
Pursuant to FAR clause 52.228-5, Insurance - Work on a Government Installation (JAN 1997) (Deviation) the contractor shall maintain the following minimum amounts of insurance:

AEDC-H003 SANITATION (MAY 2012)
The Contractor shall provide toilet facilities in a ratio of not fewer than one for each 30 persons or fraction thereof. Connections to existing sanitary sewer manholes may be made. The Contractor shall supply drinking water from connections to the existing potable water system. The Contractor shall take proper precautions to protect the water system from damage and contamination. Any temporary connections made for drinking water or toilet facilities shall be removed by the Contractor in a manner satisfactory to the Contracting Officer before final acceptance of the work.
AEDC-H004 EXISTING UNDERGROUND UTILITIES (MAY 2012)
The location of existing underground utilities as shown on the contract drawings has been taken from as built drawings. There may be underground utilities which are not shown on the contract drawings and these utilities may be dangerous if ruptured. If the Contractor unearths or strikes any underground utility not shown, the excavation work shall cease and the Contracting Officer shall be notified immediately.
The Contractor shall determine with caution the exact location of such utilities and will not proceed with further excavation unless otherwise advised by the Contracting Officer.
AEDC-H005 UTILITIES AVAILABLE (MAY 2012)
(a) Water: All reasonable required amounts of potable and raw water will be made available without cost to the Contractor from existing systems, outlets, and supplies near the vicinity of the work. All water shall be carefully conserved. All temporary connections and piping installed by the Contractor shall be removed in a manner satisfactory to the Contracting Officer prior to final acceptance of the work.
(b) Electricity: All reasonably required amounts of 60 HZ electric power at 110V and 480V will be made available without cost to the Contractor from existing electrical systems near the vicinity of the of the work.
The Contractor shall install and maintain at no cost to the Government any necessary supply connections and facilities in a manner satisfactory to the Contracting Officer. All electrical service shall be removed in a manner satisfactory to the Contracting Officer.
AEDC-H006 DISPOSAL AREAS (MAY 2012)
An approved disposal area is located about 2 miles from the construction site. This area is approved for surplus earth, stone, broken concrete, and building materials waste. Building materials waste also includes containers, dunnage, and other related items.
AEDC-H007 CONTRACTOR IDENTIFICATION (MAY 2012)
(a) Contractor personnel and their subcontractors must identify themselves as Contractors or subcontractors during meetings, telephone conversations, in electronic messages, or correspondence related to this contract.
(b) Contractor-occupied facilities (on AFMC or other Government installations) such as offices, separate rooms, or cubicles must be clearly identified with Contractor supplied signs, name plates or other identification, showing that these are work areas for Contractor or subcontractor personnel.
AEDC-H008 PROGRESS SCHEDULE (MAY 2012)
(a) In accordance with FAR Clause 52.236-15, which is incorporated by reference in the Contract Clauses section of this solicitation, the Contractor shall submit three copies of a progress schedule (Air Force Form 3064) for review and approval by the Contracting Officer no later than five days after beginning work on the project site. The Contractor shall comply with the procedures for completing the form on the reverse of the Air Force Form 3064.
(b) When requesting payment for materials stored on site, the Contractor shall include stored materials as a separate work element on the progress schedule and submit paid invoices to support the request for payment.
AEDC-H009 PERIOD OF PERFORMANCE (MAY 2012)
Period of Performance shall be 315 calendar days after Notice to Proceed.
AEDC-H010 TECHNICAL SURVEILLANCE (MAY 2012)
The Government designates the Air Force Project Engineer and the AEDC Support Contractor to perform technical surveillance. They will recommend to the Contracting Officer acceptance or rejection of work under this contract. All references to the "Government representative " within the specification or other project documents shall mean the Air Force Project engineer or the AEDC Support contractor personnel performing technical surveillance on behalf of the Government. As used in the specification or other project documents, the term "construction monitor" shall be understood as referring to the AEDC Support Contractor personnel performing technical surveillance on behalf of the Government.
AEDC-H011 VISIT AUTHORIZATIONS (MAY 2012)
Arnold Engineering Development Center (AEDC) is a U.S. Government Air Force installation. In accordance with AEDC Installation Security Instructions (ISI-31-101), all visitors to Arnold AFB must adhere to the following guidelines: U.S. citizens and lawful permanent residents are authorized to visit the facility and require a picture ID as identification at the time of visit. Permanent residents are required to present their "Permanent Resident/Alien Registration Card" as their form of identification. Foreign nationals who work in the U.S. must submit their visit request on their firm's letterhead through their AEDC POC to the Foreign Disclosure Office, stating the purpose and length of the intended visit. Two weeks advance notice for processing is required for these visits.
AEDC-H012 PRECONSTRUCTION CONFERENCE (MAY 2012)
A preconstruction conference will be held within 14 calendar days after contract award date. The Contractor shall provide the following at the preconstruction meeting:
(1) A detailed total job schedule on AF Form 3064, Contract Progress Schedule.
(2) Submittal items as noted in the specification package.
AEDC-H013 UNCLASSIFIED SECURITY (MAY 2014)

SECURITY: The contractor shall be required to comply with all security directives and other security requirements identified in this contract. These requirements apply to all contractors on Arnold AFB in the performance of their contract.
(a) Pass and Identification Items: The contractor shall ensure the pass and identification items required for contract performance are obtained for employees and non-Government-owned vehicles. The contractor shall retrieve all identification media from employees who depart for any reason before the contract expires, e.g., terminated for cause, retirement, etc.
The contractor shall comply with all installation access requirements as directed in Arnold Air Force Base (AAFB) 31-101, Integrated Defense Plan. The AEDC/CC reserves the right to refuse entry and/or re-entry of any person to AEDC for just cause to protect personnel, facilities, and property under their control through the use of a barment order when such actions are deemed necessary.
(b) Freedom of Information Act (FOIA): The contractor shall comply with Freedom of Information Act (FOIA) requirements IAW DOD 5400.7-R, FOIA Program, Chapter 4.
(c) For Official Use Only (FOUO): The contractor shall safeguard FOUO information provided under this contract as specified in DODM 5200.01-V4, DoD Information Security Program: Controlled Unclassified Information (CUI). CUI is information that does not meet the standards for National Security Classification under Executive Order 13526, dtd Dec 2009, but is pertinent to the national interests of the United States or to the important interests of entities of the Federal Government, and under law or policy that requires protection from unauthorized disclosure, special handling safeguards, or prescribed limits on exchange or dissemination. If FOUO information is lost, misused, compromised, or accessed by unauthorized persons, it could adversely affect U.S. national interest, the conduct of DoD programs, or the privacy of DoD personnel. CUI comes in many forms: personal data under the Privacy Act, personnel records, privileged data (chaplain and judge advocate records), investigative data, scientific and technical information (STINFO), export controlled data (critical technologies), proprietary data, or FOUO data. Sensitive information meets the criteria for exemption from mandatory public disclosure under FOIA. For guidance with marking CUI, contact AEDC/TSD-IP at (931) 454-3290.
(1) If access to CUI / Export Control / STINFO information is required, the contractor shall be required to be registered as a certified Government contractor through the Joint Certification Office, Defense Logistics Information Service (DLIS). To request DLIS Certification, submit a DD Form 2345, Militarily Critical Technical Data Agreement, to the DLIS, Battle Creek, MI address indicated at the top of the DD Form 2345 along with a copy of the company's state business license, incorporation certificate, sales tax identification form, or other documentation, which verifies the legitimacy of the company. A copy of their DD2345, Militarily Critical Technical Data Agreement, must be provided when issued.
Except as allowed by DFARS 252.225-7048, Export-Controlled Items, foreign nationals shall not have access to export-controlled information without an export license. All export control laws as stipulated in both Export Administration Regulation and International Traffic in Arms Regulation must be followed without exception. For guidance in applying appropriate export control markings, contact AEDC/XP2 at
(931) 454-7329.
(2) The contractor must obtain Foreign Disclosure Office (FDO) approval through the Contracting Officer prior to allowing any non-U.S. or un-validated U.S. Lawful Permanent Resident persons access to CUI or export-controlled information. (Also, see DFARS Clause 252.225-7048, Export-Controlled Items).
(d) Reporting Requirements: Contractor personnel shall report to an appropriate authority any information or circumstances of which they are aware may pose a threat to the security of DOD personnel, contractor personnel, resources, and classified or unclassified defense information.
Contractor employees shall be briefed by their immediate supervisor upon initial on-base assignment.
(e) Physical Security: The contractor shall be responsible for safeguarding all Government property and controlled forms provided for contractor use. At the end of each work period, all Government facilities, equipment, and materials shall be secured.
(f) Computer Security (COMPUSEC) / Automated Information System (AIS) Requirements: If access to unclassified computer systems is required, the following requirements apply: Users must be a U.S. citizen or receive AEDC or Air Force Materiel Command (AFMC) Foreign Disclosure Office (FDO) approval prior to access being granted; requestor must have a favorable National Agency Check with Inquiries (NACI) clearance or an approved Interim AIS request on file; and requestor must complete the Air Force (AF) Information Assurance (IA) Training. To request access to an unclassified computer system, users must complete an AEDC Government Contractor (GC) Form 591, Request for Authorized Use of Central Computer Systems. Users bringing portable electronic devices (PEDs) on base and wanting to connect to AEDC computer systems / networks shall comply with AFPD 33-2, Information Assurance Program, and AFI 33-200, Information Assurance (IA) Management. Employees shall complete any additional computer security training requirements mandated by the host base.
(g) Information Security (INFOSEC): Information, regardless of media, shall be controlled and maintained in accordance with (IAW) with the National Industrial Security Program Operating Manual (NISPOM) and guidance provided by the Servicing Security Activity (SSA), AEDC/TSD-IP.
(h) Privacy Act: Comply with AFI 33-332, Privacy Act Program, when collecting and maintaining information protected by the Privacy Act of 1974, Title 5, U.S.C., Section 552a. Remove or destroy official records only IAW Air Force Records Information Management System, (AFRIMS) located on the internet at: <https://www.my.af.mil/gcss-af61a/afrims/afrims/rds/rds_series.cfm>.
(i) Operations Security (OPSEC): Comply with AFPD 10-7, Information Operations; AFI 10-701, Operations Security; DoD 5220.22-R, Industrial Security Regulation (ISR), Chapter 10; and local plans and publications.
(j) Antiterrorism (AT) Training: DoD contractors shall be provided AT information as required by DFARS Clause 252.225-7043, Antiterrorism / Force Protection for Defense Contractors Outside the United States. Level 1 AT Awareness Training shall be provided to all DoD contractor employees.
(k) Contractor Consent to Background Checks: The Contractor shall not employ persons to perform under this contract if such employee is deemed or identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation and its population; nor shall the Contractor or subcontractor employ persons under this contract who have an outstanding criminal warrant as identified by the Tennessee Information Enforcement System (TIES) through the National Crime Information Center. TIES checks will verify if a person is wanted by local, state, or federal agencies. All contractor and subcontractor personnel must consent to TIES background checks. Contractor and subcontractor personnel who do not consent to a TIES check will be denied access to the installation.
Information required to conduct a TIES check includes: full name, driver's license number, and/or social security number, date of birth of the person entering the installation, and completion of a background check questionnaire. The contractor must have this information ready to provide to the Visitor Control Center, if requested.
(1) Contractors must ensure their employees and those of their subcontracts have the proper credentials allowing them to work in the United States. Persons without proper credentials will be remanded to the appropriate authorities.
(2) The contractor shall not be entitled to any compensation for delays or expenses associated with complying with the provisions of this clause. Furthermore, nothing in this clause shall excuse the contractor from proceeding with the contract as required.
(l) Access to Installation During Force Protection Conditions (FPCONs): Gaining access to the installation during FPCONs will be done IAW the requirements outlined in the local Antiterrorism / Integrated Defense Plan(s). Contractors will be assigned a mission essential designation IAW requirements contained in Antiterrorism / Integrated Defense Plan(s). Only the installation commander or the unit commander requesting contract support will assign the mission essential designation.
(m) Property Protection: Property protection for the facility where the contractor's primary work center is located will be the responsibility of the local facility manager and local security manager, or their duly authorized representative IAW AFI 31-101, Integrated Defense, and command / local directives to include AAFB Plan 31-101. The contractor must safeguard all Government-owned equipment and materials in their possession or use.
AEDC-H014 SAFETY (MAY 2011)
1.0 The contractor is solely obligated for compliance with OSHA, CFR 1910 and 1926, AFSOH 91- 501, NFPA 101 and other applicable laws and regulations for the protection of contractor employees, subcontractor, Government employees and Government property. The government shall assume no liability or responsibility for the contractor's compliance or non-compliance with such requirements. The contractor shall furnish to each of his/her employees a place of employment, which is free from recognized hazards. The contractor shall brief his/her employees on the safety requirements of this contract and on hazards associated with prescribed tasks. The contractor is responsible for compliance with OSHA Public Law and the resultant standards identified within. In addition, the contractor is required to flow down the safety requirements/specifications to all subcontractors. The contractor shall comply with safety rules of the AEDC Support Contractor at interface points of new construction and modifications to existing systems and with all AEDC Base Safety Standards identified in the contract/SOW.
2.0 In addition, Contractor shall comply with the following:
2.1 Air Force Safety requires that contractors performing on Air Force installations provide their employees safety and health protection equal in quality to that provided to Air Force employees.
However, the contractor will be responsible for managing their health and safety program.
2.2 Contractors are required to flow down Safety requirements to all subcontractors who qualify as applicable contractors under their contract.
2.3 Contractors are required to submit a Safety and Health Plan and corresponding site safety checklist to the AEDC Safety Office, Contracting Officer and Project Manager within 10 days after contract award. The plan shall be made available to the installation safety office for acceptance prior to contract performance.
2.4 Contractors are required to submit their TCIR and DART rates and OSHA 300A form along with their safety and health plan. The TCIR and DART rates will be reviewed by AEDC Safety and may be used to determine contractor responsibility.
2.4 Contractor's performance will be accountable for compliance with their safety and health plan, to include mishap reporting.
2.5 Contractors shall ensure their employees and subcontractors report (No later than 24 hours) pertinent facts regarding all mishaps. Contractors will cooperate in any safety investigation, to include toxicology testing.
2.6 Contractors are required to identify the processes and procedures used to track compliance with the Safety and Health Plan.
3.0 The Contractor Safety and Health Plan must demonstrate a management commitment to employee safety and health. The plan shall include application and responsibility to subcontractors and shall include as a minimum the following elements:
3.1 Worksite hazard analysis with base-line hazard identification and required control measures.
3.2 Job site analysis which lists the hazards associated with performing the task and the applied control measures.
3.3 Corrective action plan for identified hazards and identifying individual responsible for corrective actions and tracking of hazards.
3.4 Inspection program for each worksite to include identifying the individual conducting the inspection and the frequency of inspection.
3.5 Employee hazard reporting procedures.
3.6 Procedures for accident investigation and reporting.
3.7 Emergency response plan including first aid/injury procedures.
3.8 Employee safety and health training requirements and documentation process.
3.9 Identify applicable safety rules and regulations.
3.10 Identify Safety roles and responsibilities of management, supervisors, employees and contractor safety coordinator.
DEFINITIONS
Applicable Contractor. A contractor whose employees worked at least 1,000 hours at the site in any calendar quarter within the last 12 months and is NOT directly supervised by the applicant (installation).
Days Away, Restricted, and or Transfer Case Incident Rate (DART). The number of recordable injuries and illness cases per 100 full-time employees resulting in days away from work, restricted work activity, and/or job transfer that a site has experienced in a given time frame.
Total Case Incidence Rate (TCIR) - Total number of recordable injuries and illness cases per 100 full-time employees that a site has experienced in a given time frame.

52.217-07 OPTION FOR INCREASED QUANTITY -- SEPARATELY PRICED LINE ITEM (MAR 1989)

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 90 days from the completion of the Fire Protection System Design. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
52.236-04 PHYSICAL DATA (APR 1984) (TAILORED)
Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by surveys (insert a description of investigational methods used, such as surveys, auger borings, core borings, test pits, probings, test tunnels].
(b) Weather conditions
(1) The location of the work is subject to the atmospheric temperature ranging from minus 10 degrees F to plus 105 degrees F. The average annual rainfall is about 54 inches and the average annual snowfall is about 4 inches.
(2) Time Extensions for Unusually Severe Weather
a. Based on data from the National Oceanic and Atmospheric Agency (NOAA), the following number of adverse weather days can be anticipated at Arnold AFB, TN in the month indicated.

b. From receipt of Notice to Proceed throughout the contract performance period, the Government Project Officer will record daily the actual number of adverse weather days which prevent work for at least 50 percent of the contractor's workday.
c. Only after the cumulative number of "adverse weather days" as defined in b., above, has reached the total calculated from the monthly figures listed in a., above, or the proportionate number for partial calendar months in the performance period, will the Contracting Officer consider a time extension in accordance with the clause entitled "Default (Fixed-Price Construction)." A time extension will be granted on a day-for-day basis in the Contracting Officer determines that additional adverse weather days prevent work for at least 50 percent of the contractor's workday and delay work critical to the timely completion of the contract.
d. The contractor's schedule must reflect the delays associated with the anticipated adverse weather days listed in a., above. The Contracting Officer will grant no time extensions for adverse weather days within the cumulative total of the monthly numbers listed. [insert a summary of weather records and warnings].
(c) Transportation facilities Transportation Facilities to AEDC Fenced Area
(1) Highways. U.S. Highway 41A is a paved road passing through Tullahoma, Tennessee.
U.S. Highway 41 and Interstate 24 are paved roads passing through Manchester, Tennessee. State Highway 55 is a paved road connecting U.S. Highway 41 and 41A at Manchester and Tullahoma, respectively.
Access to the AEDC area can be gained from State Highway 55 near Tullahoma via new paved highway intersecting U.S. Highway 41, 5.5 miles southwest of Manchester and 3.8 miles from the area entrance, and Interstate 24, 3.5 miles southeast of Manchester and 2.5 miles from the area entrance. Concrete pavements have been constructed within the AEDC area and may be used subject to the restrictions set forth herein. Access to the sites of work from the paved areas and other routes shall be provided and maintained by and at the expense of the Contractor. The route for equipment which is not permitted to operate on the concrete pavement shall be as approved by the Contracting Officer. No construction truck or trailer vehicles shall be operated upon pavements of the AEDC area except within the following load limitations. (d) Travel Within the AEDC Area
(1) Streets and Roadways. Streets have been constructed within the AEDC area and may only be used subject to the restrictions set forth herein.
a. A "Special Permit" is required for the movement of all construction equipment, unless hereinafter provided otherwise, which is to be moved over streets or over areas containing underground ducting, piping, or overhead utilities. Application for the Special Permit to move heavy equipment will be submitted to the Contracting Officer. Application for such movements will be made sufficiently in advance of the time needed to avoid delays in movement. Only wheel or tire vehicles which fall under the following maximum allowable load limitations may operate without permit upon AEDC streets:

These restrictions permit the operation of fully loaded DW-10's with No. 10 scrapers only on pavements with a maximum allowable load of 33,600 pounds. The axle load for large tire equipment shall be based upon the manufacturer's specified weights for fully loaded equipment.
b. If any equipment exceeds the above load limitations, or any track vehicles are used, the pavement must be protected with earth or fiber at the expense of the Contractor. Compliance with the above requirements does not preclude the Contractor's liability for any damage which results from his travel over AEDC streets.
(2) Other Routes. Routes for use of equipment which is not permitted on AEDC streets shall be shown on the drawings, or as approved by the Contracting Officer. Access to the sites of work from the paved areas, and other routes, shall be provided and maintained by and at the expense of the Contractor.
(3) Traffic Regulations. The Contractor shall be cognizant of an comply with all AEDC traffic regulations as published and enforced on the AEDC installation.

A. FEDERAL ACQUISITION REGULATION SOLICITATION PROVISIONS IN FULL TEXT
52.204-08 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (JAN 2014)
(a)
(1) The North American Industry Classification System (NAICS) code for this acquisition is 238220.
(2) The small business size standard is $14,000,000.00.
(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.
(b)
(1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph (d) of this provision applies.
(2) If the provision at 52.204-7 is not included in this solicitation, and the offeror is currently registered in the System for Award Management (SAM), and has completed the Representations and Certficiations section of SAM electronically, the offeror may choose to use paragraph (d) of this provision instead of completing the corresponding individual representations and certification in the solicitation. The offeror shall indicate which option applies by checking one of the following boxes:
[ ] (i) Paragraph (d) applies.
[ ] (ii) Paragraph (d) does not apply and the offeror has completed the individual representations and certifications in the solicitation.

(1) The following representations or certifications in SAM are applicable to this solicitation as indicated:

(i) 52.203-2, Certificate of Independent Price Determination. This provision applies to solicitations when a firm-fixed-price contract or fixed-price contract with economic price adjustment is contemplated, unless—
(A) The acquisition is to be made under the simplified acquisition procedures in Part 13;
(B) The solicitation is a request for technical proposals under two-step sealed bidding procedures; or
(C) The solicitation is for utility services for which rates are set by law or regulation.
(ii) 52.203-11, Certification and Disclosure Regarding Payments to Influence Certain Federal Transactions. This provision applies to solicitations expected to exceed $150,000.
(iii) 52.204-3, Taxpayer Identification. This provision applies to solicitations that do not include the provision at 52.204-7, System for Award Management.
(iv) 52.204-5, Women-Owned Business (Other Than Small Business). This provision applies to solicitations that-
(A) Are not set aside for small business concerns;
(B) Exceed the simplified acquisition threshold; and
(C) Are for contracts that will be performed in the United States or its outlying areas.
(v) 52.209-2, Prohibition on Contracting with Inverted Domestic Corporations-- Representation. This provision applies to solicitations using funds appropriated in fiscal years 2008, 2009, 2010, or 2012.
