10. DISPOSITION OF FIRST ARTICLES
X Approved First Articles will be forwarded to
EB2090
(insert quantity) First Articles will be expended in testing. Residual components of disapproved First Articles will be returned to the contractor will be retained by pending disposition instructions from the contractor.
First Articles will be installed on aircraft/equipment to determine proper fit/function. Approved article will remain on the aircraft/equipment and will not be forwarded to USAF Supply, but will be considered part of the contract quantity.

On purchase requests designated as direct shipments the following disposition will apply. (NOTE: Always applicable on Foreign Military Sales (FMS)).
a. Approved First Articles will be returned to the contractor for shipment with production item.
b. Disposition of disapproved First Articles will remain the same as marked above.

11. CONDITION(S) FOR WAIVER OF FIRST ARTICLE APPROVAL
a. X Offerors who have previously furnished production quantities of the same or similar article to the prime contractor for delivery to the Government, DoD, X Air Force.
b. Offerors currently in production of the same or similar article for a Government, DoD, Air Force contract and who have received First Article approval under the existing contract.
c. X Offerors who have previously furnished production quantities of the same or similar articles to the Government, DoD, X Air Force, provided articles thus furnished, have exhibited satisfactory performance in service in the opinion of the Air Force.
d. X Provided not more than 48 months have elapsed since completion of the contract.

NOTE TO BUYER: UNDER CONDITIONS A AND C ABOVE, THE COGNIZANT ENGINEERING ACTIVITY WILL DECIDE WHETHER OR NOT THE ITEM HAS EXHIBITED SATISFACTORY PERFORMANCE IN SERVICE AND PREPARE AND RETAIN SUPPORTING DOCUMENTATION TO FULLY JUSTIFY THIS DECISION. THE BUYER MUST SOLICIT DUAL PRICES (That is, both with and without requirement for first article approval) AND MUST FURNISH THE COGNIZANT ENGINEERING ACTIVITY WITH THE FOLLOWING INFORMATION ON THE PREVIOUSLY SUPPLIED ARTICLE:

Justification for First Article (FA) Requirement:
1. Critical to Safety/Use (of weapon system).
2. Product described by drawing, OEM and MIL-Specs, End item requires dimensional conformance, process and materials verification, and Acceptance - testing must be properly performed. The contractor's test plan shall describe the proposed means by which the contractor will accomplish and document conformance to the requirements involved in production (incl. dimensional, material and process conformance) and testing IAW the item TDP. The test plan shall employ text, tables, sketches, drawings and/or photographs as necessary/appropriate to illustrate the contractor plan to satisfy and document conformance to the item TDP and FA CDRL requirements.
3. FAT waived if procured from the OEM or produced for and approved by the OEM.
The FATP shall:
1) List/briefly describe the equipment proposed/planned for testing.
2) Describe the means by which calibrations traceable to the NIST will be assured.
3) Describe the means by which the contractor will accomplish/document the dimensional conformance, weighing and tests required IAW the item TDP.
4) Provide sample format(s) proposed for use in FATR documentation of conformance (dimensional, material and process compliance, functional test results) to the TDP.
5) Provide evidence of a plan to photo document compliance to all permanent item marking requirements (stenciling, silk-screening, ID plates, etc. as applicable).

The Test Report (FATR) shall report the inspection and test results IAW the approved FATP and the FATR CDRL. The contractor shall manufacture the detail parts, acquire the requisite hardware, assemble and test one complete First Article IAW the item TDP. The Government QAR, C-17 COG Engineer, contracting official, program manager and/or Boeing technical representative shall have the opportunity to observe/witness FA testing in the facility used for production article testing.

NOTE: All production articles require testing at the same in-house (or sub-contracted) facility as the First Article. Only the First Article requires a test report.
The contractor's test plan shall describe the proposed method of performing the First Article Inspection/Test, using text, tables, sketches, drawings and/or photographs as deemed necessary to illustrate and detail the contractor plan to satisfy the data package and Test Plan CDRL requirements. See CDRLs for specific guidance on Test Plan and Report. In general though, the test plan shall:
1) list the equipment proposed/planned for use in testing,
2) describe the means by which current instrument calibrations traceable to National Standards will be assured,
3) describe the means and manner in which the contractor will accomplish the dimensional, weighing and electrical inspections and tests required IAW the requirements of the
TDP,
4) provide sample documentation of the technical data (ex. dimensions, continuity and isolation test result) reporting format(s) proposed for the test/inspection report,
5) provide evidence of plan to photo document compliance to item permanent marking requirements.
The Test Report shall report the inspection and test results IAW the approved Test Plan and the Test Report CDRL.
The contractor shall manufacture the detail parts, acquire the hardware and purchased parts (see TDP PL's), and assemble and test one complete First Article.
