II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This Justification and Approval (J & A) authorizes use of other than full and open competition procedures to obtain Louden Rail for the 76 MXW Organization Shops. The resulting contract will be a Firm Fixed Priced Indefinite Delivery Indefinite Quantity action with a five year ordering period. The anticipated date of contract award is 30 Nov 2009.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

FUNCTION: Louden Rails provide hoisting capabilities for the repair and construction of the 76 MXW Organizations.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1(a) (2) (ii) with an application pursuant to FAR 6.302-1(c). The approval level for this J&A is the Competition Advocate.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

76 MXW is in the process of moving shops within the organization and throughout the buildings. One of the critical facility features is the lift capability of the shops. The procurement of Louden crane rails and bridge cranes, as described in Section III above, are the key components to adding lift capability for the shops.

Currently all 76MXW shops utilize brand name Louden items for their crane systems. It is critical to have uniform Louden rails throughout the production shops to facilitate the moving of these shops within the organization and other buildings. The estimated cost of changing the current crane system for 76 MXW is approximately $10M. This estimate could go up depending on how many shops will have to be relocated. A change in crane systems would also create repair and maintenance problems for the 76 MXW.

VI. DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

IAW FAR 5.203 (a) (2) and FAR 5.203(b) and (c), the requirement will be posted to FedBizOpps as a synopsis for 15 days and the solicitation will be posted for 30 days. This requirement is for brand name only Louden items. This is not a sole source request. The requirement will be competed among the approved small business dealers for Louden items.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer will ensure the items contemplated for acquisition are negotiated at a fair and reasonable cost to the Government. The contract will be awarded in accordance with FAR Part 12. Price analysis will be performed based on competitive prices provided by the approved dealers, comparison to recent historical prices paid by the Air Force for the same or similar items and Government should-cost information. The Defense Contract Management Agency (DCMA) will assist, as necessary, with inputs throughout the life of the contract.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

IAW FAR 10.001(a) (2), market research has revealed these items are commercial as defined in FAR 2.101. The results of market research indicate these are brand name items, peculiar to one manufacturer, and are available for sale by approved dealers only. Louden does not sale direct to customers. Market research revealed there are several small businesses approved to sell Louden items. Therefore, this requirement will be solicited as a small business set aside among approved small business dealers of Louden items.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

The items described in Section III above are brand name Louden items. It is critical to have uniform Louden rails throughout the production shops to facilitate the moving of these shops. The estimated cost of changing the current crane systems is approximately $10 million. This estimate could go up depending on how many shops will have to be relocated. A change in crane systems would not be cost effective. This is a brand name request only.

There are multiple approved dealers for Louden items and all requirements for these items will be procured through competition in the future.
