AMENDMENT P00002

ADDENDUM TO FAR 52.212-2, Evaluation -- Commercial Items

1. Basis for Contract Award The Government will use FAR 13, Simplified Acquisition Procedures to evaluate offerors submitted in response to the solicitation. These regulations are available electronically at https://www.acquisition.gov. The Government will select the quote with the lowest evaluated price, which is determined to be fair, reasonable, balanced, and realistic from among those meeting the acceptability standards for non-price factors. The Government will select the offeror based on an integrated assessment of the offerors technical quote and price information.

Contract(s) may be awarded to the offeror who is deemed responsible in accordance with the FAR Part 9.1, as supplemented, whose quote conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Addenda to FAR 52.212-1 of this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the lowest price technically acceptable quote. While the Government will strive for maximum objectivity, the evaluation process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process. Quotes will be evaluated based solely on the factors contained in this solicitation.

2. Number of Contracts to be Awarded The Government intends to award one (1) contract for Integrated Solid Waste Management.

3. Communications The Government intends to award a contract without communications with the offerors. The Government, however, reserves the right to have communications with the offerors if deemed in its best interest.

If, during the evaluation period, it is determined to be in the best interest of the Government to have communications with the offerors, these communications will be considered in making the award decision. If the offeror’s quote has been evaluated as acceptable at the time of communications, any changes as a result of these communications may introduce risk that the offeror’s quote be determined unacceptable and, thus, ineligible for award.

4. Solicitation Requirements, Terms and Conditions Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable and the quote therefore, ineligible for award.

EVALUATION FACTORS

1. Evaluation Factors

The following evaluation factors and subfactors will be used to evaluate each quote. The Government will evaluate quotes for acceptability, but will not rank the quotes by the non-price factors or subfactors.

2. Technical Factor

The Government’s technical evaluation team shall evaluate the technical quotes on an acceptable or unacceptable basis, assigning one of the ratings described below for each subfactor. Any subfactor evaluated as “Unacceptable” will render the entire quote unacceptable and, therefore, unawardable. Only those quotes determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. However, the offeror is reminded that the Government reserves the right to award this effort based on the initial quote, as received, without discussion.

The quotes shall be evaluated against the following:

Factor 1: Technical Approach: To be deemed technically acceptable, the Technical Approach must demonstrate a thorough understanding of the requirement to provide a full range of Integrated Solid Waste support services and shall demonstrate the offeror’s methodology of how they will accomplish the requirements in the Performance Work Statement (PWS).

Measure of Merit: This requirement is met when the offeror’s technical approach provides rationale that can satisfy the requirements set forth in the PWS, reflecting their understanding of the work involved and experience to meet the requirements set forth in the PWS.

Factor 2: Price Factor:

Offerors whose price is determined to be unreasonable and unbalanced may not be considered for award.

(a) The offeror’s Price quote will be evaluated for award purposes, based upon the total price quoted.

(b) Reasonableness: The existence of adequate price competition is expected to support a determination of reasonableness. Price analysis techniques may be used to further validate price reasonableness. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information may be required to support the proposed price.

(c) Balance: Offerors are cautioned against submitting an offer that contains unbalanced pricing.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line item numbers (CLINs) is significantly overstated or understated as indicated by the application of quote analysis techniques. The Government shall analyze offers to determine whether there are unbalances separately priced line items or sub-line items. Prices submitted will be compared and evaluated to assure that a logical progression exists as related to price and quantity changes within each offeror’s response to the pricing structure in the Price Schedule (Attachment 2). Offerors that are determined to be unbalanced may be rejected if the lack of balance poses an unacceptable risk to the Government.

(d) The Total Evaluated Price (TEP) shall be calculated by multiplying the unit price by the quantity to calculate the extended prices for all of the firm fixed price CLINs for the basic year and the Option CLINs, then totaling those amounts.
