Notice to Offeror(s)/Supplier(s): Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.
1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.
2. FA524018Q0082 for Pacific Power Supply ASX-360 is hereby issued as a request for quotes.
3. The following solicitation document, incorporated provisions, and clauses are in effect through Federal Acquisition Circular 2005-99.
4. This solicitation has been set aside for 100% Small Business under the 335312 NAICS Code, with a small business size standard of 1,250 EMP.

The government requests that all items be delivered within 8 weeks after receipt of Contract Award 36 MUNS UNIT 14024 Yigo, Guam 96929. If this delivery schedule cannot be met, the contractor must specify the proposed delivery schedule in the quote.
6. FAR 52.212-1 Instruction of Offerors (Jan 2017) -- Commercial applies to this acquisition.
7. FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014) applies to this acquisition. The evaluation factors are as follows;
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1) Price
2) Technical Capability (technical capability is equal to price)
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
8. FAR 52.212-3 Offeror Representations and Certifications -- Commercial Items (Jan 2017) applies to this acquisition. This means that the contractor must have a valid Representations and Certifications filed in the System for Award Management (SAM) or provide the government a completed copy of the record.
9. FAR 52.212-4 Contract Terms and Conditions -- Commercial (Jan 2017) applies to this acquisition.
10. FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items (DEVIATION 2013-O0019) (Jan 2017) applies to this acquisition.
11. 52.232-18 -- Availability of Funds.
Availability of Funds (Apr 1984)
Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer
