COMBINED SYNOPSIS/SOLICITATION FA5004-24-Q-0006

Wastewater Treatment Plant Sampling Analysis

AMENDMENT 0001

The purpose of this amendment is to correct the quote submission date on page 2 from “28 March” to “3 April” (changes highlighted).

(i) This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

(ii) The solicitation number for this procurement is FA5004-24-Q-0006. This solicitation is issued as a Request for Quote (RFQ) for Wastewater Treatment Sample Analysis at Eielson Air Force Base, Alaska.

(iii) This solicitation document and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular (FAC) 2024-02 Defense Federal Acquisition Regulation Supplement Change Notice (DPN) 20231222, and DAFAC Department of the Air Force Acquisition Circular 23-0707.

(iv) This requirement is being solicited as Full and Open. The North American Industry Classification System (NAICS) associated with this procurement is 541380 with a Small Business Size Standard of $19,000,000 ($19 Million US Dollars).

(v) The Pricing Schedule is incorporated via Attachment 8, Pricing Schedule below which shall be completed in its entirety and returned with any other documentation/data as required and specified by this Combined Synopsis/Solicitation.

(vi) The Government intends to award a Firm-Fixed Price (FFP) Contract for the following: Wastewater Treatment Plant Sample Analysis Services IAW Attachment 5, Performance Work Statement

(viii) The following provisions and clauses can be viewed through Internet access at the Federal Acquisition Regulation (FAR) Site, https://www.acquisition.gov/:

1. The provision at FAR 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services (Nov 2021), applies to this acquisition and is hereby incorporated by reference with the same force and effect as if it were given in full text. In addition to the following addendums, all terms and conditions of FAR 52.212- 1 remain in effect.

2. The following has been tailored to this procurement and is hereby added via addendum:

52.212-1

General Information

The Government intends to issue a Firm-Fixed Price contract to provide Wastewater Treatment Plant Sample Analysis Services for Eielson AFB, Alaska, as outlined in Attachment 5 WWTP-WTP Sample & Analysis Performance Work Statement.

This requirement is being conducted in accordance with FAR Part 13, Simplified Acquisition Procedures, using North American Industry Classification Systems Code (NAICS) 541380, with a Small Business Size Standard of

$19,000,000.00. All interested vendors holding this NAICS, capable of fulling the requirements of this solicitation are welcome to submit a quote.

The Government reserves the right to cancel this solicitation, either before or after the close date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse a vendor for any costs associated with generating a quote in response to the solicitation.

The Contracting Officer and Contract Specialist listed below are the sole points of contact for this acquisition:

All questions and/or clarifications must be submitted electronically via email to both points of contact above. All questions, and any subsequent responses by the Government will be posted to the System for Award Management website. It is the responsibility of interested vendors to monitor this website for information.

Quotes submitted in response to this solicitation must be submitted via email no later than Wednesday, 3 April 2024 @ 1200 hours Alaska Time (AKT). In order to be considered timely and responsive quotes must be sent via email to both points of contact specified above.

Questions must be submitted electronically to both points of contact above, and no later than Thursday, 21 March 2024 @ 1200 hours AKT.

All price quotations must be submitted on Attachment 8; Price Schedule. This is a Firm-Fixed Price (FFP) requirement. A FFP contract provides for a price that is not subject to any adjustment on the basis of the contractor's cost experience in performing the contract. Each line item must be priced in this fashion. Failure to provide pricing on any line item may result in the vendor being deemed non-responsive, and subsequently being removed from consideration for award.

Technical documentation submitted by the vendor must be provided via email in a stand-alone document, entitled “Technical Capability” and must not exceed 4 pages. Ensure you address meeting all the sample testing timelines.

Past performance documentation submitted by the vendor must be provided via email in a stand alone document, entitled “Past Performance” and must not exceed 2 pages.

These page limit encompass cover pages, contents, mission statements, and all other superfluous data not specifically requested by the Government. Failure to adhere to these standards may result in the vendor being deemed non-responsive, and subsequently being removed from consideration for award.

Late quotes will be processed in accordance with FAR 52.212(f) - Late submissions, modifications, revisions, and withdraws of offers.

By submitting a quote in response to this solicitation the vendor agrees to hold the prices provided in Attachment 8; Price Schedule firm for 60 calendar days from the date specified for receipt of quotes.

All quotes must submitted in U.S .dollars (USD).

52.212-2

General Information

Basis for Contract Award: The Government intends to award a contract resulting from this solicitation to the responsible vendor whose offer conforming to the solicitation will be most advantageous to the Government, considering the factors listed in this provision.

In accordance with FAR 13.106-2, the Government will utilize comparative evaluations, and give preliminary considerations to all offers received in response to the solicitation. The Government may identify from all evaluated quotes readily discernible value indicators that fall within the parameters of the evaluation factors outlined in this provision.

Therefore, the Government reserves the right to select an awardee that provides benefit to the Government that exceeds the minimum outlined standards, but is not obligated to do so. Additionally, the Government is not bound to select an awardee whose quote may exceed the minimum requirement, but whose additional value or benefit is not deemed substantial enough by the Government.

The Government is not limited to the quote that only meets the minimum described in the below factor(s) and provides the lowest price. However, if no quotes received in response to the solicitation exceed the minimum criteria outlined in this provision, as determined by the Government; then the Government intends to award a contract to the lowest priced quote that meets the instructions outlined in 52.212-1, and the minimum requirements outlined in this provision; whose price can be determined both fair & reasonable and realistic by the Contracting Officer.

The Government intends to make an award without conducting discussions with vendors after the close of the solicitation.

Therefore, vendors should provide their best available pricing and technical quotes to the Government in their initial quote.

However, the Government reserves the right to enter into discussions with all, some, or none of the offers at any time during the evaluation period if deemed in the best interests of the Government to do so.

Evaluation Factors: The following factors will be used by the Government to evaluate quotes;

Price, Past Performance, and Technical Capability: At minimum, the vendor must;

- Provide pricing in accordance with the instructions outlined in 52.212-1 and Attachment 8 Pricing Schedule.

- Provide Technical Capability Documentation in accordance with the instructions outlined in 52.212-1

- Provide a list of current contracts or customers whom utilize the same or similar services in terms of type and complexity.

The vendor that provides the lowest price that can be determined both fair & reasonable and realistic by the Contracting Officer may be given additional consideration for awardee selection. However, the Government is under no obligation to do so.

The Government intends to only evaluate prices submitted on Attachment 3; Price Schedule. During the evaluation process the Contracting Officer will determine a “Total Evaluated Price” (TEP) for each responsive quote. The TEP is determined by totaling the amount of all line items identified in Attachment 3; Price Schedule.

For the purposes of this evaluation, a price that is deemed too high while conducting the evaluation of the quote in accordance with FAR 13.106-3 would not be considered fair & reasonable.

For the purposes of this evaluation, a price that reflects a lack of understanding of the contract requirement or displays an undue risk inherent to the vendors approach would not be considered realistic.

Technical Capability: At minimum, the vendor must;

(ix) Provide information relating to the contractor’s capability to satisfactorily meet the performance requirements of the Performance Work Statement (PWS). Include any current or previous work performed for the same services being requested.

Before the quotes specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are discussions conducted after its receipt, unless a written notice of withdraw is received before award is made.

3. The Government intends to evaluate quotes and award without discussion but reserves the right to conduct discussions. Therefore, the offeror’s initial quote should contain the offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if determined necessary by the Contracting Officer. Any proposals that fail to furnish the required representations or information, or that reject the terms and conditions of the solicitation may be excluded from consideration.

252.222-7000 Restrictions on Employment of Personnel (Mar 2000) As prescribed in 222.7004, use the following clause:

RESTRICTIONS ON EMPLOYMENT OF PERSONNEL (MAR 2000)

(a) The Contractor shall employ, for the purpose of performing that portion of the contract work in Alaska, individuals who are residents thereof and who, in the case of any craft or trade, possess or would be able to acquire promptly the necessary skills to perform the contract.

(b) The Contractor shall insert the substance of this clause, including this paragraph (b), in each subcontract awarded under this contract.

(4) Payment request. The Contractor shall ensure a payment request includes documentation appropriate to the type of payment request in accordance with the payment clause, contract financing clause, or Federal Acquisition Regulation 52.216-7, Allowable Cost and Payment, as applicable.

(5) Receiving report. The Contractor shall ensure a receiving report meets the requirements of DFARS Appendix F.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

5352.201-9101 PACAF Ombudsman (Jul 2023)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to-

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to-

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(d) Representation. The Offeror represents that-

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services-

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

Information Regarding Responsibility Matters (Oct 2018)

(a) Definitions. As used in this provision-

Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

Federal contracts and grants with total value greater than $10,000,000 means-

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).

Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
