COMBINED SYNOPSIS/SOLICITATION ‘COMBO’:

Stryker L10 Laparoscopic Light

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

(ii) Solicitation FA5000-18-Q-0049 is issued as a Request for Quote (RFQ).

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-96, effective 06 November 2017. The DFARS provisions and clauses are those in effect to DPN 20171228, effective 28 December 2017. The AFFARS provisions and clauses are those in effect to AFAC 2017-1003, effective 03 October 2017.

(iv) This requirement is solicited under “100% Small Business Brand Name Service Disabled Veteran Owned Business” competition. The North American Industrial Classification System (NAICS) code associated with this procurement is 339112 with a small business size standard of 1,000 employees.

(v) The Pricing Schedule is incorporated as Attachment 1. Vendors shall complete Attachment 1 in its entirety and return with any other documentation/data as required by this Combo.

(vi) The Government intends to award a firm-fixed price contract for the following:

(vii) Delivery shall be FOB Destination NLT 60 days ARO. Contractor shall include delivery schedule information on the Pricing Schedule, Attachment 1. All items shall be delivered to:

Joint Base Elmendorf-Richardson, Anchorage Alaska, 99506 (Specific address to be included in the Purchase Order)

(viii) FAR 52.212-1 Instructions to Offerors -- Commercial Items (Jan 2017) is hereby incorporated by reference, with the same force and effect as if it were given in full text. In addition to the following addendum, all terms and conditions of FAR 52.212-1 remain in effect. The following have been tailored to this procurement and are hereby added via addendum:

1. To assure timely and equitable evaluation of the quotes, the Offerors must follow the instructions contained herein. The quote must be complete, self-sufficient, and respond directly to the requirements of this solicitation.

2. Specific Instructions: The response shall consist of the following:

a. Submit one (1) copy of technical acceptability narrative

b. Submit one (1) copy of price schedule (Attachment 1) and any pertinent additional information

(ix) FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014) this provision has been tailored to this procurement and is provided in full-text below:

(a) The Government will award a purchase order resulting from this solicitation to whose quote, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

(1) Technical acceptability

(2) Price

(b) Technical acceptability: The government will evaluate quotes on the basis of whether or not the provided quote is technically acceptable. Technical acceptability shall consist of the following or better:

Salient Characteristics:

(See Attachment 2) Price: The government will rank all quotes by price. If the lowest priced quote is found acceptable, an award will be made without further consideration. If that quote is found unacceptable, the Government will evaluate the next lowest quote for acceptability until an award can be made to the lowest priced acceptable quote.

(c) A written notice of award or acceptance of a quote mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, may result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(x) Each vendor shall ensure the provision at FAR 52.212-3 including its Alternate I, Vendors Representations and Certifications--Commercial Items (Nov 2017) are updated at www.sam.gov. Failure to obtain SAM registration will result in submissions not being considered for award.

(xi) The clause at FAR 52.212-4, Contract Terms and Conditions – Commercial Items (Jan 2017), is hereby incorporated by reference, with the same force and effect as if it were given in full text.

(xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders – Commercial Items (Nov 2017), is hereby incorporated by reference, with the same force and effect as if it were given in full text. AFFARS 5352.201-9101-Ombudsman (Jun 2016)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman:

Concerns, issues, disagreements, and recommendations that cannot be resolved at the Center/MAJCOM/DRU/HQ AFICA/AFISRA/SMC ombudsman level, may be brought by the interested party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2395, facsimile number (571) 256-2431. (d) The ombudsman has no authority to render a decision that binds the agency.

Attachment 2: Salient Characteristics

The 673 MDG is requesting six (6) Stryker brand L10 LED Light Source with AIM attatchments for laparoscopic tools. The units will be used for invasive procedures, It functions as an attatchment to surgical devices. The associated medical equipment is only compatable with Stryker brand accessories.

The systems shall be/have/include:

· LED light source

· Maintains constant light output during use

· Must be compatable with Stryker brand 1488 AIM camera head

· Integrated Infrared lighted fibers and integrated ICG fluorescence capabilities

· Adjustable light intensity in both white light mode and in ENV mode

· Patient light and heat protection

· LED touch screen user interface

· provide real-time endoscopic visibility and near-infrared fluorescence imaging

· Enable surgeon to perform minimally invasive surgery using standard endoscopic visible light.

· Enables user to visualize white light, infrared light, and ICG fluorescence

Attachment 2: Salient Characteristics

Information Assurance (IA):

Any offered system must meet DoD Cybersecurity and the included Information Assurance (IA) Requirements described below.

· Vendor shall only quote items which already have an Authorization to Operate (ATO) or items for which the Vendor agrees to through the IA approval process and obtain an ATO.

· If the vendor does have an ATO/ATC, the vendor needs to provide a copy of the ATO/ATC approval and signed Air Force (AF) IA contract language.

· If the vendor does not have an ATO/ATC, the vendor shall provide a completed questionnaire and sign the AF IA contract language.

· Submitting a quote for any requirement under this initiative constitutes full agreement to all specific Service IA requirements and attached IA document.

· All supplied software, operating systems, databases, etc. (excluding vendor developed application software) must be on the National Information Assurance Partnership approved products list found at https:/niap-ccevs.org/ or https:/www.commoncriteriaportal.org. Vendor must provide proof that supplied software is on this approved list. Required proof is a print screen from one of the web sites above, and a letter of intent from manufacturer to work the IA certification process.

· Failure to agree to Cybersecurity or attached IA requirement shall result in rejection of the vendors quote. Failing to disclose that a system cannot meet IA requirements, failure to meet certification timeframes or failure to receive ATO may result in termination for cause in accordance with FAR 52.212-4(m).
