NOTE: If a Justification and Approval was approved for the preceding acquisition, a copy of the approved J&A for the predecessor action must be included in the staff package for approval of the instant J&A. This applies to J&A staff packages that are submitted for review and approval at a level above the contracting officer. II. Nature and/or description of the action being processed.

There will be a single firm-fixed-price award

III. Description of supplies/services required to meet agency needs.

20 Brand Name Deutz Diesel Engine Assembly Kits. Each Deutz Diesel Engine Assembly Kit must include the following items:

1 Deutz Diesel Tier 4 engine with EGR valve, rated for 63.7 HP @2600 RPM; P/N: D2011L04i, 24 Volt; EPA NSE Exemption label; OEM Black Paint Finish; 1 Power Take-off (PTO) Package, HSG Size: 4; Clutch Size: 8S (NACD), P/N: 431026AM; 1 Starter, 24 Volt, P/N: 4300286; 1 Alternator, 24 Volt, P/N: 103903; 1 Shutdown Solenoid, 24 Volt, P/N: 4103822; 2 Glow Plugs, 24 Volt, P/N:

1179017; 1 LOFA 24 Volt Control Panel with ground pre-heat indication, internal illumination wire harness and no factory wiring harness P/N: EP250KL7

IV. Statutory authority permitting Other than Full and Open Competition.

6.302-1(c) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

AFCEC/COMR has a requirement to purchase brand name Deutz diesel engine assembly kits. The Deutz diesel retracting engine is identified in the Operation and Maintenance Instructions Technical Order 35E8-2-10-1, the illustrated parts breakdown Technical Order 35E8-2-10-4. Deutz diesel engine assembly kit is an integral part of a BAK-12 energy absorber and the MAAS. The diesel powered rewind (retracting) engine installed on BAK-12 energy absorbers and MAAS is required to meet multi-fuel requirements for worldwide deployments and contingency operations. Failure to continue with standardization of these systems will have significant long term impacts to strategic goals for reductions of operational parts, spare provisioning costs and increased integration costs for non-standardized diesel engine assembly kits.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

There will be a combined synopsis/solicitation posted to FedBizOpps in an attempt to solicit as many offers from small businesses.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Competition is expected for this contract. The price will be determined to be fair and reasonable through competition.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

All mandatory sources checked resulted in not being able to fulfill the requirement. Online searches provided vendors able to provide the supplies. There are previous contracts that have 3-5 quotes from small businesses with competitive prices.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The Deutz diesel engine is the only engine that has been approved by the Environmental Protection Agency (EPA) and has received a National Security Exemption under 40 CFR 1068.225(b).

The AAS Engineer, Robins AFB has published a letter identifying the Deutz diesel engine Model # D2011L04i as the only approved engine that can be used on the BAK-12 and MAAS.

X. List of sources, if any, that expressed interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The contracting agency and user will continue to survey the market place to locate any new prospective contractors that are responsible sources and will be able to compete on future acquisitions.
