The following items are applicable to this modification:

CONTINUATION OF BLOCK 14

FA4801-13-R-0005 WWTP Additional Questions and Answers

Project Solutions, Inc.

Q. 1. If there is a dispute between the Federal Environmental Protection Agency (EPA) and the New Mexico Environmental Department (NMED), will that affect the new contractor and operations at the plant?

A. If a dispute arises between the EPA and NMED this would be a contractual issue that can be resolved on a case-by-case basis. Historically, there has been no disputes between EPA and NMED. As indicated in the Performance Work Statement, paragraph 4.11.2, "In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws/regulations come into effect. If there is an increase or decrease in cost as a result of the change, the contractor shall inform the CO pursuant to requirements of FAR 52.212-4(c) and negotiate a modification to the contract." The contractor shall abide by the current NPDES permit until a new one is issued.

Q. 2. Chlorine and sulfur dioxide amounts seemed very low for the size of this operation and for year-long chlorination.

A. The plant uses approximately 10 pounds per day (300 pounds per year) of chlorine and sulfur dioxide historically as reported to the NMED and EPA.

National O&M, Inc.

Q. 1. The reported annual chemical usage for chlorine gas and sulfur dioxide is low by a factor of 10 times. Please confirm annual usage.

A. The plant uses approximately 10 pounds per day (300 pounds per year) of chlorine and sulfur dioxide historically as reported to the NMED and EPA.
