COMBINED SYNOPSIS/SOLICITATION
Cell Phone Signal Booster
FA462020QA315
This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
The Request for Quotation (RFQ) number FA462020QA315 for Cell Phone Signal Booster shall be used to reference any written quote provided under this RFQ.
The following solicitation document, incorporated provisions, and clauses are in effect through Federal Acquisition Circular FAC 2020-05; Effective 30 March 2020.
This acquisition is set-aside 100% for small business and will utilize the North American Industry Classification System (NAICS) code 334210 with a size standard of 1,250 employees and a FSC of 5805. All prospective offerors must be registered in the System for Award Management (SAM) at www.sam.gov. Lack of SAM registration will make an offeror ineligible for award. The Unit Small Business Specialist is Mr. Michael Gilbert, at 509-247-4880; link to USAF Small Business, http://www.airforcesmallbiz.af.mil; link to SBA, http://sba.gov.
The purpose of this combined synopsis and solicitation is for the purchase, delivery, and installation of cell phone signal boosters in accordance with the attached Statement of Work (SOW). The contract CLIN structure is detailed below:

All work must be done in accordance with the attached SOW, federal, state, local laws and regulations, and commercial standards.

Firm Fixed Priced quotes: The resultant contract will be Firm Fixed Priced, accordingly, pricing is not subject to revision and/or negotiation if selected for contract award. Quotes shall include pricing for all items in the CLIN structure and unit prices shall not be more than two (2) decimal places.
Subparagraph (8); All vendors must be registered and active in the System for Award Management (SAM) at https://www.sam.gov/portal/public/SAM/ at time of quote submittal to be considered for award. Subparagraph (9); Amendments - Vendor will acknowledge, sign and submit with their quote all solicitation amendments
Paragraph (c); first sentence revised as follows: The vendor agrees to hold the prices in its quote firm for 90 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the quote.
A. To assure timely and equitable evaluation of the quotes, vendors must follow the instructions provided in FAR 52.212-1 and are required to meet all solicitation requirements, failure to meet a requirement may result in a quote being ineligible for award. The government’s terms, conditions, and respective clauses contained within this solicitation are prescribed IAW the FAR, and are not subject to conditionally proposed revisions or changes requested by offerors. Please note that all fill in clauses must be filled in by the contractor and returned with the quote.

Paragraph (g); Interchanges: The government intends to award a contract without Interchanges with respective vendors. The government however, reserves the right to conduct Interchanges, with all, some, or none of the vendors, if deemed in its best interest.
Pre-proposal Conference/Site Visit at Fairchild AFB
(a) A pre-proposal conference will be conducted at Fairchild AFB on 18 May 2020 at 1:00 PM PT. The site visit will begin at the contracting squadron, located at 110 W Ent St, Ste 200, Fairchild AFB, WA.
The site visit will conclude at the work site.
(b) Provide the name of attendee (not to exceed 1 per firm) along with contact information to SSgt Jeremy Graham, jeremy.graham.3@us.af.mil, (509) 247-2163 NLT 13 May 2020. Do not send social security numbers via email. This information must be provided in advance in order to ensure access to the military base/conference site and adequate seating for the conference attendees. Due to security limitations for base access only U.S. citizens are allowed at the site visit.
(c) Offerors are requested to submit questions to the points of contact noted above not later than 20 May 2020 at 1:00 PM PT. Information provided at this conference shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing.
(d) A record of the conference will be made by the government and furnished to all prospective offerors.
The record will include meeting minutes, questions and answers.
(e) NOTICE: All personnel at the site visit will adhere to COVID-19 Health Protection Measures.
All attendees will adhere to physical distancing (minimum of 6 feet), wash hands regularly, and closely monitor COVID-19 symptoms (cough, shortness of breath, or fever of at least 100.4). The government will take the following precautions during the site visit to ensure health protection measures are followed:
1. Guidance for proper health techniques will be provided to all parties upon arrival.
2. Personnel will ensure six feet of physical distance is maintained to the maximum extent possible.
3. Personnel will travel to the work site in separate vehicles.
4. Personnel will be required to wear proper PPE including face masks that cover the nose and mouth area. Contractors are required to provide their own face mask. This may be a cloth face covering and is required when six feet of physical distance cannot be maintained.
5. Personnel will be required to limit their activities to the site visit location, privately owned vehicles, and restrooms.

FAR Provision 52.212-2, Evaluation-Commercial Items (OCT 2014)
(a) Pursuant to FAR 12.602 contract award will be made using Simplified Acquisition Procedures IAW FAR 13.106. The government will award a contract resulting from this RFQ to the responsible vendor whose quote, conforming to the RFQ, will be most advantageous to the government, price and other factors considered. The following factors shall be used to evaluate quotes:
i. Price
ii. Past Performance
IAW FAR 12.602(a): When using the simplified acquisition procedures in Part 13, contracting officers are not required to describe the relative importance of evaluation factors.
(b) Options. The government will not be using options for this acquisition.
(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the government may accept a quote (or part of a quote), whether or not there are interchanges after its receipt, unless a written notice of withdrawal from the offeror is received before award.
FAR Provision 52.212-2, Evaluation-Commercial Items (OCT 2014), applies to this acquisition. As prescribed in FAR 12.301(c), the following addendum is provided for this solicitation:
Addendum 52.212-2-Evaluation Commercial Items
Basis for contract award: The government seeks to award to the vendor whose quote, conforming to the solicitation and for which all non-price factors have been determined to be satisfactory and to represent the best value to the government.
Price Evaluation. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; vendor may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
Past Performance: The Supplier Performance Risk System (SPRS) application (https://www.ppirssrng.csd.disa.mil/) will be used in the evaluation of suppliers’ past performance in accordance with DFARS 213.106-2(b)(i). The quality and delivery classifications identified for a supplier in SPRS will be used by the contracting officer to evaluate a supplier’s past performance. The contracting officer will use the offerors CAGE code to consider overall delivery performance. In the case of a supplier without a record of relevant past performance history in SPRS for the FSC/PSC of the supplies being purchased, and CAGE code, the supplier may not be evaluated favorably or unfavorably for its past performance history.
Vendors should propose the best pricing to the government for each item in arriving at the most competitive price. Price information submitted in each vendor’s price quote, as required by the Addendum to FAR 52.212-1, Instructions to Offerors-Commercial Items, will be evaluated to determine if proposed prices are fair and reasonable IAW FAR 13.106-3. Unbalanced pricing may pose an unacceptable risk to the government and may be a reason to reject a vendor’s quote.

FAR clause at 52.212-4, Contract Terms and Conditions-Commercial Items (OCT 2018), applies to this acquisition with the following Addendum: Paragraph (c) of this clause is tailored as follows: Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the government.
Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.

52.204-20 Predecessor of Offeror.
As prescribed in 4.1804 (d), insert the following provision:
PREDECESSOR OF OFFEROR (JUL 2016)
(a) Definitions. As used in this provision–
“Commercial and Government Entity (CAGE) code” means–
(1)An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity; or
(2)An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

52.204-24 Representation Regarding Certain Telecommunications
Surveillance Services or Equipment.
(AUG 2019)
(a) Definitions. As used in this provision- Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing-
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.209-2 Prohibition on Contracting with Inverted Domestic Corporations-Representation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018)
(a) Definitions. As used in this clause- Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.
Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.
Payment request and receiving report are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall-
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the Web Based Training link on the WAWF home page at https://wawf.eb.mil/
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:
(1) Document type. The Contractor shall submit payment requests using the following document type(s):
(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.

5352.201-9101 Ombudsman. (OCT 2019)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution.
