COMBINED SYNOPSIS/SOLICITATION

Avid Technology

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

Solicitation FA4620-18-Q-A056 for is hereby issued as a Request for Quotation (RFQ).

The following solicitation document, incorporated provisions, and clauses are in effect through Federal Acquisition Circular 2005-99, Defense Federal Acquisition Supplement Change Notice (DPN) 20180629, and Air Force Acquisition Circular (AFAC) 2018-0525.

The proposed acquisition will result in a firm fixed price contract. This is a sole source requirement with the following proposed contractor:

AVID TECHNOLOGY, INC

The Period of Performance for this requirement is 12-months (base period) plus four (4) year option periods.

Quotes shall be submitted via e-mail to the Contracting Officer and Contract Specialist identified herein SSgt Dane A. Anderson, dane.anderson.4@us.af.mil and SrA Zachary Slamon, zachary.slamon@us.af.mil. The quotes shall be submitted not later than 17 August 2018, at 2:00 PM PDT. Offerors are responsible for verifying receipt of their quotations to this office before offer due date and time.

Clauses and provisions throughout this combined synopsis/solicitation can be viewed by accessing website http://farsite.hill.af.mil/vffara.htm and https://www.acquisition.gov/. FAR provision 52.212-1, Instructions to Offerors Commercial Items, applies to this acquisition to include the following addenda: All Offerors are cautioned that if selected for award, they must be registered with the System for Award Management (SAM).

The SAM can be accessed via the internet at www.sam.gov/. Confirmation of SAM registration will be validated prior to awarding a contract.

Shipping FOB destination shall be included in the offered price. Include any discount terms, if applicable.

Upon award and satisfactory performance, payment will be made through Wide Area Workflow (WAWF).

Availability of Funds - Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered in accordance with DFARS 213.106-2. The following factors shall be used to evaluate offers:

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(c) The Government reserves the right to award to the supplier whose quotation or offer represents the best value to the Government considering price and past performance.

(d) Price and past performance will have approximately equal weight as consideration factors.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. (a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall--

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

The contractor shall provide software updates, hardware and software support, hardware warranty replacement (DNxIO, Interplay, NEXIX, Pro Tools HD), and troubleshooting for Avid Media Composer, Interplay, NEXIS, Avid Pro Tools, and Avid Media Central systems at the Joint Personnel Recovery Agency (JPRA) 11604 W. manufacturer’s recommended standards; commercial requirements; copyright laws and this Performance Work Statement (PWS).

1.2. Scope of Work. The scope of coverage ensures the Avid Interplay, Pro Tools, and Media Central systems stay up-to-date and operational.

1.2.1. Support. The contractor shall provide fully-trained Avid technicians for support on Avid hardware and software. This support includes: Diagnose problems; repair and replace failed hardware; software updates; Code Blue escalation at Avid’s discretion. (Note: Avid uses a “Code Blue” escalation process for high severity level issues that immediately engages the highest levels of technical resources, and communicates status to senior executives at both the customer and Avid.)

1.2.1.1. Avid Artist DNxIQ requires Extended Hardware coverage. The contractor shall provide 7 days x 24 hours technical support via telephone for Critical Issues with High Priority queuing. “High Priority” means the call will be answered before all calls preceding it are answered, except for calls of the same or higher priority. The contractor shall use reasonable commercial efforts to address these calls within 4 hours. JPRA will be entitled to have replacement parts shipped in advance of Avid receiving back the faulty part. JPRA will not be able to send hardware parts or logs to the contractor, due to the nature of the government work. In addition, JPRA will not allow remote access to any of the Avid systems. If needed, JPRA may be able to send proof of hardware destruction by sending a top plate, rear panel, etc. Avid will use reasonable commercial efforts to ensure Next Business Day dispatch from their depots.
