Section B: Description of the Supplies/Services Required

The Joint Personnel Recovery Agency (JPRA) is requesting the use of a single source requirement for the purchase of Avid Support Coverage and Maintenance for their Avid software and hardware. A support contract for the Avid components must be purchased in order to continue JPRA's support to the global mission and daily training operations which utilize JPRA's media production architecture. The acquisition will be solicited from a single source under the authority of FAR 13.106-l(b)(l). The proposed acquisition will result in a Firm Fixed Price (FFP) requirements contract with four option years.

Section C: Justification for Soliciting from a Single Source or Brand Name

The Joint Personnel Recovery Agency (JPRA) is designated as Department of Defense's (DoD) office of primary responsibility for DoD-wide personnel recovery (PR) matters. JPRA is headquartered in Fort Belvoir, Virginia with schools located in Fredericksburg, VA, Pope AFB and Fairchild AAFB, WA. JPRA's mission is to develop and conduct education and training courses for commanders, forces, and individuals on Joint PR activities. The agency assesses, advises, and evaluates PR curriculum and establishes Joint PR standards in collaboration with the DoD Components for formal Joint PR training, including Code of Conduct and Survival, Evasion, Resistance and Escape (SERE).

JPRA's Media department uses Avid hardware and software across the enterprise for their post-production audio and video editing hardware, shared storage, software, project collaboration, content distribution, and post-production asset management.

Avid Technology's software and hardware are protected under intellectual property laws that include patents, copyrights, trademarks and contractual provisions. Avid equipment is licensed to end users, with all products containing features to guard against unauthorized use.

To best serve the particular needs of Avid's Government customers, Avid's commercial resellers are contractually prohibited from selling Avid products and services to the Federal Government. Avid Technology sells its products and services directly to the Federal Government through its Government Solutions group located in Washington, DC.

Avid maintenance, support, and coverage can only be provided by Avid certified and authorized technicians. No other vendor can provide the maintenance and support plans as required, without interfering or violating the intellectual property of Avid products. Therefore, the hardware and software maintenance coverage services is a single source requirement to Avid Technology, Inc.

Section D: Efforts to Obtain Competition

Market research was conducted to determine if other sources can provide the maintenance support requirement. It was determined that no additional Avid certified technicians provide the maintenance or support with the capability to satisfy the Government's requirement other than Avid Technology, Inc. Other retailers that provide similar capabilities are contractually prohibited from selling Avid products and services to the Government.

Additionally, a sources sought was posted to FBO on 02 August 2018 for seven days. One response was received however, it was deemed incapable of providing a quote as resellers are contractually prohibited from selling Avid products and services to the Federal Government. Thus, further confirming the need for a sole source acquisition.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

At this time there are no plans locally or at the command level to re-engineer or replace the entire media production infrastructure. Future planning at command level may allow for other equipment to be considered as part of an Air Force wide re-engineering effort. Until such time a complete re-design of the system occurs, JPRA will continue to require the Avid Technology for media production equipment, support, maintenance, and coverage to ensure 100% integration and compatibility with JPRA's media production operations. The Government will continue to conduct market research to ascertain if there are changes in Avid Technology's standards that would enable future actions to be fully competed.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
