STATEMENT OF WORK (SOW)

BOILER MAINTENANCE

1.0 DESCRIPTION OF SERVICES: The Contractor shall provide all management, tools, supplies, equipment, and labor necessary to perform all work in accordance with these specifications. Work will consist of maintaining 86 existing boilers/water heaters located in 67 facilities across base as listed in the table below. The Contractor will also take over the maintenance of any new boilers/water heaters added to the base over the length of the contract, not to exceed a total of 100 boilers/water heaters. The Contractor shall also be responsible for maintaining and operating the Propane Air Mixing Plant (PAMP) throughout the contract term.

2.0 WORK INCLUDED:

2.1 Inspection and Acceptance Monitoring: All work will be subject to inspection by Government personnel as provided in FAR Clause(s) Inspection of Services/Construction.

2.2 Work Schedule: A proposed work schedule shall be approved by the contracting officer before work can begin. Work will be scheduled so that heating or air conditioning systems are available during normal heating and cooling seasons.

2.3 Daily Cleanup: Contractor personnel shall at all time keep the premises, free from accumulations of waste materials, rubbish, or construction debris. At the completion of each workday, all cartons, waste materials, rubbish, debris, wrapping, etc., shall be removed from the work area.

2.4 Warranties and Operating Manuals: When applicable, the contractor will maintain and administer warranties relating to equipment, parts, or systems that they maintain. Additionally, one original copy of the manufacturer's owners/operations manuals, and one original copy of the manufacturer’s maintenance manual that includes illustrated parts breakdown, and a parts number listing for all system components shall be provided for such equipment or system before final acceptance by the Government. This is applicable to future boilers/water heaters that may be installed and included in this contract.

2.5 Contractor Provided Maintenance: The Contractor shall provide manufacturer recommended scheduled monthly and annual maintenance for boilers/water heaters noted in this contract, and future boilers that may be added as part of this contract. For equipment that is maintained by the Contractor, there shall be a notice on or near each piece of equipment that directs Government and/or other contractor personnel not to perform repair work on the equipment, but to contact the Contracting Officer Representative (COR). It shall provide the name and phone number of the person to contact for repairs. The information on these maintenance tags shall be current at all times.

2.6 Interruption of Utility Services: Neither the Contractor, nor any subcontractor shall shut off any utility service to any facility without prior coordination and approval of the COR. Request for an interruption of utility service shall be made not less than five days in advance of planned interruption. The Contractor will coordinate all scheduled utility outages with the COR in advance of scheduled outage. For those utility outages accomplished to accommodate the Contractor, it shall be the responsibility of the Contractor to ensure full service is returned to all affected facilities. The Government will provide utility services for contractor personnel. The Government may not be held responsible for interruptions of utility services and will not be liable for contractor delays, damages, or increased costs caused by any such interruption of services.

2.7 Operations/Maintenance work is subject to the Service Contract Act, and these responsibilities begin immediately upon schedule approval by the CO or upon installation of new boilers.

2.8 Emergency and Urgent Repairs: For repairs deemed "emergency" by the Government, meaning endangerment to life or property, the Contractor shall have repair personnel on-site within 1 hour. For repairs deemed "urgent" by the Government, meaning disruption of the Government workforce, the Contractor shall have repair personnel on-site within 4 hours. Repair work for both "emergency" and "urgent" repairs shall continue until completed or the COR determines the repairs cannot be completed and the priority is reduced to routine. The Government reserves the right to take the actions necessary to protect life or property, or prevent disruption of the Government workforce in the absence of contractor personnel. Government actions will normally not extend to alleviating or correcting the problem; however, the Government reserves the right to make the necessary repairs to correct urgent or emergency situations. The costs for such repairs shall be passed on to the Contractor. Disagreements over such costs shall be resolved under the Disputes Clause identified in paragraph GC.23 of the Model Agreement.

2.9 For repairs deemed routine by the Government, the Contractor shall have repair personnel on-site within 72 hours. Routine repairs shall be completed within 30 calendar days of initial notification. Repair priorities may be upgraded by the Government from routine to urgent or emergency if warranted by changing conditions. The Contractor shall be liable for payment of damages for losses resulting from a negligent failure to convert urgent or emergency work into a routine priority within 8 hours after arrival on site. For routine repairs, the Government may, at its option, complete or have completed such repairs after waiting 30 days for the Contractor to complete the work. The costs for such repairs shall be withheld from the next monthly payment to the Contractor. Disagreements over such withholdings shall be resolved under the Disputes Clause identified in paragraph GC.23 of the Model Agreement.

2.10 Training: The Contractor or subcontractors shall provide 8 hours of maintenance training for up to 8 government personnel. Training documents shall be prepared and given to the Government upon completion of each training session.

2.11 Disposal of Materials: All scrap materials must be removed from the site by the Contractor or their subcontractor, at no additional expense to the Government, and disposed of off base and in such a manner that meets all federal, state, and local environmental regulations. Government containers shall not be used for disposal of scrap materials.

2.12 Any required chemicals shall be dispensed ensuring no spillage to the ground or water. Periodic inspections of dispensing areas to identify leakage and initiate corrective action shall be performed and documented. This documentation will be periodically reviewed by the Government. Chemical waste shall be collected in corrosion resistant, compatible containers. Collection drums shall be monitored and removed to a staging or storage area when contents are within 6 inches of the top. Wastes shall be classified, managed, stored, and disposed of in accordance with Federal, State, and local laws and regulations.

2.13 Contractor Generated Hazardous Wastes/Excess Hazardous Materials: Water generated from the flushing of lines after disinfection or disinfection in conjunction with hydrostatic testing shall be land applied in accordance with all Federal, State, and local laws and regulations for land application or discharged into the sanitary sewer with prior approval and/or notification to the Waste Water Treatment Plant's Operator.

2.14 Hazardous wastes are defined in 40 CFR 261, or are as defined by applicable State and local regulations. Hazardous materials are defined in 49 CFR 171 - 178. The Contractor shall, at a minimum, manage and store hazardous waste in compliance with 40 CFR 262 and shall manage and store hazardous waste in accordance with the installation hazardous waste management plan. The Contractor shall take sufficient measures to prevent spillage of hazardous and toxic materials during dispensing. The Contractor shall segregate hazardous waste from other materials and wastes, shall protect it from the weather by placing it in a safe covered location, and shall take precautionary measures such as berming or other appropriate measures against accidental spillage. The Contractor shall be responsible for storage, describing, packaging, labeling, marking, and placarding hazardous waste and hazardous material in accordance with 49 CFR 171 - 178, State, and local laws and regulations. Unused or partially used containers of hazardous materials (i.e., paint, adhesives) are not hazardous waste and will be taken off the facility for reuse by the Contractor. Spills of hazardous or toxic materials shall be immediately reported to the Contracting Officer. Cleanup and cleanup costs due to spills shall be the Contractor's responsibility. The disposition of Contractor generated hazardous waste and excess hazardous materials are the Contractor's responsibility.

2.15 Environmental Protection: The contractor shall perform all work in such a manner as to minimize the pollution of air, water, or soil, and to control noise and dust within reasonable limits in accordance with all applicable Federal, State, and Local codes and regulations.

2.16 Codes and Standards: All contractor work shall conform to the requirements of this task order and to the appropriate Local, State, and Federal/National code for technology/system being implemented. All work must conform to local installation facility standards. All products and equipment provided by the contractor shall be Underwriters Laboratory or Factory mutual listed or equal. All codes and standards requirements shall be based on the latest edition of applicable Local, State, and Federal codes at the time of task order award.

2.17 International Code Family (Building, Mechanical, Fire, Fuel Gas, etc.)

2.18 Provide sufficient instrumentation to facilitate trouble shooting equipment, including but not limited to inlet and outlet temperature and pressure gauges. This shall apply to new boilers that are added to the contract.

2.19 Provide a brass name tag for each valve, temperature control device, control system device, etc., installed in all new systems.

3.0 BOILER MAINTENANCE INCLUDED:

3.1 General

1) Perform all manufacturer warranty repair.

2) Perform labor for non-warranty repair on the gas valve train including the fuel gas piping inside the mechanical room.

3) Minot repairs of venting and chimney.

4) Any maintenance activities that require a boiler to be taken off-line will be coordinated with a Minot AFB HVAC Shop COR.

3.2 Annual Inspection (Includes Semi-Annual Items)

1) Replace air filter (filter is included) if necessary.

2) Remove and inspect pilot assembly.

3) Inspect interior of vent pipe and air intake pipe for leaks, deterioration, scale, etc.

4) Inspect outside of copper tubes and headers.

5) Remove lower front jacket panel and check for any signs of corrosion or leaks.

6) Remove all pipe plugs in header and inspect inside of copper tubes and header.

7) Flush boiler and mechanically or chemically remove any scale. Scale removal will include all boiler tubes.

8) Remove, inspect and clean water flow switch and low water cutoff(s).

9) Inspect condensate drain tubes for deterioration, cracking, etc.

10) Measure fuel input, oxygen and carbon monoxide in flue products. Document measurements.

11) Adjust burner to obtain values noted in the fire test report. Tune boiler as per manufacturer recommendations.

12) Complete safety and operating control checks.

13) Log service procedures in boiler log.

14) Repair or replace any inoperative or damaged components.

3.3 Semi-Annual Inspection

1) Replace air filter (filter is included) if necessary.

2) Inspect condensate drain tubes for deterioration, cracking, etc.

3) Flush bottom of boiler.

4) Inspect air intake and exhaust pipes for leaks, deterioration, scale, etc.

5) Measure fuel input, oxygen, and carbon monoxide in flue products. Document measurements.

6) Adjust burner to obtain values noted in fire test report and tune boiler as per manufacturer recommendations.

7) Complete safety and operating control checks.

8) Log service procedures in boiler log.

9) Repair or replace any inoperative or damaged components.

3.4 Monthly Inspections (Annual Inspection Counted as Monthly)

1) Check proper operation of boiler.

2) Check system safety and operating controls including flame safeguard.

3) Check proper operation of safety relief valve.

4) Check carbon monoxide level in flue products. Document measurements.

5) Check venting/air intake and condensate drain tubes for obstructions.

6) Log service procedures in boiler log.

7) Repair or replace any inoperative or damaged components.

8) Check the glycol level in boiler water and record reading. Report any deficiency to the MAFB HVAC Shop COR.

9)Measure pressure drop across water basket strainer, and clean if necessary. Notify the COR in writing if the strainer requires cleaning more frequently than once per month. Even though the contractor is to provide this monthly service, the responsibility for the boiler water contaminants shall remain with Base (see the following heading titled “The following services are not included in the boiler maintenance agreement”). The buildup of scale within the boiler is not considered boiler water contamination. Scale removal is addressed in the annual inspections.

10) Visually inspect the natural gas meter/regulator set (located outside of the building) and notify the Contracting Officer of any observed deficiencies or irregularities. Any issues related to the gas meter/regulator set shall be addressed under the Base’s Natural Gas Line Privatization contract.

3.5 The following services are not included in the boiler maintenance agreement:

1) Any heat exchanger and/or boiler replacement that is covered under warranty by the boiler manufacturer.

2) Replacement of venting and chimney in whole or substantial part.

3) Boiler water chemical treatment beyond the monthly glycol testing and annual scale removal.

4) Repair of pumps and leaks on the hydronic system separate from the boiler.

5) Problems relating to the Direct Digital Control system are not included.

3.6 Limitation of Boiler Maintenance Agreement

As this agreement is for routine maintenance, the contractor is not the first responder for facility “no-heat” calls. The 5 CES HVAC shop will retain responsibility for responding to no-heat calls, and is responsible for trouble shooting these issues, correcting the problem, and re-lighting the boilers once the problem is rectified. The contractor is not liable for problems that result from an event that is out of its control. This includes all costs of service calls, repairs or lost savings resulting from any failure that is determined to have been caused by:

1) An act of any persons other than Contractor staff and/or its subcontractors.

2) A force majeure event including; but not limited to:

I.Act of God
II.Acts of Terrorism
III.Fire
IV.Water damage from roof or equipment leaks
V.Electrical power failures, voltage surges, voltage sags
VI.Severe weather, including wind, lightning, floods, etc.
VII.Other events beyond the control of the contractor

At the request of the Government, the Contractor will provide a quote (based on the then-current rates) to affect repairs for any of the situations listed above. If the Government decides to proceed, the Contractor will receive written notification stating that the work is to be performed. Upon completion of the work, the Government will be invoiced for the quoted amount.

4.0 GOVERNMENT FURNISHED PROPOERTY AND SERVICES:

4.1 Utilities: All reasonable quantities of utilities shall be made available at no cost to the contractor.

4.2 Storage: Material and equipment storage will be approved by the Civil Engineer Inspector. If approved, materials shall be placed in a neat appearance and in a manner that allows safe continued facility use.

4.3 Damage to Government Property: The Contractor shall notify the Government when damage to Government property is discovered. Any damage to Government property caused by the Contractor shall be repaired or replaced by the Contractor at the Contractor’s expense. The Contractor shall annotate on the inspection report, the damage, the cause of the damage, (if known) and a projected proposal for repair.

5.0 GENERAL INFORMATION:

5.1 Federal Holidays:

5.2 Base Closures: Work scheduled but not accomplished because of base closure due to weather, exercises, or actual alerts shall commence as soon as possible after reopening the base, unless otherwise directed by the CO through coordination of the COR.

5.3 Security Requirements: Contractor personnel will be limited to work areas. The COR will identify facilities requiring additional escorts upon receipt of contract award.

5.3.1 Minot AFB Identification Requirements. All contracted personnel requesting access to Minot Air Force Base must possess a valid State or Government picture identification card. Furthermore, individuals presenting identification cards from a state that is non-compliant with the REAL ID Act will require additional documentation to gain unescorted base access. Additional documentation includes a valid U.S. or foreign government issued passport, an employment authorization document that contains a photograph, or identification cards issued by federal, state, or local government agencies that include a photo and biographic information. Additional information to include a full list of REAL ID Act compliant and non-complaint states can be found at https://www.dhs.gov/current-status-states-territories. Personnel requesting vehicle access to Minot Air Force Base must provide a valid driver's license (compliant with REAL ID Act), current vehicle registration, and insurance.

5.3.2 The Contractor shall be responsible for obtaining all necessary passes or other items required for access to the areas in which work will be performed. The Contractor shall request contractor passes through the Contracting Officer by providing the name, social security number, date of birth, work phone, and home phone of employees requiring passes. Personnel must adhere to the REAL ID Act to ensure access to base is granted. Pass requests will be forwarded by the Contracting Officer to the 5th Security Forces Squadron Visitor’s Control Center for approval and issuance. Upon completion or termination of the contract, or an individual’s release from employment, the Contractor shall retrieve the identification issued above and surrender it to the 5th Security Forces Squadron Pass and Registration Section located in the Visitor Control Center. Template will be provided at contract award and due NLT 10 days after award.

5.3.3 Reporting Requirements: Contractor personnel shall report, to an appropriate authority, any information or circumstances they believe may pose a threat to the security of DoD personnel, contractor personnel, resources, and classified or unclassified defense information. Contractor’s employees shall be briefed by their immediate supervisor prior to entering the base.

5.4 Notification of Environmental Spills: The Contractor or their authorized representative shall report any spills immediately by calling the Fire Department at 723-2461 or 911 from a standard phone. If the Contractor spills or releases any substance listed in 40 CFR 302, Designation, Reportable Quantities, and Notification or general fluids into the environment, then the type of material and quantity spilled shall be reported. The Contractor shall be held liable for the spill or release of such substances and is expected to clean up all spills of less than 25 gallons. The Contractor shall be liable for the cleanup and cost of any spill greater than 25 gallons that occurs and is determined to be contractor negligence.

5.4.1 The Contractor shall be familiar with and follow the most current "Installation Emergency Management Plan 10-2". The Contractor is required to have and maintain Safety Data Sheets (SDS) on all Hazardous Material (HM). The Contractor shall provide a list of all HM to the CO at least 30 days prior to entering the base. The CO will distribute the list to all appropriate agencies for approval. The list shall contain the following information: the expected HM to be used including a copy of the SDS, an estimate on the quantity of the HM expected to be used during the performance of the contract, and anticipated storage location for each HM intended for use.

5.5 Compliance with Laws and Regulations: The Contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws, regulations, and requirements regarding environmental protection to include AFI 32-7080, Pollution Prevention Program, AFI 32-7042, Solid and Hazardous Waste Compliance, ACC Manual 32-7051, Environmental Quality Manual, 40 CFR 273, 40 CFR 133, North Dakota Administrative Code 33-24-02-06, and base Hazardous Waste Management Plan (July 2012) 5 BW-32-7043. In the event of environmental laws/regulations/requirements change during the term of the contract, the Contractor shall comply with such laws/regulations as changed. The Contractor shall comply with the base Hazardous Waste Management Plan (July 2012) when turning in wastes generated from spill cleanup.

5.6 Traffic Laws: The Contractor and its employees shall comply with base traffic regulations.

5.7 Weapons, Firearms, and Ammunition: Contractor employees are prohibited from possessing weapons, firearms, or ammunition, on themselves or within their contractor-owned or privately owned vehicle while on Minot Air Force Base.

5.8 For Official Use Only (FOUO): The Contractor shall comply with DoD 5400-7-R, Chapter 4, DoD Freedom of Information Act (FOIA) Program requirements. This regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding FOUO material.

5.9 Records: All records, files, documents, regardless of media (e.g., paper, electronic, etc.), as described in the PWS, that are the responsibility of the contractor are the property of the Government and shall remain so upon termination or completion of the contract. The contractor shall keep these items current and maintain and dispose of them in accordance with the requirements established in Air Force Instruction (AFI) 33-322, Records Management Program, Air Force Manual (AFMAN) 33-363, paragraph 6.4, AFMAN 33-364, paragraph 2.13, and the Air Force Records Disposition Schedule which can be provided by the COR or CO upon request. Records shall be turned over to the Government upon completion of the contract unless otherwise stated. All records are subject to the Freedom of Information and Privacy Act. The Minot AFB Records Management Office (5 CS/SCXR), 723-7542/2084, will provide assistance and training to the contractor to ensure compliance with Federal record keeping requirements.

5.10 Personnel: Contractor personnel shall present a neat appearance. Contractor personnel, while performing work on this contract, shall be easily recognizable while on the installation. This shall be accomplished through the wear of distinctive clothing, overcoats, or hats bearing the company name or logo. The coloring or design of the items selected should be such that they identify personnel easily and quickly for reasons of safety and personal protection. The Government is authorized to restrict the employment under the contract of any contractor employee or prospective contractor employee who is identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation and its population.

5.11 Fire and Emergency Reporting: Call 723-2461 or 911 from a standard phone.
