DIVISION 1 - GENERAL REQUIREMENTS

SECTION 01000

USPECIAL PROVISIONS

U1. GENERALU:

U1.1 DESCRIPTION OF WORKU:

U1.1.1U The following is a summary of work for QJVF 15-6002, Repair LF Contours - IDIQ, located in the Minot AFB missile complex. This project may include work in a restricted area. The Project shall include, but is not limited to:

U1.1.1.1U Repair, replacement, and/or regrading of Launch Facility gravel access roads, ditches, and on-site gravel parking and driving areas.

U1.1.1.2U Repair and replacement of culverts, French drains, flap gates and end sections.

U1.1.1.3U Specific description of the work is detailed in:

Specifications, Appendix A - Standard Details, and Drawings.

U1.1.2U The above description of work is for the purpose of general information only and is not intended to include and describe every feature or item of work or to define the scope of work.

U1.1.3U The estimated quantities listed for this contract are approximated; the actual construction quantities at the completion of this contract will vary with these estimated quantities.

U1.2 APPLICABLE PUBLICATIONSU: Publications shall be of the most current date at the Invitation For Bid date.

U1.3 WORK ENVIRONMENTU: The Launch Facilities (LF) are remote sites with no available utilities. Restroom facilities and potable water shall be provided by the Contractor. The LFs are secure and Contractor personnel require escorts at all times.

U2. PRODUCTSU: The products to be used in the work under this contract are described in the other sections of these specifications.

U3. EXECUTIONU:

U3.1 TRAFFIC CONTROLU: The Contractor shall provide all traffic control devices within the project limits, on all haul routes and on all detour routes. When necessary, sufficient barricades and signs shall be provided to prevent traffic from entering the construction area. The Contractor will be responsible for maintaining all areas of new construction until accepted by the Government. Temporary signs shall have the back and post painted to match Federal Standard 595b, color 20040. The Contractor shall be solely responsible for furnishing, erecting, maintaining, and removing all protective barriers, signs, temporary lighting, etc., required for protection of persons and property.

U3.2 HAULING MATERIALSU: Materials will be hauled in vehicles equipped with pneumatic tires. Hauling of materials shall comply with state and local regulations. The Contractor shall be responsible for establishing and maintaining off-base haul routes. Dust shall be controlled to prevent creation of a nuisance in the surrounding area. Haul routes shall be restored to existing condition upon completion of the project at no additional cost to the Government.

U3.3 EQUIPMENT PARKINGU: Space for the Contractor's equipment shall be determined at the pre-construction conference. The Government shall not be liable for the security of any of the Contractor's equipment while on site.

U3.4 DRAWINGS AND SPECIFICATIONSU: At least one set of drawings and specifications shall be kept at the job site by each superintendent.

U3.5 AS-BUILT DRAWINGSU: The Contractor shall maintain a set of red-lined full scale, as-built construction drawings marked-up to fully indicate as-built conditions. These drawings shall be maintained in a current condition at all times until completion of the work and shall be available for review by Government personnel at all times. The location as dimensioned from permanent features, general description, type of material, and approximate depth below finished grade of all new and existing exterior underground utilities encountered shall be indicated. All variations from the contract drawings for the required coordination between trades, shall be indicated. As-built construction drawings shall be furnished to the Contracting Officer for use during the final inspection. The as-built drawings shall be submitted to the Contracting Officer in accordance with Section 01300: SUBMITTALS.

U3.6 WORK CONDUCT, CORRELATION, EXECUTION, ETC.U:

U3.6.1U Work Performance: Contractor shall conduct all work, including materials distribution in an orderly manner, with minimum disturbance and inconvenience to traffic operations. Contractor shall confine and limit his personnel to only those areas required for work performance. All work shall be performed in a neat, orderly fashion, with extreme care exercised to avoid damage to all property in and around project areas. Any damage caused by the Contractor shall be replaced, repaired, or restored at no

01000-2 cost to the Government. Upon completion, all work and equipment storage areas shall be cleaned of all evidence of Contractor's debris accumulations.

Contractor's proposed work schedule shall be coordinated with the Contracting Officer or his designated representative 30 days prior to the start of any work. All work areas shall be barricaded properly for day and nighttime vehicular safety warning.

U3.6.2U Storage: Material storage will not be allowed on site. On-site equipment storage may be allowed, but will be determined at the pre-construction conference. If on-site equipment storage is deemed necessary at the pre-construction conference, all equipment shall be moved to Contractor’s staging area at the close of each day’s operations. If Contractor should have equipment located on-site, it shall be removed, and staging area restored to its original condition within 14 days after completion of work.

U3.7 QUALITY CONTROLU: The Contractor shall provide a Quality Control Inspector who is familiar with all phases of operation. This individual shall be named and qualifications stated in the Quality Control Plan. The Quality Control Inspector's responsibility shall be to make constant quality control inspections of all phases of the operation, in order to assure constant compliance with the contract specifications. A Quality Control Plan shall be submitted to the Contracting Officer prior to the start of any work. This plan shall apply to all subsequent delivery orders.

U3.8 PERMITS AND WORK CLEARANCESU:

U3.8.1U AF Form 103: The Contractor shall obtain from the contracting Officer's Technical Representative a copy of the AF Form 103, "Base Civil Engineering Clearance Request,” prior to the start of work.

U3.8.2U AF Form 592: When any welding, cutting, brazing or use of any open flame device is to be used, an AF Form 592 permit must be obtained from the Base Fire Department (Building 896, 896 Flightline Drive) prior to beginning such work. During such work, a fully charged and operable fire extinguisher, appropriate for the task, shall be provided by the Contractor.

U3.9 FIELD ENGINEERINGU: The Contractor shall provide field engineering services, by a licensed Land Surveyor to; establish grades, lines, levels, and storm drain data.

U3.9.1U Grade Control: Grade site to drain. Protect site from puddling or running water, or accumulation of standing water in excavations.

The Contractor shall provide all surveying required to establish and maintain line and grade stakes necessary to complete the construction.

U3.10 DEWATERINGU: If water is encountered, the Contractor shall be responsible for dewatering the site. Soils affected by the water shall be dried to a workable moisture prior to work proceeding. If the area cannot be

01000-3 stabilized by drying, the Contractor shall replace unsuitable soils with select fill.

U3.11 SAFETYU:

U3.11.1U Safety Requirements: Contractor will comply with all OSHA/NEC requirements and MAFB Instruction 32-2001, Responsibilities of Base Personnel to Eliminate or Control Fire Hazards.

U3.11.2U Radioactive Sources: Non-Air Force organizations bringing radioactive materials on Air Force installations or conducting operations using radioactive materials on Air Force installations must receive written approval by the Base Radiation Safety Officer (RSO), 5 MDOS/SGOAB, at 723-5151.

U3.11.2.1U To get this approval, the non-Air Force organization must send a request to the installation RSO at least 30 calendar days before bringing the materials onto the installation.

U3.11.2.2U Requests must be in writing and include:

U3.11.2.2.1U A brief description of the proposed activities.

U3.11.2.2.2U A copy of a current Nuclear Regulatory Commission (NRC) Agreement or State license with current NRC Form 241, REPORT

OF PROPOSED ACTIVITIES IN NON-AGREEMENT STATES, AREAS OF EXCLUSIVE FEDERAL

JURISDICTION, OR OFFSHORE WATERS. EXCEPTION: Contractors using generally licensed materials (e.g., certain NITON Lead Paint Analyzers) and DoE or DoE prime Contractors operating in accordance with 10 CFR Part 835 do not require an NRC license or NRC Form 241 for NARM.

U3.11.2.2.3U The name, local address, and telephone number for the responsible local representative and the name, address, and telephone number of the RSO named on their license.

U3.11.2.2.4U A copy of that part of the Air Force contract describing work to be done at the installation and the inclusive dates of the work.

U3.11.2.2.5U An acknowledgement that the installation RSO can make periodic checks to ensure that Contractor personnel follow radiation safety practices to prevent exposures to Air Force personnel and avoid contamination of Government property. In addition, the installation RSO must have authority to suspend Contractor operations believed to be unsafe.

U3.11.3U Agreement State licensees using NRC regulated materials must supply a copy of the NRC Form 241 approved by the installation’s NRC Region

01000-4 according to 10 CFR Part 150.20. The form must specify the correct locations and dates of performance of licensed activities. State licensees may not work on Air Force or other installations where exclusive federal jurisdiction exists for more than 180 days per calendar year without first getting an NRC license.

U3.11.4U Non-Air Force organizations that do not have an NRC or Agreement State license with current NRC Form 241 and who are not DoE or DoE prime Contractors exempted from licensing must contact AFMOA/SGOR for guidance and approval to use radioactive materials on an Air Force installation.

U3.12 SECURITY REQUIREMENTS:

U3.12.1U Entry and Site Regulations:

U3.12.1.1U Entry: In order to gain entry onto a facility, Contractor personnel and mission essential Contractor owned/leased vehicles must be listed on an Entry Authority List (EAL), identified by Government inspector/escort personnel, and physically escorted on site by authorized Government inspector/personnel. No privately owned vehicles (POVs) will be permitted on LFs.

U3.12.1.2U Thirty (30) working days prior to the initial commencement of work, the Contractor must submit to the Contracting Officer a summarized list of employees and mission essential Contractor owned/leased vehicles along with a legible photocopy of each employee’s government issued credential photo ID. The lists and photocopies will be used to prepare the Contractor’s EAL referenced above. Foremen, supervisors and superintendents must be identified as such on the Contractor’s list of employee information.

U3.12.1.2.1U The Contractor’s summarized list of employee information must show each employee’s full name exactly as it appears on the credentialed photo ID submitted; date of birth (DOB); full Social Security Account Number (SSAN); citizenship; the government issuing agency name and control number exactly as it appears on the credentialed ID submitted. U.S. government issued credential photo IDs must have a picture of the individual, individual’s DOB and a control number. Acceptable government issued credentialed photo IDs are U.S. Federal passport or passport card, or state, commonwealth, territory, protectorate, District of Columbia, U.S.

sovereign insular area or tribal organization recognized by the U.S.

Department of the Interior cards.

U3.12.1.2.2U The Contractor’s summarized list of vehicle information must include vehicle make; vehicle model; vehicle year;

vehicle primary color; vehicle license plate state of issue and number.

Vehicles include mission essential company owned/leased vehicles driven out to the LF and brought onsite for use, i.e. pick-up trucks, cars, vans, lineman’s trucks, dump trucks, etc. All equipment (i.e. skid-steers, Bobcats, forklifts, 01000-5 loaders/backhoes/lifts, trenchers, air compressors, welders, etc.), materials, and hand-carried items (i.e. power tools and hand tools) brought out to the site on a trailer are not required to be listed on the EAL. A piece of equipment driven on-site rather than on a trailer needs to be listed on the EAL. No privately owned vehicles will be permitted on LFs.

U3.12.1.3U Upon arrival, the Government inspector/escort will identify and search all Contractor personnel and vehicles. All Contractor personnel will provide the Government inspector/escort with a form of photo identification as listed above, stating the employee’s full name. The Contractor's vehicles will be checked and possibly searched prior to site entry. Contractor vehicles shall be clearly marked identifying each contracting firm.

U3.12.1.4U If Contractor personnel are not listed on the EAL, or those who are listed cannot provide proper identification, they will not be permitted on the site. Delays caused by lack of proper EAL data or proper identification shall be at no cost to the Government.

U3.12.1.5U Restricted Area. The work to be performed is in a restricted area. Therefore, the Contractor shall conform to all requirements of MAFB IDP 31. Workers will be required to have an escort with them at all times. The Contractor shall allow 60 minutes each day for personnel to process on and off the work site that will not be considered delay time. All site access delays must be reported by the Contractor, in writing, to the Contracting Officer within 24 hours of occurrence. All Government-caused work stoppages must be documented by Government personnel at the time of occurrence and reported by the Contractor, in writing, to the Contracting Officer within 24 hours of occurrence.

U3.12.2U Security: The Contractor shall:

U3.12.2.1U Protect all Government property.

U3.12.2.2U Comply with base physical security regulations and procedures.

U3.12.2.3U The Government inspector/escort will be responsible for on-site security.

U3.12.2.3.1U While work is in progress, the Contractor may be required to remove his personnel due to Alert status, real or exercise.

U3.12.2.4U During all on-site work, the Contractor personnel will be accompanied and continuously monitored by one (1) Government inspector/escort. Failure to remain within the area being monitored is a serious breach of security and safety regulations. The Contractor will take all necessary action to ensure compliance. The Contracting Officer reserves

01000-6 the right to deny entry to/or take action with any Contractor personnel who refuse to conform to security and/or safety regulations. Delays resulting from such entry denial shall not result in any cost to the Government or schedule delay.

U3.13 WINTER EXCLUSIONU: The winter exclusion shall be from 15 November through 15 April. The access road and/or on-site area shall be surfaced with new or existing gravel and open to traffic during the winter exclusion.

U3.14 GOVERNMENT-CAUSED DELAYSU:

U3.14.1U Unscheduled Work Delays: In event of a missile movement or required generation, the Contractor will be required to vacate the area of all personnel, equipment, and materials for an indefinite period. The on-site supervisor shall notify the Contract Administrator within 24 hours of the delay.

U3.15 PERFORMANCE OF WORKU:

U3.15.1U Not less than 14 days prior to construction, submit a proposed plan for routing traffic through or around the work site. This plan shall be included as a submittal on the AF Form 66, Schedule of Material Submittals.

U3.15.2U The performance period for each delivery order will be defined at the time of notification of work.

U3.15.3U Provisions shall be made daily to allow refuse removal from base facilities.

U3.15.4U Transitions from existing to new work must be smooth and gradual.

U3.15.5U Any and all damage caused by the Contractor, directly or indirectly because of performance of this contract, will be fixed to the like condition prior to construction. The Contractor will inform the Contracting Officer prior to the final inspection of any and all such damages and repairs.

U3.16 WORK SCHEDULEU: Working hours for the Contractor will normally be between the hours of 8:00 a.m. and 6:00 p.m., excluding Fridays, Saturdays, Sundays and federal holidays. If the Contractor desires to work during periods other than above, additional Government inspection forces may be required. The Contractor UmustU make his/her request to the Contracting Officer three days in advance of his/her intention to work during other periods to allow assignment of additional inspection forces. If such force is reasonably available, the Contracting Officer may authorize the Contractor to perform work during periods other than normal duty hours/days. However, if inspectors are required to perform in excess of their normal duty hours/days

01000-7 solely for the benefit of the Contractor, the actual cost of inspection at overtime rates will be charged to the Contractor. These adjustments to the contract price may be made periodically as directed by the Contracting Officer.

U3.17 GOVERNMENT ACCESSU: The Government shall have access to borrow pits, stockpiles, and testing facilities for inspection and sampling.

U3.18 UTILITIESU: Water and electricity required by the Contractor for the completion of the contract will not be provided by the Government.

U3.19 UTILITY OUTAGES:

U3.19.1U Any utility outages (gas, electricity, and water) requested by Contractor shall be submitted in writing no less than fifteen (15) calendar days prior to the proposed outage.

U3.19.2U The Government reserves the right to reschedule the Contractor’s proposed outage if deemed necessary.

U3.19.3U In the event utility outages cannot be performed on any facility due to critical operation impact, the utility outages, and any related work shall be performed on non-duty hours.

U3.20 EXCESS MATERIALS:U All materials resulting from demolition shall become the property of the Contractor unless specified otherwise or as determined by the Contracting Officer.

U3.20.1U Materials determined to be Government property shall be deposited by the Contractor as directed by the Contracting Officer.

U3.20.2U Materials not wanted by the Government and all Contractor-generated rubbish shall be disposed of by the Contractor off-site at his own expense, and in compliance with applicable environmental codes and regulations of governing authorities.

U3.21 CLOSEOUT PROCEDURES:

U3.21.1U When the Contractor considers the work to have reached final completion, submit written certification that the contract documents have been reviewed, the work has been inspected, and that the work is complete in accordance with the contract documents and ready for final inspection.

U3.21.2U Provide the Contracting Officer with a requested date for final inspection, in writing, not less than 2 working days prior to the proposed date of final inspection. The Contracting Officer will coordinate

01000-8 with the members of the inspection party and establish the final inspection date. If construction deficiencies are identified, a request for reinspection must be given upon correction of the deficiencies.

SECTION 01300

USUBMITTALS

U1. GENERAL:

U1.1 PROCEDURESU:

U1.1.1U The Contractor shall be required to submit items listed in the Submittal Schedule at the end of this section to the Contracting Officer for approval.

U1.1.2U Transmit each item under AF 3000, Material Approval Submittal form. Identify contract number, project number, and Contractor. Identify section and paragraph reference for each item submitted with the AF 3000.

Submit three copies unless otherwise required elsewhere in the specification.

U1.1.3U Unless specifically stated otherwise elsewhere in this specification, each submittal shall be approved by the Contracting Officer prior to incorporation of materials into the work.

U1.1.4U Approvals of submittals which do not conform to the contract shall not be construed as a change to the contract.

U1.2 MANUFACTURER'S DATA AND SAMPLESU: Where manufacturer's data and samples are required, submit in accordance with procedures identified in 1.1 above.

U1.2.1U Manufacturer's Certification: Submit a statement from the product manufacturer that proposed products meet the specified standards and other salient characteristics identified as requirements in the specification.

U1.3 TEST DATAU: Test results shall be dated and signed by the agency performing the test.

U1.4 MISCELLANEOUS SUBMITTALSU: Submittals which are none of the above types shall meet the specific requirements identified in the referenced paragraph of the Specification Section identified in the schedule.

U1.5 SUBMITTAL SCHEDULEU: The following is a list of required submittals for this Contract and deadlines for their submittal.

UENVIRONMENTAL PROTECTION

U1.1U The Contractor shall perform all work in such manner as to minimize the polluting of air, water, or land, and shall, within reasonable limits, control noise and the disposal of solid waste materials, as well as other pollutants. Recycling of construction and demolition debris is required when economically advantageous.

U1.2 IMPLEMENTATIONU: Within 20 calendar days after Notice to Proceed and prior to commencement of the work at the site, the Contractor shall:

U1.2.1U Detail their proposal for implementing the requirements for environmental pollution control specified herein. Submit in accordance with the submittal table.

U1.3 SUBMITTALSU: In accordance with Section 01300: Submittals, the Contractor shall submit the following.

U2.1 REFERENCESU: The publications listed below form a part of this specification to the extent referenced. U2.2 PRECONSTRUCTION SURVEYU: Prior to start of any on-site construction activities, the Contractor shall make a condition survey after which the Contractor shall record on a layout plan the condition of trees, shrubs and grassed areas immediately adjacent to the site of the work and adjacent to his assigned storage area and access route as applicable. Submit in accordance with the submittal table.

U2.3 PERMITS AND FEESU: No separate payment will be made for work covered under this section. The Contractor shall be responsible for payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor. All costs associated with this section shall be included in the contract price. The Contractor shall be responsible for payment of all fines/fees for violation or non-compliance with Federal, State, Regional and local laws and regulations.

U2.3.1U The Contractor shall be responsible for obtaining and complying with all environmental permits and commitments required by Federal, State, regional, and local environmental laws and regulations.

U2.4 PROTECTION OF LAND AREASU: Except for work areas, storage areas, or access routes specifically assigned for the use of the Contractor under this

01431-2 contract, the land areas outside the limits of permanent work performed under this contract shall be preserved in their present condition. The Contractor shall confine his construction activities to areas defined for work on the plans or specifically assigned for his use. Storage and related areas and access routes required temporarily by the Contractor in the performance of the work will be assigned by the Contracting Officer.

U2.5 PROTECTION OF TREES AND SHRUBSU: Except for trees or shrubs marked on the plans to be removed, the Contractor shall not deface, injure or destroy trees or shrubs, nor remove or cut them without special authority. No ropes, cables, or guys shall be fastened to or attached to any existing nearby trees for anchorage.

U2.5.1U Tree Protective Structures: Where, in the opinion of the Contracting Officer, trees may possibly be defaced, bruised, injured, or otherwise damaged by the Contractor's equipment or by his other operations, he may direct the Contractor to provide temporary protection of such trees by placing boards, planks, or poles around them.

U2.5.2U Restoration of Damaged Trees: Any tree scarred or damaged by the Contractor's equipment or operations shall be restored as nearly as possible to its original condition at the Contractor's expense. All scars made on trees not designated on the plans to be removed by construction operations shall be coated as soon as possible with an approved tree wound dressing. Trees that are to remain, either within or outside established clearing limits, that are damaged by the Contractor so as to be beyond saving in the opinion of the Contracting Officer shall be immediately removed, if so directed, and replaced with a nursery-grown tree of the same species and size.

U2.5.3U Herbicide: Herbicide use will be restricted to those areas directed to be sprayed by the Contracting Representative. Herbicide shall not be sprayed when wind speeds are greater than 10 mph or when there is likelihood of runoff due to rain. Herbicide shall contain a visible dye for tracking application area. Contractor shall submit catalog data and MSDS for any herbicide proposed prior to use on the site.

U2.6 WATER RESOURCES AND STORM WATER DISCHARGEU: The Contractor shall monitor construction activities to prevent pollution of surface and ground waters. Toxic or hazardous chemicals shall not be applied to soil or vegetation unless otherwise indicated. The Contractor shall monitor all water areas affected by construction activities.

U2.6.1U NPDES Storm Water Program General Construction Permit

U2.6.1.1 CONSTRUCTION ACTIVITY LESS THAN ONE ACREU:

U2.6.1.1.1U For construction activity that disturbs less than 1 acre of land the Contractor shall implement Best Management Practices (BMPs) outlined in Section D, Erosion and Sediment Controls.

U2.6.1.2 WETLANDS, EROSION AND SEDIMENT CONTROLSU:

U2.6.1.2.1 WETLANDSU: The Contractor shall not enter, disturb, destroy, place fill into, or allow discharge of contaminants into any wetlands except as specifically authorized herein. The Contractor shall be responsible for the protection of wetlands on Minot AFB. Authorization to enter specific wetlands identified shall not relieve the Contractor from any obligation to protect other wetlands within, adjacent to, or in the vicinity of the construction site and associated boundaries. Maps showing locations of wetlands within Minot AFB can be obtained from 5 CES/CEIE.

U2.6.1.2.2U The Contractor shall be responsible for providing erosion and sediment control measures in accordance with Federal, State and local laws. This applies in all cases, even for construction activity that disturbs less than an acre of soil. The erosion and sediment controls selected and maintained by the Contractor shall be such that water quality standards are not violated as a result of the Contractor’s construction activities. The area of bare soil exposed at any one time by construction operations should be kept to a minimum. The Contractor shall construct or install temporary and permanent erosion and sediment control best management practices (BMPs). BMPs may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization, silt fences, construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins. The Contractor’s best management practices shall also be in accordance with the Base National Pollutant Discharge Elimination System (NPDES) Storm Water Pollution Prevention Plan (SWPPP) which may be reviewed at the Minot AFB Environmental Management Office. Any temporary measures shall be removed after the area has been stabilized.

U2.6.2U For discharge of ground water, the Contractor shall obtain a State permit specific for pumping and discharging ground water prior to surface discharging in accordance with the requirements of the State Storm Water Discharges From Construction Sites permit. Refer to the NDDH web site.

U2.6.3 PROTECTION OF WATER RESOURCESU: The Contractor shall control the disposal of fuels, oils, bitumen, calcium chloride, acids or harmful materials, both on and off the Government premises and shall comply with applicable federal, state, county and municipal laws concerning pollution of rivers, streams, and wetlands while performing work under this contract.

Special measures shall be taken to prevent chemicals, fuels, oils, greases, bituminous materials, herbicides, and insecticides from entering public waters. Water used in on-site material processing, concrete curing, foundation and concrete cleanup, and other waste waters shall not be allowed to reenter a stream if an increase in the turbidity of the stream could result therefrom.

U2.6.3.1 DEWATERING OF GROUNDWATERU: For temporary dewatering of groundwater encountered during construction, the Contractor shall land apply

01431-4 all water generated at the locations indicated on drawings in accordance with Paragraph: LAND APPLICATION.

U2.6.3.1.1 LAND APPLICATIONU: Land application shall follow state requirements; however, no permit will be necessary. "Land application" implies that the Contractor shall discharge water at a rate which allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, defined drainage areas, or discharge into the "waters of the State" shall occur. The Contractor shall contact the State of North Dakota, Division of Water Quality and Permit Program, to discuss the water quality parameters for chemical contaminants (such as chlorine), oil, grease, and total suspended solids and shall ensure that all water intended for land application will meet the state requirements.

U2.6.4 EROSION AND SEDIMENT CONTROLU: The Contractor shall be responsible for providing erosion and sediment control measures in accordance with local, state, and federal regulations. The erosion and sediment controls selected and maintained by the Contractor shall be such that local, state, and federal water quality standards are not violated as a result of the Contractor's construction activities. The area of bare soil exposed at any one time by construction operations should be held to a minimum. For areas subject to erosion including, but not limited to, steep slopes, soils spreading areas, and stockpile areas, the Contractor shall disturb as little vegetation as possible, minimize the period of time that the soil is exposed, prevent surface water runoff from flowing across disturbed areas, stabilize disturbed soils as soon as possible, and provide adequate drainage for the increased runoff. Sedimentation/erosion control features may include, but not be limited to, vegetation cover, stream bank stabilization, slope stabilization construction of terraces, interceptor channels, sediment traps, inlet and outfall protection, diversion channels, and sedimentation basins.

Runoff management practices should be employed in areas where the potential for storm water contamination exists that cannot be addressed by a prevention or source reduction measure. Runoff management procedures may include vegetative swales, reuse of collected storm water, infiltration devices, and detention/sedimentation basins. Any erosion and sediment control measures which are damaged or found to be ineffective shall be remedied by the Contractor at no additional cost to the Government. Any areas damaged by erosion shall be repaired by the Contractor at no additional cost to the Government.

U2.6.5 SPILL PREVENTION AND RESPONSE PLANU: The Contractor shall include a Spill Prevention and Response Plan in the Implementation Proposal.

The plan shall describe the Contractor's procedures for preventing and responding to spills of hazardous materials.

U2.7 AIR QUALITYU: Equipment operation, activities, or processes performed by the Contractor shall be in accordance with all Federal and State air emission and performance laws and standards.

U2.7.1U Burning of material is not allowed on site by the Contractor.

U2.7.2 PARTICULATESU: The contractor shall not operate a construction site or demolition project unless reasonable precautions are taken to control emissions of particulate matter. Such emissions of airborne particulate matter shall not exceed 20% opacity as defined in 40 CFR 60 Appendix A.

U2.7.3 SOUND INTRUSIONSU: The Contractor shall keep construction activities under surveillance and control to minimize environment damage by noise. The Contractor shall comply with the provisions of the State of North Dakota rules.

U2.7.4 OZONE DEPLETING CHEMICALS (ODCs)U: The contractor shall ensure activities performed under this contract are in compliance with the Air Force Policy on ODCs. The contractor shall not purchase, use, or specify the use of any Class I ODC in the production, design, or maintenance of the end item.

Class II ODCs may be used or specified only with the written approval of the Contracting Officer.

U2.7.5 DUST CONTROLU: The Contractor shall maintain all excavations, embankments, stockpiles, access roads, plant sites, waste areas, borrow areas, and all other work areas free from excess dust to such reasonable degree as to avoid causing a hazard or nuisance. Temporary methods consisting of sprinkling, chemical treatment, light bituminous treatment or similar methods will be permitted to control dust. Dust control shall be performed as the work proceeds and whenever a dust nuisance or hazard occurs.

U2.8 TOXICSU: The Contractor is responsible for ensuring that no employee is exposed to toxic materials like airborne asbestos, lead from lead base paint or polychlorinated biphenyls (PCB’s).

U2.9 HAZARDOUS MATERIALS (HAZMAT)U: Contractors must obtain an authorization prior to bringing any hazardous materials (Federal Standard 313) on Air Force installations. Contractors must submit all required documentation including appropriate Hazardous Materials Authorization Information Form, Material Safety Data Sheet (MSDS) and projected usage information to 5 CES/CEIE through the Contracting Officer at least 15 days before the HAZMAT is brought onto Minot AFB and facilities within the Missile Field. This review is to ensure that no Air Force restricted hazardous materials are being proposed for use. The contractor will comply with Federal Acquisition Regulation (FAR) 52.223-5. Following contract award, the contractor shall provide the name and an initial volume of each hazardous material being used on Minot AFB and its storage location. Contractors shall provide 5 CES/CEIE with specific usage data on a monthly basis and a finalized usage report at project completion, as determined by the Installation Hazardous Materials Management Process (IHMMP) Team. Reports must include: name of material, manufacturer, NSN/Part #, container size, volume start balance, volume of material used in reporting period, storage location if it’s changed since initial reporting and the name and phone number of the reporting official. Reports shall be on letterhead paper, dated, and signed by the reporting official. Prime contractors shall be responsible for reporting hazardous material used by subcontractors. FAR

52.223-3 provides guidance on Hazardous Material Identification and Material Safety Data.

U2.9.1U UEMERGENCY PLANNING AND COMMUNITY RIGHT-TO-KNOW ACT (EPRCRA)U:

Contractors shall comply with the reporting provisions of EPCRA Sections 311, 312 and 313 during the life of the contract. Contractors shall provide a list of all hazardous materials procured, used and stored along with a current MSDS for each item, an initial inventory and a monthly or quarterly inventory.

Contractors shall provide the information to 5 CES/CEIE through the Contracting Officer. The inventory reporting period shall be determined by the installation Hazardous Materials Management Process Team.

U2.9.2U The contractor shall maintain MSDSs for all hazardous materials used on base and the MSDSs shall be on file on site at the construction site office at all times. The contractor shall send 5 CES/CEIE via the Contracting Officer a MSDS for any new material not initially identified, the volume being brought on base, and its storage location. The MSDS shall be submitted to 5 CES/CEIE in accordance with Section 01300: Submittals.

U2.9.3U Prior to completion of the contract, the contractor shall provide a finalized report of the actual quantities used during the contract, and remove all excess materials. Contractors may use excess materials on other projects and shall be responsible for proper disposal of any materials removed from Minot AFB.

U2.9.4U All hazardous materials used by the contractor on Minot AFB property shall be stored properly in segregated areas in accordance with all regulatory and MAFB Fire Department requirements. Storage requirements shall include, but not be limited to:

U2.9.4.U1 Containers must be securely closed when not in use.

U2.9.4.2U Containers must be labeled with appropriate warning labels.

U2.9.4.3U Storage area must be posted with hazardous signs as required.

U2.9.4.4U Storage must have secondary containment.

U2.9.4.5U Contractor shall check at least weekly for leaks and spills and maintain a log of the inspections.

U2.9.4.6U Materials shall be stored in one central location.

U2.9.4.7U Flammable items must be stored in an approved flammable storage locker and grounded as needed.

U2.9.4.8U All fuel storage tanks and containers must have secondary containment.

U2.9.5U Fuel and Lubricants. Storage, fueling and lubrication of equipment and motor vehicles shall be conducted in a manner that affords the maximum protection against spill and evaporation. Fuel, lubricants and oil shall be managed and stored in accordance with all Federal, State, and local laws and regulations. Used lubricants and used oil to be discarded shall be stored in marked corrosion-resistant containers and recycled or disposed in accordance with 40 CFR 279, State, and local laws and regulations. There shall be no storage of fuel on the project site. Fuel must be brought to the project site each day that work is performed.

U2.10 GREEN PROCUREMENTU: In compliance with the Affirmative Procurement requirements of Section 6002 of RCRA, Executive Orders 13423 and 13514, and the Federal Acquisition Regulations (FAR), the Government requires the use of recycled and recovered materials, and products identified in the Environmental Protection Agency’s Comprehensive Procurement Guidelines as much as practical.

U2.10.1U These materials and products must meet the requirements of the specifications, must not delay the progress of the work, and must not be cost prohibitive.

U2.10.2U EPA guideline items are seen as the minimum that should be considered when evaluating recycled/reuse materials. Other materials and products not listed, but commonly used in industry outside of the government, should also be considered. FAR 52.211-5 provides guidance on recycled material usage versus virgin material usage.

U2.10.3U Material and product submittals for all recycled-content items required will clearly show the recycled/recovered content for each material used, type of material, and total weight of material used.

U2.10.4U Any decision not to acquire guideline items as required in the contract must be submitted in writing and approved by the Contracting Officer and 5 CES/CEIE. All purchases of guideline items must be verified by the Contracting Officer before contract closure.

U2.10.5U Paper products such as government documents, agreements, contracts, etc. shall be printed on paper containing at least 30% post consumer materials per FAR 52.204-4. The use of recycled or bio-based containing products is strongly encouraged.

U2.10.6U All contractually required documents and reports produced by or for the Air Force longer than two pages shall be double-sided per FAR 52.204-4.

U2.11 QUALIFIED RECYCLING PROGRAM (QRP)U: In compliance with 10 U.S.C.

§2577 and DoD Instruction 4715.4, Pollution Prevention, 6 Jul 1998, it is the intention of the Air Force to recycle at its installations.

U2.11.1 Recycling/Reuse of Excess Materials and Construction and Demolition (C&D) DebrisU: The contractor shall reuse/recycle excess materials and C&D debris to the maximum extent possible. C&D debris are those excess/residue materials resulting from construction or demolition activity that would normally be discarded to a landfill. C&D debris includes, but is not limited to soil, rock, vegetation, and concrete, if determined to be economical. All C&D debris resulting from demolition shall become the property of the contractor unless specified otherwise or as determined by the contracting officer.

U2.11.2U Reporting Tonnage of C&D Debris: contractor shall track by month and report the tonnage of C&D debris in two categories:

U2.11.2.1U Tons of C&D debris that is or will be recycled or reused

U2.11.2.2U Tons of C&D that is disposed in a landfill.

U2.11.3U The C&D debris recycled/disposed tonnage report shall consist of a written memo with the tonnage of each category (recycled and disposed tonnage) submitted to 5 CES/CEIE through the contracting officer. Submit C&D debris recycled and disposed tonnage report monthly until the project is completed.

U2.11.4U Materials not to be returned to the Government and all contractor generated rubbish, if not recycled, shall be disposed of by the contractor off-base at his own expense, and in compliance with applicable environmental codes and regulations of governing authorities.

U2.12 HAZARDOUS WASTE PROCEDURESU: All hazardous waste must be managed, handled, and disposed of in accordance with 40 Code of Federal Regulations (40 CFR) Parts 260-299 and the Minot AFB Hazardous Waste Management Plan.

U2.12.1U The contractor is responsible for the proper characterization, containerization, and disposal of all wastes generated from his operations, including RCRA hazardous, state-regulated, and spill cleanup wastes.

U2.12.2U Contractors shall coordinate with 5 CES/CEIE for the disposal of generated wastes at least 14 days before the project begins, and provide updates at least once per month throughout the entire project. Updates shall include the volume and type of waste generated, and storage location.

U2.12.3U The contractor shall dispose of/recycle solid wastes (i.e.

non-hazardous) through local disposal or recycling facilities. No liquid wastes of any kind may be put into installation garbage collection containers, or poured into drains, sinks, toilets, or on the ground. Revenue received by the contractor from recycled solid wastes shall offset contract costs. The contractor shall coordinate disposal of RCRA hazardous, state-regulated and liquid wastes from government materials through 5 CES/CEIE via the Contracting Officer. The contractor shall be responsible for disposal of RCRA hazardous, state-regulated, liquid wastes and spill-cleanup wastes generated by

01431-9 contractor processes and from contractor-purchased materials. The contractor shall characterize, containerize, handle, manage and dispose of wastes in accordance with 40 CFR 260-299 and the installation Hazardous Waste Management Plan. The contractor is responsible for provided appropriate waste collection containers.

U2.12.4U Contractors storing hazardous waste on site for more than 24 hours must follow the Minot AFB Hazardous Waste Management Plan. At a minimum, the contractor must establish a secure accumulation point, and appoint and train Hazardous Waste (HW) Managers. If more than 55 gallons of hazardous waste or more than 1 quart of acutely hazardous waste is generated then the contractor must obtain approval for and establish a 90 day accumulation site.

The contractor shall coordinate accumulation storage areas with 5 CES/CEIE via the Contracting Officer at least 2 weeks prior to establishing the storage area.

U2.12.5U The contractor is responsible for all fines and penalties, which may stem from an EPA or State of North Dakota Department of Health hazardous waste inspection of his operation.

U2.13 SOLID WASTESU: The contractor is responsible for handling and disposal of all solid waste generated at the job site including laboratory testing and any documentation submittals required by the landfill owner.

U2.13.1U Solid wastes (excluding clearing debris) shall be placed in containers that are emptied on a regular schedule. Handling, storage, and disposal shall be conducted to prevent contamination. Segregation measures shall be employed so that no hazardous or toxic waste will become co-mingled with solid waste.
