(1) Past Performance

(2) Price

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

(End of provision)

ADDENDUM TO FAR 52.212-2- Evaluation-Commercial Items

This is a competitive best value in which competing offeror’ s present/past performance history will be evaluated on a basis significantly more important than cost or price consideration. By submission of its’ offer, the offeror accedes to the terms of this model contract and all offers shall be treated equally except for their prices and performance records. The evaluation process shall proceed as follows:

FACTOR 1- PAST PERFORMANCE/EXPERIENCE

A. Initially, offers shall be ranked according to price, including all option period pricing periods. An offeror’s proposed prices will be determined by multiplying the quantities identified in the Pricing Schedule by the proposed unit price for each Contract Line Item Number or Subcontract Line Item Number to confirm the extended amount for each. The price evaluation will document for the offers evaluated under the following subparagraph B, the completeness and reasonableness of the proposed total evaluated price. The government will evaluate offers for award purposes by adding the total price for all option periods, to the total price for the basic requirement.

B. The offeror shall provide the Past Performance/Experience questionnaire (Attachment #3) to those agencies/firms responsible for the solicitation and administration of those projects identified in Part II of the offeror’s proposal. The cover letter included with Attachment #3 requests your references to complete the questionnaire. The completed questionnaire shall be mailed from the reference directly to the below listed address:

628th Contracting Squadron Attn: Scott D. Rogge 101 E. Hill Blvd, Bldg 503 Joint Base Charleston, SC 29404-5021

The questionnaires must be received not later than the receipt of proposals due date and time specified in the solicitation package.

C. Offerors are responsible to ensure their reference sources receive, complete, and return the questionnaires on time to the issuing office. Offerors shall follow-up with their evaluators to ensure questionnaires are submitted. The evaluation shall take into account experience information regarding predecessor companies, key personnel who have relevant experience, or subcontract work when the offerors firm performed major or critical aspects of the requirement when such information is relevant to the acquisition. However, the proposal shall clearly define who accomplished the work if performed by other than the prospective contractor (e.g. key personnel) and define the role (e.g. prime contractor, subcontractor, sub tier contractor, etc.) performed by the offeror. The government will consider the information provided from the offeror and may consider any other source when evaluating the offeror’s past performance. Offerors will have the opportunity to comment on any adverse past performance findings for which the offeror has not already provided comments.

D. In addition to evaluating the extent to which the offeror’s performance meets mission requirements, the assessment will consider things such as the offeror’s history of adhering to the schedules (including the administrative aspects of performance), reasonable and cooperative behavior and commitment to customer satisfaction, and generally, the contractor’s business-like concern for the interest of the customer.

E. Under the Past Performance factor, the Performance Confidence Assessment represents the evaluation of an offeror’s present and past work record to assess the government’s confidence that the offeror will successfully perform the contract as proposed. The Past Performance evaluation is accomplished by reviewing aspects of an offeror’s present and recent experience, focusing on and targeting performance which is relevant. In evaluating past performance, the Government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation. For this solicitation, relevant experience is defined as provide building supplies and materials in substantially the same quantities and manner as required by the SOW.

Very Relevant - Present/past performance effort involved essentially the same magnitude of effort and complexities this solicitation requires.

Relevant - Present/past performance effort involved much of the same magnitude of effort and complexities this solicitation requires.

Somewhat Relevant - Present/past performance effort involved some of the magnitude of effort and complexities this solicitation requires.

Not Relevant - Present/past performance did not involve any of the magnitude of effort and complexities this solicitation requires.

F. The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in the solicitionat, based on the offeror’s demonstrated present and past performance.

The assessment process will result in an overall performance confidence assessment rating, defined as follows:

Exceptional/ High Confidence Based on the offeror’s performance record, essentially no doubt exists that the offeror will successfully perform the required effort.

Very Good/Significant Confidence Based on the offeror’s performance record, little doubt exists that the offeror will successfully perform the required effort.

Satisfactory/Confidence Based on the offeor’s performance record, some doubt exists that the offeror will successfully perform the required effort.

Neutral/Unknown Confidence No performance record identifiable.

Marginal/Little Confidence Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort. Changes to the offeror’s existing processes may be necessary in order to achieve contract requirements.

Unsatisfactory/No Confidence Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.

G. Offerors with no relevant present or past performance history shall receive the rating of “Neutral/Unknown Confidence”, meaning the rating is treated neither favorably nor unfavorable.

H. If the lowest priced evaluated offer is judged to have an exceptional performance risk rating, that offer represents the best value for the Government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers. The Government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receive an exceptional past performance risk rating.

I. The Government reserves the right to award a contract to other than the lowest priced offer if that offeror is judged to have a performance confidence assessment rating of “very good” or lower. In that event, the Contracting Officer shall make an integrated assessment best value award decision.

J. Offerors are cautioned to submit sufficient information and in the format specified in the proposal instructions.

Offeror’s may be asked to clarify certain aspects of their proposal, (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Communication conducted to resolve minor or clerical errors would not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for proposals revisions.

K. The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.

FACTOR 2-PRICE REASONABLENESS

a. For the purpose of selecting the successful offeror, Past Performance is considered significantly more important then Price. While Price will not be evaluated in terms of acceptable/unacceptable or assigned a confidence rating, as is Past Performance criteria, it will be evaluated in terms of fairness, reasonableness, and realism.

b. This criteria evaluates the overall price to the government and determines if the proposed price is fair and reasonable. To determine price, each unit price listed in the CSL Listing will be multiplied by the quantity to get an extended amount. The extended amounts will be totaled for an annual price.

c. In addition to the total proposed annual price, the Non-Priced Item (NPI) charge will also be evaluated. It will be multiplied by the estimated annual number of non-priced items (1,000) to arrive at the total evaluated annual NPI charge. The total annual NPI charge will be added to the annual price from the CSL to arrive at the total evaluated annual price. This process is only for price evaluation purposes and does not commit the government to ordering this number of NPI’s.

d. Prices for all options will be similarly calculated using the CSL prices and NPI charge and added together for a total evaluated contract price.

e. Proposed total and unit prices will be evaluated to determine if prices are unreasonably high or low in relation to the government’s independent price estimate, obtained from merchants in the local area of Charleston SC on or about 1 March 2011.

f. One of the following techniques may be used to perform price analysis:

1. Comparison of proposed prices received in response to the solicitation.

2. Comparison of prior prices and contract prices with current proposed prices for the same or similar end items.

3. Comparison with competitive published price lists, published market prices of commodities, similar indexes, and discount or rebate arrangements.

4. Comparison of proposed prices with independent government cost estimates. Proposals unrealistically high or low in cost or price, when compared to the government estimate, may be deemed reflective of an inherent lack of understanding of risks of the solicitation and may result in proposal rejection.

g. Competitive Range – The government also reserves the right to limit, for purposes of efficiency, the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. If the contracting officer decides that an offeror’s proposal should no longer be included in the competitive range, the proposal shall be eliminated from consideration for award and written notice of the decision shall be provided to the unsuccessful offeror in accordance with FAR 15.503(a).

h. To maximize the government’s ability to obtain best value, based on the requirements and evaluation factors set forth in the solicitation, it may be necessary to conduct discussions. If discussions are necessary due to perceived weaknesses or other issues, which must be addressed before award, they will be conducted with only those offerors determined to be within the competitive range.
