Addendum to FAR 52.212-2 Evaluation—Commercial Items (Jan 1999)
(a) The government will award a contract resulting from this solicitation to the technically acceptable responsible offeror whose offer conforming to the solicitation offers the best value to the Government.
(b) Offers will be evaluated as follows:
A. Technical Acceptability: To be eligible for award, an offer must be technically acceptable and complete the Technical Acceptability Statement (Attachment 1 of this solicitation). The government will not consider award to an offer found to be technically unacceptable.
B. Price Evaluation: Technically acceptable offers will be evaluated as follows
(including Options):
(1) Prices will be evaluated for reasonableness. Reasonableness will be determined based on current market conditions and comparison with the Government’s estimate and prior acquisitions, as applicable. Prices will be evaluated to determine if they are unbalanced. The Government may determine that an offer is unacceptable if the prices are unbalanced.
(2) An offeror’s prices will be verified by multiplying the quantities identified in the schedule of Supplies/Services by the proposed fixed-unit price for each CLIN and/or Sub Line Item Number (SLIN), to confirm the extended amount for each price. The extended amounts shown for each CLIN or SLIN, inclusive of options, are then totaled to confirm the total price. Unrealistically low (or high) prices submitted, either initially or subsequently, may be grounds for rejecting the offer. Evaluation of options shall not obligate the government to exercise the option(s).
C. Award: A written notice of award or acceptance of an offer, mailed or otherwise furnished within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

1.0. BASIC SERVICES Provide technical, administrative, and supervisory expertise in safeguarding the scientific integrity of the JBSA’s Breath Alcohol Testing Program and assuring its acceptability for evidential purposes.
1.1. SPECIFICATIONS AND DESCRIPTION OF WORK
The contractor shall furnish all parts, labor, materials, tools, equipment, supervision and transportation necessary to perform Breath Alcohol Testing Program Technical Supervisory Services (herein referred to as Technical
Supervisory Services) at JBSA locations – Joint Base Randolph, Joint Base Lackland, and Joint Base Sam Houston.
Services shall include but are not limited to:
1.1.1. Monthly Maintenance
The contractor shall perform monthly maintenance and inspection services of JBSA Intoxilyzer 5000 instruments at locations listed in Appendix A of this SOW (in accordance with manufacturer’s guidelines, certification, and approval requirements of the Scientific Director of the Texas Department of Public Safety) and other procedures necessary to maintain the scientific integrity and reliability of the instruments and JBSA’s Breath Alcohol Testing Program. Maintenance shall include each Intoxilyzer 5000 instrument, its reference sample device(s), and other accessories, as applicable. (The UPS/line conditioner unit, printers, and print cartridges are not included as service items under this requirement. The contractor will notify the government when replacements are required and may make recommendations on the suggested replacement models. The government will be responsible for purchase of the replacement models and supplies.)
1.1.2. Unscheduled Maintenance, Major Maintenance, and Repair The contractor shall provide unscheduled maintenance, major maintenance, and/or repair of all Intoxilyzer instruments, reference sample devices, or other accessories or component parts, as necessary, to maintain the scientific integrity and reliability of the instruments and JBSA’s Breath Alcohol Testing Program. The contractor will acknowledge unscheduled maintenance or repair calls within one (1) hour of notification and initiate services within a 24 hour timeframe after acknowledgement. The contractor shall furnish a written cost estimate and an anticipated repair timeframe to the designated government representative upon inspection of the instrument(s), sample devices, and/or accessories. When required, major repairs may be conducted outside the operational locations. (The UPS/line conditioner unit, printers, and print cartridges are not included as service items under this requirement. The contractor will notify the government when replacements are required and may make recommendations on the suggested replacement models. The government will be responsible for purchase of the replacement models and supplies.)
1.1.3 Replacement Parts
The contractor shall furnish all replacement parts needed to repair instruments and equipment. Upon completion, all repair parts costs will be reimbursed to the Contractor via monthly contract payments based on approved invoices.
Parts purchased for repairs and maintenance shall be of equal or greater quality to the parts replaced. The Contractor shall purchase parts at the lowest price obtainable after securing reasonable competition for such purchases. The Contractor’s invoice shall reflect all discounts and rebates received for the purchased parts, as applicable.
1.1.4. Cost Estimates
The Contractor shall furnish a written cost estimate for approval to the designated government representative and the Contracting Officer on any repair exceeding $500.00 (to include material and labor costs). Upon approval of the estimate, the Contractor shall ensure that the repair is completed satisfactorily. Upon inspection, if the contractor determines equipment is beyond economical repair, they shall, in coordination with the designated customer, recommend to the CO, in writing, that such equipment be replaced. The Contractor shall include substantiating data to support the recommended replacement. The Contractor shall return equipment no longer used to the Government.
1.1.5 Supplies
During monthly maintenance visits, the contractor shall provide each installation with a minimum supply of 50 mouthpieces per location and one spare reference device solution per location.
Locks/Keys shall be maintained as follows:
Throughout the contract, the contractor will provide 1 key per each operator.
At the beginning of the contract performance period, each installation POC and the contractor will conduct an inventory to determine the current number of keys issued to each site and match that number to the list of active operators. A reconciliation will be conducted to achieve an accurate starting inventory. For the remainder of the contract performance period, inventories and accountability will be maintained through a cooperative effort between the contractor and installation POC’s. The installation POC’s will insure that keys are collected and returned to the contractor upon departure of assigned technicians.
Locks and keys will remain the property of the contractor.
1.1.6. Technical Support
The Contractor shall be available to provide technical support (telephone; remote computer; or physical inspection, as required) 24 hours a day, seven days a week for operational assistance for the Intoxilyzer 5000 instruments.
1.1.7. Education/Training
The contractor shall provide Breath Alcohol Testing Operator Annual Certification Training and materials to all assigned JBSA operators annually, at dates to be determined through coordination between the installation POC’s and the contractor. The contractor shall also provide Breath Alcohol Testing Operator Initial Certification training and materials to new operators, as assigned, to include hands-on demonstration of the Intoxilyzer instrument’s operation. All education, training, demonstration, and certification of Intoxilyzer instrument operation and theory shall be provided in accordance with Texas Department of Public Safety requirements. The contractor will be responsible for making all training arrangements. Each installation POC will provide the contractor with a list of operators requiring training or certification no less than one (1) week of the scheduled training sessions. Upon completion, all training costs will be reimbursed to the Contractor via monthly contract payments based on approved itemized invoices.
1.1.8. Consultation/Expert Testimony
The contractor shall provide consultation, opinions, statements, in-court testimony, and depositions, as required by the government. These services will be provided by direct expert testimony or by written affidavit, at the discretion of the government, concerning all aspects of breath alcohol testing at JBSA for the prosecution of cases involving the use of the Intoxilyzer 5000 instrument(s). The contractor shall be responsible for all travel costs associated with testifying in local military or federal court. All costs for services required outside of Bexar County will be negotiated in advance by the government and contractor.
1.1.9. Reporting Requirements
The Technical Supervisor shall serve as a records custodian for all records pertaining to the instruments; as well as, all records relating to the functioning of the instruments; to include but not limited to, maintenance, testing, calibration, and operation of the instruments. A completed set of all reports generated during the contract performance period will be delivered to the Staff Judge Advocate office at each installation upon expiration of the contract and, as requested by them, during the contract performance period.
1.2. CONTRACTOR CERTIFICATION
The Contractor shall obtain and maintain all required education, training, and certification from the Texas Department of Public Safety necessary to be qualified as a Technical Supervisor. This includes the requirement for remaining current on All Technical Supervisor training and certification at all times, without lapse. The contractor shall present certification documentation to the government, upon request.
2.0. GOVERNMENT FURNISHED EQUIPMENT AND SERVICES
The government shall provide, without cost, the equipment, facilities, and services listed below:
2.1. Equipment
Breath Alcohol Test instruments, approved by the Office of the Scientific Director, Texas Department of Public Safety (DPS) (Intoxilyzer 5000EN, manufactured by CMI). (See Appendix A for detail per installation.)
Reference Sample Devices/simulators, approved by the Office of the Scientific Director, Texas DPS (34C, manufactured by Guth Laboratories). (See Appendix A for detail per installation.)
Intoxilyzer cabinet (manufactured for Texas DPS)
Line Conditioners (manufactured by American Power Conversion)
Printers (various manufacturers)
2.2. Utilities/Facilities. All water and electricity support required for this requirement. Restroom facilities will also be available.
2.3. Police, Fire, and Emergency Services The government will provide Security Forces Services (Desk Sergeant, or 911 Emergency), Fire Protection services, 911, and emergency medical treatment during performance of the contract. In the event of a medical emergency, base ambulance service for transporting an injured employee to a local hospital is available on a cost reimbursement basis. Contractor shall be prepared to complete necessary documentation and reimburse the government for the cost of emergency medical treatment, as required.
2.4. Government Representative
Upon contract award, the government will assign government representatives at each JBSA location who coordinate with the contractor on all services required under the contract. The designated representatives will also be responsible for final acceptance and approval of the contractor’s provided services, parts approval, and monthly invoices. All contractual matters or changes to this statement of work shall be approved by the Contracting Officer.
3.0 GENERAL INFORMATION
3.1. Contract Manager The contractor shall designate a contract manager and alternates who shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager alternate(s) shall have the authority to act for the contractor when the contract manager is absent. The names and contact information for these individuals shall be designated, in writing, to the contracting officer upon contract award and prior to commencement of services. The contractor shall provide telephone numbers for the contract manager and alternate(s) upon contract award. The contract manager and Technical Supervisor may be the same individual.
3.2. Duty Hours Services will be completed during normal business hours between 8:00 a.m.
and 5:00 p.m. local time, Monday thru Friday, excluding Federal holidays and AETC Family Days, unless necessitated by unscheduled maintenance or repairs.
3.3. Federal Holidays New Year's Day, Martin Luther King Jr's Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day. Holidays falling on a Saturday will be observed on the preceding Friday. Holidays falling on a Sunday will be observed on the following Monday.
With exception to unscheduled maintenance or repairs, the contractor shall not work on a government holiday without the approval of the Contracting Officer.
3.4. AETC Family Days The government may designate a weekday as an AETC Family Day.
The government designates family days prior to the beginning of each fiscal year. This may result in the closure of buildings on the installation, negating the need for Contractor services on such days. All family days are subject to change based on mission requirements. Projected AETC 2012 Family Days are 24 Dec 12, and 31 Dec 12. AETC family days for future years will be provided at the beginning of each fiscal year. With exception to unscheduled maintenance or repairs, the contractor shall not work on an AETC Family Day without the approval of the Contracting Officer.
3.5. Illegal Drugs and Personal Weapons
Illegal drugs and personal weapons are not authorized at any time on JBSA installations. If illegal drugs and/or personal weapons are found in an employee’s possession while on the installations, that individual will be reported to Security Forces; their access pass will be revoked; and they will be escorted off of the installation.
State-issued concealed weapons permits do not apply on Federal installations.
3.6. Installation Entrance and Driving Policies
3.6.1. Commercial Vehicles
Joint Base Randolph - All vehicles with more than two (2) axles or vehicles with company logo must enter and depart the base through South Gate. South Gate can be accessed via Lower Seguin Road. South Gate is open Monday through Friday from 0600 to 0830 hrs for inbound traffic only. After 0830, South Gate is open to both inbound and outbound traffic until 1800.
Joint Base Sam Houston - All vehicles with more than two (2) axles or vehicles with company logo must enter and depart the base through Jadwin Gate. Jadwin Gate can be accessed from IH35 at Coliseum Rd. Jadwin Gate is open Monday through Friday from 0600 to 1800.
Joint Base Lackland - All vehicles with more than two (2) axles or vehicles with company logo must enter and depart the base through Growden Gate. Growden Gate can be accessed from Hwy 90 at 36th Street. Growden Gate is open Monday through Friday 24 hours a day, 7 days a week.
Contractor shall anticipate one (1) to two (2) hour delays for trucks at the Commercial Vehicle Gates due to vehicle inspection requirements.
3.6.2. Contractor Privately Owned Vehicles (POVs)
Contractor POVs with no more than two (2) axles may access the installation from any gate that is open and/or convenient. The Main Gate of each installation is open to inbound and outbound traffic 24-hours a day, seven days a week, except for temporary security event closures. Please consult with installation representative or the Security Forces for the schedules of other POV access gates.
Any POVs deemed unsafe by Security Forces or with expired stickers and/or paperwork will not be granted access to the installation.
3.6.3. Random Base Entry/Exit Check Points
The Installation Commander authorizes random base entry and exit point checks. Refusal to submit to these checks can result in loss of base driving privileges and debarment from the installation.
3.6.4. Driving on Joint Base San Antonio
Contractor and sub-contractor employees shall comply with the Texas Department of Public Safety and traffic codes at each installation. Speed limits on each installation vary from 25 - 30 mph unless otherwise posted. Speed limit in all housing areas is 15 mph or less. Speed limit in all service drives and parking lots is 5 mph.
Electronic detection devices are used for measuring speed on each installation. Contractors and their employees are cautioned to obey all speed laws, parking regulations and traffic control devices. Failure to do so can result in loss of driving privileges and debarment.
POVs are prohibited from driving on the flightline, taxiways and aircraft parking areas, except when specific permission has been granted by Airfield Management.
All personnel operating or riding in a privately owned, government or contractor vehicles are required to wear seat belts on JBSA. Employees will not ride upon any part of a vehicle not intended for carrying a passenger nor will they ride in or upon truck or trailer beds.
Use of cell phones while driving on base is prohibited, unless the device is hands free.

Inform Security Forces if an ambulance is needed and they will dispatch one. In minor accidents, if the vehicles create a traffic hazard, they may be moved off the roadway away from the flow of oncoming traffic.
Contractors and their employees shall comply with base traffic regulations.
3.7 Protection of Contractor Property
Security Forces patrols will periodically check Contractor equipment. This service is a courtesy, but the government is not responsible for lost or stolen property. Contractor shall secure all property during lunch and at close of work daily. No private security guards will be permitted.
Direct questions to the installation government representatives listed in Appendix A - Intoxilyzer Instruments by Location. Report thefts or vandalism to the Desk Sergeant at the phone numbers listed in paragraph 3.6.4. Instruments will remain locked when not in use.
3.8 Installation Exercises
JBSA conducts regular exercises to ensure readiness in the event there is a terrorist attack or natural disaster. Contractor shall be prepared to participate in exercises if required. Participation may include stopping work, denied access to the base, moving vehicles away from buildings or participating in stringent identification and/or vehicle inspection. Contractor shall participate as required at no additional cost to the government.
3.9. Safety
Contractors and their employees shall provide a safe and healthful workplace for employees while performing contract work. Contractor accidents involving injury to Air Force personnel or damage to government property shall be reported to the Contracting Officer, the 502 ABW Ground Safety Office at (210) 652-1842, and any provision outlined in the Federal Acquisition Regulation (FAR) Clause 52.236-13, Accident Reporting.
Contractor and their employees are subject to no-notice inspections by the Occupational Safety and Health Act (OSHA) Programs and Department of Labor inspectors. Contractor and their employees shall comply with applicable guidance set forth by law. These include but are not limited to:

3.10. Contractor Manpower Reporting
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Intoxilyzer Maintenance and Training via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.
Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October* of each calendar year. Contractors may direct questions to the CMRA help desk.
