This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a separate Request for Proposal (RFP) will not be issued. The purchase request number is F2MTR20037AW01 and is issued as a Request for Quotation (RFQ). This combined synopsis/solicitation incorporates provisions and clauses are those in effect through Federal Acquisition Circular 2019-06 and DFARS change notice 20190820. The purchase is restricted to Small Business concerns. This NAICS code is 339920 and the size standard is 750 employees. This is a requirement for Mobility Kits to support the Special Warfare students attending a specialized preparation course that involves soft tissue maintenance to enhance physical injury recovery and maximize field performance.
In order to be considered timely, please respond by emailing RFQ’s to Lance Watters, lance.watters.1@us.af.mil, no later than Friday, 8 April 2020, at 12:00 PM (CST), or sooner if possible. Any and all questions will be due by Wednesday, 2 April 2020, 12:00PM (CST). Any quote, modification, revision, or withdrawal of a quote received after the exact time specified in this solicitation shall be determined as late and will not be considered unless received before award is made. The Contracting Officer will determine if accepting the late quote would not unduly delay the acquisition, and it was the only quote received. The contractor must submit a spec sheet and picture with their quote.

Special Notes and Instructions:
1. This is a notice that this order is a total set-aside for small business concerns. Only quotes submitted by small business concerns holding NAICS Code 339920 and the size standard of 750 employees will be accepted by the Government.
2. Basis for Award. 502 CONS/JBKAE will issue a purchase order to the vendor who is determined to offer the best value to the Government. Failure to acknowledge Amendments may result in your quote not being considered for award. Contract type shall be Firm Fixed Price
(FFP).
3. Best Value Determination. The Offeror who is deemed responsible and responsive with the Lowest Priced, Technically Acceptable (LPTA) quote will be determined to represent the best value. Technical acceptability will be determined by an evaluation of the quoted requirements that meets the technical criteria contained in the solicited requirements. Quotes initially will be ranked from lowest to highest based on total cost. The Government will then evaluate the three lowest priced quotes for Technical Acceptability. However, the Government reserves the right to evaluate additional quotes for technical acceptability if deemed to be in the best interest of the Government. If additional quotes are evaluated for technical acceptability, they will be evaluated in the order of total cost. Award will be made to the responsible vendor whose quote is the lowest evaluated price among technically acceptable quotes.
4. Interchanges. The government intends to award a purchase order without interchanges with interested vendors/contractors. The government however, reserves the right to conduct interchanges if deemed in its best interest. Under appropriate circumstances, interchanges can be an effective method to improve the Government's evaluation of Offeror’s quoted approaches and may reduce acquisition cycle time. Interchanges may be written, email, phone call, etc., or any method which would accurately capture the contemporaneous sharing of information between the Government and the Offeror’s. Interchanges may also be oral conversations between the Government and the Offeror’s.
5. Mandatory Registrations. To be eligible for award, registration with the System for Award Management (SAM) must be current (legacy for On-line Registration and Certifications Application (ORCA) and Central Contractor Registration (CCR) registrations). To register or

6. Brand Name or Equal. When using an “Equal product” to substitute the requested brand name product, the contractor must include the following: (1) MFG name, (2) Part Number, (3) illustrations, and (4) product description to support equal product substitution in your RFQ submission. Details of the requesting product to fulfill requirement must be met. See Product description (IAW Product Description, Table 1, Attachment 1).
7. Notice to Offeror. The Government reserves the right to cancel this Request for Quotes (RFQ), either before or after suspense date. In the event the Government cancels this RFQ, the Government has no obligation to reimburse an offeror for any costs. The contractor shall not request, nor will the Government make, payments for any preliminary measurement, quotes, bids, site visit, time or proposal cost incurred.
8. Delivery/Assembly. All delivery, sporting equipment shall be inserted into and well organized in the frameless backpacks which shall include the list of equipment (IAW Product Description, Table 1, Attachment 1).
9. Salient characteristics. Equivalent offers must meet the product description (Attachment 1) to be considered an equivalent. Failure to meet the product description will render the quote as unacceptable.

The following paragraphs have been deleted: 52.212-1(h), Multiple Awards 52.212-1(i), Availability of Requirements Documents Cited in the Quote
(a) Paragraph 52.212-1(c), Period for Acceptance of Quotes, is tailored as follows: "The offeror agrees to hold the prices in its quote firm for 30 calendar days from the date specified for receipt of quotes."
(b) The following is inserted as new paragraph (m) of the provision: (m) Quote Preparation Instructions.
A. To assure timely and equitable evaluation of quote, offeror must follow the instructions contained herein.
Offerors are required to meet all quote requirements, including terms and conditions, and technical requirements, in addition to those identified as evaluation factors. Offeror must clearly identify any exception to the quote terms and conditions and provide complete accompanying rationale.
B. Specific Instructions:

FAR 52.212-2 EVALUATION - COMMERICIAL ITEMS ADDENDUM
Addendum to 52.212-2(a): Paragraph (a) is tailored as follows:
(a) Basis for Award. The Government intends to award one Firm Fixed Price contract for this acquisition.
Award will be made to technically acceptable Offeror who is deemed responsible in accordance with FAR
9.104 and whose quote conforms to the solicitation requirements. It is the Government's intent to evaluate quotes and award without interchanges with Offerors. Therefore, the Offeror's initial quotes should contain the Offeror's best terms from a price, and technical standpoint. However, the Government reserves the right to conduct interchanges if the Contracting Officer (CO) later determines them to be necessary.
1.0 Evaluation Process. The evaluation factor and process to be used is listed below.
Price
1.1.2 Price Evaluation. Evaluations will be completed by multiplying the Offeror's unit price by the estimated quantity. An offeror's proposed Total Evaluated Price will be determined by multiplying the estimated quantities identified in the Schedule of Supplies by the quoted unit price for each Line Item Number (CLIN). Government may require submission of information other than cost or pricing data to the extent necessary to evaluate price reasonableness.
Technical Acceptability1.1.1 Technical Evaluation. The three lowest quotes will be evaluated for Technical Acceptability, however if no offer is found technically acceptable. The Contracting Officer (CO) reserve the right to request technical evaluation for the next 3 offers. (A) Acceptability Ratings. The evaluation factors listed below will be used to evaluate each quote and will receive one of the following ratings:
(i) Acceptable - The quote clearly meets the minimum requirements of the as listed in the attached Product Description (Attachment 1).
(ii) Unacceptable - The quote does not clearly meet the minimum requirements of this quote and its attachments.
1.1.2.2 Interchanges. Under appropriate circumstances, interchanges can be an effective method to improve the Government's evaluation of Offerors' quoted approaches and may reduce acquisition cycle time. Interchanges may be written, email, phone call, etc., or any method which would accurately capture the contemporaneous sharing of information between the Government and the Offerors. (A) Factor # 1 - Submit product descriptions for each item being quoted The offeror shall submit product specifications that match the SOW, Statement of Work Attachment 1 and characteristics outlined in Technical Specifications, Attachment 2.

52.225-18 Place of Manufacture (Aug 2018) As prescribed in 25.1101(f)(, insert the following solicitation provision:
(a) Definitions. As used in this provision--
(a) Definitions. As used in this clause- "Commercially available off-the-shelf (COTS) item"-
(1) Means any item of supply (including construction material) that is-
(i)A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C.40102(4), such as agricultural products and petroleum products. "Component" means an article, material, or supply incorporated directly into an end product.
"Cost of components" means-
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the end product (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable http://www.acquisition.gov/ overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the end product.
"Domestic end product" means-
(1) An unmanufactured end product mined or produced in the United States; (2)An end product manufactured in the United States, if-
(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind as those that the agency determines are not mined, produced, or manufactured in sufficient and reasonably available commercial quantities of a satisfactory quality are treated as domestic. Scrap generated, collected, and prepared for processing in the United States is considered domestic; or
(ii) The end product is a COTS item.
"End product" means those articles, materials, and supplies to be acquired under the contract for public use.
"Foreign end product" means an end product other than a domestic end product.
"United States" means the 50 States, the District of Columbia, and outlying areas.
(b) 41 U.S.C. chapter 83, Buy American, provides a preference for domestic end products for supplies acquired for use in the United States. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for an end product that is a COTS item (See 12.505(a)(1)).
(c) Offerors may obtain from the Contracting Officer a list of foreign articles that the Contracting Officer will treat as domestic for this contract.
(d) The Contractor shall deliver only domestic end products except to the extent that it specified delivery of foreign end products in the provision of the solicitation entitled "Buy American Certificate."
"Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except-
(1) FPSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;

252.203-7999 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN
INTERNAL CONFIDENTIALITY AGREEMENTS (DEVIATION 2015-O0010) (FEB 2015)
(a) The Contractor shall not require employees or subcontractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contactors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(b) The Contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect.
(c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d)(1) In accordance with section 743 of Division E, Title VIII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015, (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause.
(2) The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.

"(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

5352.242-9000 Contractor Access to Air Force Installations 11/1/2012
"(a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation. (b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or Security Forces for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver’s license, current vehicle registration, valid vehicle insurance certificate, and <<1>> to obtain a vehicle pass. (c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site. (d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with <<2>> citing the appropriate paragraphs as applicable. (e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office. 5352.242-9001 Common Access Cards (CAC) for Contractor Personnel 11/1/2012
"(a) For installation(s)/location(s) cited in the contract, contractors shall ensure Common Access Cards (CACs) are obtained by all contract or subcontract personnel who meet one or both of the following criteria:
(1) Require logical access to Department of Defense computer networks and systems in either:
(i) the unclassified environment; or
(ii) the classified environment where authorized by governing security directives.
(2) Perform work which requires the use of a CAC for installation entry control or physical access to facilities and buildings.
(b) Contractors and their personnel shall use the following procedures to obtain CACs:
(1) Contractors shall provide a listing of personnel who require a CAC to the contracting officer. The government will provide the contractor instruction on how to complete the Contractor Verification System (CVS) application and then notify the contractor when approved.
(2) Contractor personnel shall obtain a CAC from the nearest Real Time Automated Personnel Identification Documentation System (RAPIDS) Issuing Facility (typically the local Military Personnel Flight (MPF)).
(c) While visiting or performing work on installation(s)/location(s), contractor personnel shall wear or prominently display the CAC as required by the governing local policy.
(d) During the performance period of the contract, the contractor shall:
(1) Within 7 working days of any changes to the listing of the contract personnel authorized a CAC, provide an updated listing to the contracting officer who will provide the updated listing to the authorizing government official;
(2) Return CACs in accordance with local policy/directives within 7 working days of a change in status for Contractor personnel who no longer require logical or physical access;
(3) Return CACs in accordance with local policy/directives within 7 working days following a CACs expiration date; and
(4) Report lost or stolen CACs in accordance with local policy/directives.
(e) Within 7 working days following completion/termination of the contract, the contractor shall return all CACs issued to their personnel to the issuing office or the location specified by local policy/directives.
(f) Failure to comply with these requirements may result in withholding of final payment."
