Single Source Justification (Simplified Acquisition)

Section A: General Contract Information
Contracting Activity: 502d Contracting Squadron, 1655 Selfridge Ave, JBSA Lackland, TX 78236
Project/Program Name: BeaverFit Training Locker
Purchase Request/Identification Number: F2MTRAH8040AW02
Estimated Contract Cost (including Options):
Section B: Description of the Supplies/Services Required
This is a Brand Name acquisition for one (1) BeaverFit Training Locker and one (1) requirement for BeaverFit's TurfX flooring.
This will be a firm fixed price contract with a delivery date 45 days after award.
Section C: Justification for Soliciting from a Single Source or Brand Name
502 Force Support Squadron (502 FSS) and JBSA Fitness Branch have a requirement to provide an additional portable fitness containers at FSH METC FC. Although there are similar brands on the market, BeaverFit Training Lockers are custom fabricated to store necessary equipment used to support world class, multi-modality training centers. JBSA METC has a 40' container size requirement w/a 12' rope climb tower incorporated into the container. BeaverFit is the only manufacturer that offers this feature in all 3 of the 10', 20' and 40' locker. BeaverFit Training Lockers are an industry leader with a government established business reputation with multiple installs to every branch of service across DoD and have a NATO Air Portability Certification to ensure safe/ secure mobility and transport. BeaverFit Training Lockers have a four Step Waterproofing process that other Training Lockers do not have. In order to attach a functional training rig to a shipping container, holes must be drilled in the container, which can allow water to leak into the shipping container. BeaverFit utilizes a proprietary unique process to attach brackets to the outside of the container and then applies waterproof sealing around the brackets. Functional training rigs are then attached to the brackets and the container remains waterproof.
BeaverFit is the original inventor of Training Lockers and has NATO Air Portability Certification, Manual adjustable leg height, Rope Climb Tower, Cargo Net tower option, Breaching door/forced entry option, airborne static line/mock door option, and folding/ collapsible rock option that other training lockers do not have. Lastly, in order to maintain brand consistency of previously purchased BeaverFit Training Lockers, JBSA fitness centers requires an additional purchase of the same BeaverFit Training lockers.
Based on the above characteristics the BeaverFit Training Lockers are essential to the Government's requirements. thereby precluding consideration of a product manufactured by another company.
Section D: Efforts to Obtain Competition
502 CONS posted a Sources Sought notice was on General Service Administration (GSA) for 5-days which resulted in three responses.
1. The response from ADS Inc., a small business, indicated it could supply both BeaverFit lockers.
2. The response from Fitness Anywhere LLC, a small business, indicated it could supply an equal product, the TRX Tactical Training Locker. This brand does not meet NATO Air Portability Standards.
3. Tactical Fitness GSA, a small business, indicated they could provide an equal product, TRX Training Fitness brand equipment. This brand does not meet NATO Air Portability Standards.
4. W.S. Darley & Company, a small business, submitted the Mobile Fitness Unit as an equal product. This product does not meet two or more salient characteristics.
It was brought to our attention from the manufacturer that the BeaverFit 40' training locker is not offered under any GSA schedule.
In addition, research conducted by 502 CONS also indicated that the 40' locker was not available via GSA Advantage. Therefore, 502 CONS posted a Sources Sought notice in the Government's Point of Entry (Federal Business Opportunities, FBO) for 7-days inquiring if there was an equivalent item offered in the current market place. There were no interested contractors with the capability of offering an equivalent item. However, the Government did receive one response form BeaverFit North America, which

20 Apr 2017 Page 2 of 2 is a small business, indicating they could supply the BeaverFit Lockers (brand name). BeaverFit, the manufacturer, indicated that ADS Inc is also a small business with the capability of providing the BeaverFit 40' locker, among other small businesses. 502 CONS research ADS Inc. and concurred they are in fact a small business under NAICS code 339920.
Lastly, a small business dynamic business search was conducted using NAICS code 339920 and the keyword “Tactical Equipment” revealed 12 vendors. Based on the capabilities statement, only 2 vendors could meet the requirement. Using the NAICS code 339920 and the keywords “Training Locker” returned no results.
It is concluded from the market research conducted that there are at least two (2) small businesses with the ability to offer competitive, fair market prices. It is determined that the requirement be set aside for small businesses via FBO.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
For future procurements, 502 FSS and the Fitness Centers will continue to seek alternative measures to determine potential future sources that will meet the required standards in order to permit competition. However, at this time it is in the Government's best interest to proceed with a brand name acquisition.I
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
