PERFORMANCE WORK STATEMENT

FOR

INTEGRATED SOLID WASTE/RECYCLING COLLECTION AND DISPOSAL

11th Civil Engineer Squadron/CEOES

JOINT BASE ANDREWS MD 20762-5000

CHAPTER 1

DESCRIPTION OF SERVICES/GENERAL INFORMATION

1.1. DESCRIPTION OF SERVICES. The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and services necessary to perform non-hazardous integrated solid waste, recycling collection, and tube television/monitor transportation and disposal services, recycling yard operation, and management on Joint Base Andrews (JBA), Brandywine, and Davidsonville Communication Sites. Performance shall be in accordance with all applicable laws, standards, instructions, executive orders, commercial practices, and requirements contained in this Performance Work Statement (PWS).

1.2. INTEGRATED SOLID WASTE/RECYCLING COLLECTION

1.2.1. JBA, BRANDYWINE, AND DAVIDSONVILLE INTEGRATED SOLID WASTE AND RECYCLING COLLECTION. The contractor shall provide equipment, materials, labor, and management to collect and dispose of non-hazardous integrated solid waste (refuse) and interior/exterior recycling in accordance with this PWS. The contractor shall empty waste and recycling containers prior to their capacity being exceeded and maintain them in a sanitary manner, free of dirt, debris, odor and pests in accordance with local commercial practices, Environmental Safety and Occupational Health (ESOH) regulations, guidance provided at www.osha.gov, and AFI 91-203. Containers designated as food waste shall be emptied daily. The contractor shall be responsible for cleaning up any spills, debris, etc. after collecting refuse/recycling at all collection sites. The contractor shall pick up all litter and waste on the ground within a ten-foot radius of the refuse and exterior recycling containers during the collection. The contractor shall ensure that the gates of any fenced container enclosures are closed after each collection. The contractor shall supply new refuse containers in accordance with Appendix D of this performance work statement at the onset of the contract. The refuse containers are contractor provided equipment and shall be maintained in accordance with this performance work statement. Any additional recycling containers required in excess of the government provided containers listed in Appendix F shall be provided and maintained by the contractor in accordance with this performance work statement.

1.2.1.1. PUBLIC AND COMMON USED RECYCLING RECEPTACLES. The contractor shall empty, collect, and dispose of all recyclables and place liners in contractor or government furnished recycling receptacles located in public and common use areas.

1.2.2. POSITION. The contractor shall position bulk containers at collection stations to best aid the user in depositing refuse/recycling and encourage the user to recycle. To best aid the user, the containers shall to be repositioned from time to time. The contractor shall always position containers to minimize interference with adjacent parking areas, sidewalks, hallways, roadways, overhead utilities, trees, and other potential obstructions. If more than one container is positioned at one collection station, the contractor shall place containers close together for user convenience. The contractor shall contact and coordinate with the facility manager for placement/re-positioning of indoor recycling containers.

1.2.3. BULK PICK-UP. The contractor shall collect and recycle/dispose of over-sized items to include but not limited to furniture, mattresses, wood, metal and all NON-FREON containing appliances. When notification is made by the Contract Officer Representative (COR) or identified on collection days or drive-around the contractor has 24 hours to remove bulk items. The contractor shall pick up bulk items from base organizations and tenant units, which are placed at a specified location. contractor shall reserve one 30 yard roll off open top and one 8 cubic yard dumpster on contractor’s premises at all times for delivery to base organizations and tenants for bulk pick-ups. The COR will notify the contractor 24–48 hours in advance to schedule pick up. The contractor shall contact the Contracting Officer (CO) or COR if the bulk pick up consists of any questionable items (controlled items, hazardous materials and etc.). The contractor shall reserve the right to refuse pick up if this occurs.

1.2.4. BULK METAL RECYCLING. Occasionally, bulk metal recyclable materials will require a roll-off or flatbed trailer to collect metal recyclables at a location outside the recycle center; this should be accomplished with no additional cost to the government.

1.2.5. PERMANENT ROLL-OFFS. There shall be 20, 30, and 40 cubic yard roll-off containers that can be rolled onto a truck and taken to a disposal site, then returned to the original or repositioned at another site. Disposal of these containers shall be as indicated in the Refuse Collection Current Workload Estimate sheet. Their locations are specified on Appendix D and on the map in Appendix H.

1.2.6. JOINT SERVICE OPEN HOUSE AIR SHOW REFUSE/RECYCLING SERVICE. This event normally hosts 150,000 to 170,000 people and is supported by 100-125 food booths. The contractor shall provide an appropriate number of 95-gallon, COR approved, matching in color, refuse and recycling toters or containers with liners. The contractor shall supply liners for all containers for the duration of the event as well as large containers/compactors in a consolidated location for overall trash and recycling collection and disposal. The contractor shall deliver the refuse/recycling containers one day prior to the opening day of the event, and position in the early morning, prior to the event start time in locations as stated on a map provided by the COR. The contractor shall be prepared to start refuse/recycling collection and disposal no later than 9:00 A.M. on the day/days of the event. The contractor shall provide all refuse/recycling collection and disposal each day of the event to include litter pick up around toters, event area(s), and airfield spectator fence lines as well as refuse/recycling removal from the installation. The toters and containers must not exceed their capacity during the event and must be emptied and removed prior to the contractor’s departure on the final day of the event. The contractor shall be responsible for collection and disposal of all refuse/recycling each day of the event and ensure all containers are available and ready for the following day. Following the event termination, the contractor shall begin to thoroughly inspect all areas and remove any and all refuse/recycling within toters, containers, event areas, and entire fence line encompassing event area to include inside event hangars and around all hangars in event area. The contractor and COR shall inspect the entire event area and verify that all toters have been removed, and refuse/recycling has been collected and disposed of prior to the contractor’s departure. The contractor shall provide and use golf carts to collect refuse/recycling from toters due to large vehicles not being permitted on the flight line event area(s) once the events have started.

1.2.7. PAYMENT OF UNSCHEDULED/SPECIAL EVENTS

1.2.7.1. REFUSE SPECIAL/UNSCHEDULED EVENT. The contract includes 30 unscheduled or special events collections per year. Additional collections require contract modification. Unscheduled or special events refer to additional standard or open top (roll-off) dumpsters that are not included in Appendix D for regular service. Unscheduled events will be performed at the direction of the CO or COR. The following are special events that could possibly occur during each year.

NOTE 1: The Pride/Beautification Days conducted several times a year will result in abnormal quantities of refuse. This may result in (but is not limited to) twice a day pickup in various locations up to two weeks prior to inspection. The COR will notify the contractor of stations that will be affected.

1.2.7.2. RECYCLING SPECIAL/UNSCHEDULED EVENTS. In addition to the scheduled cardboard recycling collections, the CO or COR may require the contractor to make unscheduled collections. For unscheduled events, the contractor shall respond within one business day of notification from the CO/COR. For special events, the contractor shall also provide or re-position as directed (slotted) cardboard and (alley-cat) comingled recycling containers. These containers shall be placed in locations for a length of time designated by the COR. Contract price shall include 25 special events per year at no additional cost to the Government.

1.2.8. CONTRACTOR REFUSED COLLECTIONS. The contractor shall notify the COR by the end of the business day of the addresses that were not collected and the reasons why the collection was refused.

1.2.9. ROUTE PARAMETERS. The contractor shall establish routes so as to gain access to the base through the Pearl Harbor Gate. These gates are manned 24 hours a day. The collection schedule shall be established so collection operations shall be between the hours of 4:00 A.M. - 6:00 P.M. Monday through Saturday for refuse and 8:00 A.M. – 4:00 P.M. Monday through Friday for recycling. Collection operations outside these hours shall require prior approval of the CO or COR. Brandywine and Davidsonville have an access gate manned 24 hours a day. Access for refuse is from 7:00 A.M. – 4:00 P.M. as scheduled. The CO or COR will make the contractor aware of changes to gate access due to emergencies and changes in security procedures. The contractor shall adjust established routes to comply with these changes.

1.2.10. FOREIGN WASTE COLLECTION. The contractor shall collect and dispose of foreign waste from building 1900 every Tuesday between the hours of 6:30 A.M. – 9:00 A.M. The contractor shall be responsible for maintaining a ten-foot area around the container. The contractor shall notify the CO or the COR immediately upon visual sighting of any liquid spills or leaks surrounding and discarding from the container. The contractor shall follow all instructions, guidelines, laws and commercial practices. The contractor shall be responsible for disposing of the foreign waste at an authorized and certified off base facility. The contractor shall always notify the COR immediately upon visual sighting of any leaks around the container. The contractor is responsible for cleaning up any spills and/or debris caused by the contractor. The Government shall recoup any damages assessed against JBA due to the contractor’s failure to provide a container that is leak proof, sealed and locked at all times. The contractor and their personnel assigned to service building 1900 shall be USDA certified/approved to handle foreign waste and must maintain certification throughout the life of the contract. The contractor shall provide proof of certification to the CO and COR.

1.3. REFUSE/RECYCLING DISPOSAL

1.3.1. REFUSE DISPOSAL. No on-base disposal shall be available to the contractor. The contractor shall transport and dispose of all solid waste at a licensed off-base disposal site. Disposal shall be in accordance with (IAW) existing local, state, and Federal regulations. The contractor shall be responsible for all permits or fees associated with the use of off-base disposal locations, including all disposal fees. Disposal fees/dump fees will be reimbursed at cost once weight tickets and receipts are provided. The Government reserves the right to direct the contractor to use specific landfills in the service of this contract if it is found to be a financial benefit to the Government. The contractor is required to obtain a tip voucher with authorized signature and stamp during normal business hours before leaving JBA.

1.3.2. RECYCLING DISPOSAL. No on-base disposal shall be available to the contractor. The contractor shall transport or arrange for transport all recyclable materials to approved off-base recycling facilities in a timely manner. The contractor shall not allow recyclable materials to pile up or collect in the recycle yard.

1.3.3. UTILITY POLES DISPOSAL. The contractor shall pick-up; transport and dispose of approximately 25 wooden utility poles at a licensed off-base site. Disposal of the utility poles shall be in accordance with all existing local, state, and Federal rules, codes and regulations. The contractor shall be responsible for all permits or fees associated with the use of off-base disposal locations, including all disposal fees. Utility poles are treated with creosote.

1.3.4. WEIGHING OF VEHICLES. All vehicles utilized in the collection of refuse/recyclable materials shall be weighed on state certified vehicle scales at the landfill. The contractor shall submit monthly weight tickets to the COR. The contractor shall submit tonnage reports (weight ticket summary) and individual tickets to the COR no later than the 10th day of the following month. Copies of documents must be legible. Foreign waste tonnage must be clearly identified. Vehicles shall arrive at JBA empty and shall proceed directly to the landfill from JBA, Brandywine or Davidsonville.

1.3.5. VEHICLES ROUTES AND COLLECTION SCHEDULES. Routes and schedules shall be submitted to the CO and COR ten working days prior to start of contract performance. Any changes in routes/schedules shall be submitted to the CO and COR. The contractor shall immediately notify the COR of any conditions that may interrupt the schedule of performance such as delays due to security measures, exercises, vehicle breakdowns, containers blocked by parked vehicles, and unauthorized refuse.

1.4. RECYCLING CENTER

1.4.1. RECYCLING CENTER OPERATIONS. The contractor shall provide equipment, materials, labor, and supervision/management to operate the recycling yard in accordance with this PWS. The contractor will operate the recycling center between the hours of 7:30 A.M. and 4:00 P.M., Monday through Friday to allow base personnel to drop off recyclable materials. The center will accept recyclables listed in Appendix G. The contractor will provide oversight and guidance for customers dropping off materials and shall maintain, on location, the proper containers to accept recyclable materials (i.e., roll-offs for various metals). The contractor will maintain the recycle yard in a neat and orderly fashion, free of debris. The contractor shall process recyclable materials and remove them from JBA in a timely manner, keeping stockpile to a minimum. In the completion of these tasks, the contractor shall comply with all Federal, Department of Defense (DoD), Air Force, State and Local rules and regulations.

1.4.1.1. TUBE TELEVISION AND TUBE MONITOR COLLECTION AND DISPOSAL. The contractor shall collect and recycle/dispose of all tube televisions/tube monitors from building # 3350 The Recycle Yard. Disposal fees shall be reimbursed at cost as stated in paragraph 1.3.1.

1.4.1.2. RECYCLING CENTER MAINTENANCE. The contractor shall maintain the recycling center, to include building 3350, building 3351, and all surrounding areas within the perimeter fence line, ensuring it is free of any and all trash and debris. Grounds will be maintained in a visibly clean state at all times and all containers, equipment, and vehicles will be parked and arranged in a neat and orderly manner when not in use. The center must remain easily accessible to customers at all times during normal duty hours and containers shall be placed in such a manner as to encourage a smooth traffic flow. contractor shall not store excess dumpsters or inoperative equipment at JBA.

1.4.2. RECEIPT OF RECYCLABLE MATERIALS. Upon receipt of recyclable materials to the recycle center, the contractor shall visually inspect the container contents to verify that they are as described. The contractor shall maintain a log of all materials dropped off to include customer name, organization, phone number, and materials being dropped off.

1.4.3. RECEIPT OF OIL AS A RECYCLABLE MATERIAL. A government provided recyclable oil collection tank is located at the recycling center. The contractor shall maintain the area in a clean, neat and orderly fashion, free of spills and debris. The contractor will accept used oil for recycling from customers and then dispose of oil into this tank. The care and maintenance of this tank will be provided by the government to include pumping and hauling of tank contents.

1.5. REPORTS, MARKETING, AND REVENUES

1.5.1. REFUSE REPORT. The contractor shall submit tonnage reports to the COR on a monthly basis to include separate tonnage totals for solid waste, foreign waste, green waste, and construction and demolition (C&D) waste as well as the overall total.

1.5.2. RECYCLING REPORTS. By the 10th working day of each month, the contractor shall provide a monthly report to the COR detailing total tonnage of recyclables collected, tickets, materials collected and recycled by commodity, and gross proceeds from recyclable sales. Sales receipts from recyclables, if available, must accompany the reports.

1.5.33 MANAGEMENT/PLANNING/REPORTING SERVICES. The contractor shall provide the necessary supervisory oversight to ensure proper operation and administration of the Recycling Center, interior and exterior collections and disposal of recyclable materials IAW this PWS. The contractor shall provide an on-site Quality Control Lead Person (QALP) to supervise field operations, coordinate and act as a liaison between the contractor and COR. The contractor shall be capable of addressing and interpreting all aspects of environmental law and regulations, including the preparation and presentation of expert testimony if required. The contractor shall provide a monthly recycling report to the COR and the base Qualified Recycling Program (QRP) Manager no later than the 10th working day of the month. Reports shall show the total weight of each type of recyclable material collected and the gross proceeds received for recyclable sales per type of material.

1.5.4. MARKETING. The contractor shall advise and assist the base QRP manager in marketing and arranging for the sale of recyclable materials IAW the base QRP Business Plan, including transportation of recyclable commodities to the purchasers. A copy of the QRP Business Plan shall be provided at time of award.

1.5.5. REVENUES AND SALES RECEIPTS. All proceeds generated by sales will be returned to the Government. The contractor will assist the QRP Manager in coordinating with recyclable commodity vendors regarding sales, pickups, scheduling, and payment of proceeds. Checks shall be made payable to US Treasury, and mailed to:

Proceeds shall be received by the Government no later than the 15th day of the following month.

1.5.6. RECYCLING PROMOTION. With the COR, the contractor shall assist with verbal and written interaction with the customers to include distribution and/or posting of education and outreach materials as necessary during daily pickups. Annually, the contractor shall assist with the operation and promotion of several key events to include, at a minimum, Earth Day and America Recycles Day. The contractor will also participate in periodic meetings with base personnel to include the facility managers meetings and the quarterly P2/EMS Subcommittee Meetings. The COR will provide dates and times two weeks prior to these meetings.

1.5.7. TRANSITION PERIOD. The contractor shall provide a complete transition plan to ensure a smooth transition in the change of work effort. Contractor shall have no more than 15 days from the start of the contract performance period to transition the work effort. The plan shall be submitted to the CO as part of the proposal. The transition is two weeks from 01 October 2015 to 15 October 2015. The following shall be addressed: (a) the scope of the transition; (b) transition strategy; (c) timeline for completing the transition; and (d) governance for the transition. Additionally, a transition out plan will be required. The contractor shall submit a Phase-Out Plan for contract completion tasks when directed by the CO. The requirements for the plan will be detailed in a CO tasking letter. Phase out is at no additional cost to the government. At a minimum, it is anticipated that the following items will need to be addressed in the Plan: a. identification of all tasks required for complete contract transition or close-out; b. a schedule that identifies the recommended sequencing and duration of these transition/close-out tasks to include a joint inventory of all assets involving government and follow-on contractor personnel; and c. assist the government and follow-on contractor as required with planning and executing a smooth turnover to ensure minimal mission impact.

1.6. EQUIPMENT AND CONTAINER MAINTENANCE

1.6.1. REFUSE CONTAINER MAINTENANCE. Contractor furnished containers shall be maintained to ensure the containers are reasonably free of unpleasant odors, dirt, debris, and pests. All containers shall remain in serviceable condition and easily accessible to customers. The contractor shall perform all cleaning, painting, repair, and other maintenance tasks off base. The containers shall match the approved base color scheme of Tudor Brown. Containers shall have a permanently affixed or painted warning signs stating “Do Not Park Within 15 Feet”, No Smoking Signs, and the contractor’s Logo. These signs shall have distinctive lettering and be visible from a reasonable distance. Maintenance/cleaning for base containers will be performed as required but at least annually. Containers that hold food waste will be cleaned monthly and maintenance performed as required but at least semi-annually.

1.6.2. MINOR MAINTENANCE. Minor container maintenance shall include cleaning, adjusting, ordinary lubrications, tightening of nuts and bolts, tightening and replacing drain plugs, preventive maintenance and actions recommended by the equipment manufacturer.

1.6.3. MAJOR MAINTENANCE. Major container maintenance shall include repair of inoperable equipment, replacing components, parts, filters, handles, hinges, lids, doors, gaskets, etc.

1.6.4. REPLACEMENT PARTS. The contractor shall furnish all replacement parts.

1.6.5. JBA RECYCLING CONTAINER MAINTENANCE. Containers shall be maintained to ensure they are free of unpleasant odors, dirt, debris and pests. All containers shall remain in serviceable condition and easily accessible to customers.

1.7. CONTAINER RELOCATION

1.7.1. RELOCATION OF BULK AND ROLL-OFF CONTAINERS. The contractor shall be required to relocate bulk and roll-off containers from time to time at no additional cost to the Government. This shall be done at the direction of the CO or COR. The contractor shall pick up and deliver these containers within 24 hours after notification from the CO or COR.

1.8. CONTRACTOR REQUIREMENT

1.8.1. CONTRACTOR PERSONNEL. The contractor shall not employ persons for work on this contract, if such employees are identified to the contractor by the CO as a potential threat to health, safety, security, general wellbeing, or operational mission of the installation and its population. Vehicle operators and crew leaders must be able to communicate with base emergency personnel and shall be able to read, write, speak, and understand English. The contractor shall ensure that employees possess certifications and licenses required to perform the refuse/recycling services. Contractor personnel shall present a neat and professional appearance. This shall be accomplished by wearing distinctive clothing bearing the name of the company and by wearing appropriate badges that contain the company and employee name.

1.8.1.1. CONDUCT. The contractor shall be responsible for the actions of any of their employees working at any location as required by this contract. The contractor shall be responsible for the action of any of their subcontractors and their employees who are working on JBA.

1.8.2. CONTRACTOR POINT OF CONTACT (POC). The contractor shall identify to the COR the individual who will be the point of contact to support this service on behalf of the contractor during normal operating hours. The contractor shall provide the COR telephone number(s) where service calls and customer follow-up calls can be reported. The contractor shall also provide to the COR, the names and phone numbers of contractor POCs for after business hours including nights, weekends, and holidays. This information shall be kept updated by the contractor whenever personnel changes occur.

1.8.3. BASE PASSES. A base identification card / vehicle pass shall be obtained for all employees including any subcontractor. Upon contract award, the contactor shall submit a personnel listing on company letterhead to the COR requesting base entry. It is the intent of the Government that each employee has possession of his/her pass at all times while working on this contract. The contractor shall be responsible for the return of any pass when employment and / or the contract is terminated. Lost or stolen passes shall be reported immediately to the COR with a written follow up to the CO within 72 hours.

1.8.3.1 RESTRICTED AND CONTROLLED AREA ACCESS. The COR and contractor shall be responsible for getting all required restricted area badges. Contractor shall supply COR with all requested employee information within 2 days of request so that documents can be submitted to request access badges. Waiting for badges is not an excuse for substandard performance. Escorts can be provided by the base when given two working days’ notice until badges are obtained.

1.8.4. QUALITY CONTROL. The contractor shall submit a Quality Control Plan (QCP) within 15 days of contract award, outlining procedures to identify, prevent and ensure non-recurrence of defective services. Through implementation of the contractor’s Quality Control program and procedures, the Government shall receive quality services meeting the requirements of the contract.

1.8.4.1. CONTRACTOR’S QCP REQUIREMENTS. The plan shall provide procedures for an independent inspection program to cover tasks and services listed in the PWS. Independent meaning the inspector doing the quality control inspections does not perform the work and is not under direct supervision of personnel directly responsible for the work.

The plan shall include a requirement to ensure all submittals, reports, etc, required by the PWS are provided to the appropriate Government organization. The plan shall include: specifics as to the areas to be inspected on a scheduled and unscheduled basis; procedures for determining inspection schedules; procedures for submission of quality control inspection reports to the COR; and the organizational structure of the Quality Control office and how it relates to the rest of the contractor’s organization.

The plan shall provide a description of the methods to be used for identifying and preventing defects in the quality of service performed as well as the means to collect data that shows compliance with the performance thresholds listed in the Service Summary, Section 2.

Once the COR receives a complaint, he/she contacts the contractor’s QA in order to validate the complaint. The plan shall include procedures for a customer feedback program to collect customer input and address customer complaints.

The plan shall develop procedures covering key and badge control that includes the turn- in of issued keys and badges by personnel who no longer require access to locked areas or base entry, and control procedures for physical security of Government property.

1.8.5. NOTIFICATION OF ENVIRONMENTAL SPILLS. In the event that the contractor spills or releases any unpermitted substance or hazardous waste into the environment, the contractor shall immediately report the incident to the Fire Department, the CO, and the COR. The contractor shall be liable for the costs of clean up and remediation of any spills or the release of such substance into the environment that are caused by the contractor’s employees or equipment.

1.8.6. FOR OFFICIAL USE ONLY (FOUO). The contractor shall comply with DoD 5400-7-R, Chapter 4, DoD Freedom of Information Act (FOIA) Program requirements. This regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding FOUO material. A copy of DoD 5400-7-R will be provided to contractor upon contract award.

1.9. GENERAL INFORMATION.

1.9.1. HOURS OF OPERATION. The contractor shall perform the services required under this contract during the following hours: 4:00 A.M. - 6:00 P.M., Monday through Saturday excluding Federal holidays. Federal holidays include; New Year’s Day, Labor Day, Martin Luther King Day, Columbus Day, Presidents Day, Veterans Day, Memorial Day, Thanksgiving Day, Independence Day, and Christmas Day. If the scheduled refuse collection falls on a Federal holiday, the collection for that day shall be accomplished the next business day. Any holiday rescheduling shall be at no additional cost to the government and shall not be the basis for non-performance.

1.9.2. INCLEMENT WEATHER SCHEDULE. The contractor shall collect refuse/recycling during periods of inclement weather. In the case of severe weather, the CO or COR may authorize exceptions. When exceptions are granted, the contractor shall accomplish all collections for each day missed and make up missed collections within twenty-four (24) hours after the severe weather has terminated. In the event missed collections cannot be accomplished within 24 hours, the contractor shall submit a revised schedule to the COR. Rescheduled makeup collections shall not be a basis for a claim by the contractor for additional compensation and permission to defer other regularly scheduled collections.

1.9.3. SEVERE WEATHER PREPARATION. It is the responsibility of the contractor to secure containers to prevent severe storms, high wind, hurricanes, etc. from damaging buildings and so waste does not blow out.

1.9.4. PARTNERING AGREEMENT. Inherent within this PWS is a partnering agreement between the Government and the contractor to ensure joint cooperation and soundness by both parties in achieving mutually beneficial goals. When deemed necessary, the contractor agrees to meet with the CO, COR, or any other Government personnel concerning performance of this contract.

1.9.5. SECURITY REQUIREMENTS. All personnel employed by the contractor in the performance of this contract, or any representative of the contractor entering the government installation, shall abide by all security regulations of the installation. The contractor shall be responsible for the action of any of their subcontractors and their employees who are working on JBA. The contractor and subcontractor shall hire U.S. citizen(s) that are in possession of a valid State driver’s license and birth certificate. If the employee is not U.S. citizen, the contactor and/or subcontractor may hire non U.S. citizens if they are in possession of a Green Card, Social Security Card, Resident Card, Work Visa and State issued Identification Card. If driving on base a State issued driver’s license is required.

1.9.6. FEDERAL CRIMINAL HISTORY BACKGROUND CHECK. The contractor and all employees of the employed contractor requiring access to JBA shall go to any local police department to be finger printed. The contractor shall be responsible for all cost associated with the fingerprinting. The contractor shall enter 00625G in the space labeled ORI on the back of the blue card. The contractor shall take the cards to the Criminal Justice Information Services in Pikesville, Maryland. The addresses below are provided to assist the contractor with obtaining information for the required fingerprinting.

1.9.7. WEAPONS. Weapons of any sort are not authorized on JBA, this includes guns, knives, swords, nunchucks, brass knuckles, or any other weapon that has a sole purpose to injure or maim. Combination tools such as Leatherman and small pocket knives with folding blades less than four inches are authorized if used in the performance of duty. Those found in violation of this directive are subject to apprehension, criminal charges and debarment from the installation.

1.9.8. ILLEGAL CONTROLLED SUBSTANCE: The U.S. Federal government is the most vocal opponent of the drug industry and it has set the de facto international standards regarding the legality and illegality of different drugs. Illegal controlled substance and narcotics are not authorized on JBA what so ever. Controlled substances shall not be transported on the installation via vehicle or on an individual person. Marijuana/cannabis, cocaine, crack cocaine, LSD, methamphetamine (meth), heroin, anabolic steroids, psilocybin mushrooms, are some of forbidden substances (this list is not all inclusive). Prescription medications are authorized for the person the medication is issued; however the medication must not be expired and the label must clearly indicate the name of the person the medication is issued to. Otherwise, the prescription medication may be deemed illegal by law enforcement officials. Those found in violation of this directive are subject to apprehension, criminal charges and debarment from the installation.

1.9.9. CONTINUATION OF ESSENTIAL DEPARTMENT OF DEFENSE (DOD) CONTRACTOR SERVICES DURING CRISIS. In the event the contractor is unable to perform his daily operations due to peacetime emergency and/or wartime contingency disturbances, etc., neither the Government nor the contractor shall take action for non-compliance with contract requirements. Upon notification by the CO, the contractor shall perform emergency and special event services, contingencies, operational readiness exercises or inspections. Emergency and special event services will be priced separately from routine services

1.9.10. CONTRACTOR-FURNISHED ITEMS AND SERVICES. Except for those items or services specifically stated in chapter three as Government furnished, the contractor shall furnish everything needed to perform this contract according to all terms and conditions. Exterior recycling containers shall be approved by the CO or COR prior to placement. It is recommended that indoor containers supplied by the contractor be the same color, brand and model as the government furnished containers for a uniform appearance.

1.9.11. GOVERNMENT REMEDIES. The CO shall follow FAR 52.212-4, Contract Terms and Conditions-Commercial Items (May 2015), for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

CHAPTER 3

GOVERNMENT-FURNISHED PROPERTY AND SERVICES

3.1. GOVERNMENT-FURNISHED EQUIPMENT AND MATERIALS – Appendix F lists equipment available for the contractor to use. If the contractor chooses to use government furnished equipment, the contractor shall maintain the equipment in a serviceable condition, free of odor and debris. All routine, minor and major maintenance will be the responsibility of the contractor. If the equipment becomes unserviceable and repairs are no longer economical, the contractor shall notify the CO and/or the COR. Government furnished equipment is not guaranteed for the contractors use and therefore replacement of unserviceable equipment will be at the sole discretion of the Government.

3.2. GOVERNMENT-FURNISHED FACILITY. The Government shall provide office space/work space at building 3350 Celmer Lane and surrounding yard for the contractor’s use at no charge to the contractor. The contractor shall maintain customer recycling drop off areas at this location. The contractor shall maintain this area at the same standards as required by this PWS, free of debris, and grass maintained with a neat and orderly appearance. The facility shall be neat and orderly, free of debris and swept and mopped regularly. This facility shall be used for the performance of this contract only. The contractor shall call the CE Customer Service Desk at 301-981-5151 when repairs are needed to the facility. The contractor shall keep a record of all repair requests, to include the date, time and job order number. Portions of this yard will be shared with other functions and facilities.

3.2.1. PHYSICAL SECURITY. The contractor shall be responsible for safeguarding all Government property provided for contractor use. At the close of each work period, all Government facilities, equipment and materials shall be secured. The contractor is responsible for safeguarding all Government property provided for contractor use.

3.2.2. KEY CONTROL. The contractor shall establish and implement methods of making sure all keys/combinations issued to the contractor by the Government are not lost or misplaced and are not used by unauthorized persons. The contractor shall not duplicate any keys issued by the Government and the Government will stamp all keys with “Do not duplicate”. The contractor shall immediately report to the COR any occurrences of lost or duplicated keys. In the event keys, other than master keys, are lost or duplicated, the contractor may be required, upon written direction of the CO, to re-key or replace the affected lock or locks without cost to the Government. The Government may, however, replace the affected lock or locks or perform re-keying and deduct the cost of such from the monthly payment due the contractor. In the event a master key is lost or duplicated, the Government shall replace all locks and keys for that system, and the total cost will be deducted from the monthly payment due to the contractor.

3.3. UTILITIES. The Government shall provide electricity, water, and sewer utilities. The Government will also provide a Class C telephone for use in contractor assigned building.

3.4. DAMAGE TO GOVERNMENT PROPERTY. The contractor shall repair or replace any damaged government property (trees, shrubs, flowerbeds, buildings, equipment, communication cables, signs, sign posts, utilities, etc.) caused by the contractor.

3.5. GOVERNMENT-FURNISHED SERVICES. The Government will provide the following services:

3.5.1. ON-BASE DISTRIBUTION. A distribution basket for providing documents to the contractor will be located on the COR personnel desk, at Operations Engineering Office, Building 3446.

3.5.2. SECURITY POLICE AND FIRE PROTECTION. The Government will provide general on base Security Police and Fire Protection service. In return for these services the contractor shall adhere to the security and fire directives, instructions and policies of JBA. Security police phone extensions 911 for emergencies, and 301-981-2001 for routine calls.

3.5.3. EMERGENCY MEDICAL SERVICES. Ambulance and emergency medical services shall be provided on a cost reimbursable basis to contractor personnel while on this installation. The contractor shall notify the COR of any mishaps that occur on the installation.

CHAPTER 4

CONTRACTOR-FURNISHED PROPERTY/SERVICES/EQUIPMENT

4.1. The contractor shall furnish all personnel, vehicles and equipment required to perform requirements stated herein. The contractor shall furnish all containers and roll-offs in the sizes and locations as listed in Appendix D and E. All containers provided by the contractor shall be Government approved and IAW this PWS.

4.2. QUALITY STANDARDS FOR CONTRACTOR FURNISHED EQUIPMENT/TOOLS AND MATERIALS/SUPPLIES: The contractor shall submit to the CO and COR for approval, a description of all bulk containers and vehicles proposed to be used on this contract. The request for approval will be submitted on AF Form 3000, Material Approval Submittal. The government may inspect the contractor’s equipment or bulk containers at any time and direct the removal of any items not meeting manufacturer’s specifications. The contractor, at contractor expense, shall replace items failing to meet required standards submitted on the approved AF Form 3000.

4.3. CONTRACTOR-FURNISHED VEHICLES. The contractor shall provide refuse/recyclable collection type vehicles and maintain all vehicles necessary to perform the requirements of this contract. Contractor vehicles shall have the company name prominently displayed on both sides of the vehicle. Vehicles shall be maintained and cleaned to present a neat, professional appearance. All vehicles shall be registered, licensed, insured, and operated in accordance with base traffic regulations by a licensed driver. All vehicles used in the performance of this contract shall be in operable condition and meet the local, state, and Federal safety requirements. Vehicles found to be unsafe and unable to function as designed, shall be removed from the installation and replaced at contractor expense. Vehicular repairs shall not be done on base. The CO or COR may inspect the contractor’s vehicles at any time and direct the removal of any unsafe or objectionable vehicle from the installation.

4.4. CONTRACTOR-FURNISHED BULK CONTAINERS. The contractor shall provide all bulk containers necessary to perform this contract. The number, size, and location of the containers listed in Appendix D and E are estimates only and changes may occur. In addition, the Government reserves the right to change sizes, locations and quantities. The Government will approve the color of the containers.

4.5. BULK CONTAINER PAINTING. The contractor shall furnish containers that match the color scheme of the base architectural color standard of Tudor Brown. Cleaning of containers shall be accomplished prior to painting. Additional re-painting of the containers shall match the approved color scheme.

4.6. ROLL OFF CONTAINERS. The contractor shall furnish roll off containers constructed for commercial use in sizes 20, 30, and 40 cubic yards that meet all Occupational Safety and Health Administration (OSHA) safety standards. Roll off container locations are identified in Appendix D and E. Roll-off containers provided for construction and demolition debris shall be 20, 30, or 40 cubic yards in size as specified by the Government.

4.7. COMPLIANCE WITH LAWS AND REGULATIONS. The contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws, regulations, and requirements regarding environmental protection to include AFI 32-7080, Pollution Prevention Program, and the base QRP Business Plan. In the event environmental laws/regulations/requirements change during the term of this contract, the contractor shall comply with such laws/regulations/requirements as changed. If there is an increase or decrease in cost as a result of change, the contractor shall immediately inform the CO and the COR for possible modification of the contract. If nothing is submitted to the CO and COR within 10 days of the new requirement becoming law, it will be assumed that the contractor shall provide the extra service at no additional cost to the government.
