Questions and Answers Solicitation FA282321Q4006 18 February 2021

Q1. Will the government be issuing a waiver to allow Small Businesses that are nonmanufacturers to provide quotes from non-small business material providers?

A1. The Government does not anticipate providing a waiver to the nonmanufacturer rule at this time as our market research indicates that ample small businesses in the area are able to provide for this requirement.

Q2. Will the Government give us a tax exemption number/form to give to the quarry from where we will be getting the material?

A2. A tax exemption letter has been attached to this solicitation and can be provided again to the awardee if needed.

Q3. I am reaching out to you regarding this solicitation is respect to the NAICS code. NAICS code is for Crushed and Broken Limestone Mining and Quarrying. I have had multiple contractors reach out to me for a quote to supply the material however, we do not hold NAICS code 212312. After doing some research on these contractors, it appears that they do not hold this code either. Can you clarify if this code is a requirement to submit a bid for this solicitation?

A3. The solicitation contains the provision at FAR 52.212-3, which allows a contractor to certify for this particular requirement that it meets the small business size standard corresponding to the North American Industry Classification System (NAICS) code identified in the solicitation. Additionally, FAR 52.219-6 (included via 52.212-5) provides the following definition of a small business concern: Small business concern, as used in this clause—(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.

Furthermore, FAR 52.212-1, which is also included, states the following: “North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.” Any company that provides a quote in response to this solicitation is requested to complete the representations and certifications in FAR 52.212-3 included in the solicitation.
