PURCHASE DESCRIPTION
FOR
ACOUSTIC CALIBRATION STANDARD UPGRADE
1.0 SCOPE: This purchase description describes a self-contained bench top Acoustic Calibration Standard Upgrade (ACSU) to Bruel & Kjaer P/N U9801. This standard shall semi-automatically generate and measure acoustical and electrical signals required for calibrating Type 1 and 2 Sound Level Meters (SLM), Band Pass Filters, Acoustic Calibrators, and Dosimeters. One unit shall be capable of calibrating Type 1 and 2 Sound Level Meters (SLM), Band Pass Filters, Acoustic Calibrators, and Dosimeters, Microphones, and Pistonphones for the AFPSL. The tests required to calibrate these items are in accordance with ANSI and IEC standards. It shall be controlled by computer operation and the results stored within the computer hard drive.
2.0 PERFORMANCE REQUIREMENTS: The ACSU shall be an upgrade to P/N U9801. The upgrade shall be capable of calibrating Sound Level Meters, Noise Dosimeters, Acoustic Calibrators, and Band Pass Filters.
2.1 Sound Level Meter Calibration: The ACSU shall calibrate different brands of Type 1 and 2 Sound Level Meters in compliance with the following ANSI S1.4 requirements:
2.1.1 Electrical Adaptor: the ACSU shall provide a set of ½” adapters with the capacitance of 12, 15, 18, and 20 pF that are used to replace the microphone for electrical tests.
2.1.2 Accuracy: ANSI S1.4 Par 3.2
2.1.3 Frequency-Weighting Characteristics and Tolerances: ANSI S1.4, Par 5.1. The frequency weighting shall be tested using a multi-frequency sound calibrator (P/N 4226) or an electrostatic calibrator that conforms to IEC 61094-6. Also reference 2.1.7 – 2.1.12.
2.1.4 Internal Noise: ANSI S1.4, Par 5.6
2.1.5 Amplifier Characteristic: ANSI S1.4, Par 6.2
2.1.6 Exponential Time Averaging Characteristics: ANSI S1.4, Par 6.1 – 6.5
2.1.7 Microphone Sound Field Corrections: The ACSU shall correct the measured DUT microphone pressure (found using a multi-frequency calibrator) or electrostatic frequency response curve to a free field or random field frequency response curve, using the microphone or preferably, the sound level meter manufacturer’s supplied sound field corrections shall be stored within the ACSU, if available.
2.1.8 Corrected SLM Calibration Results: If all the DUT sound field and SLM body reflection corrections have been applied then the ACSU shall verify that the measured and corrected DUT’s frequency response is in compliance to the ANSI S1.4 Type 1 or 2 specifications.
2.1.9 Unavailable Corrections: If either or both the microphone sound field correction or SLM body reflection correction curves are not available, then the ACSU shall permit the entry of the corrections in the case that they become available to AFMETCAL in the future.
2.1.10 Microphone Pressure Frequency Response Calibration: Regardless of whether microphone sound field or SLM body reflection correction curves are available, as a minimum a microphone pressure frequency response calibration (employing a multi-frequency sound calibrator, electrostatic calibrator, or manually entered results from a calibration performed with another calibration system than the ACSU) of the DUT microphone shall be an option. The DUT microphone pressure calibration data shall be a charted frequency response calibration with percent deviation from the reference pressure sensitivity found at 1000 Hz.
2.1.11 Corrections for Pressure Frequency Response Calibration: The ACSU shall apply known pressure sound field corrections to the microphone pressure frequency response calibration results determined or entered in 2.1.10 above. The ALSMC shall make the pressure corrections using data supplied by the DUT microphone, DUT sound level meter, multi-frequency sound calibrator, or electrostatic calibrator manufacturer, if available. The ACSU DUT pressure frequency calibration results shall state that only a microphone pressure frequency response calibration has been performed. The calibration tolerances referenced to in 2.1.3 shall be used.
2.1.12 Unavailable Pressure Corrections: If the pressure sound field corrections are not available, then the ACSU shall permit the entry of the pressure corrections in the case that they become available to AFMETCAL in the future. The individual corrections shall be stored within the ACSU.
2.1.13 Minimum Sample of Air Force Inventory to be Calibrated: As a minimum the ACSU shall have operational files required to semi-automatically calibrate the following Sound Level Meters: Quest P/N 1800 Type 1, P/N 1900 Type 1, P/N 2400 Type 2, P/N 2700 Type 2, P/N 2800 Type 2, P/N 2900 Type 2 (all of these Quest SLM instruction manuals are available on the Quest web site), and Bruel and Kjaer P/N 2230 Type 1 and P/N 2260 Type 1 Sound Level Meters.
2.2 Dosimeter Calibrations: The ACSU shall calibrate dosimeters in compliance with the following ANSI S1.25 requirements:
2.2.1 Electrical Adaptor: the ACSU shall provide a set of ½” adapters with the capacitance of 12, 15, 18, and 20 pF that are used to replace the microphone for electrical tests.
ANSI S1.4 Type 2 Sound Level Meter: In addition to taking noise dosage readings, the dosimeter shall be considered to be equivalent to an ANSI S1.4 Type 2 Sound Level Meter (ref requirements outlined in 2.1 above).
2.2.2 Frequency Response: Exchange Rate (ER) = 3, ANSI S1.25 Par 7.2.2
2.2.3 Electrical Tests:
2.2.3.1 Threshold Level Test: ANSI Std S1.25 Par 7.7.3
2.2.3.2 Frequency Response: ER = 3, ANSI S1.25 Par 7.2.2
2.2.3.3 Exponential Circuit and Integrator: Linearity Test, ER = 3, ANSI S1.25 Par 7.7
2.2.4 Minimum Sample of Air Force Inventory to be calibrated: As a minimum the ACSU shall provide operational files to calibrate the following noise dosimeters: Quest P/Ns Q-100, Q-300, Q-400, Q-500, Noisepro DLX; Cel Instruments P/N CEL-460; and Metrosonics P/N DB-3080.
2.3 Acoustic Calibrator Calibrations: Measurements According to ANSI S1.40:
2.3.1 Results Corrected for Ambient Pressure and Temperature: The Pressure, Effective Volume, and Temperature corrections shall be provided by the DUT manufacturer and entered by AFPSL/PMELs. The barometric pressure and ambient temperature shall be determined by the AFPSL/PMEL independently using AFPSL/PMEL equipment.
2.3.2 Minimum Sample of Air Force Inventory to be Calibrated: As a minimum the ACSU shall provide operational files to calibrate the following Acoustic Calibrators: Quest P/Ns QC-10, QC-20; Metrosonics P/N CL-304; and Bruel and Kjaer P/N 4230 and 4231.
2.4 Calibration of Band Pass Filters:
2.4.1 1/3 and 1 Octave Filters
2.4.2 Measurements According to ANSI S1.11: only the tests stated in ANSI S1.11 that verify the accuracy of the filter/SLM pair shall be performed e.g. relative attenuation within the filter bandwidth.
2.4.3 Signal Input to Filter: It is preferred that the same test setup as described in 2.1.1 above shall be used to calibrate the Filter while attached to the SLM.
2.4.4 Analog and Digital Filters: Externally and Internally within Sound Level Meters.
2.4.5 Minimum Sample of Air Force Inventory to be Calibrated: As a minimum the ACSU shall provide operational files to calibrate the following Band Pass Filters: Quest P/N OB-100 and OB-300; and Bruel and Kjaer P/N 1624 and 1625 Band Pass Filters
2.5 Microphone Calibration for AFPSL unit only: The ACSU shall be capable of calibrating 1”, ½”, ¼”, 1/8” microphones in accordance with ANSI 1.4.
2.6 Pistonphone Calibration for AFPSL unit only: The ACSU shall be capable of calibrating pistonphones in accordance with ANSI 1.4.
2.7 Microphone: One B&K P/N 4192-W01 microphone shall be provided with each ACSU.
2.8 Shipping Case: A shipping case shall be provided for the 4192-W01 microphone, it shall be rugged and durable and able to protect the microphone during normal shipping.
2.9 ACSU Uncertainty: An uncertainty analysis shall accompany the ACSU that include uncertainty contributions from the standards used to calibrate the ACSU, the calibrated components of the ACSU, and uncertainties incorporated within the ACSU test method (including uncertainties of corrections referenced to in 2.1.7 to 2.1.12, when publicly available). The analysis methodology shall be consistent with NIST Technical Note 1297, 1994 edition.
2.10 Calibration Tolerances: The calibration tolerances (T) shall be equal to or less than the tolerances that are necessary to verify that the DUT meets the DUT specification for the given calibrated DUT characteristic (when combined with the ACSU uncertainties defined in 3.5 above).
2.11 ACSU Frequency Response: Part of the calibration of the ACSU shall consist of determining the frequency response of the ACSU and if necessary minimizing the measurement bias due to the ACSU frequency response.
3.0 FUNCTIONAL REQUIREMENTS: For each type of acoustic workload, the software shall be Windows Based and define the test setup, step the test operator through the calibration, including test equipment switch settings, provide pass/fail criteria (tolerances), generation of test results including numerical data, storage of the test results and printing of calibration certificates. It shall be capable of generating the acoustic and electrical test signals and making the signal measurements necessary to calibrate the acoustic workload.
3.1 User Interface: All operations of the ACSU shall be operable either using simple computer commands or front panel controls on associated test equipment. All the test equipment controls shall be labeled to indicate their function.
3.2 Operating Temperature/Humidity Ranges: 23 +/-3°C/25 to 50% RH.
3.3 Storage Temperature Range: -20 °C to 70 °C.
3.4 Acoustic Units of Measure: dB re 20µPa.
3.5 International Standards: References to International Standards within this document shall implicitly refer to the most recent or up to date version of the given standard at the time of the award of this contract, unless otherwise stated within this document. The following International Organizations are referred to in this document: American National Standards Institute (ANSI), Organisation Internationale De Metrologie Legale (OIML), and International Electrotechnical Commission (IEC).
3.6 Types of Workload Supported:
3.6.1 Type 1 and 2 Sound Level Meter Calibrations: As specified by IEC60651, 60804 and 61672; SLMs with ¼”, ⅜”, ½” or 1” microphones with analog or digital readout.
3.6.2 Acoustical Calibrator Calibrations: as specified by IEC 60942.
3.6.3 Band Pass Filter Calibrations: as specified by IEC61260 and ANSI S1.11.
3.6.4 Noise Dosimeters (with and without removable microphones): As specified by IEC61252.
3.6.5 Microphone: as specified by ANSI 1.4 for AFPSL unit only.
3.6.6 Pistonphone: as specified by ANSI 1.4 for AFPSL unit only.
3.7 Acoustic Signal Sources:
Multi-Frequency Sound Calibrator: The ACSU may incorporate the use of a Bruel and Kjaer P/N 4226 Multifunction Acoustic Calibrator. This calibrator is already owned by the AFPSL/PMELs. Within the ACSU, the P/N 4226 shall be considered to meet the requirements of a multi-frequency sound calibrator reference IEC 61672-3 paragraph 11.1 (1 ea).
Electrostatic Calibrator: If an electrostatic calibrator is a component of the ACSU, an uncertainty analysis shall be included for the electrostatic calibration and a calibration procedure for verifying the uncertainty in accordance with IEC16672.
3.8 ACSU Controller: Three methods of calibration control shall be employed (SLM and Dosimeter calibrations):
3.8.1 Manual Mode: The test equipment is controlled by the computer. The User shall set up the Device Under Test (DUT). The User shall read the results from the DUT display and key the results into the computer.
3.8.2 Semi-automated Mode: The computer controls the test equipment. The user shall set up the DUT. The DUT measurement values are measured with the voltmeter connected to the DC output on the DUT.
3.8.3 Automated Mode: The test equipment and the device under test are fully controlled by the computer. This requires the DUT to have an RS-232 or IEEE 488.2 interface.
3.9 Design Requirements: The ACSU shall be an integrated standalone desk top or instrument rack mounted system requiring only the connection of electrical power.
3.10 Measurement Report Generation: A total measurement report, in accordance with ISO 17025, shall be available and printable on the accompanying ACSU printer.
3.11 Instrument Libraries: All software required to meet the requirements below shall be part of the ACSU software package.
Operational Files: The user shall be able to add a sound measuring instrument to the current DUT Operational file library by either modifying a current DUT Operational file or by adding a new DUT Operational file. Instruction for adding new DUT Operational files shall be provided in accompanying manual.
Calibration Results Data Base: As a minimum, the following calibration results data from each calibration run on a given DUT shall be stored, retrievable and available for sorting in a Microsoft Windows compatible database: DUT P/N, manufacturer, serial number, Air Force PME number (6 digits), customer name, Air Force calibration procedure number, international standard tested to, instrument type, calibration date, and calibration results in the format pass/fail/limited.
Calibration Results File Retrieval: The complete history of DUT calibration results files shall be stored on the hard drive of the ACSU computer and retrievable with reference to part number, serial number, test time and date, or manufacturer. In addition to the information required for file retrieval, the individually stored and retrieved DUT calibration result file shall include as a minimum the following information: 1) international standard tested to, 2) paragraph number of international standard tested specification, 3) nominal test points required to test for the specification referred to in two above, 4) test tolerances, 5) test numerical results, and 6) test pass or fail designations.
Report Retrieval: The report generated in 3.10 above shall be available from current or stored data (available in stored data file).
Comments: A comments section shall be available and storable in both the Operational and Data files.
4.0 MECHANICAL & PHYSICAL REQUIREMENTS:
4.1.1 AC Power Rating: 100 to 120/200 to 240 VAC, at 50/60 Hz, +/- 5% single phase input power.
4.1.2 Warm-up Time: Maximum 1 Hour
4.1.3 Electrical Safety: Documentation shall be provided to support the means by which all electric safety considerations for the ACSU have been addressed. The safety of all personnel shall be assured during any personnel conductive or non-conductive contact with the outside of the equipment, and during the changing of the fuse, with the power to the system and its components on. This documentation shall consist of a minimum of a citing of a UL (Underwriters Laboratories) or ANSI identified standard or equivalent United States Standard that the equipment conforms to.
5.0 CONTROLLER REQUIREMENTS: A laptop controller shall be provided that can efficiently operate under Microsoft Windows 7 Professional operating system. All major components of the system shall be commercially available and fully supportable by commercial sources. Where specific brands are identified in this specification, no substitutes are allowed without prior approval from the AFMETCAL. The Controller shall meet or exceed Microsoft Windows 7 Professional hardware requirements.
5.1 Processor: Intel Pentium IV or otherwise equivalent or better generation minimum, 1 GHz clock speed minimum.
5.2 Memory: Minimum 4 GB system Memory.
5.3 Input Output (I/O) External Ports, Slots and Connectors: At minimum, the following types of I/O interface connections shall be available on the controller or via port replication:
USB: Minimum of four integrated USB Ver 2.0 compliant ports.
Ethernet: One 100/1000 BaseT Ethernet RJ45 port.
Video: Areo-Capable Graphics card that supports Windows Display Driver Model (WDDM 1.0) with a minimum of 128 MB.
Floppy Disk Drive: One external 3.5" 1.44MB drive connected by USB
5.4 Display Panel: Minimum 15-inch LCD Color Display Panel with at least 1024 x 768 resolution for a 4:3 aspect ratio or 14.1-inch flat panel LCD Color Display Panel with at least 1280 x 720 resolution for a 16:9 aspect ratio.
5.5 Hard Drive: 80 GB (Minimum) Hard Disk Drive.
5.6 DVD-ROM/CD-RW Drive
DVD-R: at least 8X Speed CD-RW: at least 24X Read Speed, 16x Write Speed
5.7 Operating System and Software: All software shall run under or Microsoft Windows7 (Professional operating system or greater, 64 bit, latest version release). All software shall run Windows 7 as a non-elevated user. Microsoft Office 2010 shall be included.
5.8 Additional Hardware: Additional hardware required to make this system function as identified by this purchase description shall be required.
5.9 Licensing:
User site license for each ACSU site.
The Air Force shall be given the rights and provided the tools that facilitate the capability to freely distribute, modify, and reuse any commercially acquired drivers or calibration procedure modules within the Air Force if desired.
The contractor shall provide sufficient application software licenses and database server licenses to support the seven Precision Measurement Equipment Laboratories (PMELs) and Government surveillance personnel. Licenses shall be provided for both client-server configurations and stand-alone configurations. The contractor shall provide sufficient copies of software installation media to support all implementation sites.
6.0 TRAINING: Training on system operations by the contractor shall take place at the customer’s premises. The contractor shall spend a minimum of one (1) day on site. The only exception is the contractor shall spend a minimum of five (5) days on site at AFPSL to provide training on the system operations as well as software operations required to add additional items to be loaded into the system. Ex. Creating a file for a new Sound Level Meter.
7.0 TESTING: This item will be inspected and accepted at destination as stated in the contract. The item will be checked with test equipment with parameters equal to or better than those required to assure that specified performance parameters are met. Test equipment used shall have first echelon certification directly traceable to the National Institute of Standards Technology (NIST) or other AFMETCAL-approved equivalent international laboratory. Tests will be performed to assure that the item meets the requirements of this purchase description. Such testing at destination does not relieve the contractor of performing all inspections and quality checks at the point of manufacture as necessary to assure performance as specified herein.

Attachment to Purchase Description 16M-285A/B-SO Acoustic Calibration Standard Upgrade
DATA REQUIREMENTS
MANUALS: A complete user and service manual and calibration procedure shall be provided with each unit in contractor format. Manuals shall be on CD/DVD-ROM in Indexed Portable Document Format (iPDF). The manuals shall comply with Data Item Description (DID) DI-TMSS-80527C and the Contract Data Requirements List (DD Form 1423).
ACCEPTANCE TEST PLAN: The acceptance test plan shall be delivered to and approved by the government prior to delivery of the evaluation unit. The acceptance test plan shall detail the criteria, performance objectives, and description of tests to be performed. The plan shall be prepared in accordance with Data Item Description DI-QCIC-80553A and Contract Data Requirements List (DD Form 1423).
SOFTWARE USER MANUAL: The software user manual shall contain instructions to execute one or more related computer software configuration items. The software user manual shall be provided in paper format and prepared in accordance with Data Item Description DI-IPSC-81443A and Contract Data Requirements List (DD Form 1423).
SOFTWARE TEST PLAN: The Software Test Plan (STP) describes plans for qualification testing of Computer Software Configuration Items (CSCIs) and software systems. It describes the software test environment to be used for the testing, identifies the tests to be performed and provides schedules for test activities. The software test plan shall be prepared in accordance with Data Item Description DI-IPSC-81438A and Contract Data Requirements List (DD Form 1423).

Inspection and Acceptance shall be performed to ensure units meet all requirements of Purchase Description 16M-285A/B-SO Rev 3 dated 11 March 2016. All units will undergo acceptance testing which will be performed at the destination location. Units being shipped to locations other than AFMETCAL/WNMRH (Receiving) at Heath OH, may not be made until the contractor receives requisition numbers (RQNs) from the Contract Administrator. DO NOT ship units to these locations without RQNs. The Contract Administrator will forward the RQNs to the contractor as soon as possible. If units are ready to ship before receiving the required RQNs, the contractor must contact the Contract Administrator to make other shipping arrangements. The RQN, National Stock Number (NSN), the MARK FOR ACCOUNT number and ATTENTION PMEL TYPE must be plainly displayed on the outside of each shipping container. Acceptance testing shall be completed within 45 days after completion of contractor training at each location. Invoices shall not be submitted in WAWF until the contractor is notified by the AFMETCAL Contract Administrator that each unit has passed acceptance testing.

52.209-4 FIRST ARTICLE APPROVAL--GOVERNMENT TESTING (SEP 1989)
(Contracting Officer shall insert details)
(a) The Contractor shall deliver one (1) unit(s) of Lot/Item 0001 within 180 calendar days from the date of this contract to the Government at AFMETCAL in Heath, OH for first article tests. The shipping documentation shall contain this contract number and the Lot/Item identification. The characteristics that the first article must meet and the testing requirements are specified elsewhere in this contract.
(b) Within 45 calendar days after the Government receives the first article, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.
(c) If the first article is disapproved, the Contractor, upon Government request, shall submit an additional first article for testing. After each request, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall furnish any additional first article to the Government under the terms and conditions and within the time specified by the Government. The Government shall act on this first article within the time limit specified in paragraph (b) of this clause. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule or for any additional costs to the Government related to these tests.
(d) If the Contractor fails to deliver any first article on time, or the Contracting Officer disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.
(e) Unless otherwise provided in the contract, the Contractor--
(1) May deliver the approved first article as a part of the contract quantity, provided it meets all contract requirements for acceptance and was not consumed or destroyed in testing; and
(2) Shall remove and dispose of any first article from the Government test facility at the Contractor's expense.
(f) If the Government does not act within the time specified in paragraphs (b) or (c) of this clause, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the Changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.
(g) The Contractor is responsible for providing operating and maintenance instructions, spare parts support, and repair of the first article during any first article test.
(h) Before first article approval, the acquisition of materials or components for, or the commencement of production of, the balance of the contract quantity is at the sole risk of the Contractor. Before first article approval, the costs thereof shall not be allocable to this contract for (1) progress payments, or (2) termination settlements if the contract is terminated for the convenience of the Government.
(i) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the Offeror/Contractor and have been accepted by the Government. The Offeror/Contractor may request a waiver.

ADDENDUM
RESUBMISSION OF FIRST ARTICLE
If first article government retesting/resubmission is authorized under FAR 52.209-4, First Article Approval – Government Testing, paragraph (c), costs to the Government related to the retesting/resubmission, including administrative costs for the contract modification, in the amount of $2,048.00, shall be borne by the Contractor and deducted from the contract price. When the Government determines that a complete retest is not required, the Contracting Officer may adjust the total retesting cost accordingly.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)
(a) Definitions. As used in this clause— Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.
Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall--
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.
(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order:
(1) Document type. The Contractor shall use the following document type(s).
Combo – receiving report and invoice - Receiving report shall be submitted at time of shipment. Invoice shall be submitted only after notification by the Contract Administrator that units have passed acceptance testing.
Note: If a “Combo” document type is identified but not supportable by the Contractor's business systems, an “Invoice” (stand-alone) and “Receiving Report” (stand-alone) document type may be used instead.)

52.217-7 OPTION FOR INCREASED QUANTITY--SEPARATELY PRICED LINE ITEM (MAR 1989)
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor any time from date of award through 30 September of the option year.. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
