SECTION 010100 - SUMMARY OF WORK

PART 1- GENERAL

1.1 SUMMARY

A. The Contractor shall furnish labor, materials and equipment required for the construction of an accessible trail approximately 800 feet long and 7 feet wide. The work also includes construction of a gravel driveway and parking area for approximately five cars. The construction of a ±275 square foot accessible viewing platform of wood construction is a bid additive to the project.

B. The project will involve careful and constant coordination with the Refuge staff, the Contracting

Officer (CO) and the Contracting Officer’s Technical Representative (COTR).

C. The Contractor shall exercise extreme care and shall perform the work in a diligent and professional manner throughout the duration of this project.

D. The Contractor’s construction schedule shall reflect the specific dates and timelines imposed by this specification section.

E. The Contractor shall be responsible for strict compliance with provisions of the Rhode Island

Department of Environmental Management, U.S. Environmental Protection Agency and the Occupational Safety and Health Administration (OSHA) regulations and requirements.

F. The work under this contract is described in the following documents:

1. Specifications entitled: “Accessible Trail, Moosehorn National Wildlife Refuge.”

2. Contract Drawings consisting of 11 sheets.

G. The Contractor shall furnish plant, labor, equipment, appliances and materials and carry out operations as necessary to accomplish the work, complete and in place. The Contractor shall perform work in strict accordance with these specifications and the contract drawings, subject to the terms and conditions of the contract. The work shall be performed in accordance with applicable Federal, State and local regulations. Work shall comply with codes and standards applicable to each type of work as listed in the individual sections of these specifications.

1.2 DEFINITIONS

A. "Approved": When used to convey Government action on Contractor's submittals, applications, and requests, "approved" is limited to Government’s duties and responsibilities as stated in the Conditions of the Contract.

B. "Directed": A command or instruction by Government. Other terms including "requested," "authorized," "selected," "approved," "required," and "permitted" have the same meaning as "directed."

C. "Indicated": Requirements expressed by graphic representations or in written form on Drawings, in Specifications, and in other Contract Documents. Other terms including "shown," "noted," "scheduled," and "specified" have the same meaning as "indicated."

D. "Regulations": Laws, ordinances, statutes, and lawful orders issued by authorities having jurisdiction, and rules, conventions, and agreements within the construction industry that control performance of the Work.

E. "Furnish": Supply and deliver to Project site, ready for unloading, unpacking, assembly, installation, and similar operations.

F. "Install": Operations at Project site including unloading, temporarily storing, unpacking, assembling, erecting, placing, anchoring, applying, working to dimension, finishing, curing, protecting, cleaning, and similar operations.

G. "Provide": Furnish and install, complete and ready for the intended use.

H. “Salvage”: Remove and deliver to the Government complete and ready for reinstallation.

1.3 LOCATION AND INSPECTION OF THE SITE

A. Prospective bidders are responsible for inspecting the site and satisfying themselves as to the condition under which they will work or which will affect the work in any manner.

B. Inspection of the site can be arranged by contacting the Refuge Manager, William Kolodnicki at

(207) 454-7161.

C. The project site is located at Moosehorn National Wildlife Refuge in Barring, Maine.

D. Inquiries concerning the contract documents shall be made to the U.S. Fish and Wildlife Service, Contracting and General Services, 300 Westgate Center Drive, Hadley, Massachusetts, 01035, Attn: Teresa Wong Neyhart, P.E., Maintenance Officer, telephone: (413) 253-8518.

1.4 PROJECT SCHEDULE

A. The Contractor shall submit a project schedule to the Contracting Officer for approval within 15 days after receipt of the Notice to Proceed.

B. The project schedule shall be in the form of a chart which graphically indicates the proposed sequence to accomplish each work feature or operation. The chart shall be prepared to show the starting and completion dates of work features on a linear horizontal time scale which begins with the date of the Notice to Proceed and indicates the number of calendar days to completion.

The Project Schedule shall be prepared in an approved, reproducible form and shall include:

1. Breakdown of work activities in categories so approved and segmented as necessary to allow close monitoring of progress of the work during construction.

2. Order of work necessary to meet Time of Completion.

3. Breakdown of the work schedule of all Subcontractors scheduled in cooperation with the

Contractor's work. Work schedule shall be updated each 30 days.

4. Anticipated monthly values for work completed.

5. Space for the additional display of actual performance on the schedule.

C. After necessary revisions have been made and approved, present one print of Schedule to each subcontractor and three copies to the Contracting Officer.

D. Upon request, update the schedule to reflect changes required by actual conditions and indicate actual work completed. Provide same number of copies as required for original submission.

E. The Contractor shall indicate on the chart the important work features or operations that are critical to the timely overall completion of the project. Key dates for such important work features and portions of work features are milestone dates and shall be so indicated on the chart.

F. This schedule will be the medium through which the timeliness of the Contractor's construction effort is appraised. When changes are authorized that result in contract time extensions, the Contractor shall submit a modified schedule for approval by the Contracting Officer.

1.5 COST BREAKDOWN

A. Within ten (10) days after award of Contract submit a cost breakdown of the project in an approved form.

B. Include profit and overhead costs in each item.

C. Certificate of payment may be withheld until receipt of cost breakdown in acceptable form has been submitted.

1.6 OPERATIONAL RESTRICTIONS

A. The Contractor shall take necessary measures required to insure a clean, safe environment for the Contractor's work force, facility personnel and the general public for the duration of this project.

B. If during demolition, excavation, disposal, or other work, articles of unusual value, or of historical or archeological significance are encountered the ownership of such articles is retained by the Government. Information regarding the discovery of such items shall be immediately furnished to the Government. If the nature of the article is such that the work cannot proceed without danger of damaging the article, work in that area shall be immediately discontinued until the Government has decided the proper procedure to be followed. Any time lost thereby shall be a condition for which the time of the contract may be extended. Costs incurred after discovery in the salvaging of such articles shall be borne by the Government.

1.7 SEQUENCING AND SCHEDULING

A. The Contractor shall employ ample personnel and sufficient equipment to accomplish the work of this contract, in the least amount of time, within the prosecution period specified in these specifications.

B. Normal work hours are from 7:00 AM through 5:00 PM, Monday through Friday. The Contractor will not be permitted to work on Saturday, Sunday or legal holidays unless otherwise authorized by the Contracting Officer.

C. The exclusion of work on Saturday, Sunday and legal holidays has been considered in computing the performance time of this contract.

D. The following legal holidays are observed: New Years Day, Third Monday in January, Third

Monday in February, Last Monday in May, July 4th, First Monday of September, Second Monday of October, November 11th, Fourth Thursday of November and December 25th. When a legal holiday falls on a Sunday, the following Monday is observed as a holiday. When a legal holiday falls on a Saturday the preceding Friday is observed as a holiday.

E. Requests to perform work during times other than the normal work hours and work days shall be made in writing. Such requests will be reviewed and approved on a case by case basis. Requests will only be approved if the work involves completion of a specific phase of the work that is critical in maintaining the operation of the refuge or the Contractor has fallen behind schedule and the additional time will allow the Contractor to get back on schedule. In any event, any work approved will be at no additional cost to the Government.

1.8 ORGANIZATION AT THE SITE

A. Contractor Use of the Premises

1. Prior to beginning work of the contract, the General Contractor shall meet with the Refuge

Manager to determine procedures regarding access to and use of the site. Exterior staging, parking, storage areas, tree protection, special site conditions, and any other restrictions regarding the use of the site and areas surrounding the construction.

2. Storage Areas

a. Areas within the project limits are available for use by the Contractor to perform the work and for the storage of equipment, materials and trailers during the life of the contract.

b. The Contractor shall confine storage areas to the limits as designated or approved by the Refuge Manager and the Contracting Officer and the Contractor shall be responsible for the security of these areas.

c. Upon completion of the contract, the Contractor shall remove equipment and materials, except as otherwise specified, and shall restore the site to its original condition, as approved by the Contracting Officer, at no additional cost to the Government.

3. The refuge will be open to the public during the course of the work. The Contractor shall take precautions necessary to ensure the safety of the public.

B. Work Limits

1. Work shall be restricted to those areas shown on the contract drawings in addition to any storage areas assigned to the Contractor.

2. The Contractor shall maintain areas in a clean, organized manner.

C. Contractor Receipt of Supplies

1. The Contractor shall be responsible for making arrangements required for the receipt of materials and supplies at the job site.

2. Government personnel are not permitted to receive or to sign for items delivered to the site.

D. Access to the Work Site

1. The Contractor shall make necessary investigations for any equipment, highway and roadway route restrictions, which may hinder access to the site.

2. The Contractor shall observe Federal, State and local roadway restrictions, as applicable.

E. Protection of Turfed Areas and Areas of Native Ground Cover

1. Driving vehicles or operating equipment on native ground cover areas, grassed areas, or lawns will not be permitted except as necessary to perform the work of this contract.

2. Damaged areas, not otherwise scheduled to be treated, shall be repaired to original condition at no additional cost to the Government.

1.9 MEANS AND METHODS

A. Means and methods of construction shall be such as the Contractor or subcontractors may choose; subject, however, to the Contracting Officer’s right to reject means and methods which:

1. May constitute a hazard to the work, persons, or property and operations of the refuge.

2. Will not produce finish work in accordance with the terms of the contract.

3. Are contrary to specified means or methods included in the contract.

B. See Section 019000 "General Safety Requirements."

1.10 COORDINATION

A. The Contractor shall maintain coordination of the work at all times. A superintendent employed by the Contractor shall supervise the work at all times.

B. The Contractor shall coordinate the work with others and cooperate to facilitate orderly progress of work.

C. Other contracts may run concurrently with this contract or the Government may award additional contracts during the progress of this contract. The Contractor shall cooperate with other Contractors and with Government employees and shall perform operations in such a manner as to cause the least interference with other contracts or work.

D. The Government will notify the Contractor of contracts underway at the preconstruction conference and will notify the Contractor of additional contracts awarded during the progress of the work.

1.11 ENVIRONMENTAL PROTECTION

A. Work shall be accomplished in such a manner that waste materials, pollutants, and potential pollutants shall be completely retrievable for disposal in a manner suitable to the Contracting Officer and in accordance with applicable regulations and laws.

B. At no time shall operations be attempted or permitted where or when such operations present a possibility of fouling the refuge facility or surrounding areas with waste materials, pollutants, or potential pollutants.

1.12 CLEAN UP

A. The Contractor shall clean up and dispose of daily, rubbish and waste accumulation.

B. The Contractor shall, at completion of the project, remove tools and equipment, and leave the premises clean.

C. The Contractor shall repair or otherwise return to original condition, any parts of the existing facilities which become damaged as a result of the Contractor’s work at no additional cost to the Government.

1.13 PRECONSTRUCTION CONFERENCE

A. The Contracting Officer will conduct a preconstruction conference to review the requirements and conditions of this contact.

B. It is mandatory that the Contractor’s project manager and field superintendent be available for a preconstruction conference prior to the start of any work for this contract.

1.14 RECORD DRAWINGS

A. The Contractor shall maintain one set of full size contract drawings at the job site, marked to show deviations from the contract drawings that were made in the field.

B. Record drawings shall include buried or concealed construction and utility features revealed during the course of construction. The Contractor shall record the actual horizontal and vertical location of existing and new structures and utilities.

C. Record drawings shall be available for review by the Contracting Officer at all times. Upon completion of the work the Contractor shall deliver the original marked set of record drawings to the Contracting Officer.

D. If the record drawings are not current, funds shall be retained from partial payments and the request for final payment will not be approved until final record drawings are submitted to the Contracting Officer for review and approval.

SECTION 010250 - MEASUREMENT AND PAYMENT

PART 1 - GENERAL

1.1 GENERAL

A. Payment for items of work for this contract is based on the lump sum, allowances, and unit price costs established in the Bid Schedule as described in this specification section.

B. The lump sum and unit price costs shall include all incidental work required to complete the work as specified within the contract documents.

1.3 PAYMENT ITEMS

A. Bid Item 1: Accessible Trail and associated improvements.

1. This payment item shall include costs associated with construction of an accessible trail, parking area, and wooden deck.

2. Price of this item is to include labor, equipment and materials required to perform the work outlined above and as indicated on the drawings and specified herein. This price is to include electric utility charges, fees, taxes, mobilizations and disposal of associated debris and final site and project cleanup.

3. Unit of Measure: One lump sum.

ADDITIVES 012400-1

SECTION 012400 - ADDITIVES

1.1 SCOPE

A. This Section is subject to applicable requirements of the Contract Documents.

B. Work includes Additives required by the Contract, and in general, includes the following items.

1. Additives for additions to, and revisions in the work of the project, to be selected by the

A. Additives revise overall scope of work as specified herein.

B. This Section describes the changes under each additive. Refer to the drawings and other sections of the specifications for additional information related to these additives.

1.3 COORDINATION

A. Coordinate related work and modify surrounding work as required to complete the work of additives selected.

B. The work of the various trades to be performed under Additives shall be coordinated in full by the Contractor. Any overlap or gaps in the complete performance of the work shall be the responsibility of the Contractor.

1.4 BIDDING INSTRUCTIONS FOR ADDITIVES

A. Each Bidder shall thoroughly examine the Contract Documents and fully determine the scope of the Additives generally defined herein, recognizing any modifications to his/her work required by any Additive whether or not particular trades are mentioned. The Contractor shall coordinate sub-contractor scopes. Questions regarding the additives shall be directed in writing to the COTR as provided for in the specifications.

B. Portions of the Work which are affected by Additives shall be recognized, coordinated and carried the General Contractor’s stated Additive pricing on the Bid Form.

C. The Contractor shall enter a single amount in the appropriate space provided in the FORM FOR

GENERAL BID.

D. Prices for Additives shall include overhead, profit, and all other expense items incidental to the Work.

E. Bidders shall bid on Additives; the term “NO BID” shall not be used. If the price for an Additive results in neither an addition nor a deduction to the Base Bid sum, the words “NO CHANGE” shall be inserted in the appropriate spaces.

F. The Government shall have the right to accept or reject any or all Additives prior to signing the

Contract. The list of Additives has been prioritized by the Government. The Additives will be selected in order presented in the bid schedule.

1.5 ADDITIVES

A. Additive No. 1: Add labor, materials, and equipment required for construction of a viewing platform as indicated on the Contract Documents.

SECTION 013000 - SUBMITTAL PROCEDURES

1.1 SUMMARY

A. Government approval is required for materials incorporated into the work. In addition, Government approval is required for specific administrative documentation as specified by this contract, deviations from the contract documents, and other items as designated by the Contracting Officer.

B. Submittals are required to insure compliance with the contract documents and shall include, but not be limited to drawings by the Contractor, manufacturer or fabricator; descriptive literature, including catalog cuts and operating charts or curves; test report results including inspection reports, laboratory reports and test cylinders; samples; record drawings and progress schedules.

C. Within the terms of the Contract Clause entitled "Specifications and Drawings for Construction," submittals are considered to be "shop drawings." The terms "shop drawings" and "submittals" shall be used interchangeably within this specification.

D. Approved Submittals

1. The approval of submittals by the Contracting Officer shall not be construed as a complete check, but will indicate only that the general method of construction, materials, detailing and other information are satisfactory.

2. Approval will not relieve the Contractor of any error which may exist in the review of submittals, as the Contractor under the Contractor Quality Control requirements of this contract is responsible for furnishing and installing materials and equipment that meet the minimum acceptable level of quality established by the contract documents, the dimensions and design of adequate connections and details, and the satisfactory construction of all work.

3. After submittals have been approved by the Contracting Officer, no resubmittal for the purpose of substituting materials or equipment will be given consideration unless accompanied by an explanation as to why such a substitution is necessary.

E. Disapproved Submittals

1. The Contractor shall make corrections required by the Contracting Officer and promptly furnish a corrected submittal in the format and number of copies as specified for the initial submittal.

2. If the Contractor considers correction or notation by the Government on a submittal to constitute a change to the contract, the Contractor shall give prompt notice to the Contracting Officer in accordance with the Contract Clause entitled "Changes".

F. Withholding of Payment

1. Payment for materials incorporated in the work will not be made if required submittal approvals have not been obtained.

2. Payment will not be made for materials furnished which differ from that approved in the submittal.

G. Reproduction of Contract Documents for use as Shop Drawing is not permitted and will be returned without review.

PART 2 - PRODUCTS (Not Used)

PART 3 - EXECUTION

3.1 GENERAL

A. The Contractor shall submit items listed on the list of required submittals at the end of this specification section and as specified within the contract documents. The Contracting Officer may request submittals in addition to those listed when deemed necessary to adequately describe the work covered in the respective specification sections.

B. Submittals shall be made in the number of copies and mailed to the respective address(es) as set forth below.

C. Each submittal shall be complete and in sufficient detail to allow ready determination of compliance with contract documents.

D. Submittals shall be thoroughly reviewed by the Contractor to insure complete compliance with the contract documents PRIOR to forwarding any submittal(s) to the

1. The Contractor shall review submittals prepared by subcontractors and/or manufacturer's representatives and return those submittals that do not comply with the contract documents directly to the party responsible for preparing the submittal.

2. Under no circumstances shall submittals be mailed directly from a subcontractor or manufacturer's representative to the Government.

E. Proposed deviations from the contract documents shall be clearly identified on the submittal form.

F. Submittals shall be prepared and submitted in a timely manner prior to the acquisition of the materials or equipment covered by the submittal.

G. The acquisition and/or installation of materials without prior approval of the applicable submittal is at the Contractor's risk only. Any modifications required, including removal and replacement of the materials or equipment shall be performed at no cost to the Government.

H. The Contractor shall coordinate the submission of submittals with the project schedule.

3.2 SCHEDULING

A. Submittals covering component items forming a system or items that are interrelated shall be scheduled to be coordinated and submitted concurrently.

B. A minimum of fifteen (15) business days, exclusive of mailing time, shall be allowed for the review and approval of submittals.

C. No delays, damages or time extensions will be allowed for time lost due to the late submission of submittals by the Contractor.

3.3 SUBMITTAL FORM

A. Submittal forms shall be furnished to the Contractor and shall be used when submitting submittals.

B. Submittal forms shall be properly completed by filling out the heading blank spaces and identifying each item submitted.

C. The Contractor shall list the specification paragraph and/or contract drawing number pertinent to the information submitted in each shop drawing.

D. Submittals not properly completed will be returned to the Contractor disapproved.

3.4 SUBMITTAL PROCEDURE

A. Submittals in 8-1/2 x 11 or 11x17 format may be submitted electronically in .pdf format.

B. For full size drawings, seven (7) copies of each submittal shall be submitted by the Contractor for review. Each copy of a submittal shall have an attached submittal form.

C. Upon completion of review, three (3) copies of the submittal will be retained by the Contracting

Officer, and two (2) copies will be returned to the Contractor. One (1) copy shall be retained by the Architect/Engineer.

D. Contractor requests for the current status of submittal reviews shall be made through the

Six (6) copies of each submittal shall be mailed by the Contractor to the architect/engineer design firm for review as designated at the preconstruction conference, and one (1) copy shall be mailed to U.S. Fish and Wildlife Service, 300 Westgate Center Drive, Hadley, MA 01035-9589 to the attention of the COTR.

F. Submittals shall not be delivered to, nor received by, Refuge personnel.

3.5 DEVIATIONS OR SUBSTITUTIONS

A. Submittals which include proposed deviations or substitutions from the contract documents shall be clearly noted as such.

B. The Contractor shall include specific reasons, in writing, regarding the reason for the proposed deviation and shall highlight and note such deviations, as the deviations occur throughout the submittal package.

C. The Government reserves the right to rescind the inadvertent approval of submittals which contain unnoted deviations to the contract documents.

D. The Contractor warrants the suitability of the deviation/substitution and the compatibility of the deviation/substitution with all elements of the project. The contractor shall coordinate the deviation/substitution with all aspects of the project and will bear all costs associated with the deviation/substitution.

SECTION 013510 - ENVIRONMENTAL PROCEDURES

1.1 RELATED DOCUMENTS

A. Drawings and general provisions of the Contract, including General and Supplementary Conditions, apply to this Section.

B. See specific provisions in each Specification Section for requirements related to materials and methods of installation.

1.2 SUMMARY

A. The Contracting Officer has established environmental goals for this project (see paragraph 1.4 below).

B. The Contractor and Sub-Contractors shall provide materials and methods consistent with these environmental goals. Suggestions and input from the Contractor(s) for implementing these goals are encouraged.

C. Materials substitutions will be considered if the proposed substitution provides equal or less environmental impact as determined by the design team. Proposed substitutions will be reviewed according to procedures in Section 016000 “Materials and Equipment.”

D. Waste management methods shall be used on site to recycle wood, metals, paper and plastics accepted by local waste contractors.

1.3 SUBMITTALS

A. Submittals shall comply with the requirements of the Construction Contract Clauses, Section 013000 "Submittal Procedures" and the individual sections specifying the work.

B. Submit MSDS sheets for all products.

C. Submit certifications or other proof for substitutions when recycled content is specified.

D. Submit qualifications of on-site individual responsible for overseeing the environmental goals of the Project.

E. Submit daily log of activities and observations related to environmental procedures.

1.4 ENVIRONMENTAL GOALS FOR CONSTRUCTION

A. Energy Efficiency.

1. Use methods described below to minimize the non-renewable energy used to construct this project.

2. This goal applies on site and to suppliers and off site production facilities.

B. Water Conservation.

1. Minimize water use through careful construction practices.

2. Minimize water used for clean-up through dry cleaning methods if possible.

C. Pollution Prevention.

1. Use methods described below to prevent toxic and foreign materials from contaminating site and building during construction of this project.

2. Minimize materials going to landfills through re-use, salvaging and recycling.

D. Goals set above are to be considered concurrently. For example: water conservation techniques that increase energy use or pollute are not acceptable.

PART 3 - EXECUTION

3.1 REQUIRED CONSTRUCTION PROCEDURES

A. Reduce waste through careful management of materials.

1. Use cut-off pieces of lumber for blocking.

2. Use cut-off pieces of sheet materials for protection and blocking.

3. Seal all partially used containers when likely to be left open and un-used for longer than one half of the set time of product.

4. Use trigger activated spray nozzles.

5. Protect vulnerable stored materials from damage.

B. Use materials with greatest recycled (post production and/or post consumer) content that satisfy all other specified requirements.

C. Use materials that can be recycled.

D. Use materials with low or no toxicity thru off-gassing or leaching during use or when discarded.

1. Forbidden toxic substances include pesticides and cleaning agents.

E. Do not disturb the site beyond the area noted on the plans.

1. Protect surrounding area with fencing and erosion control.

2. Prevent spilling chemicals, fuels or waste on site. If a spill occurs, immediately contain and remove affected soils. Dispose in a manner that will not adversely affect the environment and as required by authorities having jurisdiction.

F. Do not leave motors or equipment running when not in active use.

G. Smoking is not allowed on this site.

H. All hazardous, toxic, or poisonous material shall be kept locked in containers when not in use or when left unattended.

3.2 IMPLEMENTATION

A. Contractor shall designate an on-site individual responsible for overseeing the environmental goals of the project. The individual is to instruct workers and keep a daily log of activities and observations related to these environmental goals.

B. Contractor shall inform subcontractors of Environmental procedures and distribute copies of the environmental procedures to all subcontractors and site representatives.

C. The Contracting Officer and Contractor shall review Contractor environmental procedure performance at job site meetings.

D. Environmental goals and procedures shall be discussed at the pre-construction meeting, job safety meetings and other coordination meetings.

E. Contractor shall review sub-contractor environmental procedure performance at weekly meetings.

TESTING LABORATORY SERVICES 014000 - 1

SECTION 014000 - TESTING LABORATORY SERVICES

1.1 DESCRIPTION

A. Work Included

During the progress of the work, the Government will require that testing be performed to determine that materials provided for the work meet the specified requirements.

B. The Contractor shall provide the services of a testing laboratory approved by the Contracting

Officer. It shall be the responsibility of the Contractor to schedule testing services, as required by the Contracting Officer.

C. Related Work Described Elsewhere

Requirements for testing are described in various Sections of these Specifications. Where no testing requirements are described but the Government determines that testing is required, testing will be performed under current pertinent standards for testing.

1.2 QUALITY ASSURANCE

A. Qualifications of Testing Laboratory

The testing laboratory will be qualified to the Government's approval in accordance with ASTM

E329.

B. Codes and Standards

Testing will be in accordance with pertinent codes and regulations and with standards of the

American Society of Testing and Materials.

1.3 PRODUCT HANDLING

A. Promptly process and distribute required copies of test reports and related instructions to ensure necessary retesting and/or replacement of materials with the least possible delay in progress of the work.

PART 2 - PRODUCTS

2.1 PAYMENT FOR TESTING SERVICES

A. The Contractor shall include the cost of testing in the appropriate Bid Items and Bid Options. No additional payment will be approved for testing services.

B. When initial tests indicate noncompliance with the Contract documents, subsequent retesting occasioned by the noncompliance shall be performed by the same testing laboratory, at no cost to the Government.

C. Testing of constituents used in concrete mixtures or of trial test batches of concrete for the purpose of establishing an acceptable design mix for concrete shall be at the Contractor's expense.

D. Any subsequent field testing required by the Contracting Officer shall be at the Contractor's expense.

2.2 CODE COMPLIANCE TESTING

A. Inspections and tests required by codes or ordinances, or by a plan approval authority and made by a legally constituted authority, shall be the responsibility of and shall be paid for by the Contractor, unless otherwise provided in the contract Documents.

2.3 CONTRACTOR'S CONVENIENCE TESTING

A. Inspection or testing performed exclusively for the contractor's convenience shall be the sole responsibility of the Contractor.

3.1 METHODS

A. Cooperation with Testing Laboratory:

Representatives of the testing laboratory shall have access to the work at all times. Facilities shall be provided in order that the laboratory may properly perform its functions.

B. Schedules for Testing

1. Establishing schedule

a. By advance discussion with the Contracting Officer and testing laboratory approved by the Contracting Officer, determine the time required for the laboratory to perform its tests and issue each of its findings.

b. Provide for time required within the construction schedule.

2. Revising Schedule

a. When changes of construction schedule are necessary during construction, coordinate such changes of schedule with the testing laboratory as required.

3. Adherence to Schedule

a. When the testing laboratory is ready to test according to the determined schedule but is prevented from testing or taking samples due to incompleteness of the work, extra costs for testing attributable to the delay shall be borne by the Contractor.

C. Taking Specimens

1. Specimens and samples for testing shall be paid for and are the responsibility of the

Contractor, unless otherwise provided in these Contract Documents, and will be taken by an independent testing laboratory employed by the Contractor; sampling equipment and personnel will be provided by the testing laboratory; and deliveries of specimens and samples to the testing laboratory will be performed by the testing laboratory. Contractor shall deliver cylinders to the testing laboratory for testing unless otherwise directed by the Contracting Officer.

SECTION 014300 - ENVIRONMENTAL PROTECTION

A. The Contractor shall comply with Federal, State, and local laws, regulations and permits concerning environmental protection and pollution control and abatement that are applicable to the Contractor’s proposed operations and the requirements imposed by those laws, regulations and permits.

B. The Contractor shall determine methods for the protection of features to be preserved within the

Contractor's work area and any area of the project site impacted by the Contractor's operation.

C. Resources which require protection under this specification section include trees, shrubs, plants, grass and ground cover, landscape features, fish and wildlife, and air and water quality.

1.2 CONTRACTOR QUALITY CONTROL

A. The Contractor shall establish and maintain a quality control program for the protection of environmental resources as specified herein.

B. The Contractor shall implement environmental protection measures as necessary and as required to insure compliance with all Federal, State and local regulations.

1.3 NOTIFICATION OF NONCOMPLIANCE

A. The Contracting Officer shall notify the Contractor in writing of any observed noncompliance with the Contractor's environmental protection methods and effectiveness of the Contractor's environmental protection program.

B. The Contractor shall, after receipt of such notice, take immediate corrective actions as approved by the Contracting Officer.

C. If the Contractor fails to comply promptly, the Contracting Officer may issue an order stopping, all or part of, the work until satisfactory corrective action has been taken.

D. No time extensions will be granted nor will costs or damages be allowed to the Contractor for any such suspension.

PART 2 - PRODUCTS

2.1 SEDIMENTATION CONTROL STRUCTURES

A. Hay

1. Hay for slope protection and for use as sedimentation barriers shall be clean, fresh, small grain straw.

2. Salt marsh hay shall not be used.

B. Siltation Fence

1. Siltation fence shall consist of filter fabric, a minimum of thirty (30) inches in height, supported with a polypropylene support net and wooden stakes.

2. Wooden stakes shall consist of square oak posts one (1) inch by one (1) inch by four point five (4.5) feet placed in minimum of six (6) feet on center

3.1 PROTECTION OF ENVIRONMENTAL RESOURCES

A. The environmental resources within the project boundaries and those that could be impacted outside the limits of the permanent work under this contract shall be protected during the entire period of this contract.

B. The Contractor shall confine work activities to those areas defined by the contract drawings and/or the specifications.

3.2 PROTECTION OF LAND RESOURCES

A. Prior to the beginning of any construction, the Contracting Officer shall identify land resources to be preserved within the Contractor's work area.

B. The Contractor shall not remove, cut, deface, injure or destroy land resources including trees, shrubs, vines, grasses, top soil and land forms without the expressed written approval of the

C. Ropes, cables, or guys shall not be fastened to or attached to any trees for anchorage unless specifically authorized by the Contracting Officer.

D. Where such special emergency use is authorized, the Contractor shall take effective protective measures for land and vegetation resources at all times as defined within this specification section.

E. Work Area Limits

1. Prior to start of construction, the Contractor shall isolate areas within the general work area which are to be saved and protected.

2. Areas to be saved or protected shall be marked or fenced.

3. Monuments and markers shall be protected before construction operations commence and during construction phases.

4. The Contractor shall convey to personnel the purpose of marking and/or the protecting of features designated to be protected.

F. Protection of the Landscape

1. Trees, shrubs, vines, grasses, land forms and other landscape features to be preserved shall be clearly identified in the field.

2. The Contractor shall mark, fence, or wrap with boards any landscape features that are to be protected.

3.3 PROTECTION OF WATER RESOURCES AND WETLANDS DURING CONSTRUCTION

A. The Contractor shall manage and control construction activities to prevent the contamination of surface and ground waters and wetlands.

B. The Contractor shall monitor water resource areas within the construction areas and project site and shall take preventative measures necessary to insure that contamination does not occur.

C. Construction and restoration activities shall be conducted in a manner that will not cause the siltation of the water, will not cause disturbance of aquatic and wildlife fisheries habitat and will not interfere with the natural flow of water.

D. The Contractor shall not cross brooks, streams or watercourses with construction equipment. No construction equipment shall be physically operated in water.

E. Restoration activities shall minimize alterations of undisturbed portions of any stream, bufferzone or wetland. Work adjacent to and within streams, buffer zones and wetlands shall occur during periods of low water table.

F. Wherever tracked or wheeled vehicles or equipment cause the rutting of bufferzones or wetland areas, vehicles and equipment shall travel and work on mats or platforms.

G. Prior to the start of construction within or near streams, bufferzones or wetlands, erosion control measures shall be installed as shown on the plans and specified herein.

H. The Contractor shall adequately maintain erosion control measures for the duration of the project to prevent the wash of materials or sediment within wetlands or into streams, or other water resource areas.

I. Additional erosion control measures shall be incorporated as directed by the Contracting Officer when the Contracting Officer determines that measures implemented by the Contractor are inadequate.

J. No soil shall be disturbed during any period when soils are saturated due to rain or snow melt.

K. Disturbed soil shall be immediately stabilized. If disturbed areas are not immediately restored, the Contractor shall utilize temporary measures such as sod, mulch, erosion control measures or other comparable, approved methods.

1. Hay or straw mulch, where used, shall be applied at a rate of at least one bale per 500 square feet (1-1/2 to 2 tons per acre) to all disturbed areas.

2. Mulch shall be anchored with netting, peg and twine, or other suitable method along stream and river banks to a minimum distance of twenty-five (25) feet from the stream or river and at other disturbed areas at a slope.

L. Additional measures shall be taken when necessary to prevent the sedimentation of water.

1. Evidence of sedimentation includes the discoloration of water by suspended soil particles, gully erosion or bank or slope erosion.

2. Erosion and sedimentation control measures shall be in place prior to the commencement of work but shall also be installed whenever and wherever evidence of sedimentation of water resources is apparent.

M. No fill other than soil material used to restore an altered steambed, buffer zone or wetland area to a pre-existing elevation shall be placed within a wetland, pond, stream or brook.

N. The transfer and storage of fuels, lubricants, etc. will only be permitted within areas designated by the Contracting Officer and will not be permitted within 100 feet of any wetland or water resource areas.

O. Equipment shall not be parked or stored within wetlands or buffer zones and will only be used within these areas during actual construction operations requiring the use of such equipment and only as allowed by Federal, State and local regulations.

3.4 PROTECTION OF AIR RESOURCES

A. The Contractor shall monitor and manage construction activities to control and minimize the pollution of air resources.

B. Activities, equipment, processes and work performed by the Contractor shall be in strict accordance with the rules and regulations of the State for which the work is being constructed and in accordance with all Federal emission and performance laws and regulations.

C. Particulates

1. Any lead coatings disturbed are to be protected and spread of dust is prohibited. Dust particles, aerosols and gaseous by-products from all construction activities, processing and preparation of materials shall be controlled by the Contractor at all times.

2. The Contractor shall maintain excavations, stockpiles, haul roads, permanent and temporary access roads, plant sites, spoil areas, borrow areas and all other work areas within or outside the project boundaries free from particulates or dust which would cause a hazard or nuisance.

3. Water or chemical treatment, approved by the Contracting Officer, shall be utilized to control air borne particulates in the work area.

4. Particulate control shall be performed as the work proceeds and whenever dust becomes a nuisance or hazard.

D. Hydrocarbon and carbon monoxide emissions from the Contractor's equipment shall meet

Federal and State standards at all times.

CONTRACTOR QUALITY CONTROL 014400-1

SECTION 014400 - CONTRACTOR QUALITY CONTROL

PART 1- GENERAL

A. The Contractor is solely responsible for quality control and shall establish and maintain an effective quality control program throughout the duration of this project in compliance with the Contract Clause entitled "Inspection of Construction."

B. The quality control program shall consist of the plans, procedures and organization necessary to produce an end product which fully complies with requirements of the contract. The system shall encompass all construction operations, both on-site and off-site, including the work by the Contractor's subcontractors, fabricators, suppliers and purchasing agents.

C. Separate payment will not be made for providing and maintaining an effective quality control program, and costs associated there with shall be included within unit prices or lump sum prices contained in the Bidding Schedule.

3.1 QUALITY CONTROL PROCEDURES

A. Prior to the start of any definable feature of work (ie: work which is separate and distinct from other work required by this contract) the Contractor shall perform the following quality control measures:

1. Review the contract plans and applicable specification sections.

2. Verify that materials have been submitted and approved as specified.

3. Examine the work area to assure that required work performed to date work has been completed and is in compliance with the contract documents.

4. Physically examine required materials to insure compliance with approved shop drawings or submitted data and that materials have not been damaged during storage.

5. Insure that damaged or defective materials shall not be incorporated into the work.

Segregate and mark damaged materials for eventual removal from the site.

6. Review applicable safety requirements for the proposed work and insure that adequate safety measures will be in place.

B. Once initial work associated with a definable feature of work has started, the Contractor shall:

1. Establish the level of workmanship and verify that all work meets minimum acceptable standards.

2. Inspect the work to insure compliance with the contract documents.

3. Correct deficiencies and differences immediately.

4. Check that safety requirements are in place.

C. The Contractor shall inspect work performed on a daily basis to insure continuing compliance with the contract requirements including testing as specified. The Contractor shall not build upon or conceal non-conforming work.

3.2 SUBMITTALS

A. The contractor shall thoroughly review submittals to insure complete compliance with the contract documents PRIOR to forwarding submittals to the Government for review.

B. See Section 013000 “Submittal Procedures.”

3.3 COMPLETION OF THE WORK

A. At the completion of the work or any increment thereof, the Contractor shall conduct an inspection of the work and develop a "punch list" of items which do not conform to the contract plans and specifications. The Contractor shall provide a copy of this list to the Contracting Officer.

B. The Contractor shall correct deficiencies.

C. The Contractor shall notify the Contracting Officer in writing at that time when he/she considers the work to be substantially complete.

D. The Contracting Officer shall then inspect the work in accordance with Section 017000

“Contract Closeout.”

E. Inspections and any deficiencies noted shall be corrected within the time stated for the completion of contract.

3.4 DOCUMENTATION

A. The Contractor shall maintain current records of quality control operations and activities including the work of subcontractors and suppliers.

B. These records shall be on an acceptable daily report form and shall include factual evidence that required quality control activities have been performed as specified.

C. Documentation shall include but not be limited to the following:

1. Contractor/subcontractor activities on a daily basis listing the trade, location and description of the work.

2. Operating plant/equipment on site listing hours worked, idle time or down time for repair, as applicable.

3. Tests and/or quality control activities performed with results and references to specifications and plan requirements.

4. Materials received with a statement as to the acceptability of the materials and the manner of storage.

5. Job safety evaluation including reporting of any accidents that may have occurred.

6. Instructions given to or received by the Government.

7. Conflicts with the plans and specifications.

8. Description of trades working on site including the number of personnel from each specific trade.

9. Weather conditions and any delays encountered.

D. The records shall include both conforming and deficient features of the work.

E. The Contractor shall furnish a copy of each daily report to the on site Government representative within forty eight (48) hours after the date covered by the report.

3.5 NOTIFICATION OF NONCOMPLIANCE

A. The Contracting Officer shall notify the Contractor of any identified noncompliance with the quality control requirements of this contract.

1. The Contractor shall, after receipt of such notice, immediately take corrective action.
