About this file

This is an Amendment One document to a Request for Proposal issued by the Kansas Office of the Attorney General's Office of Procurement and Contracts for consumer and public protection litigation services. The amendment addresses vendor questions and clarifications regarding the procurement process. The RFP seeks qualified attorneys and law firms to provide legal representation in consumer protection actions, false claims, fraudulent misrepresentation, negligence, public nuisance, and antitrust actions within Sedgwick County. Written questions were due by March 10, 2026, with proposal submissions due by March 31, 2026, at 2:00 PM Central Standard Time. The contract period extends from the date of award through June 30, 2031. Amendment One clarifies two key points: vendors may submit acknowledgement of amendments in either hard copy or electronic format alongside their technical proposal, and securities portfolio monitoring and representation in securities actions are not required inclusions within the scope of services. All vendors are required to submit a signed copy of this amendment with their bid response.

The compensation structure is contingent fee arrangement not to exceed 20 percent of amounts collected, with contractors advancing all costs and expenses associated with litigation. Contractors must be licensed to practice in Kansas state or federal courts, maintain professional liability insurance of at least $1 million per attorney or $2 million aggregate annually, and comply with Kansas Rules of Professional Conduct. Qualified Disabled Veteran Owned Businesses and Certified Business classifications may claim preferences with appropriate documentation. Bid responses must include detailed qualifications, staffing information, attorney resumes, conflict disclosures, and a completed Tax Clearance Certificate from the Kansas Department of Revenue. All bid responses become property of the State and are subject to disclosure under the Kansas Open Records Act upon conclusion of the selection process. The State reserves the right to accept or reject any or all bid responses and may waive minor deviations in specifications.

Question

Answer

1. 2.1 The instructions in Paragraph 2.1 specify that only one submission is allowed, either electronically or by courier. However, preceding Paragraph 1.10 relating to Acknowledgement of Amendments would be accomplished by "signing return a signed hard copy with the bid.”

All acknowledgements to amendments to the bid documents (including this amendment) can be submitted with the technical proposal (either hard copy by courier or soft copy by email).

2. 4.1. Is Section 4.1. Scope of Services interpreted to include securities portfolio monitoring and representation in securities actions?

No; not a necessary inclusion in scope of services.
