JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
(FAR 16.505(a)(4) and FAR 16.505(b)(2))
Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below using an exception to fair opportunity, pursuant to the authority cited herein.
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:

2. NATURE AND DESCRIPTION OF THE ACTION BEING APPROVED:
Pursuant to FAR 16.505(a)(4) and FAR 16.505(b)(2), the action being approved is an exception to the fair opportunity process. This justification authorizes the use of other than full and open competition for the procurement of services from TRI-COR Industries Inc. to obtain new Senior Application Developer support by modification of J6 Enterprise Technology Services (JETS) Award/Task Order SP4709-17-D-0031/SP4709-23-F-0078.

This Modification must be issued to TRI-COR on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to the Initial Task Order. Small business JETS Indefinite Delivery, Indefinite Quantity (IDIQ) contract holders were provided fair opportunity to be considered for the Task Order award.
This Modification will require the addition of new Contract Line Item Numbers (CLIN) 1007 and 2007 for Award/Task Order SP4709-17-D-0031/SP4709-23-F-0078.
The additional support to be provided is detailed below in Section 3.
3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEED/ESTIMATED DOLLAR AMOUNT:
This requirement is for the Enterprise Applications and Business System Testing Services under Award/Task Order SP4709-17-D-0031/SP4709-23-F-0078.
The Defense Logistics Agency (DLA) Program Executive Office (PEO) communicated a growing technological need in AI and RPA platforms (UiPath and others) and Automated Testing Tools (ATF, OATS and others). To address the PEO’s direction, J62LB Enterprise Testing Office must expand its expertise in automation testing areas using automated testing tools, IA and RPA technology platforms.
J62L has a requirement to increase labor support for EABSTS support services. Under this Modification, TRI-COR will be responsible for performing additional support for the work outlined in Section 2.3.5 Task 6 of the Performance Work Statement (PWS).
TRI-COR will ensure Oversight and standardization of automated testing policy and other related activities across the Enterprise including Automated Testing Tools, Artificial Intelligence (AI) and Robotic Process Automation (RPA) platforms for automated regression and performance testing.
Understanding complex requirements, shifting priorities and ability to provide process improvement strategies.
The Period of Performance start date for the requested increase is August 1, 2025 or as determined by date of modification award. The Option Year 1 scope increase will be funded with FY25 funding:

4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY (SEE FAR
16.505(b)(2)) AND THE SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION
THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE
NATURE OF THE ACQUISITION REQUIRES USE OF THE EXCEPTION CITED:
Pursuant to FAR 16.505(a)(4) and FAR 16.505(b)(2)(i)(B), an exception to the fair opportunity process is justified because award of the additional support described in Section 3 must be issued to TRI-COR on a sole-source basis in the interest of economy and efficiency because this requirement is a logical follow-on to the Initial Task Order issued to TRI-COR via the JETS IDIQ contract vehicle. As indicated in Section 2, small business JETS IDIQ contract holders were given a fair opportunity to be considered for the Initial Task Order award.
The initial Enterprise Applications Business Support Testing Services requirement was solicited to eligible small business JETS IDIQ contract holders in August 2023. The Initial Task Order was competitively awarded to TRI-COR under SP4709-17-D-031/SP4709-23-F-0078 on September 20, 2023.
Due to a significant increase of new requirements supported under the task order, The Program Executive Office (PEO) communicated a growing technological need in AI and RPA platforms (UiPath and others) and Automated Testing Tools (ATF, OATS and others). To address the PEO’s direction, J62LB Enterprise Testing Office must expand its expertise in automation testing areas using automated testing tools, IA and RPA technology platforms. Contractor personnel supporting this Task Area must have experience with testing policy development and standardization of testing activities at the Enterprise level (RPA Platform UiPath for SAP, ATF for Service Now, OATS for Oracle and others). Required expertise includes product research in the area of automation for different platforms (RPAs, SAP, Oracle, ServiceNow, and others).
Excellent writing and presentations skills are required in order to communicate technological trends, market research and implementation results. Communication will include briefs and presentations to Leadership and exchanging information across the Enterprise (presentations, White Papers, reporting, train-the-trainer sessions, etc.).
Contractor personnel supporting this Task Area must be able to design defect tracking strategies at the Enterprise level to track pre-production issues. Contractor personnel supporting this Task Area must be able to develop, build and maintain an automated Defect Tracking Tool(s) at the Enterprise level to track pre-production issues for PEO awareness (ServiceNow/Citizen Developer, Excell, RPA business process automation, etc.). The Tracking Tool may have additional requirements to capture the state of automation and performance testing at the Enterprise level as well as other PEO emerging requirements.
4. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. It is anticipated that the Government will use various price analysis techniques including, but not limited to: (1) Comparison of proposed prices to historical prices paid; (2) Comparison of proposed prices with independent Government cost estimates; and (3) Comparison of proposed prices obtained through market research for the same or similar items such that the anticipated cost to the Government will be fair and reasonable. Prices will be determined fair and reasonable prior to exercising the option.
5. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:

6. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE EXCEPTION TO
FAIR OPPORUNITY BEFORE ANY SUBSEQUENT ACQUISITION FOR THE
SUPPLIES OR SERVICES IS MADE:
At this time, the required Enterprise Business Systems Testing Support Services must be awarded to TRI-COR on a sole-source basis in the interest of economy and efficiency because this new work is a logical follow-on to Task Order SP4709-23-F-0078.
DLA has exercised, and continues to exercise, competition as often as possible and conducts ongoing reviews to keep abreast of new technology and corresponding services, both in industry and Government. DLA uses a variety of vendors, manufacturers, and contracts/orders to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable.
