Q & A to Multifamily Claims Examination Support Services Solicitation

DU100R-12-0002

1. We have read the Organizational Conflict of Interest Requirements for the above referenced solicitation and have the following question. Are there any restrictions with regard to a bidder being a

Prime Contractor on other Multifamily Program contracts? RESPONSE: No

2. Have the requirements of this RFQ been performed by another contractor? RESPONSE: YES

If so, who is the incumbent, what was the contract amount, how many hours by labor category was the contract, and how long have they been performing the work? RESPONSE: Key and

Associates, $2,355,525.00

3. Would the Government please consider extending the due date for the proposal submission?

RESPONSE: The due date will be extended two business days – New due date 12:00 NOON

September 5, 2012.

4. How long have they been under contract performing this work? RESPONSE: 3 YEARS

5. What is the contract number? RESPONSE: C-OPC-23465

6. Is the incumbent eligible to recompete? RESPONSE: The solicitation is open to all 8(a) contractors eligible to perform the work.

7. What are the major challenges a new contractor would take on when assuming this contract?

RESPONSE: To learn the different claim types is the biggest challenge.

8. Are there key personnel performing under the existing contract that the Government would like to have transferred to the new contract? If so how does the Government envision a smooth personnel transition? RESPONSE: It is up to the contractor to hire existing contractors if they wish. The

Government does not require it.

9. Does the Government envision a transition period? If so how do you envision the transition would be executed to provide the Government the greatest benefit and least risk? RESPONSE: There is a two week transition period, where you will meet with the GTR/GTM at the HUD worksite and show/discuss your duties.

10. NAICS Code: 541 -- Professional, Scientific, and Technical Services/541211 -- Offices of Certified

Public Accountants. Is the prime contractor required to have a firm CPA license from its resident state and/or the employees performing the work required to be licensed CPA's? Response: Yes and the employees performing the work do not need to be CPAs, but the project manager needs to be.

11. Is the Incumbent eligible to submit a proposal for this solicitation? RESPONSE: Any 8(a) contractor that can complete the work is eligible to submit a proposal.

12. Will some of the Incumbent’s staff (example, the mid-level employees working in the MFCB) be eligible to work under the new Contractor (if they meet the qualifications for the position)?

RESPONSE: Yes.

13. On page 10, Task 2 it noted “The contractor shall perform annually approximately one hundred fifty

(120) regular claim examinations including hospital and nursing claims.” Is that one hundred fifty

(150) or one hundred twenty (120) regular claim examinations? RESPONSE: 120 regular claims

14. On page 10, Task 3, it noted “In arriving at the appropriate amount to be paid for each claim, the contractor must utilize the same legal instruments and accounting documents as cited in Subtask 1,”.

Should that be the same legal instruments and accounting documents as cited in Subtask 2 instead?

RESPONSE: Subtask 2 instead

15. Page 15, Task 2, Item j. noted, “The examination of assignment claims must be completed within 30 business days of receipt.” “The examination of conveyance and coinsurance claims must be completed within 45 business days of receipt.” Would this be close to the average timeframe for completing examination of these types of claims? Response: No, the average time frames are 4-5 days and 7 -10 days respectively. The longer timeframes allowed are the maximum, in case you run into difficulties obtaining required documents from the mortgagees.

16. Page 19, (first paragraph) noted, If the total number of claims received by the Contractor exceeds forty (40) in a 30 business day period, the noted completion schedule must apply. Does the claims received by the Contractor in excess of forty (40) include all claim types (noted in Task 1 and Task

2)? As noted on Page 15, Task 2, Item j. “The examination of conveyance and coinsurance claims must be completed within 45 business days of receipt.” Please clarify if the examination of conveyance and coinsurance claims are not required to be completed within the 30 days of receipt by

Contractor? RESPONSE: Conveyance and Coinsurance claims must be completed within the 45 day timeframe noted in the statement of work.

17. Do you have a budget or “not to exceed” amount you can provide for this solicitation? RESPONSE:

That information is not available.

18. Page 92, (11) (e) noted “Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.” Can you please clarify these statements? RESPONSE: Please refer to the prescription for FAR 52.212-1.

19. Page 93, Item (h) noted “Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations.” Does this mean the

Government may award the contract to more than one Contractor? RESPONSE: Please refer to the prescription for FAR 52.212-1.

20. Page 4 – 0004-7 Define “Lot”. RESPONSE: Lot is a measure considered as everything.

21. Can HUD provide the current Process Flow diagram with items, hand-offs, and expected delivery times? RESPONSE: This information is not available

22. In two areas of the RFP it is noted that there needs to be, at the Contractor site, space for two HUD employees with access to MFCB system-of-record. Does this means a separate workstation for each of the two (2) HUD employees? RESPONSE: Yes, two separate work stations.

23. Can the COTR supply us with the existing index protocol being used? RESPONSE: This information is unavailable.

24. Task 8 – Can you provide clarification on level of effort or annual average amount of time to assist

HUD in responding to Congressional inquiries, administrative reviews and litigation proceedings?

RESPONSE: The average time for this task is 8-12 hours the occurrence is less than once a year on average.

25. Task 1 - Can you provide an estimate of the average time (or range of time) spent to process a single

Election? RESPONSE: 1-2 hours on average.

26. Task 2 - Can you provide an estimate of the average time (or range of time) spent to process a single

Regular Claim? Response: 3-4 days on average.

27. Can you provide an estimate of the number of positions (FTE) for Task 1, Task 2 and Task 3?

RESPONSE: Three.

28. Can you provide an equivalent GS Pay Scale (Grade) for any of the professional positions that have been staffed for this Contract in the past? RESPONSE: This information is unavailable.

29. Is leased storage space an allowable ODC? RESPONSE: Yes, as long as it meets the requirements stated on the statement of work.

30. Is TEAM a system, a process, a timekeeping system or all? RESPONSE: It is a process that we gather and upload to a program.

31. Page 12 noted HUD will provide the Contractor with up to five (5) days of formal classroom training for three (3) to six (6) Contractor staff. And HUD will provide for training on-site (in the MFCB) for the first sixty days of the task order. Will the Contractor be allowed to bill the Federal Government for the full firm-fixed price during the first sixty days of work on the task? RESPONSE: Yes.

32. I would like to inquire about the following disclaimer posted on FBO for the above referenced opportunity: “Please note: Due to inherent organizational conflict of interests, all classes of mortgagees, lenders or loan servicers are excluded from the competition. This applies to both prime and sub-prime contractors.” Are we still excluded from submitting a proposal in response to this opportunity? No you are not excluded from submitting a proposal. Please review all of the information regarding Organizational Conflicts of Interest in Section F. 2452.209-70 of the solicitation.
