A.1.1 CONTRACTORS SIGNATURE

(a) Individuals. A contract with an individual shall be signed by that individual. SECTION B – SUPPLIES OR SERVICES AND PRICES/COST

B.1. SCA Hourly Rate: This Service Contract Act (SCA) rate is set by the Department of Labor through Wage Determinations. This rate is adjustable at option years. See FAR Clause 52.222-43 -- Fair Labor Standards Act and Service Contract Act -- Price Adjustment (Multiple Year and Option Contracts).

B.2. Wage Premium: In order to receive and maintain the highest quality of staff, it has been determined that a wage premium should be applied in addition to the SCA Hourly Rate.

B.3. Rate Paid to Employee: The SCA Hourly rate plus the wage premium is the hourly rate that should be paid to the employee and is subject to Government inspection for contract compliance.

B.4. H & W Rate: The health and welfare rate is set by the Department of Labor through Wage Determinations. This rate is adjustable at option years. See FAR Clause 52.222-43 -- Fair Labor Standards Act and Service Contract Act -- Price Adjustment (Multiple Year and Option Contracts). This must be paid directly to the employee or provide acceptable Service Contract Act fringe benefits of equal value and is subject to Government inspection for contract compliance.

B.5. Contractor Mark-Up: This is the contractor’s category. For example: profit and overhead costs. That Contractor’s Mark-Up shall be a fixed and non-adjustable cost for the base and all option years.

B.6. Total Hourly Rate: This is the rate that the contractor will bill the agency at for hours ordered. It equals the Rate Raid to Employee + H & W Rate + Contractor Mark-Up.

B.7. Minimum Guarantee: The minimum guarantee for this contract is $50,000.00.

B.8. Contract Ceiling: The contract ceiling for this contract is $5,000,000.

SECTION I

DESCRIPTION/SPECIFICATIONS/PERFORMANCE WORK STATEMENT

1.1 OBJECTIVE (NAICS 541340): This Indefinite Delivery/Indefinite Quantity (IDIQ) contract is for providing non-personal CAD/Drafting services for the Western Federal Lands Highway Division (WFLHD) of the Federal Highway Administration (FHWA) in the facility located at 610 East Fifth Street, Vancouver, Washington. There may be a need for these services at the Optional locations in Sterling, VA and Lakewood, CO. There is no anticipated need for the services at the optional locations at the time of contract award.

Work will be set forth in this contract and in individual Task Orders.

1.2 DEFINITIONS

1.2.1 Contract Clause - Both the Solicitation Provisions and Contract Clauses, are collectively referred to as Contract Clauses.

1.2.2 COR - The Contracting Officer's Representative (COR) who has the authority to administer the contract and task orders. The COR is WFLHD's primary contact with the Contractor. The terms “COR” and “COTR” are used interchangeably within this document and refer to the same position.

1.2.3 FAR – Federal Acquisition Regulation.

1.2.4 Government – Federal Highway Administration

1.2.5 Resume - As used in this contract, a list of information about an individual’s qualification as required to meet the requirements of this contract.

1.2.6 TAM – Transportation Acquisition Manual supplement to the TAR.

1.2.7 TAR – Transportation Acquisition Regulation supplement to the FAR.

1.2.8 PERFORMANCE WORK STATEMENT (PWS) – As used in this contract, each

Task Order will include a PWS that sets forth the services required.

1.2.9 Task Order - Written order by the Contracting Officer requiring the Contractor to provide specified services.

1.2.10 FHWA – Federal Highway Administration acting through the Western Federal Lands

Highway Division.

1.3 DAYS OFF AND SUBSTITUTIONS

The Contractor shall provide for coverage of the position when the employee is on leave, unless otherwise agreed to by the COR. The Contractor shall notify the COR one week in advance of an employee’s scheduled leave and as soon as practical whenever an employee is on unscheduled leave. Except when the COR agrees that coverage is not needed, the Contractor shall provide a substitute for the time the regular employee is on leave. Substitute personnel shall be qualified to meet the general occupational descriptions and must have the approval of the COR. All substitute personnel must have security clearances pursuant to paragraph 3.2 prior to performing work at the site.

1.4 CHANGE OF PERSONNEL AND TRANSITIONS

1.4.1 The Contractor should make every effort to utilize reliable, long-term employees for the purpose of this contract. When a change in personnel is needed, the Contractor shall notify the COR, when possible, no later than 14 working days prior to the change of regularly assigned personnel. When 14 working days prior notice is not possible, the Contractor shall provide notification as soon as possible.

1.4.2 Proposed replacement personnel shall meet the qualification requirements of this contract and be screened by the COR prior to FHWA job assignment. The Contractor shall submit the qualifications of the proposed replacement personnel to the COR. The Government will notify the Contractor within 3 days if the submitted qualifications do not meet the minimum qualifications. If the qualifications are acceptable, no notification will be made.

1.4.3 The training time for a new employee shall not be charged to the Government. The new employee will have access to the agency’s CAD/Bentley learning system at no charge to the contractor.

1.5 REPLACEMENT OF CONTRACTOR PERSONNEL

The Contracting Officer shall have the authority to require the dismissal from work of those employees deemed incompetent, careless, insubordinate, unsuitable, or otherwise objectionable, or whose continued employment is deemed contrary to the public interest or inconsistent with the best interest of national security; see TAR Clause 1252.237-70, Qualifications of Contractor Employer. Personnel removed due to Government determination of unsuitability shall be replaced within 7 days.

1.6 REMOVAL OF CONTRACTOR EMPLOYEE BY GOVERNMENT REQUEST

The Contractor must comply with any removal request. For clarification, a determination to remove an employee will be made for, but is not limited to, incidents involving the most immediately identifiable types of misconduct or delinquency as set forth below:

a. Failure to receive a suitability determination, temporary clearance, or clearance from

FHWA.

b. Violation of Federal, State, or local law.

c. Violation of the Rules and Regulations Governing Public Buildings and Grounds, 41

CFR 101-20.3. This includes the carrying or possession of explosives, or items intended to be used to fabricate an explosive or incendiary device.

d. Falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records, or concealment of material facts by willful omissions from official documents or records.

e. Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words or actions, fighting, or participation in disruptive activities, which interferes with the normal efficient operations of the Government.

f. Theft, vandalism, immoral conduct, or any other criminal actions.

g. Selling, consuming, or being under the influence of intoxicants or substances which produce similar effects while in or on Federally-controlled property.

h. Improper use of Government identification.

i. Unauthorized use of Government communication equipment on Government property.

j. Violation of security procedures or regulations.

k. Violation of Title 18, U.S.C., Section 930, which prohibits the knowing possession or the causing to be present of firearms or other dangerous weapons in Federal facilities and Court facilities.

The Contracting Officer will make all determinations regarding the removal of any employee(s) from work site(s), except under certain conditions, with concurrence by the contractor. When a Contracting Officer is not available, either during the day or after hours, or in situations where a delay would not be in the best interest of the Government or is identified as a potential threat to the health, safety, security, general well-being or operational mission of the facility and its population, the COR will have the authority to notify the contractor for concurrence in immediate removal of the contractor employee from the work site.

1.7 CONTACT PERSON

The Contractor shall designate a contact person for this contract. This person shall be the Government’s contact for Task Orders, invoices, and any other information required for this contract. The contact person shall be designated in writing. Any substitution of the contact person must be provided by written notice to the Government.

1.8 CONTRACTOR’S SUPERVISORY OVERSIGHT

1.8.1 The Contractor, and not the Government, shall control, manage, and supervise performance of

Contractor employees while performing the services required under the contract.

1.8.2 The Contractor shall provide written notification to the Contracting Officer of the name and contact information of the Contractor’s supervisor for each task order. This can be the local Drafting Lead or a level higher than this position.

1.9 PROTECTION OF INFORMATION

1.9.1 Performance under this contract may require contractor access to data and information proprietary to FHWA, to another government contractor, or of such nature that its dissemination or use, other than as specified in this contract, would be adverse to the interests of the Government and/or others. Employees shall not divulge or release data or information developed or obtained under performance of this contract, except to authorized government personnel or upon written approval of the Contracting Officer.

Employees shall not use, disclose or reproduce proprietary data other than as specified in each task order.

1.9.2 Inquiries received by the Contractor for work performed under this contract shall be referred to the COR for evaluation under the Freedom of Information Act. The determination of whether records will be released shall remain with FHWA. The Contractor is responsible for search and submission of records upon request by the COR.

1.9.3 Contractor personnel requiring access to WFLHD computer systems shall receive, as a minimum, initial training on protection of information and the implications of the Economic Espionage Act of 1996 (Sections 1831 thru 1839) and the Privacy Act.

Documentation of the training shall reflect the date of the training and the names of the individual(s) in attendance and forwarded to the Contracting Officer. The Economic Espionage Act can be found at http://www4.law.cornell.edu/uscode/18/1831.html.

1.10 QUALITY CONTROL/ INSPECTION

The Contractor shall establish and implement a complete Quality Control Plan (QCP) to assure the requirements of the Contract are met. The QCP is a system for identifying and correcting deficiencies in the quality of services before the level of performance becomes unacceptable.

The QCP shall be prepared by the Contractor and provided to the Contracting Officer as part of the offeror’s proposal for review and acceptance by the Government.

The QCP shall include, at a minimum:

1) Responsibilities and authorities of Contractor Management and representatives

2) Description of services and duties of employees

3) Quality Assurance/Training plan for employees

4) Plan for separation of employees and employee absence

5) Evaluation criteria for contract services. The Contractor shall state how it will monitor deficiencies of work output in relation to the performance standards, methods of informing employees of deficiencies in their area(s) of responsibility, and a process to ensure that the deficiencies are corrected and do not reoccur.

6) Random and Planned Inspection criteria

7) An inspection plan and checklist tailored to the specific services under this contract that includes performance indicators/ inspection processes and methods. The inspection plan shall detail how services at the work site shall be inspected to ensure that the outcome of the work meets all the quality standards set forth in the Contract. The inspection plan shall include a QCP inspection form(s) to be used for inspections, which form shall include, but is not limited to:

• Date of inspection performed

• Location of inspection

• Description of findings

• Description of corrective action(s) taken for unsatisfactory inspection

• Signature and date of completion

The QCP is a living document and may be subject to change depending on the needs of the contract. When the QCP is revised the Contractor is required to provide an updated QCP to the Contracting Office and COR for acceptance.

1.10.2 The COR may perform inspections of the work of the products and services of the Contractor.

The COR may invite the Contractor to join in the Government’s inspection

1.11 QUALITY ASSURANCE/TRAINING

1.11.2 The Contractor is responsible for ensuring that its employees are kept current on the latest standard office CAD technology. The Contractor shall provide cross training where back up is necessary. The Contractor shall provide all training for replacement personnel at no cost to the Government.

1.11.3 The Contractor’s employees will have unlimited access to Bentley Learn Lessons at no cost to the contractor; this is a learning/training module within the Microstation Computer Aided Drafting Software that is used at the agency.

1.11.4 The Contractor is responsible for the quality, technical accuracy, and the coordination of work performed or services provided under this contract and subsequent task orders. All work shall be neat, well organized, and fully comply with the requirements of this contract and the respective task orders. The Government may reject any service performed that does not comply with the above.

SECTION II

GOVERNMENT-FURNISHED PROPERTY AND SERVICES

(On-Site Support)

2.1 OFFICE

2.1.1 The Government will provide office space with furnishings. Utility bills will be the responsibility of the Government.

2.1.2 The Government will provide access to telephone, FAX and computer necessary to perform the work requirements. Contractor employees may not use Government long distance telephone services for communication on Contractor matters or personal matters. The Contractor shall provide its employees with alternative means to contact the Contractor (i.e. a calling card, an 800 number, a cell phone, etc.)

2.1.3 The Government will provide all office supplies and equipment (paper, pencils, staplers, etc.).

Some property will be assigned to the Contractor for the exclusive, or near exclusive, use by Contractor employees for use on Government work. Upon completing this contract/task order, the Contractor shall follow the instructions of the Contracting Officer regarding the disposition of all such Government-furnished property not consumed in performing the contract/task order or previously delivered to the Government for use on Government work.

2.1.4 The Government will provide all standard issue furniture. Any other furniture or appliance required by a contractor employee beyond standard issue in order to satisfactorily perform assigned duties will be the responsibility of the contractor.

2.1.5 The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor’s failure to use reasonable care causes damage to any of this property/equipment, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contactor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

2.2 SERVICES

The Government will provide printing/reproduction services and pick-up/delivery of official FHWA mail. Office copiers are provided for official Government use only. Contractor personnel may not use Government provided envelopes or postage, except as permitted by the Contracting Officer and only for official Government mail.

2.3 SECURITY

2.3.1 Access to the FHWA facility is strictly controlled and requires all non-federal personnel entering the site to wear either a visitor badge or a DOT identification badge.

2.3.2 Electronic entry devices shall be issued to each Contractor employee whose workstation is located within the WFLHD facility. The COR is responsible for coordinating with office administration for the issuance of entry devices to new hires, and the return of devices upon contract employee termination.

2.3.3 Contractor personnel receiving electronic entry devices shall only utilize those devices for entry in support of duties to meet the requirements of this contract. These electronic entry devices shall remain in the possession of the individual it is assigned to and shall not be “loaned” to any other person. Any Contractor personnel abusing the use of these devices may be removed from this contract. The electronic entry device shall be returned to the COR upon the individuals release from the contract or contract completion, whichever occurs first.

SECTION III

GENERAL INFORMATION

3.1 SAFETY

3.1.1 All work performed by contractor and Contractor employees shall be performed safely. The

COR will provide safety training to the Contractor Supervisor that describes actions to take in the event of an emergency at FHWA. The Contractor Supervisor will be responsible to provide safety training to the Contractor staff.

3.1.2 Each Contractor employee provided by the Contractor is expected to have full command of the

English language and be able to provide clear communications to emergency responders and FHWA staff in the event of an emergency.

3.1.3 The Contractor shall maintain safety and health standards. FHWA reserves the right to conduct investigations of all mishaps which occur as a result of contractor operations in which there is reportable damage to government property or equipment, or occupational injury or illness to personnel.

3.2 SECURITY CLEARANCE

Contractor Employees who will work in FHWA facilities and who will have access to the DOT network, access sensitive information, or access to DOT resources cannot begin work until all of the following has been completed:

1) The “Required Security Documentation” listed in the table below is received by FHWA directly from the Contractor Employee (The government will provide the security clearance investigation forms to the Contractor for completion by the Contractor Employee); and

2) The COR issues a Notice to Proceed or other official notification that the Contractor Employee is cleared to report for duty.

The Contractor Employee shall submit Items 1-9 of the “Required Security Documentation” listed in the table below directly to the WFL COR Security Liaison within ten (10) days of selection for a position. Neither the Contractor Employee’s supervisor nor other Contractor Company personnel may have access to the information in Items 3, 4, 5, 8, 10, and 11 in the table below.

• If the Contractor Employee does not receive the eQIP email within four (4) days from the date the documentation for Items 1-9 is sent to WFL, the Contractor Company shall immediately email the COR and WFL COR Security Liaison (WFLCORSecurityLiaison@dot.gov).

• The Contractor Employee must access the link and follow the instructions to complete the questionnaire and forms within the three (3) day limit.

• At the end of the eQIP questionnaire, the Contractor Employee must print, sign, release the application and scan the signature pages to upload into eQIP. If documentation cannot be scanned, the Contractor Employee must send the hard copies to the WFL COR Security Liaison.

• FHWA will not reimburse the Contractor for the time and expense incurred by the Contractor

Employee to complete the paperwork or the eQIP questionnaire. The Contractor Employee will not have access to a government computer until the process is completed and the employee is cleared.

Once all of the items listed in the table above are received and processed by FHWA Personnel Security, the COR will notify the Contractor whether the Contractor Employee is cleared to report for duty. If the Contractor Employee is required to report to duty in less than four (4) days from the date all of the documentation has been submitted to FHWA, the Contractor Company should request expedited processing and ensure that all documentation has been completed and submitted to FHWA. The FHWA will consider requests for expedited clearance on a case by case basis.

This clearance process enables the Contractor Employee to report for duty. Final clearance is granted by the Office of the Secretary of Transportation (OST) after the background investigation is complete.

Completion of the background investigation can take months depending upon the actual investigation findings and the depth of the investigation that results from those findings.

The Contractor Company will be notified when an employee is determined unsuitable and will be required to withdraw or remove the Contractor Employee from all duties under this contract.

The Contractor Company should contact the COR to determine the required documents for Contractor Employees who previously have been assigned to a contract with FHWA.

Contractor Employees who do not need to have and will not have connectivity to the DOT network, access to sensitive information, or access to DOT resources are exempt from the requirement to obtain a security clearance.

The Government will provide the contractor employee with a Federal Government issued photo identification card. While on the government worksite, the contractor shall prominently wear at all times either a Temporary Federal ID Card or the Permanent Federal ID badge once it is received. It should be displayed on an outer garment at all times at the workplace.

3.3 OFFICE CLOSURE/UNFORSEEN SHUTDOWN

3.3.1 In the event the FHWA offices are closed due to official Government closures such as Federal Holidays, contractor and contractor employee costs on such designated days are included in the contractor’s overhead and are not billable to the Government. Costs incurred after office shutdown due to weather, natural disasters such as an earthquake, flood, etc., or a pandemic epidemic will not be billable under the Contract.

In the event the FHWA offices are closed due to extra holidays granted by Presidential Order, or Government Administrative leave not due to weather or other natural disaster, contractor employee costs can be billed to the Government.

When the office is shut down after start of a workday, the direct cost/labor charge to the contract would be allowed only for those contractor employees who had reported to work on the day the office was shut down. Any other pay to the contractor employees on these days is at the discretion of, and cost to, the contractor.

The Contractor and Contractor Employees can call the toll free FHWA Emergency Line for status of office opening/closure at (866) 935-8262.

3.3.2 Legal Holidays – the following holidays are observed by the Federal Government and contract employees will not have access to the Government facilities on these days:

3.4 PROHIBITED POLITICAL ACTIVITY

Contractor personnel shall not engage in any political activity while at the FHWA facility or while using Government equipment. Such activity includes the wearing of campaign paraphernalia, discussing partisan political issues, campaigning, or soliciting funds or votes.

SECTION IV

Provide drafters/CAD operators who are proficient in drafting and CAD operations. Drafters/CAD operators shall meet the requirements set forth below, including both the Service Contract Act Directory of Occupations for Drafter II and the Agency Specific Performance Work Statement. The drafters/CAD operators will be responsible for generating and providing design drawings for FHWA in a timely manner, as requested under task orders issued by the CO. FHWA anticipates a need for 2 drafter /CAD operator II positions and 1 lead drafter/CAD operator.

4.1 US DEPARTMENT OF LABOR WAGE AND HOUR DIVISION (WHD) Service Contract Act Directory of Occupations:

Drafter II (29062)

Prepares various drawings of such units as construction projects or parts and assemblies, including various views, sectional profiles, irregular or reverse curves, hidden lines, and small or intricate details.

Work requires use of most of the conventional drafting techniques and a working knowledge of the terms and procedures of the occupation. Makes arithmetic computations using standard formulas. Familiar or recurring work is assigned in general terms. Unfamiliar assignments include information on methods, procedures, sources of information, and precedents to follow. Simple revisions to existing drawings may be assigned with a verbal explanation of the desired results. More complex revisions are produced from sketches or specifications which clearly depict the desired product.

Typical assignments include:

From a layout and manual references, prepares several views of a simple gear system. Obtains dimensions and tolerances from manuals and by measuring the layout.

Prepares and revises detail and design drawings for such projects as the construction and installation of electrical or electronic equipment, plant wiring, and the manufacture and assembly of printed circuit boards. Drawings typically include details of mountings, frames, guards, or other accessories; conduit layouts; or wiring diagrams indicating transformer sizes, conduit locations and mountings.

Draws base and elevation views, sections, and details of new bridges or other structures; revises complete sets of roadway drawings for highway construction projects; or prepares block maps, indicating water and sewage line locations.

4.2 AGENCY SPECIFIC PERFORMANCE WORK STATEMENT

Requirements: Two years of CAD software working experience.

Completion of two years of college with coursework demonstrating proficiency in CAD software applications.

One year of experience as a team lead or supervisor.

General Duties: The Lead Drafter will manage and prioritize workload and assign work to self and other drafters. Mentor and train new drafters. Manage and or report personnel issues for resolution.

The drafter will be required to prepare various drawings on Microstation V8i from Bentley of such units as construction projects or parts and assemblies, including various views, sectional profiles, irregular or reverse curves, hidden lines, and small or intricate details. Work requires use of most of the conventional drafting and CAD techniques and a working knowledge of the terms and procedures of the

SECTION V

Ordering By Other Federal Lands Highway Divisions

5.1 Other Divisions Ordering Services:

Orders for Optional Locations: There are two optional locations – Central Federal Lands Highway Division located in Lakewood, CO, and Eastern Federal Lands Highway Division located in Sterling, VA. If work is to be performed in these locations, the contractor will be provided a synopsis of the upcoming request and provided adequate time to coordinate resources and prepare for performance. The hourly rates in the schedule will be utilized as the basis for negotiations for pricing work in the optional locations. Ordering Contracting Officers in other Federal Lands Highway Divisions will be assigned and designated in writing by the FHWA CO in the Western Federal Lands Highway Division Office.

E.1 ROLES OF GOVERNMENT PERSONNEL AND RESPONSIBILITY FOR CONTRACT

ADMINISTRATION

E.1.1 CONTRACTING OFFICER (CO). The Contracting Officer (CO) has the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The CO may authorize certain representatives (COR) to act within the limits of their authority as delegated by the contracting officer letter for delegation of authority.

E.1.2 TAR CLAUSE1252.242-73 CONTRACTING OFFICER’S TECHNICAL REPRESENTATIVE

(COTR) (Oct 1994)

(a) The Contracting Officer may designate Government personnel to act as the Contracting Officer's Technical Representative (COTR) to perform functions under the contract such as review and/or inspection and acceptance of supplies, services, including construction, and other functions of a technical nature. The Contracting Officer will provide a written notice of such designation to the Contractor within five working days after contract award or for construction, not less than five working days prior to giving the contractor the notice to proceed. The designation letter will set forth the authorities and limitations of the COTR under the contract.

(b) The Contracting Officer cannot authorize the COTR or any other representative to sign documents (i.e., contracts, contract modifications, etc.) that require the signature of the Contracting Officer.

E.2 DOCUMENTATION OF INSPECTION AND ACCEPTANCE

The COR is responsible for the performance of inspections of deliverables upon receipt by the Government and/or evaluations of services completed to date, documentation of every inspection/evaluation, and providing the Contractor with copies of all inspection/evaluation reports.

E.3 ACCEPTANCE

Acceptance shall be considered at the time when all services have been performed and all records have been delivered to and inspected by the COR.

E.4 FAR CONTRACT CLAUSE

E.4.1 52.246-4 INSPECTION OF SERVICES—FIXED PRICE (Aug 1996)

(a) Definitions. "Services," as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may (1) require the Contractor to take necessary action to ensure that future

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may

(1) by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or (2) terminate the contract for default.

Performance is defined as the time from commencement of work until all services and deliveries have been inspected and accepted as complete and in accordance with contract requirements.

F.4 WORK BY OTHERS

The Government reserves the right to undertake by contract, by Government personnel, or by other means, the same or similar kinds of work as contracted for in this contract, depending on the availability of resources. Such actions shall not be violations of this contract, and shall not be considered as terminations in whole or in part of any work procured through this contract.

F.5 TASK ORDERS

F.5.1 GOVERNMENT’S ACTION

The Government will send the contractor a Task Order requesting CAD/Drafting Services. At a minimum, the Task Order will include the following:

(a) Task Order name and number

(b) Location

(c) Description of service required under the task order.

F.5.2 REVIEW OF PERSONNEL QUALIFICATIONS

The Government will review the submitted personnel qualifications upon receipt from the Contractor. The Government will notify the Contractor within 3 days if the submitted qualifications do not meet the minimum required qualifications required for the task order.
