About this file
This is a Drug-Free Workplace Act Certification Form required by the South Carolina Department of Disabilities and Special Needs (SCDDSN) for contractors and vendors seeking state contracts. The certification applies to all domestic contracts for goods, construction, or services with a stated or estimated value of fifty thousand dollars or more. The form requires certification from either business entities or individuals, with different requirements for each classification. Business entities must establish comprehensive drug-free workplace policies, including publishing workplace prohibition statements, implementing drug-free awareness programs, requiring employee acknowledgment of policies, establishing reporting procedures for drug convictions, and maintaining good faith efforts to sustain drug-free operations. Individuals must certify that they will not engage in unlawful manufacture, distribution, dispensation, possession, or use of controlled substances during contract performance.
Contractors and vendors must comply with South Carolina Code Ann. 44-107-30 and 44-107-40, which mandate drug-free workplace compliance as a condition of contract eligibility. Business entities are required to notify SCDDSN within ten days of receiving notice of employee drug convictions and must take appropriate personnel action, including potential termination, or require satisfactory participation in approved drug abuse rehabilitation programs within thirty days of receiving conviction notice. The certification form must be signed and dated by an authorized representative, with the applicable certification statement selected based on whether the certifying party is a business entity or individual. This requirement applies uniformly across all state contracts meeting the fifty-thousand-dollar threshold.
