1. Site Description The Lawrence Berkeley National Laboratory (LBNL) is located in the Berkeley hills, within the city limits of Berkeley and Oakland in Alameda County. The land is owned by the Regents of the University of California (the University), and has numerous buildings and smaller structures, including mobile trailers. See the LBNL Fire Hydrant Map.pdf and LBNL Site Map.pdf documents for Site Maps. Most larger buildings are of noncombustible construction.
Smaller and temporary buildings are of both noncombustible and combustible construction. Of the approximately 226 buildings and structures on the LBNL main campus, almost all buildings are equipped with automatic sprinklers or are equipped with automatic fixed fire-suppression systems. Upon activation of any detection or suppression system, an alarm signal is sent via local dialer to a UL Listed Central Station. Alarm information is then transmitted to the Alameda County Regional Emergency Communications Center (ACRECC) for dispatch.
Almost all buildings are protected by fire alarm systems that consist of heat detectors and/or smoke detectors, manual pull stations, fire alarm bells, and visual notification appliances.
These systems warn building occupants automatically as well as summon the Lab’s subcontracted Fire Department in the event of a fire. LBNL has approximately 5,000 full-time and part-time employees. The Subcontractor shall provide fire suppression, hazardous materials response, emergency medical response, technical rescue, and assigned fire prevention services as further described below.
2. Subcontractor Qualifications The Subcontractor shall maintain a minimum of Public Protection Classification of Class 3 based on the Insurance Services Office’s (ISO) Fire Suppression Rating Schedule (FSRS). The Subcontractor shall furnish a copy of the report on the ISO grading to LBNL.
3. Responsibility of the Subcontractor The Subcontractor shall assume full responsibility for operating the fire department at LBNL, including minimum staffing and fire apparatus as prescribed in this Statement of Work.
Subcontractor shall be responsible for providing full-time fire suppression and rescue services;
emergency dispatch and communications; technical rescue; pre-incident planning; assigned fire prevention activities; emergency medical services; participation in LBNL emergency management training, drills, and exercises; and the inspection, maintenance, and testing of the Subcontractor-provided and Government Furnished Property (GFP) and equipment as required by as required by applicable laws and terms of this subcontract and industry standards. Unless specifically identified as cost reimbursable activities under SLINs 002 and 003, all work effort described herein as the subcontractor’s responsibility shall be performed as a part of the firm-fixed priced work effort. The Subcontractor shall be responsible for coordinating the delivery of these services with the University Technical Representative. More specifically this responsibility includes, but is not limited to, the following activities:
3.1 Transition of Services: During the Transition of Services, the Subcontractor must:
● Identify assigned Subcontractor personnel and have the assigned personnel complete required LBNL training.
● Conduct LBNL site walk-throughs for the development of pre-incident planning.
3.2 Minimum Staffing: The Subcontractor must meet the following staffing requirements.
Staffing On Duty Period of Time
Battalion Chief
The position must function as both management/oversight of operations, and on-scene command in the case of a major event.
The management/oversight function is a Monday through Friday business day function.
On-scene command in the case of a major event can happen at any time.
The Battalion Chief is not an LBNL on-site position.
One (1) Engine Company consisting of four (4) personnel:
● Captain
● Engineer
● Firefighter
● Firefighter
24 hours per day, 7 days per week, 365 days per year
(Note - one Engine Company must be on duty at any given time)
● At a minimum, a Battalion Chief or higher Chief Officer shall be assigned to manage the daily operations of the on-site fire department personnel and equipment. The Chief Officer shall, in respect to hours, shifts, duties, etc., be governed by the Subcontractor’s procedures and supervision. The assigned Chief Officer shall serve as a manager and representative of the Subcontractor’s Fire Chief to directly coordinate and manage the assigned fire prevention and fire protection services at LBNL.
This Chief Officer shall directly supervise the assigned fire suppression staff at the LBNL Station and shall have the authority to make decisions on immediate issues and shall coordinate and implement Subcontractor and DOE fire prevention and protection policies applicable to LBNL. The Chief Officer’s activities shall include ensuring all aspects of the Fire Suppression subcontract are met, maintaining a constant state of readiness, and establishing working relationships with LBNL Security & Emergency Services Division (SES), LBNL Health Services, and other LBNL support organizations. Other duties include attendance when requested at staff meetings of the department or group to which the subcontract is assigned, attendance at specified safety committee meetings, activity pre-planning meetings, and other meetings relating to fire suppression and prevention activities.
The Chief Officer shall be the day-to-day contact point for the Subcontractor’s communications with the LBNL PPC or University Technical Representative.
● Engine Company minimum staffing is four (4) personnel consisting of a Captain, an Engineer, and two Firefighters as noted below. Assigned Engine Company staffing should ensure the same personnel are assigned to LBNL. Substitutions are to be minimized.
● The Engine Company Captain shall be assigned to each shift and be responsible for the day-to-day supervision, training, and direction of the engine company. The Captain is responsible for knowing and implementing all aspects of the Fire Suppression subcontract as they relate to response, safety, incident command, and workplace rules at LBNL.
● The Engine Company Engineer must be qualified to operate the fire apparatus assigned to LBNL.
● Two (2) Engine Company Firefighters (non-probationary) must be capable of performing all duties under this subcontract.
All Engine Company personnel must meet the requirements to operate as an Alameda County EMS Agency Emergency Medical Technician (EMT). At least one Firefighter on the Engine Company must meet the requirements to operate as an Alameda County EMS Agency Paramedic.
All Engine Company personnel must be trained to the Hazardous Materials First Responder Operational level as a minimum, with three of the four responding personnel trained to the Technician level or higher, as outlined in National Fire Protection Association (NFPA) 470 Hazardous Materials/Weapons of Mass Destruction (WMD) Standard for Responders.
● All Subcontractor personnel assigned to work at LBNL shall continuously meet all the Subcontractor’s requirements for training, performance, attendance, behavior, physical fitness, in the appropriate uniform when in public, and any requirements of a Collective Bargaining Agreement.
3.3 Apparatus at LBNL:
3.3.1 Type 1 Fire Engine, to be provided and maintained by the subcontractor: A Type 1 Fire
Engine used for structural fire response, emergency medical services, and initial rescue response. The apparatus must meet the minimums of Type 1 fire engine as defined by the National Wildfire Coordinating Group or equivalent, must not be greater than 15 years old, plus the following:
● Fire suppression capability:
● Water tank, minimum of 500 gallon capacity
● Fire pump with operating pressures:
● minimum of 1,500 GPM at 150 PSI
● minimum of 750 GPM at 250 PSI
● Fire hose minimums:
● 1 inch hose, 300 feet
● 2.5 inch hose, 800 feet
● 1.75 inch hose, 800 feet
● 5 in hose, 800 feet
● 1.5 inch hose, single jacket, 400 feet
● Foam System capable of 150 psi and,
● 100 GPM at 3% foam
● 300 GPM at 1% foam
● 600 GPM at .5% foam
● Equipment minimums:
Ladders meeting NFPA 1931 standards or demonstrated equivalency:
● 24 foot wood extension ladder
● 14 foot wood roof ladder
● 10 foot wood attic ladder
● Pike pole, 6 foot and 10 foot
● PVC hard suction hose, 10 feet
● Rubbish hook
● Cab air conditioning and heating, with defroster capability
● Inverter rated at 825 watts
● Seating for a minimum of four personnel
● Shore tie receptacle with auto eject for 120V, 20A service
● Exhaust exit on right side of apparatus
Safety equipment:
● Vehicle Data Recorder capable of storing vehicle information to include time and date, engine parameters (e.g., engine RPM, throttle position), vehicle speed, seat belt buckle status, acceleration and deceleration velocities
● Intercom system for four positions inside cabin with radio integration for driver and officer, radio monitor and intercom for other occupants
● Back up camera system with alarm
● Siren system
● Airhorn system
Flashing warning lights that conform to California Title 13
Physical dimensions, not to exceed:
● Maximum overall length of 35 feet
● Maximum overall height of 14 feet
● Maximum overall width of 100 inches
Due to the unique topography and tight turns required to navigate the LBNL site, turning performance must not exceed:
● Wall to Wall turning radius of 33 feet
● Curb to Curb turning radius of 30 feet
● Additionally, due to steep inclines at the LBNL site, the apparatus must have a combination of engine power, tire/wheel size and, rear axle gearing conducive to safe operations at rated maximum gross vehicle weight.
Apparatus must support the execution of all applicable Statement of Work requirements in the LBNL subcontract to include the documentation of dispatch time, turn out time, and response times.
Service provider must conduct all maintenance for Type 1 Fire Engine and provide an engine in kind for maintenance periods where the apparatus is not in service at the LBNL fire station.
3.3.2 Type 6 Wildland Engine, to be provided and maintained by the subcontractor: A Type 6 Wildland Engine (or Patrol) is used for initial attack of wildland fire response and acts as a support platform for structural fire and rescue response. The apparatus must meet the minimums of a Type 6 fire engine as defined by the National Wildfire Coordinating Group or equivalent, must not be greater than 10 years old, plus the following:

Fire suppression capability:
● Water tank, minimum of 400 gallon capacity
● Fire pump with “pump and roll” capability with diesel engine
● Fire pump with operating pressures:
○ minimum of 150 GPM at 50 PSI
○ minimum of 50 GPM at 300 PSI
● Fire pump must be plumbed to front discharge manifold
● Fire pump must be plumbed to support .75” and 2.5” hose at rear
● Ground sweep discharges at the front bumper
● Fire hose minimums:
○ 2 hose reels with 100 feet of .75” hose
● Foam System capable of 200 psi and,
○ Selectable proportioning rates
○ Foam flow meter
Equipment minimums:
● Stokes basket or equivalent
● Shore tie receptacle with auto eject for 120V, 20A service
● Appropriate scene and work lighting to safely operate in low light conditions
● Back up alarm
● Siren system
● Flashing warning lights that conform to California Title 13
Apparatus must support the execution of all applicable Statement of Work requirements at LBNL to include the documentation of dispatch time, turn out time, and response times.
Service provider must conduct all maintenance for apparatus and provide a resource in kind for maintenance periods where the apparatus is not in service at the LBNL fire station.
3.3.3 Type 2 HAZMAT Apparatus, to be provided and maintained by the subcontractor: A Type 2 HAZMAT vehicle to be used for hazardous materials response as defined by Cal OES or equivalent. Apparatus shall not be greater than 20 years old plus the following:
Seating for four personnel with appropriate communication equipment for internal and external communications.
On board power generation to support ongoing emergency equipment, lighting, and communications.
Monitoring and detection:
● 4 Gas monitoring
● Flammable gas monitoring
● Toxic gas monitoring
● Radiological monitoring
Personal Protective Equipment:
● Level A chemical protective ensembles
● Level B chemical protective ensembles
● High and low temperature gloves
Leak patching kits for tank trucks and piping Field testing equipment for Hazard Categorization efforts Technical reference data to include
● Computer for chemical analysis and plume modeling
● Camera for scene characterization
● Air monitoring capability
Safety equipment:
● Vehicle Data Recorder capable of storing vehicle information to include time and date, engine parameters (e.g., engine RPM, throttle position), vehicle speed, seat belt buckle status, acceleration and deceleration velocities

3.4 Duty to Remain at LBNL: The on-duty Engine Company personnel assigned to LBNL are dedicated to the LBNL site and their primary obligation is to remain at LBNL and assist LBNL as needed. The Engine Company shall not leave the LBNL site for non-emergency activities (training, maintenance, etc.) unless and until a replacement Engine Company is assigned to and arrives at LBNL. The one exception is listed below:
● A single member of the on-duty Engine Company personnel may leave the LBNL site in the Type VI patrol unit fire vehicle for a maximum duration of one hour as follows:
o Mondays through Fridays, before 9:00 AM, and after 5:00 PM.
o On Saturdays, Sundays, and LBNL holidays, before 10:00 AM and after 4:00
PM.
o At least one Firefighter on the Engine Company meeting the requirements to operate as a Paramedic must remain on the LBNL site at all times.
3.5 Coordination with LBNL Site Operations Center: The Subcontractor shall be the primary responder to all structural and/or wildland fires, hazardous materials incidents, medical emergencies, and technical rescue events at LBNL.
The Subcontractor’s dispatch center must immediately notify the LBNL Security Operations Center for all activities of its assigned Engine Company.
3.6 Hazardous Waste Handling Facility: The Subcontractor’s personnel are a required component of the response to events at the Hazardous Waste Handling Facility (HWHF), Building 85/85A as described in the Section VIII Contingency Plan of the Hazardous Waste Treatment and Storage Permit Application, Part B, as revised. Please see the Section VII Contingency.pdf document. The Subcontractor must become part of a Unified Command for all HWHF events and coordinate its activities with the LBNL Incident Commander.
3.7 Automatic/Mutual Aid: The Subcontractor must have and maintain automatic and/or mutual aid agreements with neighboring fire departments. In the event of an emergency which occurs under an automatic aid or mutual aid agreement, the Engine Company may respond for assistance, provided that the LBNL Security Operations Center is notified.
3.8 Required Inspections: The Subcontractor is required to perform the following inspections as directed by LBNL:
● Buildings and built-up areas - Inspect all areas of LBNL not less than twice per year to ensure familiarity with building, hydrants, Fire Department Connections, hazards, and other features of the Pre-Incident Plans, as outlined in NFPA 1660 Standard for Emergency, Continuity, and Crisis Management: Preparedness, Response, and Recovery. All Pre-Incident Plans should be reviewed annually and shall be signed by each Engine Company Captain after training the Engine Company crew.
● In performing the above-described inspections, the Subcontractor shall comply with all applicable access restrictions, training requirements, and safety procedures.
3.9 Maintenance of Fire Apparatus and Equipment (Cost Reimbursable SLINs 002 and 003):
The Subcontractor is responsible for inspecting, maintaining, and repairing fire apparatus assigned to LBNL and equipment to meet operational needs. The Subcontractor shall meet the care and custody requirements of LBNL Personal Property Policy Manual. See the LBNL_PersonalPropertyPolicyManual.docx document. The subcontractor will comply with the original equipment manufacturer maintenance manuals. For the government furnished air compressor, see the 2005 Bauer Compressor Mtce Schedule.pdf documents. The Subcontractor shall inspect such apparatus and equipment on a daily basis. Subcontractor shall immediately report any deficiencies or damage of apparatus, facilities, or equipment and obtain approval for repair or replacement at the sole discretion of LBNL.
LBNL will provide a fuel card, and LBNL will pay for fuel for assign apparatus to LBNL.
The Subcontractor shall meet the maintenance schedule for assigned apparatus, in accordance with the latest National Fire Protection Association standards for emergency response vehicles and the original equipment manufacturer maintenance schedule.
3.10 Incident Command: The Subcontractor must participate in the LBNL Incident
Command System and must follow standard Incident Command System (ICS) protocols, a component of the National Incident Management System (NIMS). This may include:
● Establishing a Unified Command for significant events with LBNL, Law
Enforcement, and Federal officials.
● Evacuating personnel from areas where clear or potential hazards continue to exist.
● Maintaining liaison with LBNL, Emergency Medical Services (EMS), and police officials upon their arrival at the scene of the emergency, relinquishing authority to these officials in their area of responsibility, and subsequently providing advice and support for their efforts.
3.11 Reporting Requirements: The Subcontractor shall provide the following reports to the LBNL PPC or University Technical Representative in standard electronic format (PDF, MS Word, MS Excel).

These maintenance records shall contain a description of Services performed during the report period and the Services planned for the succeeding period.

The Subcontractor shall maintain a minimum of Public Protection Classification of Class 3 based on the Insurance Services Office’s (ISO) Fire Suppression Rating Schedule (FSRS). The Subcontractor shall furnish a copy of the report on the ISO grading to LBNL.

3.12 Compliance with DOE Orders and Requirements: The Subcontractor shall comply with all fire protection regulations and requirements (including incident reporting requirements) of LBNL and must assist LBNL in discharging its obligation to DOE. A copy of the applicable DOE Orders regarding fire protection, specifically DOE Orders 420.1C and 440.1B, have been included to assist the Subcontractor in their understanding of this obligation. See the CFR-2011-title10-vol4-part835.pdf, DOE 440.1B.pdf, DOE Order 420.1C.pdf, and the DOE Order 458.1AdminChg3.pdf documents.
The Subcontractor shall participate with LBNL in meeting with representatives of DOE for the purpose of planning, reviewing, and evaluating the fire prevention and suppression activities at LBNL.
The Subcontractor shall adhere to all LBNL Site Access and Parking requirements and shall not enter any restricted or controlled area without LBNL direct authorization unless responding to an emergency event.
3.13 LBNL Workplace Safety Rules: The Subcontractor must comply with all workplace safety rules and meet the requirements of the LBNL Subcontractor Job Hazard Analysis (SJHA) practices as outlined by LBNL Environmental Safety & Health (ES&H) Manual, Chapter 6. See the E, S&H – Chapter 6.pdf document. This requires that the Subcontractor submit an analysis to LBNL demonstrating equivalence. This equivalency process is to occur each year and documentation shall be submitted to the LBNL PPC or University Technical Representative and comments incorporated as identified by LBNL.
3.14 LBNL Standard Operating Guidelines: The Subcontractor is responsible for understanding and incorporating the LBNL Fire Department Standard Operating Guidelines and the ES&H PUB 3000-CH12.pdf, LBNL-SOGs.docx, and the Required LBNL Training for Firefighters Working at LBNL.docx documents, into the execution of their duties. These documents are to be used as a reference guiding the Subcontractor in assisting LBNL in complying with its contractual obligation to DOE.
3.15 Discharge of Domestic Water: Other than during actual and necessary firefighting activities, the Subcontractor shall not cause the discharge of domestic water into any storm drain or other uncontrolled runoff without approval and assistance of the University/LBNL. Washing of personal vehicles is prohibited at LBNL. Washing of apparatus may only be performed in the designated wash area at Building 76. All discharged water must be treated at the time of release.
4. Resources Dispatched to LBNL Incidents The minimum required Subcontractor resources and response performance metrics are provided in the Baseline Needs Assessment (BNA). See the 2021-LBNL-BNA-Final- Signed.pdf document. The Subcontractor must meet all training, staffing, and response criteria in the BNA and meet the Total Response Time performance metrics as noted therein.
4.1 LBNL Building Fire Alarm: One (1) engine company from the LBNL Fire Station and an Automatic Aid Agreement truck company must respond to the alarm. If an actual fire condition exists, the Fire Incident Commander must activate the Structure Fire response in 4.2 below.
4.2 Structure Fire: One (1) engine company from the LBNL Fire Station plus, an
Automatic Aid Agreement with neighboring fire departments, to provide a full assignment consisting of three (3) fire engines, one (1) ladder truck, one (1) ambulance and one (1) Battalion Chief.
4.3 Emergency Medical: One (1) engine company from the LBNL Fire Station supported by an advanced life support (ALS) ambulance from offsite, if needed.
4.4 Wildland Fire: (Non-fire season) – one (1) engine company from the LBNL Fire Station. (Fire season) – one (1) engine company and one (1) wildland fire apparatus from the LBNL Fire Station and activation of a documented Automatic Aid Agreement and/or Mutual Aid Plan.
4.5 Hazardous Materials Incident: One (1) engine company and one (1) Hazardous Materials Vehicle from the LBNL Fire Station plus additional Type 1 Hazardous Materials responders from a documented Automatic Aid Agreement and/or Mutual Aid Plan, upon confirmation and request.
4.6 Technical Rescue: One (1) engine company from the LBNL Station plus additional responders from a documented Automatic Aid Agreement and/or Mutual Aid Plan as appropriate, upon confirmation and request.
4.7 Other Calls for Service: One (1) engine company from the LBNL Fire Station with other resources as deemed necessary for the event as per the above.
5. LBNL Furnished Facilities and Equipment LBNL must provide the following services, facilities and equipment at LBNL for use and purposes covered by this Subcontract:
5.1 Building Maintenance: LBNL has a Building Manager for Building 45 (fire department apparatus bay) and Building 48 (living quarters). Per LBNL standard protocol, when repairs or items require attention, the Subcontractor will contact the LBNL Building Manager, who submits work requests for the repairs by the LBNL Facilities Division.
The LBNL Facilities Division prioritizes repairs to Building 45 and Building 48.
5.2 Utilities: Basic Utilities (electricity, water, natural gas, etc.) are provided by LBNL as the owner of the building. Personnel comforts such as cable TV are borne by the Subcontractor. LBNL maintains a visitor Wi-Fi network across its campus that the fire department personnel may use. For secure communications, the subcontractor will provide their own IT infrastructure and personnel who maintain it.
5.3 Living Quarters: Firefighter living quarters are located in Building 48, second floor, consisting of kitchen, dining, living, office, storage, bathroom, and dormitory spaces.
5.4 Apparatus Bays: Bays 1, 2, and 3 (lower bays) in Building 45 for subcontractor-furnished fire apparatus. Additional space in Building 45 for equipment and supplies is identified in the LBNL-supplied Government Furnished Property.
5.5 Fire Detection and Alarm Systems: LBNL, at its own expense, shall arrange for code-compliant means to transmit fire and other emergency alarms from LBNL to the Subcontractor’s dispatch facility. The Subcontractor shall provide LBNL technical assistance in accomplishing this task.
5.6 Government Furnished Property. LBNL shall provide to the Subcontractor
Government Furnished Property (GFP). The Subcontractor shall maintain the GFP in a state of readiness equal to or exceeding the level at which it was provided. The Subcontractor shall track reimbursable expenditures against the annual budget set forth in the subcontract (SLINs 002 and 003) for normal replacement of both durable equipment and consumable supplies/equipment. Consumable supplies/equipment are depleted during use. Examples are absorbent material used in Hazardous Materials response, foam, medical supplies, etc. Durable equipment is not consumed during use.
Examples of durable equipment are power tools, hand tools, Self-Contained Breathing Apparatus (SCBA), etc.
5.7 Property Accountability: Subcontractors are accountable for all government property in their possession, and must manage, control, and protect that property in a manner consistent with LBNL Personal Property Management Policies as shown in the LBNL_PersonalPropertyPolicyManual.docx document. As part of the annual inventory of subcontractor GFP, LBNL Property Management will ask the Subcontractor to provide a listing of GFP and certify in writing that the data is correct.
LBNL Property Management will match the information provided by the Subcontractor to the information in the Laboratory’s asset management system. For any lost items, the Subcontractor shall provide information to Property Management on the circumstances of the loss and actions taken to correct the situation. Property Management will report the loss to LBNL Security.
5.8 LBNL Site Rules: Subcontractors are required to comply with LBNL rules to include:
● No modifications to Building 45 or 48 (Subcontractor occupied areas) can be made without approval and assistance of the University Technical Representative to include mounting any equipment (penetrations permit), installation of any electronic equipment (UL certification), new furniture (earthquake safety), and/or other modifications to include painting, plumbing, electrical, etc. All requests for service and repair of LBNL buildings, systems, or equipment shall be made to the University Technical Representative.
● No use of outside vendors for service or repair of any Subcontractor and/or personally owned equipment on-site without University Technical Representative approval and assistance. Outside vendors must be approved, receive a Subcontractor Job Hazards Analysis, and be issued permits, as needed, by LBNL prior to any work being performed.
● Due to narrow roadways, hilly terrain, a lack of sidewalks, restricted visibility, and other hazards, the speed limit at LBNL is 15 MPH. The Subcontractor shall exercise all due care when responding to incidents and shall not exceed a speed limit that is considered safe based on environmental conditions at any given time, including when responding to emergencies with lights and sirens.
● The backing of any fire apparatus shall only be accomplished when one or more persons are outside and to the rear of the vehicle directing the driver by hand signals or voice communications.
6. Subcontractor Provided Property The Subcontractor shall furnish the following equipment:
6.1 The Subcontractor shall provide a vehicle for the Battalion Chief that is appropriately equipped for responding to emergencies and handling Incident Command duties. The Subcontractor shall provide the fuel for this vehicle and the fuel cost will be included in the firm fixed price.
6.2 The Subcontractor shall provide all necessary safety clothing, equipment, supplies, tools, medical goods, and any other necessary and/or required equipment, except those items included as GFP necessary to equip and operate a fire station equivalent to Subcontractor’s other fire stations and in compliance with State of California, NFPA, and Collective Bargaining Agreements.
6.3 All equipment and property, including GFP and Subcontractor provided, are subject to
DOE requirements and regulations regarding radiological contamination during routine or emergency operations. See 10 CFR Chapter 111 Part 835 (CFR-2011-title10-vol4-part835.pdf document) and DOE Order 458.1 (DOE Order 4518.1AdminChg3.pdf document) . Should any vehicle, apparatus, equipment, property, or personal items become contaminated and subject to quarantine, confiscation, decontamination, or destruction, LBNL will provide replacement items as similar as possible to the original items.
7. Personnel Complaints The Subcontractor must maintain a documented Personnel Complaint Process and shall receive, investigate, and adjudicate all complaints against its personnel assigned to LBNL. The LBNL PPC or University Technical Representative has the right to reject Subcontractor personnel for assignment to LBNL.
8. Patient Care Reports As the primary LBNL medical provider, the LBNL Health Services clinic has a business need to assess any health or safety concern that may be related to a workplace injury or illness. They also have a legal requirement to make workers compensation determinations based upon patient evaluation because every injury or illness that occurs at a LBNL facility is considered to be work related until proven otherwise. However, LBNL Health Services clinic is not part of the University of California’s covered entity as defined by 45 CFR §160.103. While the Health Insurance Portability and Accountability Act (HIPAA) requirements do not apply to LBNL since LBNL is not a covered entity, Health Services staff endeavors to respect patient privacy by following applicable medical privacy and IT security regulations.
The Subcontractor shall seek necessary patient authorizations from injured or affected employee prior to providing the LBNL Health Services clinic with a copy of patient care reports (PCR) resulting from emergency medical services or other medically-related Subcontractor services involving injured or effected employees treated at LBNL facilities or LBNL sponsored events. If such patient authorization cannot be obtained, the Subcontractor shall only disclose Protected Health Information (PHI) of injured or effect employees treated at LBNL facilities or LBNL sponsored events to LBNL Health Services clinic in accordance with 45 CFR §164.512(l) for Disclosures for Workers’ Compensation Purposes and shall reasonably limit the amount of PHI disclosed to the minimum necessary to accomplish a workers’ compensation determination.
9. Workplace Substance Abuse Program Plan
Before the work can begin, the Subcontractor shall submit for approval a written Workplace Substance Abuse Program Plan (WSAPP) consistent with 10 CFR 707.
