USMS MEDICAL OVERSIGHT PROGRAM FOR SPECIAL OPERATIONS GROUP
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Agency and Contracting Activity:
The United States Marshals Service (USMS), Special Operations Group (SOG), is responsible for the submittal of this Justification.
2. Nature and Description of Action Being Approved:
The purpose of this Justification is to provide the basis for procuring medical oversight services for the SOG’s Operation Medical Support Unit (OMSU).
3. Description of Supplies or Services Required:
The USMS has an ongoing requirement for on-line medical control, on-site medical consultation, and patient admission services The total estimated value of this acquisition (base and four option periods) is $422,136.
4. Statutory Authority Permitting Other Than Full and Open Competition:
In accordance with the Federal Acquisition Regulation (FAR) subpart 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, the statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). This acquisition is being conducted under the authority of the test program for commercial items (FAR subpart 13.5 and section 4202 of the Clinger-Cohen Act of 1996).
5. Nature of Acquisition and Contractor’s Unique Qualifications:
The USMS is actively engaged in enforcing the nation’s laws and executing federal court orders. The USMS locates, pursues and arrests state and local fugitives under legislative acts and brings them before the criminal and civil justice systems. SOG is a specially trained and equipped unit deployed in high risk law enforcement situations. The secondary mission is the tactical support of USMS initiatives during national emergencies, civil disorders, natural disasters, or as ordered by the Attorney General.
The purpose of this acquisition is to acquire on-line and off-line medical control, consultation, and patient admission services for SOG’s OSMU. Johns Hopkins University Medical Center (JHU), located in Baltimore, Maryland, is the only known responsible source that can satisfy USMS’ requirements.
6. Competition Efforts:
In accordance with FAR 5.201, USMS will provide advance notice of the proposed contract action via the Government Point of Entry (GPE), FedBizOpps.
7. Fair and Reasonable Cost:
A purchase order awarded to JHU in February 2009 for the identical services (DJMS-09-M-0516) found the prices offered by JHU to be fair and reasonable.
8. Market Research:
SOG conducted market research of firms within a 60-mile radius of USMS Headquarters in Arlington, Virginia using the Internet and yellow pages. Of the firms surveyed, only JHU has a specialized division that focuses on providing federal and state law enforcement tactical medical program. JHU offers clinical facilities for training and patient admission equipped to render emergent and urgent care for patients with major and minor injuries. JHU offers 24/7, dedicated on-line and off-line medical direction and consultation for EMTs and registered nurses and physicians available on-call to travel domestically and internationally, if required.
9. Other Supporting Facts:
JHU has provided the identical services to SOG for three years. In addition, JHU currently provides medical direction to other federal and state agencies including the United States Secret Service, Bureau of Alcohol Tobacco and Firearms, Bureau of Immigration and Customs Enforcement, and the Maryland State Police. For USMS, JHU has conducted Emergency Medical Technician (EMT)-B recertification; expanded scope medical training; performed medical screening in support of annual SOG selections; provided 24/7 on-call physician consultations; and developed medical treatment protocols for all Deputy United States Marshals and SOG Medics. JHU developed proprietary software to work specifically with USMS via its on-line medical training program. JHU developed software to capture data needed for the USMS’ Electronic Patient Care Report. JHU has physicians available on-call to travel internationally, when required.
Continued use of JHU to perform this mission-critical function is in the best interest of the Government because the services cannot be obtained as conveniently or economically by contracting with another source. The cost and time required to educate a different vendor regarding SOG and its mission requirements would be detrimental to the continuity of operations.
