Justification for Other than Full and Open Competition
1. Identification of the agency and the contracting activity.
This justification was prepared by the Department of Justice (DOJ}, Procurement Services Staff (PSS) in accordance with the requirements of Federal Acquisition Regulation (FAR) 6.303-1 to support the recommendation that other than full and open competitive procedures be used for the procurement action described below.
2. Description of the procurement action and estimated value.
Negotiations will be conducted with the University of South Florida (USF) on a noncompetitive basis to award a contract for science-based anti-bias training to be provided to DOJ law enforcement agencies. The period of performance for this action is date of award through fifteen (15) months thereafter. The total estimated value of this action is $300,000.
3. Description of the supplies or services required.
USF will tailor, test, and implement its existing Fair and Impartial Policing Training Program (FIPTP) to address the needs of the various DOJ law enforcement agencies. USF will customize the curricula currently in place for local and state personnel to more accurately reflect the nature of the work for each DOJ law enforcement agency. USF will also provide training to law enforcement instructors to enable them to provide training to academy recruits, patrol officers, and first-line supervisors at each law enforcement agency. Finally, USF will provide training to command-level personnel that covers the science of bias and its implications for policing.
4. Statutory Authority permitting other than full and open competition.
41 U.S.C. 253(c}(2) as implemented in FAR Subsection 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements".
5. Rationale justifying the use of the cited statutory authority, including the unique qualifications of the proposed contractor or the nature of the action.
The President's Task Force on Twenty-First Century Policing declared that "mitigating implicit bias should be a part of training at all levels of a law enforcement organization to increase awareness and ensure respectful encounters both inside the organization and with communities". Since 2008, DOJ's Office of Community Oriented Policing Services (COPS) has worked with USF through various cooperative agreements in the development, pilot testing and implementation of FIPTP. FIPTP developed and customized five curricula
- addressing biases based upon things such as race/ethnicity, gender, sexual orientation, religion, and socio-economic status - for academy recruits and/or patrol officers, first line supervisors, mid-level managers, command personnel and community leaders, and law enforcement trainers at the state and local level. This is the only program with a comprehensive curriculum tailored for different ranks and agency roles and the ability to provide it across North America. Leveraging the existing FIPTP developed cooperatively between DOJ and USF to customize and expand it to DOJ's law enforcement agencies will avoid duplication of work to develop a new training curriculum from scratch and, thus, limit the time and cost required to provide DOJ's law enforcement agencies with this essential training.
6. Efforts made to solicit offers from as many sources as practicable, including publication per FAR Subpart 5.2.
On August 12, 2015, a synopsis was posted in GSA's Federal Business Opportunities website providing notice of the Government"s intent to negotiate with and award a contract to USF under the authority of FAR 6.302-1. One firm expressed interest in the requirement.
7. Determination that the anticipated cost will be fair and reasonable.
The Contracting Officer will compare the pricing proposed by USF for this effort to the pricing US F's national expert has utilized for similar work provided to state and local law enforcement agencies.
