DJJE-10-RFP-0662 Asset Forfeiture Program Support Attachment 13

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer 1 Attachment 9, L.9.1.2

With such a large acquisition (over $500 million dollars), is it the government's intent to have diverse small business participation covering the socio-economic groups presented on the Small Business Participation Template? Will a lack of participation by all socio-economic groups have a negative impact on a prime's evaluation?

The Government is always interested in qualified small business participation.

Indeed this is represented in the evaluation criteria for solicitation DJJE- 10-RFP-0662. Please refer to Sections L and M.

2 Cover Letter L.9(a) L.11

The number of proposal copies specified in RFP Section L.9, paragraph (a) does not agree with the number of copies specified in the RFP Cover Letter and in Section L.11. We assume the Cover Letter and Section 11, which are in agreement with each other, are correct. Please confirm.

The Cover Letter and Section 11 are correct. The error in Section L.9 has been corrected.

3 Cover Letter L.9(d) L.9.2.3(4) L.11

125-126

Please confirm that the Staffing Plan Addendum cited on page 113 as well as Section L.9.2.3(4), page 125 and page 126 and Section L.11, page 129, should be submitted as a separate volume bound in a 3-ring binder in the same quantities as required for Volume 2. This would require a correction to the Cover Letter, which states, “Your proposal shall be submitted in two (2) separable parts in accordance with the instructions contained in Section L of the RFP.”

The Staffing Plan addendum shall be submitted in a separate 3-ring binder, however it is an addendum to the Technical Volume as a whole and will be evaluated as such. This statement in the cover letter has been amended for additional clarity.

4 B.1(d) C.1.9

Please confirm that the sentence, “The specific phase-in assistance to be provided will be determined by the Government” refers to phase-in assistance to be provided by the outgoing incumbent contractor.

Yes, that is correct.

5 B.3(b) Attachment 2 n/a

To ensure consistency among offers, can the government provide a concrete mapping of which

The MSA Table in B.3 defines cities that are commonly staffed by the

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer WD (or WDs) apply to each of the 36 MSAs and incorporate these WDs into the solicitation?

current contract and make up a particular MSA. This is also detailed in Attachment 2. As stated in Section B.3, further city identification for the MSAs can be found in Attachment 4 by referencing the applicable MSA number provided in the Table in B.3. Note that some cities are in the “All Other” category and the instructions in B.3(b), B.6.2 and L.9.1.5(b)(2) shall be followed. The 2nd revision to Attachment 5, provided with Amendment 0003, reflects the most current applicable WDs and shall be cross-referenced when formulating your offer.

6 C.1.6 22 Section C.1.6 – Security Clearances: Sub paragraph (c) states that there are 305 current employees with clearances. What is the breakout of those clearances by level (TS, S, C) and by labor category? Does the 305 figure include the number of Moderate Risk Public Trusts (MRPT)? If not, what is the total count of MRPTs by labor category?

This information is not necessary to formulate a proposal/offer. However, currently there are:

TS – 275

S – 30 Most of the TS/S positions are within the Records Examiner Labor Category.

Some of the 305 positions do fall into the Moderate Risk Public Trust category.

7 C.1.9 L.9.2.4

127-128

Please clarify the incoming contractor's staffing responsibility during the 60-day transition period.

In addition to filling the positions already staffed by the incumbent contractor, will the incoming

In accordance with B.1(d), the transition period is 120 days.

The Contractor shall be responsible for

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer contractor also be responsible for positions ordered but not staffed, such as the 157 indicated in Attachment 3? If so, when would these positions need to be filled?

the phase-in of Contractor personnel and the assumption of ongoing tasks in accordance with the proposed transition plan and the Government’s phase-in schedule. If at the time of contract award there are vacancies, whether or not it is 157 or more or less, the successful offeror would be responsible to fill them as soon as practicable.

8 C.2.1 24 Please clarify what the contractor requirements are this portion of RFP Section C.2.1.1 regarding the Order Entry and Tracking System: “It should have the capability to capture and track the status of a purchase request from the time of initiation through the time it becomes a task order issued under this contract and through the term of the order.”

Specifically, what is meant by “…and through the term of the order.” We understand that, all things considered acceptable, an order typically triggers issuance of a task order. However, please clarify specifically what the contractor should track and report on through the term of the order.

“Through the term of the order” means until the end of the order’s period of performance. The Government requires the system to have the capability to, at a minimum; track and create orders, issue orders, fill orders, close orders and track funds. The Government is looking for Offerors to propose a system and its capabilities.

9 C.4 25 There is no level 4.1 subheading under “General Requirements.” Was anything omitted here?

No. There was nothing omitted. It is a numbering error and has been corrected.

10 C.4.3.2 27 Section C.4.3.2 says the contractor must, “Minimize turnover of existing Contractor staff.

The Contractor’s program shall set a goal of no

Based on historicals, the Government’s minimum requirement is attrition no greater than 15%. As is evidenced by the Award Term Plan, Attachment 1 to

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer greater than 15% attrition per contract period.”

Can the Government provide the most current attrition rate for the incumbent and the rate for each year of the current contract?

the RFP, the Government is encouraging offerors to strive to reduce this percentage.

11 C.4.9 32 Do any of the items developed under this task apply to the Asset Forfeiture Program Support contract itself? Is there any actual or apparent conflict of interest created by the Contractor’s performance of this procurement assistance task for any future work under this contract or other DOJ contracts?

No. The Government is not aware of any conflicts of interest in performing the requirements in the SOW.

However, if the Offeror has knowledge of a conflict, they should apprise the Government of such as soon as it is known in accordance with Clause H.20.

For future reference, the Government will not knowingly ask the Contractor to write requirements and then fulfill them.

12 C.4.10 32 The RFP states that, “File room operation normally requires only part-time clerical support at most offices.” Are these duties currently performed by part-time employees or by full-time employees who perform file room tasks in addition to their other duties?

Currently, full-time employees perform the tasks in addition to other tasks.

However, this may change and depends on Government requirements at the time the position is ordered.

13 H.13(f) 57 Is the “supervisor/manager” described in this paragraph intended to be the Contractor’s Program Manager?

Offerors are free to bid their own management structure within the requirements of C.1.5.1, C.4.2, H.8 and L.9.2.2.

14 H.16.1 59 Section H.16.1 states that Contractor Personnel Investigations will be conducted in accordance with applicable Executive Orders, DOJ Orders, Office of Personnel Management (OPM)

This information is not needed to develop a proposal/offer. If DOJ orders are required post-award to ensure compliance, the Government will assist

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer Guidance, Homeland Security Presidential Directive 12 (HSPD-12) and Federal Information Processing Standard Publication 201 (FIPS 201).

Will the Government provide offerors the specific DOJ Orders that apply to ensure compliance?

the successful offeror in locating these.

15 H.16.1.2 H.16.1.2.1

The RFP indicates three categories for Contractor personnel requiring access to unclassified information. Can the Government define the labor categories that typically fall into each category (high risk, moderate risk, and low risk)?

This information is not pertinent to developing a proposal/offer. Any labor category can fall within any risk category depending on the Government’s requirement at time of order.

16 H.16.1.2.1 61 Paragraph (a) refers to the minimum pre-appointment investigative requirements based on the risk positions. Sub paragraph (1) states that for High Risk Positions the minimum background investigation (BI) required is a five year scope BI and the five year reinvestigation required is an Access National Agency Check with Inquiries (ANACI) utilizing the SF-85P for Public Trust.

Please verify if the Government requires an SF- 85P or if the correct form is an SF86 for the 5 year BI for High Risk positions?

The SF-85P is the required form.

17 H.16.1.2.1 61 Sub paragraph (2) Medium Risk Positions have a minimum background investigation for “Moderate” impact. The five year reinvestigation required is the National Agency Check with Law and Credit (NACLC) utilizing the SF-85P.

Please verify if the Government requires an SF-

The SF-85P is the required form.

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer 85P or if the correct form is an SF86 for the 5 year BI for Moderate Risk positions?

18 H.24 C.4.3.1

In order to allow Contractors to expedite employment offers to incumbent employees upon contract award, will the Government provide contact information (such as a Government e-mail address) or will the Government require the incumbent contractor to provide contact information for each employee?

Offerors’ process/approach for contacting and transitioning incumbent personnel is part of what the Government is looking for and will be evaluating in proposed transition plans.

19 L.2.4 83 This section states that the total duration of the contract is not to exceed 72 months, however, elsewhere the period of performance is stated as 7 years (84 months). Please confirm that 84 months is correct.

84 months, if all options are exercised and the award term is awarded, is the correct period of performance. Section I.2.4 has been corrected.

20 K.3 92 The heading reads, “Prohibition of Nonsegregated Facilities” rather than “Prohibition of Segregated Facilities”. Can the Government correct this title?

The title has been corrected.

21 L.6 110-111 We understand the Government’s concern that incumbent employees’ compensation levels could be reduced under a recompete. However, only the incumbent Joint Venture, Forfeiture Asset Associates, has definitive information about current employee compensation levels. Will the Government provide annual or hourly compensation data for every labor category listed in Section L.9.1.4 by region and MSA within each region in order to provide a level playing field so offerors can ensure that the salary component of their total compensation packages does not provide “lowered compensation for essentially the same

This is a competitive procurement. Part of this competition involves evaluation criteria that require industry to propose a solution to the challenging requirement to attract and retain skilled and experienced personnel capable of performing. Offerors’ solutions to this challenge are part of what is required in Section L.9.2 and will be evaluated in accordance with Section M.2.1.

Offerors will not be evaluated against the incumbent’s labor rates but will be evaluated in terms of their

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer professional work” that “may indicate lack of sound management judgment and lack of understanding of the requirement” as called out in the RFP? If not, how does the Government intend to fairly evaluate offerors’ proposed compensation levels given this disparity in current compensation information?

compensation’s impact upon recruiting and retention, realism and consistency with the offeror’s total compensation plan.

22 L.9(d) M.3(i)(2)

The table in paragraph (d) states that “compensation data such as salary/wage data” is not subject to the page count. However, the RFP does not define what “compensation data” offerors should provide other than a brief mention in Section M.3(i)(2), which states, “The compensation data required will be used in evaluation of the offeror's understanding of the contract requirements. Proposals which are unrealistically low or do not reflect a reasonable relationship of compensation to the professional job categories so as to impair the Contractor's ability to recruit and retain competent professional employees, may be viewed as reflecting a failure to comprehend the complexity of the contract requirements.”

Is this “compensation data” the same data in the offeror’s response to the Health Insurance Questionnaire and the completed Fringe Benefits table to be provided in the Staffing Addendum Volume?

If not, please clarify what “compensation data”

The Government specifically, and in detail, asks for Compensation Data as per L.9.2.3(4)c which shall be part of the Technical Volume. The RFP cover letter states “Your technical proposal should not make reference to pricing data, except as instructed in the RFP… The solicitation instructs this data to be bid in the Technical Volume;

therefore, please bid it as requested.

The required information as per L.9.2.3(4)c and the Health Benefits questionnaire, Attachment 11, are not the same. However, the information requested in the “Fringe Benefit” table may supplement the information requested in L.9.2.3(4)c depending on a given offeror’s compensation plan.

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer offerors should include. Please also clarify if offerors should provide this information as part of Volume 1, the Business Volume, rather than Volume 2, since “compensation data” could include pricing information required to be excluded from Volume 2.

23 L.9.1.2(a) L.4(2)

Section L 9.1.2(a) states that the SDB participation goal shall be a percentage of a contract’s subcontracted value. However, in Section L.4(2) this requirement is expressed as “dollars and percentages of total contract value….” Please clarify the SDB participation goal.

The Department’s goal for this contract for SDB is 10% of a contract’s subcontracted value. References to total contract value have been removed.

24 L.9.1.4 117 The Labor Category Classification Table lists “Accounting Clerk III” as an RFP labor category;

however, it is not listed in Attachment 3 or the pricing sheets. Please reconcile this apparent inconsistency.

Accounting Clerk III is in the Pricing Tables at line 35 and 36 of the tabs “MSAs” and “All Other”. It is also in the Labor Category Descriptions, Attachment 6 page 13. It is not in the Manpower report as it is a position not currently ordered.

25 L.9.1.4 118 In the Labor Category Classification Table, under the “DOJ Guidance” column, in the last row of the table, please clarify if the “General Clerk II” should be General Clerk I. Note that the “class Code 0111” is the code for the General Clerk I classification.

That is correct… “Clerical I” corresponds to “General Clerk I” and the classification code is 01111. The error has been corrected.

26 L.9.2.3 124 This section references random drug testing, however, there is no other reference to drug testing in the RFP. Please provide additional information regarding this requirement. Which contract

The Government is not stating there is a random drug testing requirement, but is interested and will evaluate offerors on the process/approach offerors use to

efficiently recruit and retain employees while ensuring no disruption to the program.

27 L.9.2.3 Attachment 3

124-125 n/a

Can the government provide a breakdown of the positions in Attachment 3 by agency?

Identification of the agencies is not pertinent to developing a proposal/offer.

28 L.9.2.6(a) 128 The first sentence of paragraph (a) begins, “Provide five (3) references.” Please confirm that this should read “Please provide five (5) references.”

Offerors shall provide 3 Past Performance references. The error has been corrected.

29 Attachment 3 1 The Manpower Report indicates that there are three Project Directors in DC and one in Arlington, VA. Please provide the names of the Agencies these Project Directors serve.

See answer to question # 27.

30 Attachment 3 n/a Attachment 3 indicates that there are 157 positions ordered but not filled. Please clarify whether these positions are vacancies created by attrition, newly ordered positions, or fall into some other category.

If available, please provide counts of vacancies, new positions, and other categories.

This information is not pertinent to developing a proposal/offer.

31 Attachment 3 n/a Attachment 3 indicates that there are 157 positions ordered but not assigned. Please clarify whether these positions are vacancies created by attrition, newly ordered positions, or fall into some other category.

Duplicate question. See answer to question #30.

32 Attachment 3 n/a Does the Government have standards for how quickly the ordered but not staffed positions should be filled? Of the 157 positions, how many have not been filled according to the mandated schedule?

Offerors shall provide a sufficient number of qualified personnel who have sufficient experience, education, training, and skills to satisfactorily perform the requirements of the SOW

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer and RFP as soon as practicable.

33 Attachment 5 n/a At least some of the WDs provided in Attachment 5 are outdated. Can the Government incorporate a current list of WDs into the solicitation or otherwise instruct all offerors to use the most current available revisions.

Due to the number of WDs and the fact that revisions are not made simultaneously, the Government will do its best to provide the most current WDs. An updated WD document was provided with Amendment 0002 0n 16 June. Another update (Rev 2) is being provided with Amendment 0003 due to new Fringe Benefits rates.

The Government also requests that offerors use the most current available revisions when developing their offers and inform the Government if they had to use a more recent revision than the Government provided.

34 Attachment Attachment n/a

Our team’s medical, dental, and vision plan carriers have informed us that they are unable to run a GeoAccess study using the 3-digit ZIP codes provided in Attachment 12. Can the Government provide this employee census information including 5-digit ZIP codes? Also, can the Government could provide the data in Excel format to allow offerors to obtain the information more quickly?

The Government is providing the file with 5-digit ZIP codes and in Excel format. To ensure privacy of health information and proper use of the information, the file is now encrypted and requires a password. Therefore, please contact, via email, Richelle.wright@usdoj.gov for the Password. Passwords WILL NOT be supplied over the phone.

Section L.9.2.2 (10) (Management Plan) requires resumes for…. “and the Project Director.” Both Section C.1.5.1 and Section H.8 note Key

discretion. The Government recognizes that there are currently 4 PDs. Please provide resumes for at least 4 PDs. The language in L.9.2.2 has been changed to be plural – more than 1 PD.

36 L.11, L.9.2.3 (4) g;

h

125, 126

L.9.2.3 (4) (g)(Retention) references a “separate volume marked as “Staffing Plan Addendum.” The delivery instructions in L.ll Delivery Locations does not specify this volume or the number of copies required.

Question. How many copies of Volume III, Staffing Plan Addendum, are required at the primary delivery address? How many copies are required at the secondary address?

L.9.2.3(4)g and h – together are an addendum to offerors’ proposed staffing plan which is part of the Technical proposal. As is clearly stated in parentheticals in L.11, the “Staffing Plan Addendum” is part of the Technical Volume. The “Staffing Plan Addendum” shall be in its own separate 3-ring binder. The use of the word “volume” may have been confusing.

Therefore, it has been corrected with the word “binder”. As is stated in L.11, 1 original Technical Volume, which includes the Staffing Plan Addendum in a separate binder, shall be delivered to the address detailed for Ms. Wright;

and, seven copies of the Technical Volume, which includes the Staffing Plan Addendum in a separate binder, shall be delivered to the address detailed for Mr. Sharp which offerors should note has changed in Amendment 0003.

Pricing Tables

NA In the process of utilizing the Pricing Tables included with the RFP, it appears that the formula intended to calculate the Fixed Unit Prices is missing for a number of the labor categories.

Specifically the formulas for : Technical Writer, Junior Technical Writer, Supervisory Forfeiture Financial Specialist, Senior Forfeiture Financial Specialist, Forfeiture Financial Specialist and Litigation Financial Analysts, as found in Rows 23 through 34 and Columns L through Q, is not

This has been corrected and a new pricing model Attachment was provided with Amendment 0002 on 16 June. See question 65 below.

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer functioning.

Should Offerors “cut and paste” the formula into these rows and columns, or will the Government provide new Pricing Tables with all of the necessary formulas?

57 L.6 A & B 110 The Government acknowledges in reference to incumbent salaries that “lowering can be detrimental in obtaining the quality of professional services needed…” and in section B “..proposals envisioning compensation levels lower than those of the predecessor contractors for the same work….”.

Question:

Will the Government provide incumbent salaries or consider evaluating this off a contract markup alone?

See answer to question #21 above.

58 L.6 110 Question:

Will the Government provide a tenure list for the SCA employees to provide adequate compensation for earned vacation time?

This information is not pertinent to developing a proposal/offer, but will be provided to the successful offeror post-contract award.

59 C.2.1 24 Question:

In reference to the Order Entry and Tracking System; is it the Governments intent to have a single system that provides for order tracking, time keeping and invoicing all in one? Are there any

The Government’s requirement is for an Order Entry and Tracking System.

How offerors choose to track timekeeping and invoicing is dependent upon their administration operation.

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer other requirements that the proposed system will be judged on?

60 L.9.2.6(a) 128 Past Performance References states “Provide five

(3) references for commensurate projects that are in progress or were completed within the past three years.” Please clarify if the number of intended past performance references is 3 or 5.

See answer to question #28.

61 Section L.9 (a)

112 States that Volume I (Business Proposal) shall be delivered as an Original plus 1 copy, and Volume II (Technical Proposal) shall be delivered as an Original plus 5 copies. This contradicts Section L.11, which states the Primary Delivery Address will receive Volume I as an Orignal, 1 Copy and 2 Electronic Copies and Volume II as an Original and 1 Electronic Copy. The Secondary Delivery Address will receive only Volume II as 7 Copies and 7 Electronic Copies. Can you please verify the correct quantities each delivery address (Primary and Secondary) will receive?

See answer to question #36.

62 Attachment 3 Manpower Report and Attachment 6, Labor Categories, are inconsistent. Specifically, Attachment 3, contains two categories (a Senior Civil Investigator and a Sr. Financial Analyst) that are not included in Attachment 6; while Attachment 6 has 4 categories (an Accounting Clerk III, File Room Supervisor, Program Manager, Regional Director) that do not appear in Attachment 3.

Which Attachment contains the correct set of Labor categories to use as the basis of our pricing

Attachment 3 reflects the current state of the current contract. Attachment 3 and 6 are not supposed to be consistent.

Senior Civil Investigator is located in Attachment 6 at page 19. Sr. Financial Analyst will not be used in the new contract. The reason that any labor category is in Attachment 6 and not in Attachment 3 is because they are positions that are not currently on order but could be ordered. Program

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer and staffing models? If neither represents the Government’s desired basis of cost or staffing, will the Government clarify the proper set of categories?

Manager and Regional Director are not charged directly to the contract.

Pricing shall be as per Sections B and L.

The categories to be priced are in the pricing table provided in revised Attachment 2 in Amendment 0002 posted to FEDBIZOPPS on 16 June.

Further, please note that management positions shall be priced in accordance with L.9.1.5(b) Note.

Further, see Question 65 below.

63 L.9.2.3 (4) c. 125 Requires a Total Compensation Plan including salaries/wages and benefits and that the Plan is part of the 25 page Staffing section. L.9.2.3 (4) g and L.9.2.3 (4) h further require that the Health Benefits Questionnaire and the Fringe Benefits table be completed as the Staffing Plan Addendum, under separate cover and outside of page count.

According to the table in L.9 (d), there is no limit on compensation data such as salary/wage data or Staffing Plan Addendum. It is not clear from the instructions whether the salary/wage data is to be included in the Staffing Plan Addendum or whether the Total Compensation Plan is itself outside of page count. Please clarify how the Government wants this section structured and which parts are to be within the 25 pages and which are to be submitted in the Addendum or

The parts that are not subject to the page limitations are:

1. The Health Benefits Questionnaire

2. The Fringe Benefits Questionnaire

3. Any data supporting Offerors’ Total Compensation Plan requested in L.9.2.3(4)c.

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer otherwise outside of page count.

64 On June 9, 2010 the Deputy Administrator of the Department of Labor issued Agency Memorandum 209 revising the Wage Determination Health and Welfare benefit from $3.35 per hour to $3.50 per hour effective June 22, 2010. The Memorandum requires Service Contracts awarded after June 22nd include the new Health and Welfare amount. Does the Department of Justice wish that bidders propose the Asset Forfeiture contract at the new $3.50 rate or the now existing $3.35 rate?

The new $3.50 rate. Updated WD’s are being provided (Rev 2) with Amendment 0003.

65 Attachment 2 Pricing Tables

“MSA

16980” rows 23 through 33, Tab, Column L

Did the government intend to leave the formulas out of these rows?

The formulas of L23 through L34 are inadvertently missing in Tab 16980 of Attachment 2 rev 1, which was posted to FEDBIZOPPS on June 16. Rather than post another new pricing table, Offerors shall simply copy the formula from L22 down into these cells in the MSA 16980 tab only.

66 L.9.2.2(8) 123 What does the acronym “ACO” stand for? “Administrative Contracting Officer” 67 B.1(d)

C.1.9 L.9.2.4

Sections B.1 (d) and C.1.9 of the RFP states “Transition costs will be the responsibility of the Contractor.” Section L.9.2.4 states that the Transition Period begins on October 1, 2010 (the anticipated award date) and ends on January 31, 2011 (the expiration date of the current contract).

To ensure a smooth transition, start-up costs will be incurred early in the Transition Period. Assets (such as software licenses) will have to be acquired

There is no unfair competitive advantage. As is stated in THIS RFP for THIS competitive procurement, transition costs will be the responsibility of the Contractor. As is required in L.9.1.6 (b)(6) Offerors shall detail the costs that support their proposed transition plan.

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer and personnel will have to be hired and trained.

This will be a significant investment of capital and resources in the program prior to receiving any revenue from the contract.

To win this award a bidder will have to submit a proposal that contains an aggressive pricing structure with modest margins. Considering the initial investment and modest margins the anticipated breakeven point for a non-incumbent occurs much later in the program. It is noted that for the previous contract competition, the winning bidder (the incumbent) received a separately funded (non-evaluated) CLIN for transition costs.

Therefore the current incumbent will not incur transition costs on this re-compete, but did receive funding for their previous start-up costs.

When the Department of Justice requires a non-incumbent to absorb the Transition Period costs, doesn’t this give the incumbent an unfair competitive advantage?

To eliminate the unfair advantage of the incumbent, would the government consider issuing a separate task order to the successful offeror to pay for the Transition Period cost to be incurred?

68 Bidders Questions

69 Bidders Questions

3 Based on the information in the original SOW it appeared that the Order Entry and Tracking System (OETS) requirements were fairly simple.

The answer to Question 8, however, seems to require a much higher level of complexity. Please clarify the following regarding the OETS system requirements:

a. Regarding filling orders:

i. Will the Government be responsible for entering data indicating an order is filled?

ii. If the contractor is responsible for entering data indicating an order is filled, will the system require a mechanism for the Government to approve that the order was filled?

b. Regarding closing orders:

i. Will the Government be responsible for entering data that an order is closed?

ii. If the contractor is responsible for entering data indicating an order is closed, will the

After reviewing the Bidder’s Question here and reviewing the response to Question #8 above, DOJ realizes the response may have made the requirement unclear. Our basic requirement is for a system that can capture and track the status of a purchase request from the time of initiation through the time it becomes a task order issued under the contract and through the term of the order. While periodically the Government will need to know from the contractor the status of positions filled or whether an order has been closed, it is not required that the system generate this information.

Therefore, “fill orders” and “close orders” are not considered minimum requirements.

Once again, the Government is looking for an Order Entry and Tracking System in accordance with the SOW. It is up to each Offeror to propose a system and its

iii. What form does the government use to close orders?

c. Regarding tracking funds:

i. Will the system be required simply to track total funds ordered, total funds filled, and total funds closed?

ii. In the alternative, will the system be required to track monthly expenditures and remaining funds for each individual order in the OETS?

d. Will the system be used to issue modifications to orders?

i. If so, which form is used to issue modifications?

capabilities to fulfill these requirements.

The exact process used to fulfill these requirements depends on each Offerors individual system and its capabilities.

This detailed information is not required to develop a proposal.

No. RFP Section RFP Pg. Bidder’s Question DOJ Answer retention of qualified, experienced and skilled personnel, our healthcare provider, a Blue Cross Blue Shield provider, requires certain information regarding claims history. The information they require is contained in the information provided to DOJ by the incumbent in accordance with the contract modification dated 4-6-05 which states:

“Section III A(4): The Contractor shall provide copies of the standard health claim data reports furnished to the Contractor by their chosen health insurance carrier. Unless prohibited by federal or state laws/regulations, these reports will include claims, enrollment, and large claim information under the carrier's normal reporting schedule.

Claims data shall be submitted to the COTR by March 1 St of each year and cover the preceding calendar year.”

Since there is no need for us as an offeror to have this information history, but only for the provider in order to establish the lowest possible rate, will the government please provide this information directly to our health care provider? We will provide the health care provider POC information directly to the Contracting Officer Ms. Wright to permit the transfer of this information.
