Continuation of 36C24921Q0391

All interested companies shall provide quotations for the following:

STATEMENT OF WORK FOR ARC FLASH IMPROVEMENT

1. SCOPE OF WORK:

This requirement is to have contractor provide Electrical System Improvements Per 2016 Arc Flash Study Recommendations. The requirement exists to provide upgrades on the Electrical System to mitigate Arc Flash by increasing circuit protection. The Contractor shall furnish all labor, supervision, and material to include all parts and labor during normal business hours and or after hours at the Memphis Veteran Administration Medical Center (VAMC), 1030 Jefferson Ave, Memphis TN, 38104-2127.

2. WORK REQUIREMENTS:

Removal and Replacement of existing under-rated circuit breakers existing electrical panels, safety disconnects, and Motor Control Center. New devices with adjustable setting shall be adjusted (set) on-site for proper coordination, with setting from device coordination work as recorded by the 2016 Arc Flash Study recommendations.

A. Removal and Replacement of existing circuit breaker in existing electrical panels, switchboard, and safety disconnects- for providing incident energy mitigation. These new devices shall be adjusted (set) on-site for proper coordination and mitigation of incident energy, contractors shall furnish all equipment needed to accomplish this task.

B. Removal and Replacement of existing Non-Fused safety disconnects with new Fused safety disconnects-for providing incident energy mitigation. Exact fuse types critical for achieving the calculated mitigation to be provided by 2016 Arc Flash Study recommendations.

C. Electrical Equipment Additions: Installations of fused safety disconnect switches and separately enclosed circuit breakers -for providing incident energy mitigation. Exact fuse types and circuit breaker setting critical for achieving the calculated mitigation to be provided by 2016 Arc Flash Study recommendations.

D. See attachment spreadsheet for inventory.

3. INSTRUCTIONS:

A. Contractor shall provide supervision to ensure proper procedures are used.

B. Contractor and their staff are not permitted to take any pictures, or videos.

C. Contractor and their staff are not permitted to take any pictures, videos of any type. Taking of photographs/videos are prohibited while on VAMC premises.

D. The contractor’s staff shall check in with the VAMC police to receive a VAMC work authorization badge.

E. The badge shall be worn facing forward and above the waistline. The contractors’ staff are required to wear the VAMC issued badge at all times.

4. CONTRACTOR QUALIFICATIONS

1. Contractor shall provide technicians that have had safety training in electrical safety outlined in the OSHA Standard, and NFPA70E-Standard Safety in the workplace.

5. SUPPORTING INFORMATION:

A. Contractor shall furnish all materials, labor, and equipment to perform the job.

A. Contractor’s employees should be knowledgeable of standards associated with this type work.

B. At all times during the performance, the Contractor’s Superintendent (if applicable) shall be available by cellular phone. Prior to beginning any work, the Contractor shall supply the COR with the telephone number for the Superintendent. The Contractor’s “Competent Person” that meets OSHA training guidelines, can make decisions and acting on behalf of the Contractor shall be physically located on site at all times during performance of the contract. If the Contractor’s Competent Person is absent from the job site for an extended period of time, the COR may send all Contractor/sub-contractor employees off the job.

C. Contractor shall identify which employees shall be working under the awarded contract. Contractor personnel shall include employees, sub-contractors, subcontractor employees, suppliers and delivery personnel entering the VAMC. This does not apply to suppliers and delivery personnel making deliveries to the VAMC warehouse dock only. Those employees shall bring photo ID to obtain a VAMC Contractor identification badge that shall be worn above the belt at all times while on VAMC property. Contractor’s employees shall return all I.D. badges to designated personnel at time designated in the task order.

D. The COR is responsible for the inspection of the work called for in this job. The COR will be identified in the task order by name, telephone number and location. Inspections made by the COR are for the sole benefit of the Government and do not relieve the Contractor of any quality control responsibilities.

E. The Safety Manger is responsible for safety inspections of all contract operations. The Safety Manager shall be identified in the task order by name, phone number and location.

F. Contract drawings (if applicable) shall indicate the extent and location of work. If any departure from the contract drawings are deemed necessary by the Contractor, the details of such departure and the reasons therefore shall be submitted to the Contracting Officer for approval as soon as practical. No such departure shall be made without proper written permission of the Contracting Officer. The Contractor is responsible for all information and requirements in drawings and specifications that pertain to the task order.

G. The Contractor shall visit the job site to thoroughly familiarize himself with all the details of the work and working conditions. The Contractor shall also verify all dimensions in the field and shall advise the Contracting Officer of any discrepancy before performing any work. The Contractor shall be specifically responsible for the coordination and proper relation of his work to the building, structure, phasing and ensure the safety of employees and workmen.

H. The Contractor shall ensure employees do not smoke on VA property.

I. The Contractor shall not park on grassy areas unless approved by the COR and the Contractor agrees to restore areas back to VAMC standards. Drivers should be particularly concerned with pedestrian traffic. Yield to pedestrians in crosswalks. Posted speed limits and all other traffic controls are to be observed by operators at all times. Seat belt use is mandatory on the VAMC grounds.

(viii) The provision at FAR 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. The following provisions are included as addenda to FAR 52.212-1:

ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS This is an open-market combined synopsis/solicitation for Arc Flash Improvement Service at the Memphis VA Medical Center as defined herein. The government intends to award a purchase order as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein.

The quoter shall submit their quote on company letterhead and include the Price/Cost Schedule provided with the Statement of Work. Quoter shall include unit price, total, unit quantity and item description as specified above, as quoted discounts, proposed delivery time, name, address, and telephone number of the quoter, firm’s DUNS# and ORCA document in SAM at www.sam.gov, terms of any express warranty, unit price, overall total price, applicable shipping charges, completed copy of 52.212-3 Quoters Representations and Certifications- Commercial Items, and ORCA document. All prospective quoters must include appropriate references which must include all applicable company information. In addition, the quote shall include a separate narrative to specifically communicate the quoter’s technical ability to meet the performance requirements. Submitted licensing and insurance must be in the name of the prime contractor and only the prime contractor. To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows:

The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and non-price factors considered.

The following factors shall be used to evaluate quotes:

1. Technical factor - Experience – The quoter shall provide a list of at least three (3) recent contracts for Electrical System Improvements that included the following scope: circuit breaker adjustment, proper setting and adjustments of motor control centers, electrical panels, and safety disconnects on commercial buildings. Include in response those facilities/companies/agencies (Government and/or private), name and address of the facility, contact name at the facility and phone numbers. Recent is defined as within the past 4 years of the posting date of this solicitation.

2. Past Performance – The quoter shall submit up to three (3) past performance references, including both the reference information and details of the work performance; past performance information shall be recent and relevant work as described in this solicitation. Past Performance information from the prime contractor is the only Past Performance information that will be considered. Past performance information may be obtained through other sources known to the VA and the Federal Government as well. In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past. Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered neutral.

3. Price - Provide pricing information by including a completed version of the table found in section (v) of this document with your response to this combined synopsis/solicitation

(ix) 52.212-2, Evaluation-Commercial Items;

Evaluation will be determined based on Best Value to the Government IAW FAR Subpart 13.106-1(a)(2).

The Government will award a Fixed Price Purchase order resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, that is determined to be the best overall value to the Government. Procedures will be conducted by comparative evaluation of offers based on price and non-price factors.

This Request for Quote (RFQ) is issued in accordance with Far 12 and in conjunction with Simplified Acquisition Procedures Far 13.5. Evaluation of price and non-price factors will be performed in accordance with procedures outlined in FAR 13.106. A single award will be made to quote that is determined to be the best overall value to the Government. Procedures will be conducted by comparative evaluation of offers based on price and non-price factors.

The following factors shall be used to evaluate offers.

Evaluation Factors:

1. Technical Factor - Experience will be evaluated on recency and relevancy on the following:

a. Government or private contracts for Electrical System Improvements that included the following scope: circuit breaker adjustment, proper setting and adjustments of motor control centers, electrical panels, and safety disconnects on commercial buildings.

2. Past Performance – will be evaluated on:

a. Contractor has GOOD or NO past performance

b. Negative past performance within the past three (3) years.

3. Price – Price will be determined as best value. The Government may consider award to other than the lowest priced offeror or other than the highest technically rated offeror.

852.219-74 Limitations on Subcontracting—Monitoring and Compliance. (JUL 2018) (DEVIATION)

(a) This solicitation includes ., VA Acquisition Regulation (VAAR) 852.219-10, VA Notice of Total Service-Disabled Veteran-Owned Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor’s compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor’s offices where the Contractor’s business records or other proprietary data are retained and to review such business records regarding the Contractor’s compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor’s business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor’s compliance with the limitations on subcontracting or percentage of work performance requirement.

52.212-3 Offeror Representations and Certifications (FEB 2021) As prescribed in 12.301(b)(2), insert the following provision:

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision—

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Reasonable inquiry has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended."Sensitive technology"—

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3)of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veteransor, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16).

Small business concern—

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

Small disadvantaged business concern, consistent with13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—

(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

Women-owned small business concern means a small business concern—

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.
