THE SOLICITATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES FOR CERTAIN COMMERCIAL ITEMS UNDER THE AUTHORITY OF FAR 13.

This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-05 dated May 22, 2024.

1352.215-72 INQUIRIES (APR 2010)

Offerors must submit all questions concerning this solicitation in writing to both the Contract Specialist Brandon Butler at Brandon.Butler@nist.gov and the Contracting Officer Donald Collie at Donald.Collie@nist.gov. Questions should be received no later than five (5) calendar days after the issuance date of this solicitation. Even if provided in other form, only the responses included in the amendment to the solicitation will govern performance of the contract.

(End of Provision)

The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 – Analytical Laboratory Instrument Manufacturing with a small business size standard of 1,000 employees.

This acquisition is being solicited as a Full and Open Competition.

BACKGROUND:

The Security Technologies Group (STG) within the Materials Measurement Science Division is involved in a CHIPS Metrology-funded proposal to advance accurate cure kinetics, stress, mechanical properties, and warpage measurements for next-generation microelectronics packaging under device-relevant conditions. This project is aimed at overcoming key metrological challenges facing the U.S. semiconductor industry, especially in the sphere of advanced packaging. The industry currently confronts significant hurdles due to the dependency on overseas sources for polymeric materials, which are critical in advanced semiconductor manufacturing processes. Our goal is to develop state-of-the-art metrologies, methodologies, and database tools that can comprehensively characterize, test, model, predict, and validate the structure-processing-property relationships of these vital polymeric materials. The acquisition of a Thermomechanical Analyzer (TMA) is a strategic necessity for the success of this project. The TMA system is essential for providing precise measurements of thermal and mechanical properties under varied environmental conditions for electronics packaging materials, thereby aiding in predictive modeling and ensuring the reliability and quality of semiconductor packages. Specifically, the TMA will be used for thermal expansion coefficient measurement of polymeric materials used in advanced packaging under different curing conditions. This procurement aligns with the CHIPS Mission by bolstering the domestic semiconductor industry's metrology capabilities to support the semiconductor ecosystem and foster innovation and competitiveness within the industry.

The Contractor shall provide a Thermomechanical Analyzer (TMA), temperature or environmental control system, software, and related accessories. The contractor shall install the system at NIST and provide on-site training. The contractor shall provide a one (1) year warranty period and two (2) options to extend the warranty for 3 years.

ADDENDUM to 52.212-2, EVALUATION - COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

EVALUATION CRITERIA

Evaluation Factors

The Government intends to award a single purchase order (PO) from this solicitation utilizing simplified acquisitions procedures in accordance with FAR part 13. The Government reserves the right not to award a PO and to make an award without discussions based solely upon initial quotes.

This contract is to be awarded to the most highly qualified offeror based on the selection criteria. The Government intends to use a price/non-price tradeoff process to award a contract to the responsible Offeror whose proposal represents the best value to the Government, evaluated price and other factors considered. The Government reserves the right to make an award to other than the lowest-priced Offeror or to the Offeror with the highest technical rating if the Contracting Officer determines that to do so would result in the best value to the Government. The following factors will be used to evaluate offers:

Factor 1 – Technical Capability Factor 2 – Experience Factor 3 – Evaluated Price

In determining best value, non-price Factors 1 and 2, when combined, shall be more important than Factor 3 evaluated price. The Non-Price Factors 1 and 2, are considered equally important, while Factor 3 is considered less important than each of Factors 1 and 2. Upon evaluation, if a quote is deemed Unacceptable on any given non-price factor, that proposal may not be evaluated further by the Government.

An Offeror's failure to address any factor may be considered indicative of the Offeror's lack of understanding of the Government's requirements and may result in the offer being determined unacceptable.

Factor 1-Technical Capability: No prototypes, demonstration models, used or refurbished instruments will be considered. Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the offeror has demonstrated that its proposed equipment meets or exceeds all minimum requirements. Quotations that do not demonstrate the proposed equipment meets all requirements will not be considered further for award. If an offerors technical description and/or product literature does not indicate whether its proposed equipment meets a certain minimum requirement, NIST will determine that it does not meet the requirements.

Factor 2- Experience:

The Government will evaluate the Offeror’s previous experience to determine the level of experience the Offeror possesses in providing the requirements as defined in the SOW. The Government will consider the experience of the prime contractor. The Government will only consider the Offeror’s experience on work that was actually performed within the last three years. The Government will only evaluate the descriptions of the previous experience that is provided in the Offeror’s proposal. The degree of relevance between the projects submitted and the work required in the SOW shall be considered.

Factor 3- Evaluated Price: The proposed price will be evaluated. The evaluation will determine whether the proposed prices are reasonable in relation to the solicitation requirements. Prices must be entirely compatible with the technical portion of the quotation.

A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.

NIST LOCAL-53 Contract Performance During Changes in NIST Operating Status Unless otherwise stated in the contract terms and conditions, normal days of business operation are Monday through Friday, excluding Federal Holidays. However, throughout the contract period of performance, there may be circumstances beyond the control of the U.S. Department of Commerce, National Institute of Standards and Technology (NIST), that will impact normal days of business operation, such as inclement weather, power outages, etc. In circumstances such as these, the Contractor must call the appropriate NIST campus status line to verify the operating status:

Gaithersburg Campus Operating Status Line:

(301) 975-8000

(800) 437-4385 x8000 (toll free)

Boulder Campus Operating Status Line:

(303) 497-4000

During a lapse in appropriation, access to Government facilities and resources, including equipment and systems, will be limited to excepted personnel for both Federal employees and Contractor personnel. If performance of the contract is onsite and/or requires Government interaction, unless you have been, or are notified that you are to work under an excepted status, you will automatically enter a temporary work stoppage. The work stoppage shall remain in effect until the lapse is resolved and notification is provided via the NIST website at https://www.nist.gov/ and/or the NIST operating status lines. Additionally, Contractors are encouraged to monitor public broadcasts or the Office of Personnel Management’s website at www.opm.gov for the Federal Government operating status.

NIST will provide notification to all contractors that are determined to have excepted status. All excepted contractors are required to continue performance and communicate with the appointed Contracting Officer’s Representative (COR) for further guidance, or NIST Contracting Officer if a COR is not appointed.

Contractors with supply or service contracts that are fully funded at the time of contract award and do not require access to Government facilities, resources, or active administration by Government personnel in a manner that would cause the government to incur additional obligations during the lapse in appropriation may continue performance.
