COMBINED SYNOPSIS/SOLICITATION

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

(ii) The Request for Quotation (RFQ) number FA445222Q0010 shall be used to reference any written quote provided under this RFQ.

(iii) The RFQ document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-06; Effective 05-26-2022.

(iv) This is a 100% set-aside for Small Business (SB). The North American Industry Classification System (NAICS) code for this project is 541990 with a size standard of $17M.

(v) The purpose of this combined synopsis and solicitation is for the procurement of Battalion Mass Tactical Week (BMTW) Exercise Support Services as described in the Scope of Work. The bid schedule and contract CLIN schedule are below, all CLINs will include the following verbiage: “The contractor shall provide services as described in the Scope of Work and in accordance with the terms and conditions of this contract.”

(vi) Description of the requirement:

The description of the requirement is provided in the attached Scope of Work. Period of performance is detailed in each CLIN above.

(viii) FAR Provision 52.212-1, Instructions to Offerors – Commercial Products and Commercial Services (Nov 2021) applies to this acquisition and the following addendum applies:

The following words stating “offer”, “offeror”, and “proposal” are replaced with “quotation”, “vendor”, and “quote.”

Paragraph (b)(12) is added as follows: Additional information required:

a) Relevant Experience Document. Submission of a detailed narrative of the vendor’s relevant experience in working projects that are the same, or similar, to the Scope of Work of this requirement is required.

This document is limited to 5-pages.

b) Submission of the following additional information:

All companies must be registered in the System for Award Management at https://www.sam.gov/SAM/pages/public/index.jsf to be considered for award. The Government will not provide contract financing for this acquisition. Invoice instruction shall be provided at time of award.

Paragraph (c) first sentence revised as follows:

The vendor agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes unless another time period is specified in an addendum to the solicitation.

Paragraph (e) is deleted in its entirety.

(ix) Pursuant to FAR 12.602, contract award will be made using Simplified Acquisition Procedures in accordance with FAR 13.106. Vendor’s submissions will be evaluated based upon the following:

(1) Price; to include all Base + Option CLINs.

(2) Relevant Experience – the Vendor’s relevant experience submission will be evaluated and given a confidence rating as defined below.

Basis for Award

1. Price will be evaluated to determine if it is fair and reasonable in accordance with FAR 13.106-3.

2. The Relevant Experience submission will be evaluated and assigned one of three available Confidence Ratings:

High Confidence The Government has high confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements with little or no Government intervention.

Some Confidence The Government has some confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements with some Government intervention.

Low Confidence The Government has low confidence based on the Vendor’s relevant experience that they will be successful in performing contract requirements even with Government intervention.

Award will be made on a best value determination.

(x) FAR Provision 52.212-3 Offeror Representations and Certifications -- Commercial Items Alternate I (Nov 2021) applies to this acquisition. All vendors must be registered in System for Award Management at https://www.sam.gov/SAM/pages/public/index.jsf at the time of Quote submittal.

(xi) FAR clause at 52.212-4, Contract Terms and Conditions – Commercial Products and Commercial Services (Nov 2021), applies to this acquisition with the following Addendum:

Paragraph (c) of this clause is tailored as follows:

Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.

Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.

The following AFFARS Clause is applicable to this acquisition:

5352.201-9101 AFICC-WP Ombudsman (Oct 2019)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Mr.

(d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be Page 19 of 40 directed to the contracting officer.
