*ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS
DLA DISPOSITION SERVICES ELECTRONIC PROPOSAL GUIDANCE
You must submit your offer/quote via email. Offers or quotes submitted in paper form are unacceptable and will be returned. You must submit your electronic proposal and any supplemental information (such as spreadsheets, backup data, and technical information), using any of the following acceptable electronic formats: files readable using these Microsoft Office® Products: WORD, EXCEL, POWERPOINT, or ACCESS; spreadsheets must be sent in a file format that includes all formulas, macro and format information (scanned document that cannot show the calculations is not acceptable); files in Adobe® PDF (Portable Document Format); files in HTML (Hypertext Markup Language), HTML documents must not contain active links to live Internet sites or pages, all linked information must be contained within your electronic offer and be accessible offline.
Other electronic formats – before preparing your offer/quote in any other electronic format, you must send an e-mail to the Primary Point of Contact listed for this Contract Opportunity to obtain a decision as to the format’s acceptability. This e-mail must be received by the P.O.C. no later than seven calendar days before the closing date.
Failure to e-mail the P.O.C. within this timeframe to seek an alternate format’s acceptability may result in rejection of your submission. All alternate methods must be at no cost to the Government.
Questions must be emailed directly to the Primary Point of Contact listed for this Contract Opportunity.
Maximum size of each e-mail message shall be five megabytes. You may use multiple e-mail messages for each submission; however, you must annotate the subject lines as described above for each message, and number them in this manner: “Message 1 of 3, 2 of 3, and 3 of 3.” DLA DISPOSITION SERVICES cannot guarantee the security of the offer;
offers are submitted at the Contractor’s risk.
Late rules are outlined in FAR 52.212-1(f). Pay particular attention to the provisions that relate to the timing of e-mail submissions.
Security Note: If you choose to password-protect your offer, you must provide the password to DLA DISPOSITION SERVICES before the closing date. Contact the Primary Point of Contact listed for this Contract Opportunity to arrange a means of providing it.
See FAR 15.207(c) for a description of the steps the Government shall take with regard to unreadable offers.
Offerors shall make every effort to ensure that their submission is virus-free, due to information technology security software currently in use which may block transmission of messages/proposals if the email or attachment(s) contain anything that is suspected of containing viruses or malicious content. Offerors are cautioned to contact the Contracting Officer to verify receipt of their proposal well before the time due for bids, in order to allow time for alternate means of transmission, if needed. Offerors remain responsible for ensuring proposals are received by the Contracting Officer before the specified time, and extensions will not be granted in the event a particular offeror’s proposal is found to have been blocked. Submissions (or portions thereof) submitted which DO reflect the presence of a virus, or which are otherwise rendered unreadable by damage in either physical or electronic transit, shall be treated as “unreadable.”
Joint Contingency Contracting System (JCCS) REGISTRATION
The Offeror shall provide evidence of registration in JCCS. Registration Requirements as follows: U.S. and Coalition Commanders possess inherent authority to maintain law and order, provide security, and impose discipline necessary to protect the inhabitants of U.S. and/or Coalition installations, U.S. and Coalition personnel operating outside of installations.
This authority allows commanders to administratively and physically control access to installations and/or project sites, and to bar contractors – including prime contractors, subcontractors at any tier, and any employees, from an installation or site. A commander’s inherent force protection (FP) authority is independent of an agency’s contracting authority, and it may not be superseded by any contractual term or provision. An offeror/Prime Vendor acknowledges that submission of a bid, offer, or a proposal; acceptance of contract award of any type; or continuing effort under any resultant contract requires that the Prime Vendor, and all subcontractors under any affected contract, be initially eligible, and remain eligible during the entire period of contract performance to include any warrant period, for installation/base access to a U.S. and/or Coalition installation, regardless of whether the performance will take place on or off a U.S. or Coalition installation. Failure to obtain or maintain installation/base access eligibility for the Prime Vendor, or any subcontractor, may render a proposal unacceptable or be grounds for termination for cause. To be eligible for installation access, Contractors and subcontractors at all tiers are required to register for installation access in the Joint Contingency Contracting System (JCCS). All offerors are required to register with JCCS as follows:
a. Go to www.jccs.gov
b. Read Registration Instructions
c. Enter Company and Financial Information
d. Enter Point of Contact Information
e. Registration Confirmation – User ID and Password Issued
f. Complete JCIIAS Vendor Questionnaire
g. Upload Documents
Failure to be approved in JCCS and failure to be eligible for installation access at the Prime and subcontractor levels – or failure to inform the contracting officer of the names of all prospective subcontractors (or provide a negative reply) – may render the offerors/contractor ineligible for award or continued performance. Additionally, any firm that is declared ineligible for installation access may be deemed non-responsible until such time as that firm is again deemed eligible by the appropriate access approval authority. Installation access determinations arise from the Combatant Commander’s inherent authority and are separate and distinct from any law, regulation, or policy regarding suspension and debarment authority. Contractor queries or requests for reconsideration related to U.S. or Coalition installation base access eligibility must be directed to the authority responsible for base access decisions.
Offerors with an active JCCS registration shall provide their vendor ID and their current rating in JCCS will be used to determine their eligibility for installation access.

PAST PERFORMANCE INSTRUCTIONS
The offeror is required to provide any current relevant information regarding the level of performance, in terms of delivery and quality achieved under either Government or commercial contracts for the same or similar services within the last 2 years. The information provided should support a qualitative review of the offeror’s record of performance in the areas of quality, adherence to contract schedules, management of the contract and regulatory compliance. Additionally, if performance deficiencies were identified what were they and what corrective action was taken.
(a) Attachment 3 - Past Performance Questionnaire contains a document that must be used by the reference to evaluate an offeror’s past performance, the past performance of their principal subcontractor(s), and/or key employees of their firm.
The offeror shall provide the past performance questionnaire to the reference they identify on page two of the questionnaire. The past performance reference shall independently submit the completed questionnaire to john.e.mcdonald@dla.mil, melissa.herrick@dla.mil, and hazardouscontractseast@dla.mil prior to the closing date of the solicitation. Any past performance surveys received after the date of closing or directly from the offeror will not be considered in the past performance evaluation. The offeror is responsible for ensuring references submit past performance surveys; the Government will not be contacting references to obtain a survey on behalf of the offeror.
(b) The offeror shall complete the first two pages of the questionnaire and include these two pages (for each reference) with their proposal. On these pages, the offeror shall identify the reference’s name, telephone number, contract number, contract type, dollar value, contract award and completion dates, point of contact, description of worked performed, and e-mail address. The description of work performed shall be in sufficient detail to explain how each reference relates to same or similar requirements of the instant solicitation in areas such as number of pickup locations, complexity, scope mailto:melissa.herrick@dla.mil mailto:hazardouscontractseast@dla.mil and magnitude of the services to determine the relevancy of the work.
(c) If the offeror elects to provide principal subcontractor past performance, the offeror shall provide the principal subcontractors’ consent allowing the Government to disclose negative past performance information to the offeror.
(d) References and corresponding reference questionnaires are limited to three projects considered by the offeror to be the most relevant to the requirements of this solicitation. If more than three reference questionnaires are received, the Government will consider the first three projects based upon the date and time the reference questionnaires are received.
(e) A past performance questionnaire is not required for any DLA Disposition Services Hazardous Waste Disposal contract that is submitted as a past performance reference; however, the offeror must identify the contract(s) they would like used as a reference.
(f) The Government will not evaluate a reference, if no corresponding past performance questionnaire is received, unless the Government has other past performance data readily available to evaluate the reference. If the Government receives a past performance questionnaire from a reference and there is no information in an offeror’s proposal regarding that reference, the reference will not be considered.
(g) The submission of a past performance proposal is required from all offerors. If an offeror does not have any past performance references, the offeror must at least state they do not have any past performance to provide. Otherwise, they may be considered non-responsive and excluded from the competition. Offers received that have no references to evaluate will be considered to have no identifiable past performance and will be evaluated in accordance with the Past Performance Evaluation section in this solicitation.
PRICE SCHEDULE INSTRUCTIONS
BASIC AND OPTION PERIOD UNIT PRICING
(a) Offerors are required to submit pricing on all CLINs.
(b) Offerors are cautioned against offering more than one price, a range of prices, or a split bid with respect to any contract line item and are advised that, for purposes of this procurement, DLA Disposition Services will consider any such method of pricing to be a material deviation from the bid schedule and/or a nonconforming proposal that will be
(c) excluded from further consideration. Offerors must list only one price for any individual CLIN in any single contract period. NOTE: Zero ($0.00) unit pricing will NOT be accepted.
(d) Unit prices which exceed two (2) digits right of the decimal will be subject to standard rounding conversion as described below.
(e) Standard Rounding Conversion – Rounding up means to increase the terminating digit by a value of 1 and drop off the digits to the right. If the next place beyond the terminating decimal is greater than or equal to five (5), the number will be rounded up. For example, 5.438 will be rounded up to 5.44. If the number to the right of the terminating decimal place is four or less (4, 3, 2, 1, 0), the number will be rounded down. This is done by leaving the last decimal place as it is given and discarding all digits to its right. For example, 6.734 will be rounded down to 6.73.
(f) The offer shall ensure all documents submitted are translated in English.
PERIOD FOR ACCEPTANCE OF OFFERS
FAR 52.212-1(c) is revised as follows: The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers.

ATTACHMENT 12 CENTCOM Regional Export SP4500-23-R-0010
Addendum to 52.212-2 EVALUATION FACTORS - Commercial Items Source
Selection Method -- Best Value
(a) Trade-off Process Award will be made to the firm with acceptable Technical - Disposal and Transportation Plan that is determined to be the best value based upon the factors of Technical - Management Plan, Past Performance, and Price. When combined, Past Performance and Technical - Management Plan evaluation factors are significantly more important than Price. Past Performance is equal in importance as Technical
- Management Plan. An Offeror with an unacceptable Technical - Disposal plan for all proposed CLINs will not be eligible for award and will be eliminated from the competition prior to the best value trade-off analysis.
(1) Technical Factor – The Government will evaluate the technical proposal in accordance with FAR Part 15.101-1, FAR Part 15.305, and FAR Part 52.212-2.
(2) Past Performance Factor – The Government will evaluate past performance in accordance with Attachment 12 Addenda to the Evaluation provision in this solicitation.
(3) Price Factor – The Government will evaluate the offered prices for price reasonableness in accordance with the requirements of FAR Part 15.305 and FAR Part 15.404-1.
(b) Options.
(1) The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The total evaluated price will be for the base period and any option periods, plus an additional (20%) of the value of the last priced performance period in the bid schedule. This additional sum is for evaluation purposes only to address the possible use of FAR 52.217-8, Option to Extend Services, for a period not to exceed 6 months.
(2) Please note that if the 52.217-8 option is exercised, the applicable unit prices for the option will be the same as the immediately preceding period of performance. Therefore, if the option under FAR 52.217-8 is exercised prior to the end of the base period, the unit prices from the base period will be used during the extension period. If the option under FAR 52.217-8 is exercised prior to the end of any option period, the unit prices from the applicable option period will be used during the extension period.
(3) The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
EFFICIENCY IN COMPETITION
The US Government will first review the disposal and transportation plan for all offerors to determine whether they warrant an acceptable rating. Offerors are advised that the US Government may not evaluate the management plan, past performance, and the total price under this RFP if an offeror’s disposal and transportation plan is not determined acceptable. The management plan of offerors with an acceptable transportation plan will be evaluated and rated prior to evaluation of offerors’ past performance and price.
Past performance will be evaluated and rated in order of precedence from offerors management plan adjectival rating (i.e., the past performance of offerors with the most highly rated management plans will be evaluated first), but prior to offerors proposal pricing. Offerors pricing will be evaluated last, in order of precedence from highest rated management plan to highest evaluated past performance. Offerors are advised that the US Government may not evaluate the past performance and pricing of all offerors under this RFP. This would occur when the Contracting Officer determines that any possible past performance or pricing superiority of any unevaluated past performance and pricing associated with an offeror’s lower management plan adjectival rating over those proposals whose management plans, past performance, and price that were already evaluated and assigned the highest ratings, would not warrant any additional price premium.
TECHNICAL PROPOSAL EVALUATION
There are two parts of the Technical Plan that offerors must submit, and each part is used differently in the source selection process, as addressed below. Only the Management plan will be evaluated as part of the comparative Best Value price technical trade off process. To be considered in the Best Value tradeoff process an offeror must first be found to have submitted an acceptable Technical-Disposal Plan.
Evaluation of Technical - Disposal and Transportation Plan
(1) To be rated as “acceptable,” all CLINs must include:
a. A completed Facility Profile Sheet (Attachment 8) for each firm that will be performing disposal and/or recycling support, and evidence of valid facility permits and/or licenses or confirmation of permit and/or license applications submitted with expected approval date, for ALL the permit/license-required contract line items in the price schedule.
b. A completed Transportation Profile Sheet (Attachment 9) for each firm that will be performing transportation support, and evidence of valid transportation permits and/or licenses or confirmation of permit and/or license applications submitted with expected approval date, for ALL the permit/license-required contract line items in the price schedule.
Evaluation of Technical - Management Plan
(1) The U.S. Government will conduct a subjective review of each Management Plan to determine the degree and ability of the offeror to perform the contract requirements. This will include an assessment of whether the management plan demonstrates the capability to provide for compliant management and disposal of hazardous wastes and an ability to export wastes from multiple locations in accordance with the Basel Convention on the Transboundary Movement of Hazardous wastes and other applicable law and regulations.
PAST PERFORMANCE PROPOSAL AND EVALUATION
I. Evaluation of Past Performance
(1) The Government will conduct a Performance Confidence Assessment for each offeror based upon submitted current, relevant PPI (consisting of Past Performance (PP) references) as it relates to the expectation of the offeror being able to successfully perform the requirement. There are two aspects to this evaluation: (1) The determination of relevance to this solicitation in scope, magnitude and complexity and (2) How well the offeror performed on their contracts. Past performance will be rated on an adjectival scale. Thus, an offeror with a higher confidence assessment rating for past performance will have a higher expectation of meeting the solicitation requirements than a firm with a lower confidence assessment rating. The Government’s subjective evaluation of the overall quality of an offeror’s submitted PPI will be a factor in determining the relative merits of the offeror’s proposal and in selecting for award the offeror whose proposal is considered the best value to the Government.
(2) In investigating an offeror’s past performance, the Government may consider information in the offeror’s proposal and/or readily available information obtained from other sources, including but not limited to the Past Performance Information Retrieval System (PPIRS), DLA Disposition Services personnel administering DLA Disposition Services contract references provided by the offeror, past and present customers and their employees, other government agencies, including state and local agencies, consumer protection organizations and better business bureaus, former subcontractors, and others who may have useful information.
(3) Evaluation of past performance will be a subjective assessment based on a consideration of all relevant facts and circumstances. It will not be based on absolute standards of acceptable performance. This is a matter of judgement. Offerors will be given an opportunity to address especially unfavorable reports of past performance, and the offeror’s response, or lack thereof, will be taken into consideration.
(4) An offeror that has no identifiable record of performance of a same or similar nature to the current requirement may be considered by the Government to have no relevant past performance. In the case of an offeror without an identifiable record of past performance or for whom information on past performance is unavailable (this may include PPI identified by an offeror in their past performance proposal for which a corresponding PPI questionnaire was not received by the Government), the offeror may not be assessed either favorably or unfavorably on Performance Confidence, as the degree of confidence to the Government cannot be adequately determined and is therefore unknown.
PRICE SCHEDULE EVALUATION
(1) Cost or price evaluation. Normally, competition establishes price reasonableness. Therefore, when contracting on a firm-fixed-price, comparison of the proposed prices will usually satisfy the requirement to perform a price analysis, and a cost analysis need not be performed. In limited situations, a cost analysis may be appropriate to establish reasonableness of the otherwise successful offeror's price.
(2) The objective of proposal analysis is to ensure that the final agreed-to price is fair and reasonable.
The contracting officer is responsible for evaluating the reasonableness of the offered prices. The analytical techniques and procedures may be used, singly or in combination with others, to ensure that the final price is fair and reasonable. The complexity and circumstances of each acquisition should determine the level of detail of the analysis required.
(3) Price analysis shall be used when certified cost or pricing data are not required.
(4) Cost analysis may also be used to evaluate data other than certified cost or pricing data to determine cost reasonableness or cost realism when a fair and reasonable price cannot be determined through price analysis alone.
(5) The contracting officer may request the advice and assistance of other experts to ensure that an appropriate analysis is performed.
(6) Recommendations or conclusions regarding the Government’s review or analysis of an offeror’s or contractor’s proposal shall not be disclosed to the offeror or contractor without the concurrence of the contracting officer. Any discrepancy or mistake of fact (such as duplications, omissions, and errors in computation) contained in the certified cost or pricing data or data other than certified cost or pricing data submitted in support of a proposal shall be brought to the contracting officer’s attention for appropriate action.
(7) At a minimum, the contracting officer shall obtain appropriate data, without certification, on the prices at which the same or similar items have previously been sold and determine if the data is adequate for evaluating the reasonableness of the price. Price analysis may include evaluating data other than certified cost or pricing data obtained from the offeror or contractor when there is no other means for determining a fair and reasonable price. Contracting officers shall obtain data other than certified cost or pricing data from the offeror or contractor for all acquisitions, if that is the contracting officer’s only means to determine the price to be fair and reasonable.
(8) The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price.
