1 CONSUMER FINANCIAL PROTECTION BUREAU (CFBP), 1700 G STREET, NW WASHINGTON, DC 20552

Question 1 On page 9 of the solicitation, it states, “training length is no longer than 2 business days”. Does this mean that the government is seeking one two-day “Targeted Communication” workshop that addresses the 5 bulleted topics OR is the government looking for separate training sessions for each the topics listed as themes under "Targeted Communication" training?

Answer: One training, that is no longer than 2 business days, should meet all minimum items listed under B.2, Objectives.

Question 2 If the government is seeking different courses, will the same audience be attending more than 1 class each?

Answer: The CFPB is seeking one training that is no longer than 2 business days, and should include all minimum items listed under B.2, Objectives.

Question 3 Is the client open to only 1 day vs. 2 days of training?

Answer: Yes, as long as all the requirements stated in Section B.2, Objectives can be met.

Question 4 Is client open to a half day follow-up session?

Answer: Yes, details of this half day session should be included in the proposal.

Question 5 Are the travel costs of $5,000 and $10,000 currently in place in the pricing template there to stay?

Answer: The travel costs are an estimate used only for price evaluation purposes. All travel expenses will be paid at cost based on the provisions of the Federal Travel Regulation (FTR).

Question 6 If a facilitator is in the DC area and does not need travel funding unless there is additional training required at sites outside of DC, should these costs be kept in?

Question 9 Why is the NTE travel provision $833.00 per course in the base year and $1,000.00 per course in subsequent years?

Question 10 Is Train the Trainer a 3-day course?

Answer: The Train-the-Trainer length does not have a pre-determined length.

Question 11 What is meant by “3T”?

Answer: Train-the-Trainer (3T). See the amended solicitation, Attachment B - Pricing

Question 16 It is clear that the quality of the curricula is one of the most important evaluation criteria. Are we limited to the ten (10) page limit to provide information to the government, providing an overview of recommended training and/or sample materials?

Question 17: Section E-3, Submission Instructions, Page 26, Contents of Submission.

It states “Volume I – Technical Proposal. The Technical proposal shall be no longer than ten (10) one-sided pages”. Does cover page and table of content count as part of the 10 page limit?

Answer: No. The Cover page and Table of Contents do not count towards the page count. See the amended solicitation, Section E-3, Submission Instructions.

Question 18: Section E-3, Submission Instructions, Page 26, Experience/Past Performance.

It states: “Firm must demonstrate past success within the Federal Government by providing 3 references from within the past 5 years.” Does the past performance write up and reference list pages count against the 10 page limit?

Answer: Yes, this would be included in the 10 page limit.

Question 19 Are client references to be included in the proposal or are we required to provide client references in separate questionnaire and submitted separately to client?

Answer: Offerors are required to provide client references in Volume I of the firm’s proposal.

Question 20: Section E-3, Submission Instructions, Page 26, Training Curriculum and Facilitation.

It states” Firm must provide information regarding curriculum, facilitation of training courses, training course day schedule, and description of training materials provided as it relates to the requirements stated in Section B.3, Scope.” Does the “Training Curriculum and Facilitation information write up about curriculum, facilitation of training courses, training course day schedule, and description of training materials” count against the 10 page limit?

Answer: Yes. The training curriculum and facilitation write-up will count towards the page limit.

Question 21 Do resumes count as part of the ten pages maximum for Technical Volume 1?

Answer: No. The resumes will not count towards the overall page limit, but each resume will be limited to no more than 2 one-sided pages and must be 12 point font or larger. See the amended solicitation, Section E-3, Submission Instructions.

Question 22: Section E-3 Submission Instructions, Page 26, Key Personnel Resumes.

Does the contractor’s staff plan (Resumes) count against the 10 page limit?

Answer: No. The resumes will not count towards the overall page limit, but each resume is limited to no more than 2 one-sided pages and must be 12 point font or larger. See the

Question 23: Section E-3 Submission Instructions, Page 26, Key Personnel Resumes.

Is there a page limit on Resumes?

Answer: Yes, no more than 2 one-sided pages with 12 point font or larger per resume. See the

Question 24 How does the government intend to assess if a training professional is a master facilitator?

Answer: The requirements for a Master’s Degree in the stated fields, years of experience as a trained facilitator and past performance will aid in evaluating the Key Personnel, see Section E.3, I, bullet 3 Key Personnel (Facilitator) Resume.

Question 25 Requirement for Facilitator to have a Master’s Degree: Would years of experience (i.e. 20+ years, with the Federal Government in similar course content) be accepted as an equivalent in lieu of Master’s Degree?

Answer: Experience beyond the required 7 years facilitation experience may be considered in lieu of a Master’s Degree, as long as it is applicable and relevant to the requirements of this solicitation. See the amended solicitation, Section E-3, Submission Instructions.

Question 26: Section E-3 Submission Instructions, Page 26, I. Volume I – Technical Proposal, Expertise/Past Performance.

Is there a page limit on past performance?

Answer: No, this will count towards the overall page limit of 10 pages. These are intended to be a list of references that the Bureau will contact to discuss the training provided and the success of that training.

Question 27 Do the facilitator resumes need to be in a formal resume format or are bio’s acceptable?

Answer: Facilitator bios are acceptable.

Question 28 Where will the trainings be taking place?

Answer: During the Base year, all training sessions will take place in Washington DC. For Option Year 1 and 2, the training sessions will take place in Washington, DC as well as in the various regions; i.e. West, Mid-west, Northeast and Southeast – exact city locations are yet to be determined.

Question 29: Section C.4, Period of Performance.

“There will be an estimated six (6) trainings in the base year with up to 10 (7 at HQ and 3 in the various regions) in each of the one-year option years.” – Are the 6 training sessions in the base year all scheduled to take place at HQ, or will some number in the base year also occur in the various regions? Please identify the specific regional offices in which training sessions will occur.

Answer: During the Base year, all training sessions will take place in Washington DC. For Option Year 1 and 2, the training sessions will take place in Washington, DC as well as in the various regions; i.e. West, Mid-west, Northeast and Southeast – exact city locations are yet to be determined.

Question 30 We assume the Representations and Certifications should be included in the Price Volume, please confirm.

Answer: Contracting officer shall review SAM information for all offerors deemed responsive.

Question 31

Do we need to verify that we fulfill certain requirements for items such as C.12 (Section 508 requirements) and E.4 paragraph (b) (Annual Representations and Certifications)?

Answer: The Contracting Officer will verify that the Annual Representations and Certifications are current in the System for Award Management (SAM) for offerors deemed responsive.

Vendor will need to verify that Section 508 Compliance requirements are met.

Question 32 Where in our response do we need to include Items E.5 (c) 1-8? Or would this information be covered with SAM registration?

Answer: SAM registration should provide this information.

Question 33 What is the Amendment referred to in the Contents of Submission? “Signed SF1449/Cover page and Amendment” (page 26)

Answer: An Amendment is issued when any change is made to a solicitation. An Amendment was issued with the responses to these questions. Any Amendment that is issued must be signed and returned as part of the complete proposal.

Question 34 Are there any FAR regulations pertaining to lowest pricing? If so, what is the regulation number?

Answer: Evaluation of responses is carried out under FAR Part 52.212-2. As stated in Section E.2 Expertise/past performance is significantly more important than curriculum and key personnel. Technical, non-price factors, when combined, are significantly more important than price. However, as technical factors among Offerors become closer, price becomes more important.

Question 35 We assume the non-disclosure agreement should be included in the Price Volume, please confirm. If not and it is to be included in the Technical – we assume it will not count against the page limit? Please confirm.

Answer: The Non-Disclosure Agreement will only be signed and submitted by the awardee. It is included in the solicitation so all vendors are aware of what it says and the requirement to sign it upon award.

Question 36 When does the government anticipate that a decision will be made regarding this RFP?

Answer: The Bureau intends to award a contract for these requirements by May 2015.

Question 37 Is there any deadline for asking additional questions?

Answer: All questions were due 2:00 pm Eastern Time on March 31, 2015. Vendors may continue to submit questions beyond that deadline but there is no guarantee that those questions will be answered prior to the closing of the solicitation.

Question 38 Is there a senior executive that is championing this effort?

Answer: This acquisition has been presented to and has received support from CFPB

Management.

Question 39 What is the government’s expectation regarding how to measure success of the initiative?

Answer: The CFPB is concerned with meeting the objectives outlined in this solicitation.

Success of the effort will be realized if objectives are met.

Question 40: Section B.3.1 “Include appropriate and effective post-course evaluation metrics”. What does this mean?

Answer: Provide information on how post-course evaluation would take place and what metrics will be used to measure the success of the training.

Question 41: Section B.3, Scope.

“Include a post-training implementation support or plan” – Please clarify this statement. Does it require the contractor to deliver post-training support after each 2-day training session? If so, what is the level of effort anticipated or budgeted for the contractor to provide such post-training support beyond the 2-day training session?

Answer: Yes, post-training support will be provided after each 2-day training session.

However, this is NOT intended to be a facilitated post-training but “reference” support to assist with long-term knowledge retention of the training topics.

Question 42 The solicitation mentions that the training must include a post-training implementation support or plan.

We assume that the government will implement this post-training implementation support or plan. Is that correct?

Answer: Yes, the Contractor will provide CFPB with the content of the post-training and

CFPB will disseminate it to the attendees.

Question 43 Are different topics to be offered each year, i.e., 6 of THIS and next year 10 of THAT, or the same training offered 26 times for groups up to 25 persons each?

Answer: The same training will be offered up to 26 times for groups up to 25 persons each.

Question 44 Are the current expectations for the program to use off the shelf training materials, completely costumed designed training materials, or adapted off the shelf training materials to meet the specific needs of CFPB?

Answer: The CFPB is interested in a commercially available, off the shelf training program, not a customized training program.

Question 45 Does the government intend to give any preference for a SDVOSB for this solicitation?

Answer: This is an unrestricted solicitation.

Question 46 Is there any guarantee of a minimum class size (i.e. 10 attendees per class minimum)?

Answer: The planned class size is for at least 25 attendees. Each Offereor should indicate at which point an additional attendee will be an additional cost.

Question 47: Section B.2, Objectives.

“The target audience for this training shall include members of CFPB Staff and Management.” -- What is the total number of CFPB employees expected to go through this training?

Answer: As staffing numbers are expected to fluctuate, there is no way to predict a total number of attendees. We are planning for the class numbers and attendees as state in Section C.4, Period of Performance

Question 48: Section B.2, Objectives.

“The target audience for this training shall include members of CFPB Staff and Management.” -- Will each 2-day training session include a mix of Staff and Management or will training sessions be allocated so that some are exclusively for Staff and some are exclusively for Management?

Answer: Each training session may include staff and/or management but will most likely never be management only.

Question 49: Section B.2, Objectives.

“The target audience for this training shall include members of CFPB Staff and Management.” -- What is the GS-level range and main occupations for Staff attendees? What are the GS-level/SES level range and main occupations of Management attendees?

Answer: While the CFPB does not follow the GS Pay Schedule, participants may be from all CFPB pay bands.

Question 50 Off-the-Shelf training – what does this mean? Does it mean that the training modules must be published for the public? Can it include proprietary information?

Answer: Training material can include proprietary information, however the training shall not be customized to the CFPB, but available in the commercial marketplace.

Question 51: Attachment B, Pricing Template Facilitator Cost Category per day under the rate. Does the Government want this rate as the hourly rate or cost per day?

Answer: Contractor shall provide pricing per attendee for the two day class, and the cost of the facilitator to teach the class.

Question 52: Attachment B, Pricing Template Total Cost/Attendee Category. Does the Government want a total cost per student to attend the 2 day training? Does the Government want both facilitator cost and a cost per student amount submitted?

Answer: Contractor shall provide pricing per attendee for the two day class, and the cost of the facilitator to teach the class.

Question 53 Is the government open to contractor assisting including a post-training implementation support or plan, as a separate line item?

Answer: A post training implementation and support plan is part of the scope of this project, see Section B.3.1. The Offeror may add a separate line item to the Pricing Tables for this post training requirement, if necessary. The additional line item will be evaluated as part of the total Firm Fixed Price offer.

Question 54 Will the CFPB be extending the deadline for proposals beyond April 10th?

Answer: Since there are no material changes to the RFP based on the questions received, there will be no extension to the response due date and time.

SUBJECT: Request for Proposals: CFP-15-R-00003 - Targeted Communications Training, Amendment 001

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

Description of Requirement: The following requirement is to provide training content, participant materials and facilitation for communications topics related to conflict resolution. The following topics are of specific importance:

• Resolving conflict and disagreements

• Building acceptance and overcome resistance

• Speaking persuasively about high-stakes, emotional, or controversial topics

• Fostering better decision making

• Building teams that work together and act with unity and conviction

The period of instruction will cover a base year and two (2) 12-month option periods with a minimum of six (6) sessions during the base year and as many as 10 classes during Option Year 1 and Option

B. CONTINUATION OF SF1449 BLOCK 20 - SCHEDULE OF SUPPLIES OR SERVICES, AND PRICES

B.1 INTRODUCTION

B.1.1 The Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 (Dodd-Frank

Act), Pub. L. 111-203, established the Consumer Financial Protection Bureau (CFPB) to regulate the offering and provision of consumer products or services under federal consumer financial laws. Consistent with the purposes of the Dodd-Frank Act, the CFPB’s mission is to establish and enforce clear, consistent rules for the financial marketplace, protect American families from unfair financial practices, and develop and implement a strategy to improve the financial literacy of consumers. The CFPB is committed to a work environment that promotes fairness and equality of opportunity for everyone on the basis of merit and without regard to race, color, disability, religion, national origin, age, sex

(including pregnancy, LGBT status and gender identity or expression), genetic information, sexual orientation, parental status, or prior protected Equal Employment Opportunity

B.1.2 Pursuant to Title 29 of the Code of Federal Regulations (CFR) § 1614.104 and the Equal

Employment Opportunity Commission’s (EEOC) Management Directive 110 (MD-110), the CFPB is required to provide Counselees access to pre-complaint counseling and an alternative dispute resolution program, offering the parties an opportunity for an early resolution of disputes in a mutually-satisfactory fashion. If the parties fail to reach a resolution, the Counselee may file a formal complaint of discrimination. The CFPB is required to investigate the complaint of discrimination in accordance with 29 CFR §

1614.106-1614.108 and MD-110. These services are successfully being provided to the bureau. However, the Office of Civil Rights has identified an opportunity to assist proactively with dispute resolution through offering targeted communication training to all

CFPB employees.

B.1.3 The CFPB requires contractor assistance in providing Commercial, Off-the-Shelf training products to meet the stated objectives of this solicitation.

B.2 OBJECTIVES

The contract resulting from this Request for Proposal will be required to support the goals of the

CFPB, Office of Civil Rights. The objectives of this contract include at a minimum, but may not be limited to the following areas.

Required outcomes include:

• Resolving conflict and disagreements

• Building acceptance and overcome resistance

• Speaking persuasively about high-stakes, emotional, or controversial topics

• Fostering better decision making

• Building teams that work together and act with unity and conviction

Contractor shall be required to provide training content, participant materials and facilitation for communications topics related to conflict resolution. The target audience for this training shall include members of CFPB Staff and Management.

B.3 SCOPE

B.3.1 The CFPB requires commercial, off-the-shelf training content, participant materials and facilitation for communications topics to support conflict resolution. At a minimum, the training and related training materials must:

• Be pertinent, current, and up-to-date in both design and content;

• Require extensive student interaction and skill building

b. Performance of work under the contract must be subject to the technical direction of the COR identified above, or a representative designated in writing. The term

d. The Vendor shall proceed promptly with performance resulting from the technical direction issued by the COR. If, in the opinion of the Vendor, any direction of the

COR, or his/her designee, falls within the limitations in subparagraph 12.3 herein, the

Vendor shall immediately notify the Contracting Officer no later than the beginning of the next Government work day.

e. Failure of the Vendor and the Contracting Officer to agree that technical direction is within the scope of the contract shall be subject to the terms of the clause entitled

“Disputes.”

C.7 FAR 52.232-39 UNENFORCEABILITY OF UNAUTHORIZED OBLIGATIONS (JUN

2013)

(a) Except as stated in paragraph (b) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of

Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency

Act violation (31 U.S.C. 1341), the following shall govern:

(1) Any such clause is unenforceable against the Government.

(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse-wrap” agreements), execution does not bind the Government or any Government authorized end user to such clause.

(3) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.

(b) Paragraph (a) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulation and procedures.

C.8 CONTRACTOR POINT-OF-CONTACT (CPOC). The Contractor’s POC is identified here:

The Contractor’s designated Point-of-Contact shall be responsible for the overall management and coordination of this contract and shall act as the central point-of-contact with the

Government. The POC shall have full authority to act for the Contractor in the performance of the required services. The CPOC, or a designated representative, shall meet with the COR to discuss problem areas as they occur. The CPOC or designated representative shall respond within four hours after notification of the existence of a problem. The CPOC shall be able to fluently read, write, and speak the English language.

C.9 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS

(a) Definitions. As used in this clause—

(1) “Payment request” means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Payment documentation and process" and the applicable Payment clause included in this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Invoice Processing Platform (IPP). Information regarding IPP is available on the Internet at www.ipp.gov. (c) The Contractor may submit payment requests using other than IPP only when the

Contracting Officer authorizes alternate procedures in writing.

(d) If alternate payment procedures are authorized, the Contractor shall include a copy of the

Contracting Officer’s written authorization with each payment request.

C.9.1 PAYMENT AND INVOICE QUESTIONS

C.9.2 OVERPAYMENTS.

C.9.2.1 In accordance with FAR 52.212-4, section (i)5, overpayments: Accounts

Receivable Conversion of Check Payments to EFT: If the Contractor sends the

Government a check to remedy duplicate contract financing or an overpayment by the government, it will be converted into an electronic funds transfer (EFT).

This means the Government will copy the check and use the account information on it to electronically debit the Contractor’s account for the amount of the check. The debit from the Contractor’s account will usually occur within twenty-four hours and will be shown on the regular account statement.

C.9.2.2 The Contractor will not receive the original check back. The Government will destroy the Contractor’s original check, but will keep a copy of it. If the EFT cannot be processed for technical reasons, the Contractor authorizes the

Government to process the copy in place of the original check.

C.10 CONTRACTOR TRAVEL Contractor will be required to travel CONUS and within the

National Capitol Region (NCR) during the performance of the contract. The contractor may be required to travel to off-site training locations and to ship training aids to these locations in support of this Contract. substantive provisions of the Federal Travel Regulation (FTR) and the limitation of funds specified in the contract. All travel requires Government approval/authorization and notification to the COR. For proposal purposes, a not-to-exceed amount for travel will be established.

C.11 TRANSPARENCY. CFPB is dedicated to transparency and plans to make the award document available to the public after award. If selected, your firm will agree to electronically submit to the Contracting Officer’s Representative (COR) and copy

CFPBprocurement@cfpb.gov mailbox, within ten business (10) days from the date the task order is awarded (exclusive of Saturdays, Sundays, and federal holidays), a .pdf file of the fully executed task order with all proposed necessary redactions, including redactions of any trade secrets or any commercial or financial information that it believes to be privileged or confidential business information, for the purpose of public disclosure at the sole discretion of

CFPB. The contractor agrees to provide a detailed written statement specifying the basis for each of its proposed redactions, including the applicable exemption under the Freedom of

Information Act (FOIA), 5 U.S.C. § 552, and, in the case of FOIA Exemption 4, 5 U.S.C. §

552(b)(4), shall demonstrate why the information is considered to be a trade secret or commercial or financial information that is privileged or confidential. Information provided by the contractor in response to this requirement might itself be subject to disclosure under the

FOIA. CFPB will carefully consider all proposed redactions and associated grounds for nondisclosure prior to making a final determination as to what information in the fully executed task order may be properly withheld.

C.12 SECTION 508 REQUIREMENTS. All deliverables shall comply with Section 508 requirements per 36 C.F.R 1194 and Section 508 of the Rehabilitation Act of 1973. The full text of the Section 508 regulations and provisions are available at http://www.section508.gov.

C.13 FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
