PERFORMANCE WORK STATEMENT

US Naval Hospital Guam Commercial Internet & Cable Services

1.0 GENERAL INFORMATION

1.1 Description of Services/Introduction. The Contractor shall provide reliable, ‘turn-key’ internet & cable service at the required dedicated bandwidth to separate Government sites within Guam (as specified in Tables 1&2 in Technical Exhibit 3). These services shall provide dedicated commercial internet connectivity and shall be completely independent from and not interfere with, violate, interconnect with, or otherwise be associated with any other Government network or other communications systems present (i.e. NIPR, SIPR, DSN, CENTRIXS, or others).

1.2 Objectives/Scope. The Contractor shall provide Internet Services to each location in Technical Exhibit 3 with the required dedicated bandwidth by means of Fiber Optics, Copper, or Satellite. Each location in Technical Exhibit 3 shall have separate ‘dedicated’ Uplink and Downlink bandwidths (not be shared between locations or other users). The contractor shall provide all equipment, cabling, leased circuits, and infrastructure necessary to provide the internet service to include the core router. If the U.S. Government adds additional switches, firewalls, or other network equipment to the core router, the contractor shall assist in ensuring the connectivity from the core router to the device is established, but shall not be responsible for configuration, maintenance, or failures of the additional devices. All services require a static IP address that shall be provided to the Chief Information Officer (CIO). It is the contractor’s responsibility to notify the CIO of any changes to the IP address prior to the change taking place.

The Contractor is responsible for delivering the internet service all the way to the end user workstations for the locations in Technical Exhibit 3. Additional task information can be found in Paragraph 5.3 General Tasks.

1.3 Period of Performance. The period of performance shall be for one base year (12 months) and two (2) twelve month option years.

1.4 Quality Control (QC). The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-reoccurrence of defective services. The contractor’s quality control program is the means by which to ensure performance complies with the requirement of the contract. As a minimum, the contractor shall develop quality control procedures that address the areas identified in Technical Exhibit 1, Performance Requirements Summary. After acceptance of the quality control plan, the contractor shall receive the Contracting Officer’s acceptance in writing with any proposed change to the QC system. The contractor shall submit one copy of a comprehensive written Quality Control Plan (QCP) to USNH Guam Chief Information Officer (CIO) within 10 days after contract award. The contractor will receive the Contracting Officer’s written acceptance of its QCP along with any proposed changes to the QC system. For any changes thereafter, the contractor shall submit a copy of the proposed changes to the USNH Guam CIO for review/approval. The USNH Guam

CIO will render their decision on the proposed changes within five (5) working days after receipt.

1.4.1.1 Quality Control Reports. The contractor shall submit a monthly Quality Control Report covering each functional area identified in the contract. The report shall be submitted to the USNH Guam CIO on the last day of the month for review as part of the contractor’s quality control program.

1.4.1 Quality Assurance. The Government shall evaluate the Contractor’s performance under this contract in accordance with Technical Exhibit 1, which defines how the performance standards will be applied, the frequency of surveillance, and the maximum acceptable defect rate(s).

1.4.2 Recognized Holidays. Internet service is required to be operational 24 hours a day, 365 days a year, to include all holidays.

1.4.3 Place of Performance. The work performed under this contract will perform work at all site locations as stated in Technical Exhibit 3 of this PWS.

1.5 Security Requirements

1.5.1 Physical Security. The Contractor shall be responsible for safeguarding all Government equipment, information, and property provided for Contractor use. At the close of each work period the contractor shall secure government facilities, equipment, and materials in the contractor’s possession.

The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer.

1.5.2 Lock Combinations. The Contractor shall establish and implement methods of ensuring unauthorized persons do not have access to combinations. The Contractor shall ensure that lock combinations are changed upon personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan.

1.5.3 Badging Instructions. Naval Base Guam Installation Access

In order to obtain entry to military sites in Guam, Contractors must contact the Rapid Gate/Badging Office at 671-339-1095 for forms, procedures, and instructions.

1.5.4 Identification of contractor personnel. All contract personnel attending meetings and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.7 Post Award Orientation/Periodic Progress Meetings. The contractor agrees to attend any post award orientation convened by the contracting activity per the Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. These meetings shall be at no additional cost to the Government.

1.8 Out-of-Scope. If the contractor is directed to do any work that the contractor considers outside the scope of this contract, the contractor shall notify the Contracting Officer immediately and follow-up in writing within two (2) days of discovery and contractor shall not work on that portion of the project believed to be outside the scope of this contract until and unless the Contracting Officer orders performance of it.

1.8.2 Contracting Officer’s Authority. Only the Contracting Officer is authorized to make changes to the contract. No other Government or non-Government official may alter this contract. The contractor is to report any attempts to alter this contract to the Contracting Officer.

In the event the contractor effects any such changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. The contractor may also be required by the Contracting Officer to undo any such unauthorized changes at no additional expense to the Government.

1.9 Data Rights. The Government has unlimited rights to all documents/material produced under this contract. Any documents and materials, to include the source codes of any software, produced under this contract shall be Government owned and are the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government.

These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purposes. This right does not abrogate any other Government rights.

2.0 DEFINITIONS AND ACRONYMS.

2.1 Definitions.

CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

CONTRACTING OFFICER (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government.

Note: The only individual who can legally bind the Government and who can make changes to the terms and conditions of a contract.

DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured items such as meeting minutes or reports.

PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

POINT OF PRESENCE. An artificial demarcation point or interface point between communications entities. An Internet point of presence is an access point to the Internet.

QUALITY ASSURANCE. The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

SUBCONTRACTOR. One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.

WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract. Internet service is required to be operational 24 hours a day, 365 days a year, to include all holidays.

3.0 GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES.

3.1 Facilities. The Government will provide climate-controlled space for all indoor Government equipment at each location noted in Technical Exhibit 3 and will include 110 V AC / 60 HZ power source.

3.2 Equipment. The Government will provide and maintain all workstations to include computers, monitors, printers, webcams, peripherals, power source, and peripherals’ cabling.

Maintenance/replacement/upgrade of Government furnished equipment shall be the sole responsibility of the Government.

3.3 Services. All utilities in the facility will be available for the contractor’s use in the performance of duties outlined in this PWS. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities.

4.0 CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES.

4.1 General. The contractor shall furnish all supplies, equipment, and services required to perform work under this contract that are not listed under Paragraph 3.0 of this PWS.

4.2 Equipment. The contractor shall be required to provide and maintain all equipment, cabling, leased circuits, UPS/surge protection, and infrastructure necessary to provide the internet and cable services to the point of presence and the surrounding area.

Maintenance/replacement/upgrade of contractor furnished items shall be the sole responsibility of the contractor. All contractor furnished items shall be clearly marked with company name and POC information.

4.3 Specific Tasks.

4.3.1 Required Support. Contractor shall ensure repair and installation personnel have all required installation access paperwork completed and approved. Failure to have proper installation access does NOT relieve the contractor from the time requirements for performing repairs and services restorations.

4.3.2 Preventive Maintenance. Contractor shall complete all manufacturer and Department of Defense (DoD) required software and firmware upgrades within 60 days of release to prevent service interruptions and ensure secure internet services at all specified locations. The contractor shall maintain all contractor provided equipment and perform preventive maintenance per the equipment manufacturer's recommended standards for a 'dirty/dusty' environment. Contractor shall submit a Preventive Maintenance Completion Report quarterly to the CIO.

4.3.3 Availability. Contractor shall ensure 100% network availability rate.

4.3.4 Scheduled Outages. The contractor shall provide written notification to the CIO and get approval at least forty- eight (48) hours in advance of any scheduled maintenance that may result in services outages. By location, the contractor shall schedule major maintenance actions during times of reduced use by the Government such as 2300 to 0400 hours. The contractor shall notify the Government within one (1) hour of any unscheduled service outage. The contractor shall maintain a roster of people to be notified in the event of an outage. The CIO will provide a roster of contacts to the contractor.

4.3.5 Monitoring. Contractor shall provide real-time monitoring and technical support staff 24 hours a day, 365 days a year for the entire period of performance. The real-time monitoring and technical support solution shall be a commercial type technical support. The contractor shall continuously monitor all services at all locations and immediately notify the Government of all services outages, services degradations, and contractor owned equipment failures. Contractor shall automatically initiate troubleshooting and fault isolation procedures to restore services. The contractor shall provide the Government with access to a web-based industrial standard monitoring and recording software solution such as Solar winds, Multi Router Traffic Grapher (MRTG), and Paessler Router Traffic Grapher (PRTG), or the commercial equivalent, and make such solution fully accessible to the Government through the internet. Such a solution shall be accessible by the Government through a user access method such as a username and password.

4.3.6 Firewalls. The Government will provide its own information firewall solution. Contractor shall assist in the integration of all firewall equipment into contractor provided equipment.

4.3.7 Help Desk and Remote Technical Support. The contractor shall provide immediate Help Desk and Remote Assistance and Repair capability 24 hours a day 365 days a year. Contractor shall initiate 'trouble tickets' within 30 minutes of notification. Contractor shall restore services within two (2) hours of notification for all outages not caused by on-site equipment failures or not requiring an on-site repair. All faults, system outages, services degradations, and trouble tickets shall be logged and provided to the Government. This log shall show, at a minimum, total outage time, reason of outage, who reported the outage, response times, and resolution. In the case of major outages, all affected services locations will be recorded as a single customer-generated trouble ticket. The contractor will submit the log to the CIO on the first business day after the end of the previous month. Contractor shall provide the Government with Technical Support and Fault Escalation points of contact to the CIO. Contractor shall appoint a specific system engineer as the primary point of contact for the US Government to contact with all services related issues.

4.3.8 On-site Repairs. If remote assistance cannot restore services or if on-site equipment requires repair or replacement, the contractor shall restore on-site service within four (4) hours of notification of outage.

4.3.9 Repair Technicians. The contractor shall ensure a qualified repair technician will be on call and available to the Government at all times. The contractor shall maintain sufficient staff and material to repair two (2) simultaneous services outages at separate locations.

4.3.10 Abuse and Neglect. The contractor is not responsible for damages caused by negligence or abuse solely the fault of the Government (required services restoration times do not apply).

Contractor shall provide cost estimates and receive written approval from the Contracting Officer before performing any repairs necessitated by negligence or abuse solely the fault of the Government.

4.4 General Tasks

4.4.1 Site Survey. Within seven calendar days of contract award, the contractor shall perform preliminary investigation and site surveys of installation sites. The contractor shall immediately bring any adverse conditions that would affect performance of services to the attention of the CIO at Naval Hospital Guam. The contractor will ensure that customer support and personnel conducting installation, maintenance, services, repair, or acting under this contract will have at least one person present capable of communicating effectively in English and acquire necessary access approvals. Within 10 days of contract award, the contractor shall provide a detailed installation plan, a list of all installed equipment by serial number, model, and power consumption requirements, and necessary environmental requirements (necessary temperature operating range and estimated heat generation).

4.4.2 Site Installation. Contractor shall complete each location's installation and provide required services for each location in Technical Exhibit 3. Contractor shall be responsible for coordination with the Naval Base Guam and shall be responsible for leasing all required circuits and fiber optic cabling. If the contractor requires access to US Government manhole systems or telephone switching equipment, the contractor shall provide a detailed description of the required access and affected equipment and cabling. Contractor shall be responsible for dig permit approval prior to any digging or trenching on US Government controlled areas. All installed equipment and cabling shall be clearly marked and installed in accordance with (IAW) industrial standards and marking requirements.

4.4.3 Internet Services. Contractor will connect a 50 Mb or higher transmit “Uplink” and a 25 Mb or higher receive “Downlink” to Building 50 room 1zA19 copper RJ45 tie into the USNH Guam’s Cisco 1921 router and to Branch Clinic Apra Harbor. Contractor will provide a 5 Mb or higher connection to the Gym, Conference Center, Warehouse 6, Public Health Activity (Bldg 1A), and Boller Veterinary Clinic. Contractor will block all pornographic, X-Rated sites to Government facilities. Contractor shall provide 32 Internet Protocol (IP) addresses for Building 50, and at least five other locations. Priority for laying CAT5e or CAT6 cable shall be given to existing conduit inside walls. When existing conduit does not exist or cannot be used, cable shall be ran along walls and through conduit or protective cable coverings and laid in such a way that the cable is secure to the wall and does not cross any common walk areas. All installed cabling becomes property of the U.S. Government.

4.4.4 Cable Services. Contractor shall provide Business Basic Cable Services for USNH Guam and the outlying facilities listed in Technical Exhibit 3 below.

4.4.5 Required Reports. The contractor shall provide the CIO with weekly Traffic/Bandwidth Utilization reports. Contractor shall provide the CIO with monthly outage/services interruption reports and a listing of all trouble tickets (See 4.3.7). Contractor shall provide the CIO with monthly reports documenting completion of all required preventive maintenance and services (See 4.3.2).

4.4.6 Power Sources. Lightning Protection and Grounding: The contractor shall coordinate with the Department of Public Works (DPW) to integrate into the existing Government power systems. To protect attached equipment and personnel, Contractor shall provide adequate grounding and lightning protection on all installed equipment. Many of the US Government locations use local power generation (vs. commercial power). Contractor shall provide and utilize surge protection and uninterruptable power supplies (UPS). The contractor installed equipment shall have adequate UPS capability to maintain services for a minimum of 30 minutes of normal usage.

4.4.7 Administration, Inspection, and Acceptance. Prior to acceptance by the Government, all work and locations shall be inspected. As a minimum, the following shall be inspected:

Cabling and installation Electrical wiring Lightning protection Grounding Power connections Fire Safety Dedicated Bandwidth Equipment Compatibility Required Permits and Licenses Site clean up

The Government will provide the contractor with a deficiencies list upon the completion of any inspection. If deficiencies cannot be repaired to the satisfaction of the Government at the time of discovery, the contractor shall provide the Government a plan to correct the deficiencies within 24 hours. The Government will re-inspect upon the correction of deficiencies.

Contractor shall provide a dedicated account manager/administrator with whom the US Government can coordinate all administrative, payment, and installation issues. This manager/administrator shall be identified at the Post Award Orientation, to be scheduled prior to commencement of work.

5.0 PHASE-IN/PHASE-OUT PLANS (TRANSITION PLAN)

5.1 Phase-In. The contractor shall provide a Phase-In plan with proposal submittals that address those actions, plans, and procedures necessary to ensure a smooth transition to full operational status. The contractor's plan shall include a detailed plan for the phase-in period that includes mobilization, training, and orientation of the work force, and assessment of potential security risks. The plan shall describe the contractor's approach to develop and disseminate operational instructions, procedures, and control directives in preparation for the performance of all work.

5.2 Phase-Out. The contractor shall provide a Phase-Out plan with proposal submittals that address those actions, plans, and procedures necessary to ensure a smooth and orderly transfer of contract responsibility to a successor contractor. The plan shall fully describe how the contractor shall approach such issues as GFP/GFE inventories (See 1.13, 5.3.3, etc.), data and information transfer, and any other actions required to ensure continuity of operations.

5.3 Damage to Property. The contractor shall be liable for all damages to Government and private property caused as a result of any aspect of the contractor's performance of this contract.

5.4 Ordinances. The contractor shall comply with all ordinances, local laws, and regulations respective to the performance of work under the contract. All fees for said ordinances and licenses shall be solely borne by the contractor.

5.5 Safety Standards. The contractor shall abide by all applicable federal and local safety and security regulations and procedures for Naval Hospital Guam cleanliness, safety and health standards consistent with the requirements of OPNAVINST 5100 series, Navy Occupational Safety and Health (NAVOSH) Program.

The contractor shall be responsible for the safety of their employees during all contractor operations conducted in accordance with the Performance Work Statement, federal and local regulations, and Occupational Safety and Health Administration (OSHA) standards.

Contractor shall ensure all areas are cleaned up daily and prior to departing from the work locations. The contractor shall properly and neatly secure all cabling. Cabling shall be installed in a manner to prevent safety or trip hazards. If necessary, cabling shall be buried underground or installed behind ceiling areas. Cabling installed inside structures will be installed inside proper conduit. The contractor shall follow all industrial and Government safety codes in installing, servicing, and maintaining all equipment and services.

5.6 Environmental Protection. The contractor shall be responsible for following and complying with all environmental regulations and policies established by the Government of the United States while conducting daily operations under this contract on Government installations. The contractor shall ensure and maintain environmental compliance throughout the period of the contract.

The contractor shall obey all US laws regarding secondary containment, environmental training, and proper disposal of hazardous material or debris from installation. The Contractor shall dump waste in an approved site and comply with environmental laws.

6.0 APPLICABLE PUBLICATIONS (Current Editions)

Performance Requirements Summary The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.
