GENERAL SERVICES ADMINISTRATION

MID-ATLANTIC REGION

Justification for other than full and open competition.

1. Background, identification and description of action being approved.

A solicitation is being prepared for the Internal Revenue Service at the located at The Robert C. Byrd USCH and Federal Building located in Beckley, West Virginia. The solicitation covers procuring physical security equipment, inclusive of relative construction services and testing to add ePAC access control to the Beckley Finance Center for relocated spaces. GSA is requesting to procure physical security equipment, inclusive of relative construction services and testing for the project. The specifications may reference parts that are branded Access Control, IDENTIV, Intrusion Alarm and Video Systems.

2. Description of supplies or services required.

The solicitation includes the Government (GSA) requiring an experienced and supplier certified Access Control and alarm equipment installation Contractor to install the Access Control, IDENTIV, Intrusion Alarm and Video Systems. It includes to secure the services of an IDENTIV/HIRSCH certified, approved, licensed and bonded Contractor to install new SMART card readers and access control hardware with capable of being IDENTIV access control Technology, control panels, firmware, card readers, etc. in order to be in compliance with HSPD-12, FICAM, and NIST. All of the equipment described above will function in a stand-alone manner and will be procured using other than full and open competition. The existing security ePAC system is to be replaced by the Access Control, IDENTIV, Intrusion Alarm and Video Systems. The Contractor shall install the alarm system according to applicable agency certification and Underwriters Laboratories (UL) guidelines (installation methods, wire supports, etc). ld equipment is not HSPD-12 and FICAM compliant which is a government requirement. All new equipment will be tied into the IRS national servers for Access Control running Velocity only. This justification is a brand name requirement for system and parts. It is not a sole-source requirement for the installer subcontractor.

There are many firms with the certification to install this equipment.

3. Identification of statutory authority.

Section 303(c)(1) of the Federal Property and Administrative Services Act (41 U.S.C. 253(c)(1)), permits other than full and open competition when supplies or services required by the agency are available from only one responsible source and no other type of supplies or services will satisfy agency requirements.

4. Demonstration that the acquisition requires use of the authority cited.

The purpose of this project is to add ePAC access control to the Beckley Finance Center for relocated spaces. Work will be located at The Robert C. Byrd USCH and Federal Building located at 110 North Heber Street, Beckley, West Virginia. However, the existing ePAC system the IRS utilizes is original to the building (1999) and has become unreliable as well as obsolete. Parts are no longer available for the system and any fixes are band-aids to keep the system operational until the new equipment can be installed. Over the course of the past year and a half, the system has gone down on multiple occasions, which puts the IRS staff in a vulnerable security status and makes it difficult to move about their space and access their office space. The project has been deemed critical and getting this project priced and awarded is a top priority for GSA.

Therefore, this system should be the same as the other IRS Security Upgrades across the nation.

5. Description of efforts to solicit as many offers as practicable.

Full and open unrestricted competition of the overall contract will maximize competition, as will the contractor’s ability to select the necessary Access Control, IDENTIV, Intrusion Alarm and Video Systems.

6. Demonstration that the anticipated cost will be fair and reasonable.

The Government will utilize an Independent Government Estimate prepared by the designer of record to determine price reasonableness. The independent government cost estimate for the brand name supplies is $83,351.06. The total independent government cost estimate for the entire project is . The cost of the brand name supplies shall be deemed fair and reasonable provided the Contracting Officer specifically determines in writing that the overall price for contract award is fair and reasonable.

7. Description of market survey conducted.

A market survey was not conducted because of the Government’s need for products by one particular manufacturer.

8. Other facts supporting the use of other than full and open competition.

Conversations with the designer of record, IRS and GSA’s engineers, the project manager, and the technical support representative took place at different instances to confirm that the above information is correct.

9. List of sources that expressed an interest in the acquisition.

This brand-name justification will be posted on SAM.GOV for 30 calendar days to notify the industry of this brand-name requirement and it allows potential competitors to comment.

10. Statement of actions to overcome barriers to competition.

This procurement is set-aside for the 8(a) small business program, but this justification will be posted on

SAM.GOV.
