Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C259-21-AP-0427 PR/IFCAP: TBD Forecasted JOFOC Tracker#: 2021-03-04T14:41:05

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO19), VISN 19, 6162 S Willow Drive, Suite 300, Greenwood Village, CO 80111.

Organizational Activity: Eastern Colorado Healthcare System, Rocky Mountain Regional, VA Medical Center, 1700 N. Wheeling Street, Aurora, CO 80045; VISN: 19; Station: 554.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Rocky Mountain Regional VAMC Pulmonary Outpatient Service proposes to enter into a Brand Name, Firm-Fixed Price (FFP) Contract to upgrade 03 VMAX Systems (1776760, 1776814, 2183941) 02 Vyntus Spirometers (1776742, 1776754) and 01 new Vyntus Mobile System. RMRVAMC utilizes the Vyaire Vmax systems and Vyntus spirometers for essential patient diagnostic tests including spirometry testing, comprehensive pulmonary function testing, and cardiopulmonary stress testing.

RMRVAMC is requesting to upgrade the Vyaire Vmax and Vyntus units to Windows 10 and procure one new Vyntus mobile system. The Vyaire systems will no longer be supported on Windows 7 and will need to be upgraded to the latest version. Period of performance is 30 days ARO once awarded.

The estimated amount for this upgrade is $81,576.56

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The Sentry Connect Seat License for SES Client Device is the only license that is compatible with RMRVAMC current operating systems required for the Vyaire Vyntus Spiro Laptops, and VMAX Systems. RMRVAMC incumbent hardware/software platform is Vyaire. RMRVAMC is currently using the Sentry Suite SQL database, only another Vyaire Sentry Suite driven product can connect into this database. Additionally, these Spiro’s would be able to connect to RMRVAMC’s already established Vyaire network marrying all the data collected on any Vyntus/Vmax PFT system. David Freeman, Sales Consultant, Vyaire, confirmed this information via email on 02/03/2021, meta-tagged as P03.

Additionally, RMRVAMC was notified via letter dated 01/08/2020, meta-tagged P03, from Vyaire stating the Vyaire Systems would no longer be supported on Windows 7 and need to be upgraded.

This upgrade is required in order to provide security updates, hot fixes, support or online updates for the current operating systems.

4. Description of market research conducted and results or statement why it was not conducted:

An FPDS search showed the items requested have been previously purchased from TrillaMed, LLC, SDVOSB; The Janz Corporation, SDVOSB; First Nation Group, LLC, SDVOSB; and CareFusion 211, INC, large business. RFI 36C25921Q0289 determined TrillaMed and The Janz Corporation can provide the items requested as non-manufacturers. Vyaire Medical 36F79719D001, and CareFusion 36F79718D0508, both large businesses can also provide the brand name items requested. With NMR class waiver for the NAICS 334510 and Product Description approved by the SBA, two (02) SDVOSBs (TrillaMed and The Janz Corporation) stated they can provide the items requested. Due to the operating system requirements, and upgrades required stated above, it is in the best interest of the government to set-aside this requirement to SDVOSBs, and solicit this request Brand Name, IAW 13.106-1(b).
